3 Original Page 3 NOTICE CONCERNING ALL TERMS AND CONDITIONS AND RATE The State of Maine Public Utilities Commission (MPUC) requires that each telephone utility s Terms and Conditions comply with and not conflict with requirements of Maine Statutes (primarily in Title 35-A) and MPUC rules. Any provision in these Terms and Conditions or rate schedules that conflicts with a Maine statute or MPUC rules is inapplicable and will not be enforceable. 4 Original Page 4 NOTICE CONCERNING ALL TERMS AND CONDITIONS AND RATE (cont d) In addition, the following provisions (the first one is required by statute) are part of this utility s Terms and Conditions: 1. Discount for Hearing-Impaired Customers Upon customer request, the Company will automatically apply a 70% reduction for intrastate toll calls made from line used by certified deaf, hard-of-hearing or speech-impaired persons who must rely on teletypewriters for residential telephone communications, and others as provided in 35-A M.R.S.A To qualify for an automatic reduction, the customer must submit an affidavit to the Company on a form approved by the Maine Department of Human Services, stating that due to one of the aforementioned conditions, the customer or a member of the household must rely on a teletypewriter for telephone communications, and that the equipment is connected or acoustically coupled to his telephone. Upon request, customers making calls to certified persons are eligible for a 70% rate reduction for relevant billed called made during each billing period. 2. Any provisions in these Terms and Conditions that limit liability or damages do not apply to the extent they conflict with 11 M.R.S.A 2-316(5) of the Maine Revised Statutes, Exclusion or Modification of Warranties. The utility agrees that it is responsible for complying with all applicable rules of the Maine Public Utilities Commission and with the Maine Revised Statutes. It understands that if it applies or enforces any provision of these Terms and Conditions that is in conflict with a rule of the Maine Public Utilities Commission, or the Maine Revised Statutes, the rule or statue will govern; and the utility may be subject to action by the Consumer Assistance Division of the Maine Public Utilities Commission or an investigation by the Commission pursuant to 35-A M.R.S.A Proposed August 18, 2003 MEO0301

5 Original Page 5 DEFINITIONS ASR (Access Service Request) - Service ordered processed to the underlying local exchange or interexchange carrier. "Carrier", "Company" or "Utility" - refers to Broadwing Communications, LLC. "Completed" - call is a call which the Company's network has determined has been answered by a person, answering machine, fax machine, computer modem device, or other mechanical answering device. "Customer" - means any person, firm, corporation or governmental division who has applied for, been accepted, and is either receiving utility service or has agreed to be billed for utility service. This terms also includes a person who was a customer of the same utility within the past 30 days and who requests service at the same or a different location. Dialed Number Information Service (DNIS) - A toll free service option, under which Carrier electronically transmits to Customer, identifying digits (up to 10 digits) that indicate which number was dialed when multiple numbers terminate on the same trunk group. Expedite - The best effort acceleration of the installation date in advance of commitment date provided by the Company. Post-engineering - After provisioning of service elements. 6 Original Page 6 DEFINITIONS (cont d) "Residential" - customer is a customer who has telephone service at a dwelling and the service is used primarily for domestic or social purposes. All other customers are nonresidential customers. "Service" - means any telecommunications service(s) provided by the carrier under these schedules. "Station" - is a telephone instrument consisting of a connected transmitter, receiver, and associated apparatus to permit sending or receiving telephone messages. "Time Period" - means the interval of hours that distinguish either, 1) day, evening, night/weekend, or holiday rate periods. 7 Original Page 7 General Description of Services Offered TERMS AND CONDITIONS 1. These Terms and Conditions and Rate Schedules govern Company services originating and terminating at points within Maine. Specific services and rates are described in the Rate Schedules. 2. The Company's intrastate service territory is the State of Maine. Company services are available twenty-four (24) hours per day, seven (7) days a week. 3. Company services are available for both residential and non-residential customers. Calculation of Rates 1. Rates for service are based on airline mileage between rate centers of the calling and called stations. The location of Rate Centers is based on information provided by Bell Operating Companies. Mileage is calculated using the Vertical and Horizontal (V&H) coordinate system from the National Exchange Carriers Association Tariff F.C.C. No Unless otherwise specified, billing for calls placed through Carrier are based in part on the duration of the call. Call timing begins when the called party answers the call. Answer detection is based on standard industry answer detection methods, including hardware and software answer detection. Chargeable time for calls ends when one of the parties disconnects from the call. Calls are billed based on the rate in effect at the time the call begins. Calls that cross rate period boundaries are billed the rate in effect at the beginning of the call for the duration of the entire call. Proposed August 18, 2003 MEO0301

