1 CITY OF COMPTON Community Redevelopment Agency Residential Rehabilitation Program Polices and Procedures Fix-It Grant The Community Redevelopment Agency of the City of Compton does not discriminate based on ancestry, race, color, religion, sex, disability, familial status or national origin.

2 The Fix-It Grant The Fix-It Grant provides assistance up to $7,000 to low-income owner occupied households for single family dwelling. The Program provides minor repairs such as painting, windows, screens, smoke alarms, toilets, handicapped grab bars, ramps, termite treatment or tenting. The Agency may deem appropriate other repairs such as electrical, roofing and plumbing ONLY if code violation impedes the health and safety of the homeowner. These repairs require final approval of Agency staff. The property must be a single-family residence located within the city limits. No payments or lien is required for this program. The Program is strictly a grant and does not require repayment. The program is not designed for upgrading, remodeling or room additions. Submission of an application does not guarantee approval. Please be advised that properties with illegal or un-permitted structures or garages must meet the City s Building and Safety Code requirements prior to submittal of application. Please be advised that applicants, who have received a previous rehabilitation Grant/Loan or First Time Homebuyer Loan, are not eligible for the program. Applicants with a Second Mortgage on the property are not eligible for the loan portion of the rehabilitation program. The Program is limited to the availability of Federal funds; as a result, applications will not be accepted after May 15, 2012 or until available funds have been exhausted. 3 Types of Rehabilitation and Repairs The Residential Rehabilitation Program is designed to rehabilitate properties by correcting code violations, potential code violations, or unsafe or hazardous living conditions only. Please note that items listed on application will be replaced and/or repaired only, if needed, all repairs will be reviewed and approved by a city inspector and redevelopment agency staff. This program is not designed for upgrading, remodeling or room additions. NO COSMETIC REPAIRS WILL BE COMPLETED. THE PROGRAM IS FOR HEALTH AND SAFETY VIOLATIONS ONLY. REPLACEMENTS WILL BE OF LIKE-KIND OR EQUAL. Applicants are not eligible for the Residential Rehabilitation Program if they have an illegal garage conversion or illegal structures on their property. Please be advised that applicants, who have received a previous rehabilitation Grant/Loan or First Time Homebuyer Loan, are not eligible for the Program. Applicants with a Second Mortgage on their home are not eligible for the loan portion of the rehabilitation program. All repairs will be approved by Agency staff prior to start of work. The types of repairs eligible include: Beams, joists or rafters as needed Cornices, eaves and fascia board Doors Electrical service and panel boxes (convert from fuses to breakers only) Electrical wiring, dwelling and garage Floor coverings (replace what is removed as needed) Furnace/heaters Garage repair (per inspection only) Gas lines Gutters and down spouts Light fixtures (replace what is removed as needed) Painting or protective covering (exterior, if paint is chipping, flaking, etc) Painting or protective covering for interior walls and ceilings Plumbing and fixtures Porches or steps (if dangerous) Replacement/removal/relocation of hot water heater and metal housing as needed Roof, dwelling and garage Screens Sewer lines and service Shut-off valves (gas and water) Sinks Sub flooring in dwelling (where needed) Termite work Walls, (plaster, patching, drywall) Water lines Windows 3 Revised 7/11

4 Frequently Asked Questions 1. What if my income exceeds the limits of the program? You may not participate in the program. 2. What if I do not have proof of income? If unemployed, you must submit signed Federal and State Income Taxes for the last three (3) tax years with form 4506-T and verification on non-filing from IRS, SSI Printout and provide verification from EDD (Unemployment Office). 3. I live in the unincorporated area of the City of Compton. Do I qualify for your program? No. The home must be located in the incorporated area of the City of Compton. You may call the Building and Safety Department to verify that your home is within the City limits at (310) Residents located in the unincorporated area of Compton, may contact the County of Los Angeles Community Development Commission for assistance at (323) I have a rental house. Can I use the loan or grant to make the necessary repairs? No. The Program is for homeowners who reside in the property as their primary residence. 