4 I. Introduction MiddleOak s Umbrella policy offers the Named Insured excess limits of liability protection. The intent of this contractual coverage is to provide excess limits over the covered person s primary insurance liability limits. In addition to providing coverage for comprehensive personal liability, automobile liability, and watercraft liability, coverage can be extended to include liability as stated in the policy over and above the limit retained (the Umbrella Policy deductible). The benefits of the MiddleOak Umbrella Program include: Coverage in $1 million increments up to $5 million Credits for optional, higher self-insured retention (deductible) limits Simplified policy language For New Business, the underlying exposures must be covered by MiddleOak. The benefit of this is a higher quality risk selection process, a consistent and uniform claim settlement process, coverage consistencies, a common Company/Policyholder business relationship, and simple one-step handling. The above outline highlights the MiddleOak Umbrella policy. For further details, refer to the Underwriting Eligibility and General Rules sections of this manual. II. Underwriting Philosophy MiddleOak s Umbrella coverage is designed to apply only after the Insured s underlying coverage is exhausted or retained limit is met. Therefore, all underlying policies must have limits of liability that reasonably reflect the insured s risk from his or her automobile, property, and watercraft exposures. The policy s purpose is to protect an individual who has significant assets and is considered a better than average risk. The Named Insured must be an individual whose underlying policies (Personal Auto, Homeowners, Dwelling Fire, and Watercraft) are written with MiddleOak and is considered a preferred customer for all applicable programs. Underwriting Eligibility Guidelines The following Eligibility Guidelines and General Rules sections are designed to assist you in identifying new and renewal business which is eligible for this program. Generally, if all underlying policies demonstrate a preferred profile and meet the eligibility requirements for each specific line of business (Personal Auto, Homeowners, Dwelling Fire, and Watercraft) then Umbrella coverage can be provided. NOTE: Only one Personal Umbrella policy may be written per household. In addition, the following specific Eligibility Guidelines apply to New Business and Renewals except where noted: A. Applicant/ Named Insured The Applicant/Named Insured is an individual and/or spouse residing in the same household. B. Underlying Requirements New Business: All underlying policies must be written by MiddleOak and must include a completed ACORD application signed by the Named Insured and Agent. Renewal Business: Refer to Section VII paragraph B of this manual. All applications must be signed and dated by the Agent and the Applicant. C. Occupation Individuals who pose a greater risk of loss due to being in the public limelight are INELIGIBLE. This includes, but not limited to: advertisers, athletes, authors, bail bondspersons, broadcasters (radio and television), clergy, editors, labor leaders, law enforcement officials and officers, newspaper or magazine reporters or photographers, entertainers and entertainment agents, actors, actresses, public lecturers, publishers, and anyone seeking or holding local, state, or federal office. D. Automobile The underlying automobile policy must be written in a MiddleOak Personal Automobile program, and all vehicles must be registered and regularly located in the state of New Hampshire. If the underlying automobile policy is a renewal and not currently with MiddleOak, the risk must meet our preferred automobile eligibility standards and the carrier must be A.M. Best rated "A-" or better. (Refer to the MiddleOak Auto Manual for Eligibility Criteria details.) New Hampshire Page 5 of 16 New Business 04/01/2011
