1 2014/2015 COSMETOLOGY PROGRAM ENROLLMENT CONTRACT The European Academy of Cosmetology & Hairdressing, LLC 1575 Boston Post Rd.Guilford, CT Phone Fax As used in this Enrollment Agreement (the Agreement), the terms I, my, you and your refer to the person, or persons, who sign the Agreement and the terms School and TEACH refer to The European Academy of Cosmetology and Hairdressing, LLC. I. STUDENT ENROLLMENT AND ATTENDANCE I accept the place TEACH has reserved for Address D.O.B. Phone (the Student ) as a FULL TIME / PART TIME (circle one) student in its school with training beginning and ending on which, if successfully completed, will allow the student to take the State of Connecticut Boards for a Cosmetology/Hairdressing license. I understand that as a FULL TIME student my class time will be 34 hours a week. I understand that as a PART TIME student my class time will be 20 hours a week. Classes Start the first Monday of Jan., March, May, July, Sept. Nov. Both full and part-time students are required to complete their course hours within the maximum time allowable of 1,650 scheduled hours. Full-time is approximately 47 weeks, Part-time approximately 82 weeks. All classes are taught in English. The student is scheduled to begin training on and complete training on. Tuition payments made under this contract are calculated according to that schedule. Students may make up excused absences without penalty. If the student does not complete the program within the 1,650 scheduled hours and additional training is required to complete the course, the extra hours will be billed at a rate of $ and paperwork will not be completed until the full financial obligation is met. Full time classes run: Monday from 9:00 a.m. to 4:00 p.m. Tuesday through Friday from 9:00 a.m.to 5:00 p.m. Part time day classes run: Monday through Friday from to Part time evening classes Tues, Wed. Thurs. 5 p.m. to 9:00 p.m & Sat. 9. A.m. To 5:00 p.m This reservation is contingent upon the receipt of (i) the completed, signed Agreement, signifying acceptance of the terms set forth herein; (ii) the non-refundable Tuition Deposit, as indicated below; II. POLICIES AND PROCEDURES I agree to uphold and abide by the School s policies and procedures, including but not limited to 1

2 my obligation to pay the Tuition and all fees and charges when due. I understand that if the Student or I fail to uphold and abide by TEACH s rules, regulations, policies and procedures, which may be amended from time to time, the School may prohibit the Student from attending classes, taking examinations, and/or may withhold the Student s documentation necessary to apply and sit for the State Cosmetology/Hairdressing Boards. Further, if I am not supportive of the School s goals and compliant with its policies and procedures, I understand that, at the discretion of the directors and owners of TEACH, I may be asked to withdraw. a. Grounds for Termination If a student does not adhere to the TEACH Rules and Regulations, found in the Catalog and signed by the student, and they have been given ample opportunity to comply, they will be terminated. A written evaluation will be done with each student as they complete 450, 900, and 1,200 hours. The Director tracks student s hours and schedules meetings with students to review progress. 70% is the minimum requirement for students in theory and practical. 70% is required in attendance. Students not making satisfactory academic progress in these areas will be placed on probation or may be terminated. b. Graduation Requirements Students must complete 1,500 hours and all course work within the contractual time period. Passing grades are required on all theory and practical tests. In addition any homework, projects or reports must be completed. All tuition and other charges owed to the school must be current. Upon completion students are eligible to take the State of CT Board of Licensure test for Hairdressing, Cosmetology and Barbering. Upon successful completion of the course students receive a Diploma. Barriers to Employment Employers are free to make their own judgments concerning employment. A criminal record, history of drug abuse, or poor job history are some of the factors they may consider. c. Extent and Nature of Employment Assistance Teach does not guarantee job placement to any student, however the school makes every effort to place students and graduates and provides placement rate information to all applicants. TEACH stays in contact with local salons and displays job posting. Teach, upon request, will write a letter of recommendation. In addition the school provides classes in interviewing skills, professional conduct and resume writing. The educators at TEACH will coach all students on: Employment opportunities in the student s field What to expect from their first job How to prepare for an interview 2