5. May I use the grant to fix up my duplex, triplex or 4 unit dwelling? If you live in one unit, assistance will be provided for that unit only. You are responsible for any units that you do not live in. NOTE: Mobile homes are not eligible for assistance under the Residential Rehabilitation Program. 6. I have owned my property for less than six (6) months. May I participate in the Residential Rehabilitation Program? No, you must have owned and lived in the property for at least six (6) months. 7. If I already had one grant or loan, may I get another grant or loan? No. You may only apply for one program. Applicants who have received a previous rehabilitation Grant/Loan or First Time Homebuyer Loan are not eligible. 8. May I use the funds to repair my driveway or walkway? The Program is designed to make the dwelling areas safe and livable. Therefore, these items will be repaired based on redevelopment agency staff approval. 9. What are considered minor and/or major repairs? Minor repairs are repairs that are of a smaller amount, size or degree of work. Examples of minor work are: replacing doors, fumigation, heater replacement, one or two windows. Examples of major repairs are: electrical, plumbing, roofing, window replacement throughout the property. 4 Revised 7/11

5 10. How long is the process? The process takes approximately days from qualification of applicant to completion of work. The Environmental and Historical Assessment process will add an additional 30 days to the application process. 11. Are the rehabilitation funds dispensed to the homeowner or the contractor? The funds are dispensed directly to state licensed contractors upon completion of Rehabilitation work and approval of the Homeowner and the Community Redevelopment Agency. 12. May I use any contractor I choose? You must use a contractor who is on the Community Redevelopment Agency s list of approved contractors. 13. I have had trouble with contractors in the past. What assurance do I have that this will not happen again? The Agency requires each contractor to have a valid State license and the proper bonding and insurance. Payments are made to contractor only after work has been completed and approved by homeowner and agency. There is a one (1) year warranty by contractor. 14. There is someone on my Grant Deed that does not live in my house. Do I have to count that person s income? The person who is listed on the Grant Deed but does not live in the house must provide a signed affidavit stating they do not live in the household and that they consent to the repairs on the property and that they are aware that a lien will be place on the property. (Under these conditions income will not be included) If individual does not want to provide signed affidavit, individual must sign Contract Agreements (Under these conditions income will be included) 15. What is considered disabled? A doctor must certify the disability. 16. Who is qualified as a senior? A person 62 years of age or older is qualified as a senior. 17. How do I participate in the Program? Complete Application and Policies/Procedures and return it to the Community Redevelopment Agency along with required documentation (See Attached Table on Page 6 for required documentation) 18. Where do I turn in my application for the Residential Rehabilitation Program? Submit Application, Policies and Procedures and copies of all required documentation to the 5 Revised 7/11

Contact the Community Redevelopment Agency at (310) DOCUMENTS (MUST SUBMIT WITH APPLICATION) Grant Deed Most recent Grant Deed that has been recorded at the Los Angeles County Registrar/Recorder s Office. If recorded copy is not available, a copy may be obtained from LA County Recorder s Office at Imperial Highway, Norwalk. Deed of Trust cannot replace Grant Deed. If a person on title is deceased, a copy of a Death Certificate must be submitted. If the property has been paid in full must submit a Full Reconveyance or Substitution of Trustee and Full Reconveyance. CA Drivers License or CA Identification Card for all household members age 18 and over Social Security Cards and Birth Certificates or Court Guardianship- Must submit copies of Social Security Cards and Birth Certificates for all minors listed on application or Court Guardianship Documents NOTE: All minors listed on application must be on all Federal Income Tax Returns. Income Verification for all persons in the household age 18 and over Three (3) months of most current consecutive pay check stubs, one (1) current Social Security printout, Veteran s Benefit, Retirement Statement, Pension, AFDC, etc. If not employed, household member must provide unemployment verification (EDD printout), SSI printout and 4506T for most current tax