6 E. Recreational Vehicles Ineligible Exposures: 1. Three (3) wheel vehicles, alternative fuel vehicles, ATVs, mopeds, dune buggies, etc 2. More than two (2) unregistered recreational vehicles NOTE: ANY request for Umbrella coverage for snowmobiles over 500 CC requires prior Company Underwriting approval before coverage is bound. IMPORTANT SPECIAL NOTE: Coverage is not provided for any off-premises use of a recreational vehicle (except for snowmobiles). F. Primary Residence Eligible Exposures: 1. Primary residence is a 1-4 family dwelling, condo, or apartment; 2. The underlying Homeowners policy must be with MiddleOak; 3. The Insured must be considered a preferred liability exposure; and 4. All in-ground pools at the Applicant s residence must be fenced in and access limited by a latched or locked gate. Depth markers should be clearly identifiable. Above ground pools must have detachable ladders that can be removed or raised to a locked position when not in use. Diving boards may be acceptable if they meet MiddleOak s criteria (consult your Underwriter for guidelines). Slides are ineligible. Ineligible Exposures: 1. Business exposures other than business covered by an underlying policy; 2. Farms (other than incidental farm exposures), boarding of non-owned animals, or training of non-owned animals; 3. Properties in the name of a DBA/LLC or on a commercial policy; 4. Properties owned by two or more individuals; New Hampshire Page 6 of 16 New Business 04/01/2011
7 5. Any Homeowners policy where coverage is restricted or excluded by manuscript endorsement or other restrictions; 6. Animals trained for attack, guard, or for-sport fighting; any exotic/domesticated wild animals such as, but not limited to wolves, raccoons, coy dogs, or wolf hybrids; any dog listed under MiddleOak s Homeowners prohibited or restricted dog list; 7. Family day care providers. G. Owner Occupied The Owner Occupied Seasonal/Secondary Secondary/Seasonal eligibility is the same as the primary residence with the following exceptions: 1. Pools located at other than the primary residence are ineligible; 2. No business on premises; 3. No more than one out-of-state property that is not primarily insured by MiddleOak. H. Rental Property The rental property(s) must be covered under a MiddleOak Dwelling Fire policy and must meet the same criteria as the Owner Occupied Seasonal/Secondary property (Section G above). I. Maximum Covered Properties The total combined number of primary, seasonal/secondary, and rental properties cannot exceed five (5). J. Business Pursuits Teachers with their business pursuits insured under a Homeowners Liability policy are eligible unless they have unusual loss exposures due to their specialties. Teachers involved with contact sports, laboratories, industrial arts, or extensive administrative duties such as clergy, guidance counselors, and principals generally represent unacceptable exposures. Corporal Punishment is NOT a covered liability. K. Watercraft All exposures must meet our Personal Yacht Program guidelines or our preferred Homeowner liability standards and must be insured with the appropriate MiddleOak product. 8 Ineligible Exposures: 1. No Insured may be involved in racing or speed contests of any motorized watercraft. 2. No watercraft over 50 feet in length. 3. No watercraft requiring a paid crew. 4. No watercraft used for commercial chartering. 5. No Insured may own a watercraft whose engine s horsepower exceeds the watercraft manufacturer's specifications. 6. No watercraft which can exceed 45 MPH. 7. No unusual watercraft including but not limited to: Homemade boat Houseboat Hydroplane Jet Ski Wet bike Any similar watercraft L. Civic Activities Individuals involved in non-profit civic, religious, or charitable organizational activities without receiving remuneration for their services are eligible. All others should be referred to the Company prior to binding. M. Miscellaneous No Insured may own, lease, or rent any aircraft, glider, hang glider, or parasail. N. Foreign Exposures Risks with exposures to loss due to the ownership, leasing, or availability for regular use of vehicles or property located in foreign countries are not eligible. 9 IV. General Rules A. Amount of Insurance MiddleOak s Umbrella policy limits may be written from $1,000,000 up to $5,000,000. See the rate section for the applicable premium. B. Applicant The applicant is an individual or husband and wife residing in the same household. Corporations, trusts, or other entities are not eligible. C. Application A completed and signed ACORD application is required for all submissions. It must be signed and dated by the Agent and Applicant. D. Binding Authority Coverage may be bound by the Agent if: 1. The policy limit is for $ 1,000,000; 2. The policy meets all umbrella eligibility requirements; 3. All underlying coverage is written with MiddleOak. All requests for coverage that exceeds the Agent s binding authority must be referred to the Underwriting Department and approval must be obtained prior to binding coverage. E. Coverage The MiddleOak Umbrella policy provides coverage for covered liability losses: 1. In excess of the required underlying primary insurance; 2. In excess of the Retained Limit (the Umbrella policy deductible). F. Eligibility In addition to these General Rules, specific eligibility guidelines are included in this manual under Section III - Underwriting Eligibility Guidelines. RISKS WHICH DO NOT MEET PROGRAM GUIDELINES MUST BE REFERRED TO THE COMPANY FOR CONSIDERATION AND PRIOR APPROVAL BEFORE COVERAGE CAN BE QUOTED AND/OR BOUND BY THE AGENT. 