Residential Customers: Application for service, billing, payment, deposit, disconnection, dispute resolution and other credit and collection procedures for residential customers are governed by Chapters 81 and 870 of the Maine Public Utilities Commission's Rules and Regulations. 2. Nonresidential Customers: Application for service, billing, payment, deposit, disconnection, dispute resolution and other credit and collection procedures for nonresidential customers are governed by Chapters 86 and 870 of the Maine Public Utilities Commission's Rules and Regulations. 3. The Company does not charge a fee to establish basic service. 4. For billing purposes, service is established on the date the Customer s or End User s local exchange carrier switches the service to Company s network. 5. Company does not charge a fee to restore service that was disconnected for non-payment of bills, violation of the Terms and Conditions, or fraudulent use of Company s services. 6. The Company does not charge a fee to restore service that was disconnected for nonpayment of bills, violation of the Terms and Conditions, or fraudulent use of the Company's services. 7. All state and local taxed (e.g. sales tax) are listed as separate line items and are not included in the rates quoted in the Rate Schedules. 8. As provided in Chapter 870 of the Maine Public Utilities Commission s Rules, the Company charges $5.00 per account to which the check is applied or the amount of the bank charges the Company, not to $15.00 for each check returned for non-payment by a bank. If the Company charges more than $5.00, the Company shall furnish the customer with proof of the bank charge. Proposed August 18, 2003 MEO0301

The bill becomes past due no less than thirty (30) days after postmarked. Once a bill is past due, the carrier may proceed with collection activities per Chapters 290, 291, 292 or 860, and apply a late payment shall be charged on the undisputed past due amount, calculated at the maximum monthly rate specified in Chapter 870 as updated in November of each year by the Commission s Director of Finance. 10. Customer complaints are handled by a full service customer service department. 10 Original Page 10 Interruption of Service/Liability TERMS AND CONDITIONS (cont d) 1. The Company will attempt to provide continuous and uninterrupted service. When the Company schedules a service interruption for maintenance or repairs, the Company will notify customers of the cause and expected duration of the interruption at least twenty-four (24) hours in advance, when possible. 2. The Company's liability for damages arising out of mistakes, interruptions, omission, delays, errors, or defects in the transmission occurring in furnishing service or in Company facilities, and not caused by the negligence of its employees or agents, will not exceed the amount that the Company would have charged the customer for service for the period the aforementioned faults occur. 3. Upon customer request, the Company will credit a customer's account for service interruptions, which are not due to the Company's testing or adjusting, negligence of the customer, or to the failure of channels or equipment provided by the customer. Before requesting a credit, the customer will take reasonable steps to verify that the trouble could not have been prevented by the customer and is not in the customer's wiring or equipment. No credits will be given for usage sensitive or message rated toll charges due to interruption of service. For services with a monthly recurring charge, no credit shall be allowed for an interruption of continuous duration of less than twenty-four hours. For purposes of computing a credit for leased facilities, a month consists of 720 hours. The Company will credit the customer's account at the rate of 1/720th of the monthly charge for the facilities affected for each full hour of the interruption. 4. The Company is protected against customer claims for libel, slander, or copyright infringement arising from the material, data, information, or other content transmitted using Company services. The Company is protected against all other claims arising from any act or omission of the customer while using Company services. Proposed August 18, 2003 MEO0301

