7 EEG basis: 3 Definitions For the purposes of this Act... Paragraph 2:"System operator" is who - irrespective of ownership - uses the plant for the production of electricity from renewable energy sources or from mine gas. 11 Rent a PV System (Avoiding of EEG allocation) PV System tenant (solar power user: building owner or tenant) is the operator, gets EEG compensation as operator has sufficient risk (Income loss, damage, lack of maintenance, insolvency of the investor) Responsible for insurance (all risks, operator liability insurance) pays rent (usually a fixed amount over 10 or 20 years "averaged" (calculation similar to "power supply price") Recognition of rental payments as business expenses May involve third party for delivering the electricity

12 Concept Nr.3 Part rent a PV (Avoiding of EEG Allocation) Background: The solar power user doesn t want bureaucracy as an additional burden to his normal business Possible Solution: The operator rents to the Solar power user an ideal part of the system of % of the rated power for joint use. The rent for the joint use of the system ("PV-rent") is a monthly fixed amount The rent is based on the (previously calculated) annual private consumption share of the solar power user..