3 How to select a prospective employer How to conduct themselves during an interview III. LENGTH OF PROGRAM, SCOPE AND SEQUENCE The program course length as mandated by the state of CT is 1,500 clock hours to include practical and theory training in Hairdressing, Cosmetology & Barbering. Full-time students are required to complete 34 clock hours per week and part-time students are required to complete 20 hours per week. Both full and par-time students are required to complete their course hours within a maximum time allowable of 1,650 scheduled hours. TEACH will not complete the paperwork necessary for the student to take the State Boards as outlined above without the student completing 1,500 hours of training. The hours of training are mandated by the state. IV. STUDENT ACTIVITIES AND INFORMATION Unless I give TEACH prior written notice to the contrary, I agree that the Student has my permission: (i) to take part in any and all TEACH activities on or off School property; (ii) to take School sponsored trips; and (iii) to ride in buses chartered by TEACH, or vehicles driven by employees or representatives of TEACH or by parents of other students. Further, I agree to complete and promptly return to TEACH any additional permission slips, releases and/or medical information forms regarding the Student. Furthermore, I agree to the use by TEACH of the Student s name, portrait, likeness, photographs, voice recordings, videos, and written extractions, awards or achievements in whole or in part, in connection with publications or the promotion of TEACH. V. INDEMNIFICATION The School provides no insurance coverage for personal property belonging to individuals or, for student health care or accidents. I agree to release and hold harmless the School, its agents and employees from all claims, damages, or other liabilities for injuries to the Student which are not the result of gross negligence by the School, its agents or employees. I also agree to indemnify the School for damages caused by the Student. VI. DELAY IN ENFORCEMENT I understand that TEACH can delay enforcing any of its rights or remedies under this Agreement without losing any of its rights or remedies under this Agreement. VII. GOVERNING LAW AND SEVERABILITY This Agreement shall be interpreted in accordance with the laws of the State of Connecticut. Should any part of this Agreement be held invalid that will not affect any other provision of this Agreement. 3

4 VIII. TOTAL AGREEMENT \ AMENDMENT This Agreement and the terms and conditions set forth in the TEACH Rules and Regulations, which is hereby incorporated as part of this Agreement, constitute the full and complete agreement between the parties hereto. TEACH Reserves the right, in its sole discretion, to amend the Rules and Regulations as it deems proper for the protection of the student, other students or to promote a safe and appropriate learning environment. TEACH will give each student notice of any changes to the Rules and Regulations as they are made. This Agreement supersedes any prior agreement, written or oral, and may be amended only by a written instrument signed by the School. No custom or course of dealing between the parties shall in any way vary or alter the terms and conditions of this Agreement. IX. REMITTANCE \ ACKNOWLEDGMENT This Agreement is a legal document. My signature below is acknowledgment that I have read carefully, understand, and accept the Agreement s provisions. I acknowledge that I am responsible for the education of the Student under Connecticut law and unless I provide the School with a copy of a separation or divorce decree that assigns financial responsibility for the Student s education and it is incorporated into this Agreement, I agree to be jointly and severally liable to pay the Tuition, fees and charges described in this Agreement. I understand and agree that TEACH shall not be bound by informal, non-legally binding financial arrangements between separated or divorced parents. 6 Please read this Tuition Installment Payment Contract carefully and feel free to ask us any questions you may have about it. When we use the words you and your we mean you the student as well as any co-signers of this agreement. When we use the words us, we and our, we mean The European Academy of Cosmetology & Hairdressing, LLC. When we use the word agreement we mean this Tuition Installment Payment Contract. This contract contains the entire agreement between you and us relating to your installment payments of the remaining tuition you owe to our school. Any changes to this Tuition Installment Payment Contract must be in writing and signed by all of the parties to this agreement. No oral changes or modifications will be binding or accepted. XI. INSTALLMENT PAYMENT SCHEDULE In order for the student to attend our school, you agree to pay the amount financed shown in four installments on or before the dates listed below. The finance charge is one percent (1%) for each month the payment is overdue. If you do not make the payments as they become due, we may suspend you from the program and prevent you from taking any further classes until your account is brought current. We may also declare that you are in default under this agreement, terminate your right to attend any further classes and accelerate the Total Amount Financed under this agreement. Further, if you are in default, we may refuse to release any of your records of attendance and/or hours of study until we are paid in full. In addition, if you are in default, we may refuse to submit any paperwork which would allow you to take the State board exams until we are paid in full. If we must refer this matter for collection, you agree to pay all costs of collection including but not limited to reasonable attorney's fees, court costs and filing fees, marshal's fees. In addition, interest shall run on any unpaid amounts at the rate of one percent 1% per month or twelve percent 12% per annum. 6