year. If in school, household member must submit current school transcripts. Federal and State Income Tax Returns (for the past three (3) years) for all wage earners 18 years of age or older. NOTE: If Federal and State Taxes have not been filed, IRS form 4506-T must be completed and submitted to IRS. Verification from IRS of non-filing must be submitted for the past three (3) years. Please submit all pages with attachments Three (3) current bank statements, savings, checking, CDs, retirement and investment accounts - Please submit all pages. If bank statements are not available, applicant must write and submit a statement affirming or acknowledging that applicant does not have statements. Mortgage Statement (3 current statements) If the property has been paid in full, please submit a Full Reconveyance or Substitution of Trustee and Full Reconveyance Property Insurance Verification (Hazard insurance) Submit current insurance policy which indicates the amount of coverage. Joint Consolidated Annual Tax Bill (Property Tax Bill)- Submit current statement from Tax Assessor s Office To request a duplicate statement contact Tax Assessor s Office at (562) Utility Bills - Must submit one (1) copy of each current utility bills such as: Gas, Water and Electricity (light) bill Money Order for $ A title report is required for the Program to verify title. 8 POLICIES AND PROCEDURES RESIDENTIAL REHABILITATION PROGRAM FIX-IT GRANT The Community Redevelopment Agency of the City of Compton (Agency) receives Federal funds to provide property rehabilitation for residents in the community. The Residential Rehabilitation Program is designed to assist senior citizens, handicapped citizens and low income families. ELIGIBILITY REQUIREMENTS: Applicant must be recorded owner of subject property (As shown on the Recorded Grant Deed) Applicant must be currently living on the subject property (Must be a single-family residence) Income and family size must meet the Department of Housing and Urban Development (HUD) income limits (see chart on Page 2) Property must be located within the boundaries of the City of Compton (Incorporated area of Compton) If Title Report shows a second trust deed, the homeowner is not eligible for the Program Applicant must complete and submit an Application along with ALL required documentation (Refer to Page 6 for list of required documents) Only completed applications with all required documentation will be accepted. Incomplete applications will not be accepted by Community Redevelopment Agency Applicant must respond within seven (7) days to any correspondence from the Community Redevelopment Agency. Failure to comply or respond will result in cancellation. Applicant must wait a period of at least six (6) months before they can reapply for the Program Applicants must be available for the various inspections that will be performed. Failure to comply will result in Cancellation Applicant does not qualify for the Residential Rehabilitation Program if applicant has participated in the Agency s First Time Homebuyers Program or another Residential Rehabilitation Program. An applicant may only participate in one Residential Rehabilitation Program Applicant is not eligible for the Residential Rehabilitation Program if there is an illegal garage conversion, illegal structures on the property, or have previous code violations that have not been corrected Properties with illegal or un-permitted structures or garages are not eligible to participate in the Program. All properties must meet the City s Building and Safety code requirements prior to the submittal of application Applicants are not eligible for the Residential Rehabilitation Program if the cost of repairs exceeds the Program limit 8 Revised 7/11

9 Applicants are not eligible for the Program if they have a Reverse Mortgage or are currently going through a Loan Modification INCOME DETERMINATION (IRS 1040 Form) ADJUSTED GROSS INCOME The Agency will determine applicant s eligibility for the Program by completing an Income Determination Sheet (IRS 1040 Form) for all household members 18 years of age and over. The annualized income will be determined for each member and all inclusions and exclusions will be identified to determine the Total Household Annual Adjusted Gross Income as listed on your most current Federal Tax Returns. The annualized income will be determined by adding (3) three month gross pay stubs (or from any other source of income) then divide by total number of check stubs and multiply by corresponding pay period. Sample of income calculation The Agency will annualize income from wages/salary as follows: Pay periods: Weekly - 52 weeks (Paid once a week usually 40 hours per week) Bi-monthly or Semi-monthly - 24 weeks (Paid twice each month usually the 15 th and 30 th of each month) Bi-weekly - 26 weeks (Every other week, usually 80 hours per pay period) Monthly - 12 months Based on eligibility requirements, the Agency will send an approval letter or a disapproval letter to applicant. If an applicant is determined eligible, the property will undergo an Environmental and Historical Assessment and an inspection and work write-up will be requested through the Building and Safety Department. Note: Approval is conditional, contingent upon inspection and final determination by the Agency. INSPECTION AND WORK-WRITE UP PROCESS All properties participating under the Program will undergo an Environmental and Historical Assessment whereby the State of California will determine if the property has historical value. This process will add an additional 30 days to the application process, and it is required by the Department of Housing and Urban Development (HUD). No Residential Rehabilitation Work will commence on the property until this process is completed. A series of inspections will be performed on the property. Such inspections include: initial, Site Bid Proposal, and Final Inspection. (Termite and Lead based paint inspections only if applicable). In order to participate in the Program, all applicants must be available for the various inspections. Failure to comply will result in Cancellation. Pre-1978 property: A lead based paint assessment inspection will be scheduled by a licensed 9 Revised 7/11

10 Lead Assessment Company. A report will be submitted to the Community Redevelopment Agency; the Agency will then notify the applicant of the results of the inspection and attach a copy of the report The Agency will submit a request for inspection (to determine eligible repairs) to the Inspection Unit (Building and Safety Department). The Agency confirms scheduled appointment with the Inspection Unit and notifies homeowner of scheduled appointment The Building & Safety Inspector will determine eligible code violation repairs under the Program The Agency provides the Building & Safety Inspector with two forms that must be sign by the applicant at the time of the inspection, the forms are: photo release authorization and cost estimate. As part of the requirements, the inspector will take photographs of the property (before pictures) and determine if a termite inspection is required After inspection is performed on the property, the Building & Safety Inspector submits the write-up (correction notice) containing all violations noted at the subject property, beforepictures of the property, photo release authorization and cost estimate to the Agency If termite inspection is required, the Agency will coordinate with Termite Company to schedule an appointment with applicant. Upon completion of Inspection, the Termite Company will issue a report to the Agency and the Applicant. If sufficient funds are available under the contract, these funds may be utilized towards termite work All repairs are subject to Agency staff approval If property was built before 1978, the Agency will provide homeowner with a pamphlet titled Protect Your Family from Lead in Your Home. Applicant will sign an affidavit to acknowledge that Agency provided Lead Disclosure pamphlet CONTRACTOR SELECTION AND BID PROPOSAL PROCESS Under the Program, there is a list of approved, licensed and bonded General Contractors. The Agency has created a group bidding process, with five (5) groups with three (3) contractors per group The Agency will prepare and provide five (5) bid proposals to the homeowner and contractors. The bid proposals will list the eligible repairs under the Program. The Agency will coordinate Building and Safety Department inspector to have a group of five (5) contractors bid on each item of the bid proposal The Agency will coordinate a Job Site Bid Meeting with homeowner, inspectors, and contractor Homeowner must sign three (3) completed bid proposals Contractor must submit (3) completed bid proposals to the Agency no later than 3 days after Job Site Meeting In order to comply with Federal Procurement Laws, the Agency will review bid proposals and assist homeowner in the selection process of the contractor. The process for selecting the Contractor is based on the lowest responsive bid 10 Revised 7/11