11 Original Page 10.1 TERMS AND CONDITIONS (cont d) Liability of the Company NOTWITHSTANDING ANY OTHER PROVISION HEREOF, NEITHER PARTY SHALL BE LIABLE TO THE OTHER PARTY OR ANY THIRD PARTY FOR THE INDIRECT CONSEQUENTIAL, INCIDENTAL RELIANCE, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST REVENUES OR COST OF PURCHASING REPLACEMENT SERVICES) ARISING OUT OF OR RELATING TO SERVICES PROVIDED UNDER THIS TARIFF. ADDITIONALLY, SUPPLIER SHALL NOT BE LIABLE TO THE CUSTOMER FOR ANY ACTUAL DAMAGES IN EXCESS OF THE AGGREGATE AMOUNT THE SUPPLIER HAS PRIOR TO SUCH TIME COLLECTED FROM THE CUSTOMER WITH RESPECT TO SERVICES DELIVERED HEREUNDER. 12 Original Page Carrier Long Distance Service Description SECTION RATE SCHEDULES Carrier offers interexchange telecommunications service within its Service Area to other Carriers that will resell the Company s services, subject to the terms and conditions of a Service Agreement and this tariff. 13 Original Page 12 SECTION RATE SCHEDULES (cont d) 2.1 Carrier Long Distance Service (cont d) Timing of Calls A. Usage sensitive charges are based on the actual usage of Carrier's network. Such charges are measured in Conversation Minutes. B. Chargeable time for Customer shall begin when the called party answers, as determined by hardware answer supervision, provided that such capabilities are available from the local telephone company. If hardware answer supervision is not available, then Carrier will employ industry accepted standards for the timing of calls. Chargeable time for a call shall end upon disconnection by either party Unless otherwise specified in the individual product descriptions contained in this tariff, Conversation Minutes, reflecting usage sensitive charges resulting from use of Service, for all non-prepaid, presubscribed services, are billed in increments of six (6) seconds with an initial period (minimum billing period) of six (6) seconds. Following the initial period, all charges are rounded to the next higher six (6) second increment for non-prepaid, presubscribed service If Customer believes it has been incorrectly billed for a call, Carrier shall, upon notification, investigate the circumstances and issue a credit as appropriate The amount of any credit issued to Customer by Carrier shall not exceed the calculated usage charges for a call with a duration equal to the lesser of three (3) minutes or the actual duration of the call being credited. 14 Original Page 13 SECTION RATE SCHEDULES (cont d) 2.1 Carrier Long Distance Service (cont d) Customers will receive credit for short duration calls that are not completed or placed to a wrong number, upon notification by the Customer to the Company. Notification must include the date, time of day, originating number and terminating number (if known) Service Offerings - General Applicable rate schedules for the following services are provided in Section 4.4. Dedicated Access Lines may be required to connect Customer or End User locations to Carrier s Hub. Such dedicated Access Lines, when required, shall be the sole responsibility of Customer. Notwithstanding such responsibility, Carrier shall, upon Customer's request, order such dedicated Access Lines on behalf of Customer or its End Users, and shall invoice Customer for all related recurring and non-recurring charges. Intrastate rate plans are tied to specific interstate and international rate plans which may include term plan options for interstate calling rates.. A. Minimum Reseller Customer Usage Commitment Reseller service rates shall be based upon the Minimum Customer Usage Commitment made by Customer and listed in the Service Agreement. Applicable rates are as indicated below: 1. Option A Rates shall apply to all Customers with a Minimum Customer Usage Commitment of less than $1 million per month. 2. Option B Rates shall apply to all Customers with a Minimum Customer Usage Commitment equal to or greater than $1 million per month. Proposed August 18, 2003 MEO0301

Availability of Non-Day Reseller Rates Non-Day rates for reseller services are only available to those Customers who in their Service Agreement select the Non-Day Rate Option, and who ensure that a minimum of sixty percent (60%) of their monthly billable minutes fall within the Non-Day rate period. B. Dedicated Access Lines Dedicated Access Lines may be required to connect Customer s location(s) to Carrier s Point-of-Presence (POP). Such dedicated Access Lines, when required, shall be the sole responsibility of Customer. Notwithstanding such responsibility, Carrier shall, upon Customer s request, order such dedicated Access Lines on behalf of Customer, and shall invoice Customer for all related recurring and nonrecurring charges. 24 Original Page End User Long Distance Service (cont d) Timing of Calls The customer s monthly usage charges for the Company service are based upon the total number of minutes the customer uses and the service options to which the customer subscribes. Chargeable time begins when the connection is established between the calling station and the called station or PBX. Chargeable time ends when the either party hangs up. If the called station hangs up but the calling station does not, chargeable time ends when the connection is released by automatic timing equipment within the telecommunications network No charges apply if a call is not completed Start of Billing For billing purposes, the start of service is the day following acceptance by the customer of the Company s service or equipment. The end of service date is the last day of the minimum notification of cancellation or any portion of the last day, after receipt by the Company of notification of cancellation as described in Section 1 of this tariff. 25 Original Page End User Long Distance Service (cont d) Interconnection Service furnished by the Company may be interconnected with services or facilities of other authorized communications common carriers and with private systems, subject to the technical limitations established by the Company. Service technical limitations established by the Company. Service furnished by the Company is not part of a joint undertaking with such other carriers. Any special interface equipment of the Company and other participating carriers shall be provided at the customer s expense. Interconnection with the facilities or services of other carriers shall be under the applicable terms and conditions of other carriers tariffs. The customer is responsible for taking all necessary legal steps for inter connecting its customer-provided terminal equipment or communications systems with the Company s. The customer shall secure all licenses, permits, right-of-ways, and other arrangements necessary for such interconnection. Proposed August 18, 2003 MEO0301

