Many reasons to be bullish on intermediate and long-term natural gas prices: U.S. natural gas producers are rapidly moving to an oilier production base Once producers convert to drilling wells that produce $10-17/mcfe units and finish drilling to HBP their gas shale leases, why would they go back to drilling natural gas wells if prices increase from $4/mcf to $5/mcf or to $6/mcf to $7/mcf? CHK believes this is the single biggest misunderstood aspect of the future bull case for U.S. natural gas... 24 Oklahoma: State Legislation Accelerated Pathway To Adoption House Bill 1949 (2009): Securing Oklahoma s Energy Future An income tax credit to the buyer of a dedicated or bi-fuel CNG vehicle: 50 percent of the incremental cost of the vehicle or 50 percent of cost to convert vehicles No incremental cost cap EPA certification is only requirement No provision for transfer of tax credit if buyer is a tax-exempt entity Credit available to already-converted used vehicles at 10 percent of purchase price, capped at $1,500 so long as credit has not been taken before in Oklahoma Fuel Station Equipment Tax Credit: 75 percent of cost of CNG or LNG fueling equipment placed in service that year No cost cap and multiple credits may be taken on same property for additional investments 24

25 Oklahoma: State Legislation Accelerated Pathway To Adoption House Bill 3028 (2010): Energy Security Act it is the intent of the Legislature to increase the number of public access CNG fueling stations located along the interstate highway system in the state it shall be the goal to have at least one public CNG fueling station located approximately every one hundred (100) miles along the entire interstate highway system in the state by the year 2015 The goal shall increase to at least one public CNG fueling station approximately every fifty (50) miles by the year 2025 the State of Oklahoma Department of Central Services through the Fleet Management Division may take steps to meet the goal set forth in this section by cooperating with or entering into partnership agreements with private entities to construct the necessary CNG fueling stations for use by the public, state agencies and political subdivisions of the state Any agreement to construct a CNG fueling station pursuant to this section shall be subject to the public bidding requirements as set forth in The Oklahoma Central Purchasing Act 25

26 Oklahoma: State Legislation Accelerated Pathway To Adoption House Bill 1815 (2011): Motor Fuels Taxation The Legislature finds that the existing taxation system for compressed natural gas requires modification to promote fairness and improved administration of motor fuel taxation by the Oklahoma Tax Commission HB 1815 modifies the current tax for use of CNG as a fuel by changing from a decal sticker to a tax rate that increases over time to the rate at which diesel is taxed ($0.13) Oklahoma law currently states that gasoline and special fuels are taxed at $0.16 per gallon; diesel is taxed at $0.13 per gallon. Special fuels, including CNG, can purchase an annual decal based on weight of between $50 fee for passenger cars and in vans for vehicles to $150 per year for vehicles exceeding one ton. HB 1815 aims to address concerns including (1) compliance for fuel retailers and (2) with eventual growth in the CNG market and funding for Oklahoma s roads and bridges Institute a $0.05 excise tax on the natural gas supplier, not the retailer, allowing collection of the excise for public facilities as well as private operations through