11 PRE-CONSTRUCTION MEETING AND CONTRACT SIGNING The Agency will coordinate scheduling a Pre-Construction Meeting and Contract Signing appointment with Homeowner, Contractor and Agency staff. As part of the Contract Signing the following agreements will be signed: Homeowner/Contractor Agreement, HOME Program Written Agreement, Dispute Settlement Process Agreement, No Side Deals Agreement, Notice of Extensive Repairs and Contractor Selection Form The Agency will provide the contractor with guidelines on Lead Safe Work Practices. The Agency will only honor approved Residential Rehabilitation Repairs agreed upon during contract signing The Agency will not authorize Change Orders or Amendment deviations from the original bid proposal. Any Change Order pertaining to Health and Safety or unforeseen hazard to the property requires an inspection from Building and Safety and must be authorized by the Director of the Community Redevelopment Agency The Agency will provide contractor and applicant with copies of all agreements and a copy of the bid proposal that indicates the work to be completed (scope of work). NOTE: Final approval of funds is determined once written agreements are signed between homeowner, contractor and agency. Conditional approval is subject to inspection and final determination by the Agency. COMMENCEMENT OF REHABILITATION WORK Contractor must obtain permits for Residential Rehabilitation Work from Building and Safety Dept Contractor must obtain required permits from Building and Safety and submit to Agency within (7) days after signing Contract Agreement The Agency will issue a written Notice to Proceed to Contractor authorizing the Rehabilitation work Contractor must begin Rehabilitation Work within 10 days of issuance of Notice to Proceed Contractor must coordinate with Homeowner to schedule an appointment to begin Rehabilitation Work If any discrepancies arise between Contractor and Homeowner that cannot be resolved contact the Community Redevelopment Agency Contractor must complete Rehabilitation Work within (30 to 60) days. Failure to do so will result in cancellation of the Program 11 Revised 7/11

12 COMPLETION OF REHABILITATION WORK Homeowner must be available for scheduled appointments and inspections Homeowner must verify all work performed on property to ensure satisfaction of work performance or craftsmanship Homeowner must deem work satisfactory by signing the required forms provided by the Agency. (ONLY AUTHORIZED SIGNATURES WILL BE ACCEPTED) Homeowner agrees to release the Agency and Contractor of any future repairs not related to agreed scope of work per signed Contract Agreement Contractor must have all necessary forms provided by Agency at the time of inspection. (Failure to comply will result in rescheduling of inspection and if problem becomes persistent, Contractor will be subject to disciplinary action and possible removal from active list) Contractor must submit detailed invoice not to exceed the approved amount of Residential Rehabilitation Work specified on Contract along with Final Sign-off from Building and Safety and required forms signed by homeowner, inspector and contractor in order to obtain Payment. Contractor must honor 1 year warranty period agreed upon on signed Contract Agreement The Agency will monitor compliance with Flow-Chart in order to maintain timeline of days. The Agency coordinates with homeowner, contractor and inspector to conduct Final Inspection. During the inspection, the Field Inspection Report will be completed by Agency staff along with photos Agency will prepare Notice of Completion and Final Check List and provide to homeowner for signature Agency will reimburse Contractor for Rehabilitation Work performed on the property. All payments are made directly to the Contractor Agency will coordinate with Termite Company and Homeowner if termite work is required Termite Company will contact homeowner to schedule an appointment to begin termite work. All Termite work is to be performed after completion of Rehabilitation Work Agency waives all rights to any Termite work perform by Termite Company The Agency is not liable for any repairs or rehabilitation work performed by the contractor. 13 AFFORDABILITY PERIOD Based on the amount of assistance, the Department of Housing and Urban Development (HUD) requires that any property assisted with HOME funds meet an affordability period, therefore if HOME assistance is provided under $15,000, the affordability period is five (5) years. The Department of Housing and Urban Development s (HUD) requires that monitoring take place during the affordability period. In order to comply with HUD s requirement, the Community Redevelopment Agency will contact the homeowner by correspondence and request that homeowner complete the Annual Residence Certification Form and submit along with required documentation to the Community Redevelopment Agency. During the affordability period, the Community Redevelopment Agency will perform monitoring on an annual basis. Homeowner must comply with The Department of Housing and Urban Development (HUD) requirements and the Residential Rehabilitation Program Policies and Procedures.