7 XI. COLLECTION COSTS AND FEES In the event I fail to pay all Tuition, fees and/or other charges when due, TEACH may turn my debt over to an attorney or collection agency. In such event, I agree to pay reasonable collection costs, including attorney s fees and court costs I understand that attorney s fees are payable if my account is referred to an attorney whether or not a lawsuit is filed. XII. REFUND POLICY The refund policy is based on the scheduled hours of attendance for students who have begun classes using the last day of attendance as the withdrawal or termination date. For applicants who cancel enrollment or student who withdraw from enrollment, a fair and equitable settlement will apply. Applicants not accepted by the school shall be refunded all monies paid to the school. If a student ( or in the case student under legal age, his/her parent or guardian) cancels the enrollment in writing or in person, within three (3) business days of signing the enrollment agreement, all monies collected by the school will be refunded even if the student has begun classes. The formal cancellation date will be determined by the school, or 15 days after the last day of attendance or the expiration date of an approved Leave of Absence. If a student cancels the enrollment more than three business days after signing the contract but prior to starting classes, a refund of all monies paid to the school less the application fee of $50.00, and enrollment fee in the amount of $ will be made. For students who enroll and begin classes but withdraw prior to course completion (after three business days of signing the contract), the price of the kit will not be refunded and the following schedule of tuition earned by the school applies: Percentage of Time Scheduled Percentage of Tuition Owed 0.01 to to to to to and over 100 Any monies due the applicant or student shall be refund within 45 days of formal cancellation date as defined above. In the case of disabling illness or injury, death in the student s immediate family or other document mitigating circumstances, a reasonable and fair refund settlement will be made. If permanently closed of no longer offering instruction after a student enrolled, the school will provide a pro rata refund of tuition to the student. If the course is canceled subsequent to a student s enrollment, the school will either provide a full refund of all monies paid or completion of the course at a later time. The school does not participate in any teach-out plans with other institutions. Students who withdraw or terminate prior to course completion are charged a administrative fee of $ This refund policy applies to tuition and fees charged in enrollment agreement. Other miscellaneous charges to the student may have incurred at the institution, kit materials, books, Products, unreturned school property, in the amount of $ will be calculated separately at the time of withdrawal. 8 in the catalog and in this enrollment agreement. If Title IV financial aid recipient withdraws prior to course completion, a calculation for return of Title IV funds will be completed and any returns by the school shall be paid, as applicable, first to unsubsidized Federal Stafford Student Loan Program; second to subsidized Federal Strafford Student Loan Program; third to the Federal Pell Grant Program; fourth to other Federal, State, private or institutional student financial assistance program: and last the student. After all applicable returns to Title IV aid have been made, this refund policy will apply to determine the amount earned by the school and owed by the student. If the student has received personal payments of Title IV aid, he/she may be required to refund the aid to the applicable program. XIII. EXPULSION, CANCELLATION OR WITHDRAWAL If you are expelled, cancel your enrollment or withdraw from our school, you agree that our Refund Policy in our Enrollment Contract will govern the extent to which you may receive a refund or partial credit of tuition from us. We will calculate the amount of any refund pursuant to our Refund Policy and will apply any refund first to any late charges, collection costs or other amounts you might owe under this agreement. Only after applying any refund due to any costs or charges due us will we apply that amount to any unpaid balance of the Amount Financed which is still due us under this agreement. You agree to reimburse us for all returned check charges and any bank charges that result from a check that is returned for any reason, including insufficient or unavailable funds. You will be in default under this agreement if: XIV. DEFAULT 1. You do not pay the amounts due on or before the dates listed above. 2. You cancel your enrollment or withdraw from the school. 3. You are expelled due to a violation of our Rules and Regulations and/or the grounds for termination under the Enrollment Contract. If you are in default, the Amount Financed together with any other costs or fees which may be due under this agreement shall become immediately due and payable. The provisions of our Policies on Tuition shall apply to any refund or partial credits which may be due to you at the time of default. You agree that any delay or failure to enforce any of our rights under this agreement or under applicable law does not prevent us from enforcing any of our rights at a later time. If any of the provisions of this contract are found to be in conflict with and unenforceable under any applicable laws, the remainder of the terms of this contract shall remain in full force and effect. This agreement shall be interpreted under the laws of the State of Connecticut. 8

9 XV. PREPAYMENT You may prepay all or part of the unpaid balance of the Amount Financed at any time before it is due without penalty. You may prepay all amounts due under this agreement by contacting us for a payoff figure. That figure will include all amounts due under this agreement. Partial payments will not change the due dates of any subsequent installment payments. Partial payments will be applied toward late fees, interest, attorney fees and costs of collection, then to the final installment payment and then to all payments due in reverse chronological order. By signing this agreement, I agree that I have fully read this agreement and received and read the Teach Academy Catalog. I understand them and agree to be bound by their terms, and have received an executed copy of the contract. Further each co-signer understands and agrees that they are individually guaranteeing all such fees and costs regardless of whether any payments are made by the student or the cosigner if any. 10 Agreement upon completion and signing, please remit ONE copy of the Agreement along with the initial Tuition Deposit to the School. Signature of Academy Owner: PERSONAL GUARANTEE I/we personally guarantee any and all payments due to TEACH pursuant to the terms of this contract, and understand that the full amount of tuition is due and owing two weeks prior to the start of training, regardless of whether the student actually attends any classes. If there is more than one guarantor, the undersigned agree to be jointly and severally liable for any and all amounts due TEACH under this agreement.