26 Original Page End User Long Distance Service (cont d) Terminal Equipment The Company s service may be used with or terminated in customer provided terminal equipment or customer provided communication systems, such as teleprinter, handsets, or data sets. Such terminal equipment shall be furnished and maintained at the expense of the customer, except as otherwise provided. The customer is responsible for all costs at its premises, including customer personnel, wiring, electrical power, and the like incurred in its use of the Company s service. The customer shall ensure that its terminal facilities are of the proper mode, bandwidth, power, data, speed, and signal level for the intended use of the customer, and that the signals do not damage the Company s equipment, injure personnel or degrade service to other customers. If the customer fails to maintain and operate its terminal equipment properly, resulting in the occurrence or possibility of harm to the Company s equipment or personnel, or impairment to the quality of service to other customers, the Company may, upon written notice, require the use of protective equipment at the customer s expense. If this fails to produce satisfactory quality and safety of service, the Company may, upon written notice, terminate the customer s service. Proposed August 18, 2003 MEO0301

27 Original Page End User Long Distance Service (cont d) Minimum Call Completion Rate The customer can expect a call completion rate of 99% per 100 calls attempted during peak use periods for all Feature Group D (1+) services. The Company will engineer its switching systems on the basis that ninety-nine percent (99%) of the customers accessing their system will be served during the busy hour Special Service Arrangements Special Service Arrangement charges will be based on the estimated cost of furnishing such services including the cost of operating and maintaining such a service, the cost of equipment and materials used in providing such a service, the cost of installation including engineering, labor supervision, transportation, and the cost of any other specific item associated with the particular Special Service Arrangement request. 28 Original Page End User Long Distance Service (cont d) General The Company offers Message Telecommunications Service or MTS, outbound Wide Area Telecommunications Service (WATS), Inbound 800 Service, Travel Card Service, Operator Assisted calling programs, Private Line Services and Frame Relay Service. The customer s total monthly use of Carrier s service is charged at the applicable rates per minute set forth herein. A. Message Telecommunications Service (MTS) MTS or 1+ dialing is achieved by when the LEC programs the customer s telephone lines to automatically route 1+ calls to the Company s network. Service is billed in six (6) second increments, with partial seconds of usage rounded up to the next six (6) second increment, with a minimum billing of eighteen (18) seconds. B Toll Free (i.e., 800/888) Service Toll Free Service is inbound telecommunications service which permits calls to be completed to the customer s location without charge to the calling party. Access to the service is gained by dialing a ten-digit telephone number which terminates at the customer s location. Toll Free Services originate via normal shared use facilities and are terminated via the customers local exchange service access line. Proposed August 18, 2003 MEO0301

Toll Free (i.e., 800/888) Service (cont d) The Company will accept a prospective Toll Free Service at customer s request for up to ten (10) toll free telephone numbers and will reserve such numbers on a first-come first-served basis. All request for Toll Free Service number reservations must be written, dated and signed by the customer. The Company does not guarantee the availability of numbers until assigned. The requested Toll Free Service telephone numbers, if available, will be reserved for and furnished to the customer. If a customer who has received a Toll Free Service number does not subscribe to Toll Free Service within thirty (30) days, the Company reserves the right to re-assign the number to another customer. Description of Service Three options are available to Residential Customers for intrastate outbound direct dial, intrastate inbound toll free and intrastate calling card service: Bonus Package, Premier Package, and Exclusive Package.
