What is this course about? 1.1 Course description Understanding how Civil Engineers obtain work is essential for those in private practice as well as their clients, and enhances the probability of success. The course focuses on best practice in contracts management and administration. You explore the procurement (tendering) process; the structure of contracts and options available; the relationship between the parties; and interpretation of the contract clauses and requirements. You learn how to prepare and evaluate tender responses, and contracts to carry out work. The course is based on the AS4000 suite of contracts for Australian clients. 1.2 Course content Ethical principles; trade practice principles; the tender process; tender preparation; tendering to win; tender evaluation; qualification - based selection; types of contracting; managing the contract for successful outcomes for all parties. 2. Product: Tender response to undertake a condition survey Format: 1. You are to prepare an individual response to a request for tender issued by a large regional local government. The tender is about undertaking a condition survey of a small road network to assess its safety, serviceability and structural adequacy. 2. You are to use the AS4000 (Australian Standard) template to provide a technical tender response only (not price response). This response will be read and evaluated by an engineer from the local government. The tender response considers, e.g. what resources and personnel you need, timing, risks, how you will carry out the condition survey (including what equipment you would use) as per the template requirements and guidelines. Criteria 1. demonstrate knowledge of requirements and best practice in contract management to prepare a tender response for a condition survey for a phase of the pavement life cycle in a local regional context. 2. communicate to an engineer from local government in the form of completed written Australian Standard AS4000 template for a tender response. 3. act professionally during the tender response phase of contract management by: functioning autonomously demonstrating ethical conduct being accountable for people and the environment, and sensitive to cultural issues adhering to engineering standards demonstrating management skills Generic skill assessed Skill assessment level Organisation Problem solving

4 Page 4 Assessment Task 2: Tender evaluation Goal: To act in role as a local government engineer and apply your knowledge to evaluate a tender response and justify your recommendation with evidence. Product: An evaluation of a peer s tender response Format: You are to make an individual evaluation of a peer s tender response (from task 1), assuming the tender response was accepted by the regional local government. For this task you are acting in the role of an engineer from the local government who is assessing all the tender responses received for the condition survey. 1. Complete the given evaluation table that sets out the qualification-based criteria to use. Record in bullet point form what you consider are the advantages and disadvantages of the tender response, in terms of how well it meets all the criteria for carrying out the work. 2. Make a recommendation in the row at the end of the table that the tender should be accepted for further consideration, and justify it with reference to your information in the table. 3. Grade the tender response or give it a mark according to the lecturer s instructions. 4. The lecturer will moderate your judgment and either accept it and award the same grade/mark, or reject it and award a different grade/mark. 5 Page 5 Assessment Task 3: Contract Goal: To act in role as a contract manager and apply your knowledge to write a contract that shows the client how evidence from a condition survey will be gathered and synthesised to deliver solutions on time. Product: A contract to undertake a condition survey Format: The tender you submitted for task 1 was evaluated and accepted in task 2. As a result, the next phase of contract management requires you to be in the role of a contract manager for the local government (as such, you are an experienced engineer). In this role, you write a contract between the tenderer (vendor) and the local government in charge of the road, to deliver the job (i.e. undertake the condition survey). Your job is to ensure the service is provided in terms of the submitted tender. 1. Select a contract delivery type, stating why you chose it for this job based on the advantages and disadvantages you identified. 2. In the contract template: outline the steps that you will take in order to guarantee delivery to the satisfaction of all stakeholders, including listing criteria to be measured and how they will be tested specify the method of control and penalties for non-conformance of tasks necessary for delivery. 3. As evidence that the tender response was accepted, include the evaluation table (task 2) with the contract. Criteria 1. demonstrate and apply knowledge of requirements and best practice in preparing a contract for a job for a phase of the pavement life cycle in a regional context. 2. synthesise information for the local government client in the form of an engineering works contract between the tenderer and the client that: sets out how the work will be delivered by solving the client s problems and meeting their requirements is justified with research-based evidence and shows how criteria will be met & measured 3. communicate to a representative of the vendor (the engineering company) in the form of completed written Australian Standard AS4000 contract template. 4. act professionally during the contract phase of contract management by: functioning autonomously demonstrating ethical conduct being accountable for people and the environment, and sensitive to cultural issues adhering to engineering standards demonstrating management skills Generic skill assessed Skill assessment level Communication Applying technologies

6 Page Additional assessment requirements Eligibility for Supplementary Assessment A student s eligibility for supplementary assessment in a course is dependent of the following conditions applying: a) The final mark is in the percentage range 47% to 49.4% b) The course is graded using the Standard Grading scale c) The student has not failed an assessment task in the course due to academic misconduct Blackboard As a student enrolled in this course you will have access to course information on the Blackboard site. You are strongly recommended to log onto the course site on a regular basis. All course announcements, course changes, posting of course materials and grades (via My Interim Results) will be accessed through Blackboard. It is your responsibility to ensure you have adequate internet access (either off campus or oncampus) in order to access Blackboard regularly and to complete required assessment tasks. Safe Assign In order to minimise incidents of plagiarism and collusion, this course may require that some of its assessment tasks are submitted electronically via Safe Assign. This software allows for text comparisons to be made between your submitted assessment item and all other work that Safe Assign has access to. If required, details of how to submit via Safe Assign will be provided on the Blackboard site of the course. 5.4 Submission penalties Late submission of assessment tasks will be penalised at the following maximum rate: 5% (of the assessment task s identified value) per day for the first two days from the date identified as the due date for the assessment task. 10% (of the assessment task s identified value) for the third day 20% (of the assessment task s identified value) for the fourth day and subsequent days up to and including seven days from the date identified as the due date for the assessment task. A result of zero is awarded for an assessment task submitted after seven days from the date identified as the due date for the assessment task. Weekdays and weekends are included in the calculation of days late. To request an extension you must contact your course coordinator to negotiate an outcome. 6.
