The bank may extend the empanelment period by six months, in tranches of three months, with mutual consent of bank and vendor of the next empanelment process gets delayed. The bids will be opened in two stages. The technical and commercial bids will be opened together. Date & Time of Technical Bid Opening from 11:30 am The empanelment period for procurement of servers and add-on components will commence from the date of issuance of the empanelment letter, and will be valid for a period of 18 (Eighteen) months with yearly downward review of prices. After the end of 18 (Eighteen) months, the bank may extend the empanelment period by six months, in tranches of three months, with mutual consent of bank and vendor if the next empanelment process gets delayed. The bids will be opened in two stages. The technical bid will be opened first. The Bidders who qualify the eligibility and technical evaluation criteria shall be considered for Commercial evaluation. Thereafter and the successful Bidder will be determined based on the Lowest Commercial Quote (L1) as per the stated Page 4 of 27

The date on which the complete system is delivered will be taken as the date of delivery. In case of part delivery of the system, the date of last items delivered will be taken as the date of delivery. Bidder shall be responsible for installation of the systems ordered at site within 7 days from the date of delivery or within 3 days of logging the call for installation. Please refer to the modified clause as per Section 2 Eligibility Bid Evaluation of this corrigendum document. Revised clause to be read as: Bidder shall be responsible for delivery of the Servers and add on components ordered at site within 7 weeks from the date of order. The date on which the complete system is delivered will be taken as the date of delivery. In case of part delivery of the system, the date of last items delivered will be taken as the date of delivery. Bidder shall be responsible for installation of the systems ordered at site within 2 weeks from the date of delivery or within 7 days of logging the call for installation. 26 Terms & Conditions Section 4.48 Page No Payment Terms The Bank will make payment as per following scheduled terms: 0% on installation and submission of centralized performance Bank Guarantee. No payments related to purchase order shall be released in case of nonsubmission of Performance Bank Guarantee. However, in case the total rate contract or TCO value is more than 4 Crores the additional PBG of the % of the order value is to be submitted immediately. The bidder shall also be liable to indemnify the bank, at its own cost and Page 9 of 27 Site Not Ready The Bidder shall not be liable for any delay arising out of Bank s failure to make the site ready within the stipulated period. In case of Site Not Ready for 3 months, the Bidder will be paid 60% of the due payment. The empanelled vendor shall submit a Performance Bank Guarantee worth % of TCO quoted with, minimum value of the PBG being INR Lacs (Annexure-N: Performa for Performance Bank Guarantee) valid for 18 months within 30 days from the date of empanelment at DIT, Head Office. No payments related to purchase order shall be released in case of nonsubmission of Performance Bank Guarantee. The bidder shall also be liable to indemnify the bank, at its own cost and expenses, against all

12 Section 2 Eligibility Bid Evaluation Corrigendum 1 for Request for Proposal The Bank will examine the bids against Bidder s Eligibility Criteria mentioned below: S.No. Criteria 1 The bidder should be a Government Organization/ PSU/ or a Limited Company/ Private Limited Company under Companies Act in India 2 The bidder should be either Original Equipment Manufacturer (OEM) of Servers or their authorized partner in India for the last 5 years. 3 The bidder should have annual turnover of Rs.500 Crore during the any two of the last three years (i.e., , , ) 4 The Bidder should have a positive net worth as per the computation logic provided below in the last three years (i.e., , , ) Net Worth is to be calculated as follows: Capital Funds (Paid up equity capital + Paid up preference shares +Free reserves)-( Accumulated balance of loss + Balance of deferred revenue expenditure+ other intangible assets) 5 In case of bidders, other than the OEM, the bidder must have at least 20 qualified Engineers (minimum qualification diploma holder), on its roll, trained by the OEM of the quoted Servers. 6 The bidder or OEM should have exclusive country-wide service/support infrastructure (minimum 40 service/support centers) for offered hardware / software items spread across all the (Proof to be submitted) Copy of the Certificate of Incorporation and Certificate of Commencement of Business to be submitted OEMs need to submit a self-declaration stating that the firm is an OEM of the offered components. In case of authorized representatives, Authorization letters from the Original Equipment Manufacturers (OEMs) / software copy right holders to this effect should be furnished. The authorization letter should mention that if authorized representative fails to meet the obligation for items supplied and / or to be supplied under this tender, then OEM would be responsible for all obligations for their items. Bidders should quote the rack servers, blade servers, blade chassis, server management, provisioning and orchestration software solution and TOR switches of only one OEM. 11 The Offered OEM should be in the top 3 blade server vendors globally as per 2015 IDC report 12 OEM should have been selling and supporting the quoted products series for last 5 year at the time of bidding. 13 The OEM should have sold their Rack servers/blade servers in atleast 5 public sector banks in India 14 In a bid only Bidder/OEM can bid but both cannot bid simultaneously, if both have submitted the bids only OEM bids will be considered. Bidder must comply with all above-mentioned criteria. Non-compliance of any of the criteria will entail rejection of the offer summarily. Photocopies of relevant documents / certificates should be submitted as proof in support of the claims made. ORIENTAL BANK OF COMMERCE reserves the right to verify /evaluate the claims made by the bidder independently or by virtue of a third party. Any decision of ORIENTAL BANK OF COMMERCE in this regard shall be final, conclusive and binding upon the bidders. Public sector / scheduled commercial banks refer to Public sector / scheduled commercial Banks in India only. Post warranty, any deviation on the above lines shall be treated as breach of contract and are subject to penal action resulting into forfeiting of Performance Bank Guarantee and/or blacklisting of the Company. The prices shall be quoted in Indian Rupees (INR) only up to 2 decimal places and shall not have any effect from variations / fluctuations of any other currency. The price charged by the bidder for the services performed to fulfill the scope of this RFP shall not vary from the contracted prices and shall remain valid for the contract period. No adjustment of the contract price shall be made on account of variation of costs of labor and materials or any other cost component affecting the total cost in fulfilling the obligations under the Page 26 of 27

The Contract price shall be the only payment, payable by the Purchaser to the bidder for completion of the contractual obligations by the bidder under the Contract, subject to the terms of payment specified in the Contract. The price would be inclusive of all applicable taxes under the Indian law like customs duty, excise duty, import taxes, freight, forwarding, insurance, delivery, etc. exclusive of only applicable Service Tax, VAT and Octroi / Entry Tax / equivalent local authority cess, which shall be paid / reimbursed on actual basis on production of bills.
