5 CLG Program Preservation Ordinances Local Historic Preservation Ordinance A set of rules and regulations adopted by the community that outlines the legal organization or structure of a preservation program. Basic components include: Statement of purpose/definition of terms Identifies the Historic Preservation Officer position Identifies HP Board/commission, powers, duties Lists criteria for designation of historic bldgs/districts Establishes review procedures, review standards and appeal process

Review all historic buildings, or designated only? 17 CLG Program Secretary of the Interior s Standards The Secretary of the Interior's Standards for the Treatment of Historic Properties are common sense historic preservation principles in non-technical language. They promote historic preservation best practices. The Standards should be followed for all rehabilitation, preservation, restoration, or reconstruction projects. It is the Historic Landmarks Commission s responsibility to ensure that projects meet the Standards before a COA is issued.
18 Design Guidelines and Standards Design guidelines and standards encourage sympathetic alterations to historic buildings, while fostering compatible new construction within local historic districts.

20 CLG Program Improving the COA Review Process 1. Remember that the purpose of the meeting is to make a decision! 2. Focus on the big issues, not on personal biases or petty details. 3. The commission's role is to administer the Design Guidelines, not to draft new guidelines at every meeting.
21 CLG Program Improving the COA Review Process 4. Actively listen to the presentation by the applicant and his representatives. 5. Ask for clarity of presentation content. 6. Check to see that documentation for the proposal is complete.
22 CLG Program Improving the COA Review Process 7. If the documentation is complete, critique the proposal following the design criteria and guidelines. 8. When the discussions seem to be over, ask these questions of yourselves. First: "Have the criteria and guidelines been sufficiently met to merit an approval? You have two choices for an answer: "Yes" or "No." Second: "Which criteria and guidelines give you the basis for making this decision?" An approval or disapproval should be based on specific criteria in the ordinance, and you should be able to identify the critical ones. 9. Once you have voted, summarize the outcome clearly. Cite the guidelines and standards. 10. Finally, thank the applicant for participating in the process.
23 CLG Program Making a Motion Motion to Grant/Deny COA: I move to Approve [or] Approve with the following conditions [or] Deny the application (Case Number) for (Street Address/Property Name) as submitted [or] as amended in plans/correspondence dated (Date) because the application does [or] does not meet section of the City of Plano s Design Guidelines and is in keeping with the Secretary of the Interior s Standards for Rehabilitation. The motion is then seconded, discussed, and adopted.

26 CLG Program NRHP input National Register of Historic Places Review CLGs have 30 days to review NRHP nominations for resources in their community. Opportunity to comment before draft goes to the State Board of Review.
27 Historic Survey/Inventory Survey is an important component of the CLG program. CLG communities are required to maintain a system for the survey and inventory of local historic properties that is coordinated with the statewide cultural resource survey process.
28 Section 106 Section 106 Review Section 106 of the National Historic Preservation Act of 1966 requires federal agencies to take into account the effects of their undertakings on historic properties, and afford the Advisory Council on Historic Preservation (ACHP) a reasonable opportunity to comment. Triggered if project is federally- funded (monies, grants, loans HUD, FHA, FEMA, etc.) licensed or permitted (USACE, FAA, etc.) owned (P.O., federal courthouse, military base, etc.) Review process instigated by the lead federal agency; project specifics are reviewed by the THC (with input from the CLG) and sent on to the ACHP if necessary.
29 CLG Grants Grant projects can include but are not limited to the following: Historic resource surveys National Register nominations Education outreach programs Design guidelines Hosting a regional training Preservation planning Construction projects for NR listed structures Property acquisition for preservation
30 CLG Grants Grant Application and Schedule Applications are due at the beginning of the fiscal year (around the end of October or beginning of November) Selections are made by January Project must be complete by the end of the next fiscal year Example: Apply October 2015 Selected January 2016 Project Completion by September 30 th 2017