10 G. Minimum Premium The minimum premium is $221 for each policy, regardless of credits. H. Occupation The rates for MiddleOak s Umbrella program reflect normal loss exposure. The occupational pursuits of certain individuals may represent an excessive exposure. These types of exposures must be referred to the company for prior approval before coverage can be quoted and/or bound by the Agent. I. Policy Term The policy term is one year. J. Rating Procedures: 1. Base Charge The Base Charge includes the initial owner occupied residence and 2 vehicles. Remember credits cannot decrease the premium below the minimum premium amount. 2. Additional Exposures Add the charges for each exposure not included in the Base Charge. a. Auto Add the applicable charge for each additional vehicle above two. Add the applicable charge for each youthful operator under age 22. Add the applicable charge for each operator over age 75. Add the applicable charge for each vehicle in the Dauntless, Standard, or Standard Select tier. b. Recreational Vehicle Add the applicable charge for each recreational vehicle. c. Personal Liability Add the applicable charge for each additional owner occupied residence. Add the applicable charge for incidental business property. Add the applicable charge for incidental farming. d. Rental Property Add the applicable charge for each 1-2 family rental property and each 3-4 family rental property. e. Increased Limits To determine the premium for $2M - $5M of coverage, first calculate the total premium for $1M (including any additional charges for other exposures not already included in the base premium), then multiply by the corresponding increased limit factor below. NOTE: minimum premiums apply for each additional million of coverage, as shown below. Limit Increased Limit Factor Minimum Premium $1M 1.00 $221 $2M 1.65 $365 $3M 2.20 $486 $4M 2.75 $608 $5M 3.30 $729 Example: Base (2 vehicles, 1 home) $221 Additional vehicle $50 Secondary home $10 $281 $3M factor x 2.20 $ Optional Retained Limit The minimum basic retention (deductible) for exposures not covered by the Insured s underlying insurance is $250 per occurrence. Higher retention limits of $500, $1,000, $5,000, or $ 10,000 are available. (See Rates Page for credits.) 5. Higher Primary Limits A credit will be applied when ALL underlying policy limits are $500,000 or higher. (See Rates Page for credits) 6. Surcharge for Auto Add $30 for each auto incident to the final Incident premium. (The number of incidents will be determined by the number of Careful Driver Credit incidents on the underlying auto policy.) 7. 13 VI. Rates A. Exposure Rate Charges (Each Premium is added to the Base Premium Charge) Category Premiums Automobile, A. Basic Premium (primary residence $221 w/out UM/UIM Motor Homes and 2 vehicles) $275 with UM/UIM B. Each additional vehicle $50 w/out UM/UIM $65 with UM/UIM C. Each youthful operator $120 (under 22 years of age) D. Each operator over 75 years of age $30 E. Each vehicle in the Dauntless, Standard, $55 or Standard Select tier. Recreational Vehicles A. Each recreational vehicle $20 Snowmobiles A. Each snowmobile $20 Personal Liability A. Each additional owner occupied $10 residence B. Incidental Business property $15 (office, private school, or studio) C. Incidental Farming $25 (Primary residence only) Rental Property A. Each 1 or 2 family dwelling $15 B. Each 3 or 4 family dwelling $20 Watercraft A. Powerboat Under 26 feet $20 Liability B. Powerboat 26 feet to 50 feet $55 C. Sailboat - 26 feet to 50 feet $30 Contact your Underwriter for consideration on boats exceeding 50 feet in length. Prior approval and pricing will need to be obtained by MiddleOak through our reinsurer. NOTE: The total number of additional dwellings is not to exceed FIVE to qualify for Personal Umbrella coverage. 14 B. Increased Limits Multiply the calculated exposure rate by the appropriate increased limit factor shown below to determine the premium before credits and surcharges are applied. Coverage Limit Increased Limit Factor Minimum Premium $1,000, $221 $2,000, $365 $3,000, $486 $4,000, $608 $5,000, $729 Minimum Premium charge includes two cars and the primary residence. C. Optional Retention Limits Credit $500 ($2) $1,000 ($5) $5,000 ($7) $10,000 ($10) Apply the flat Optional Retention Limit credit to the end premium. Remember credits cannot decrease the premium below the minimum premium. D. Higher Primary Limits Credits Credit When ALL underlying policy limits are $500,000 or ($10) higher, apply the following credit to the end premium. NOTE: Higher limits must apply to ALL of the Insured's exposures to receive the credit. E. Surcharge for Auto Incident A $30 surcharge for each incident on the underlying auto policy will be added to the final premium. (The number of incidents will be determined by the number of Careful Driver Credit incidents on the underlying auto policy.) 15 VII. Procedures A. New Umbrella Policies 1. Coverage may be bound in accordance with your written binding authority. 2. A completed ACORD Personal Umbrella application signed and dated by the Insured(s) and Agent must be submitted on all new business. 3. All underlying policies must be with MiddleOak. 4. If there are new changes to the underlying policy(s) existing information (i.e., employment, usage, other operators or household members, or additional residence exposures), the respective underlying policies will require updating and underwriting prior to binding Umbrella coverage. B. Renewal Umbrella Policies 1. When all underlying policies are with MiddleOak, a fully completed Personal Umbrella ACORD application will be required every third year. The application will be released to the Agent approximately 120 days prior to the renewal. The application must be thoroughly completed emphasizing exposure updates and must be signed by the Insured and the Agent. The application must be returned to MiddleOak a minimum of 80 days prior to the renewal to avoid potential nonrenewal. For the other two years an agency renewal reminder is released soliciting any updating of occupation, board representation, or underlying changes. Response is not required if no changes or additions exist. Any response should be received by the Company at least 80 days prior to renewal. All Umbrella policies with coverage limits of $3,000,000 or higher will require an annually completed Personal Umbrella ACORD application with signature and date. 2. When one or more underlying policies have been cancelled/non-renewed and all underlying policies are with MiddleOak: a. A letter will be released to the Agent a minimum of 15 days prior to the release of the Non-Renewal notice indicating the Umbrella policy will be nonrenewed due to an underlying MiddleOak policy being cancelled/nonrenewed. b. The Non-Renewal notice must be released a minimum of 45 days prior to the renewal effective date. 3. When the underlying auto is with another carrier (Note: it must meet preferred eligibility) the following documentation is required annually: a. A thoroughly completed ACORD application signed by the Agent and the Insured b. A current Dec Page from the auto carrier New Hampshire Page 15 of 16 New Business 04/01/2011
16 c. If a new operator exposure develops and requires a questionnaire (Youthful Operator Questionnaire (YOQ) or Health Statement), the completed questionnaire must accompany the Umbrella application. 1) YOQ - Ages 16 to 22, in the youth's own handwriting 2) Health Statement - Age 70 or older, in the operator's own handwriting d. An MVR and CLUE will be ordered every other year. e. Class Checks will be utilized where discrepancy of information exists. If the renewal application and a copy of the declarations (including the questionnaires) are not received prior to the renewal, the Agent will be notified and a Direct Notice of Non-Renewal will be sent at least 37 days in advance. B. Mid-term Changes to an In-force Umbrella: The Umbrella policy must be updated mid-term to reflect any changes in exposures. These amendments will be processed on a pro-rata basis. Please note that any replacements, additions to, or deletions from an underlying policy will require updating the Umbrella policy. If an in-force Umbrella policy has a new exposure or underlying account that does not meet the eligibility criteria, a call to the Underwriter is necessary before binding Umbrella coverage. The same documentation requirements (questionnaires) that are necessary for all the underlying business also exists for the Umbrella renewal and any mid-term exposure changes. If Umbrella coverage limits are increased above $1,000,000 mid term or at renewal, prior approval is required before the coverage increase is bound.
