1 M.D EURONETCOM LTD Acceptable Use Policy AUP(Acceptable Use Policy) please read this AUP along with our Terms of Use-Policy and Agreement Introduction If you do not agree with this AUP or any other legal document in this file please DO NOT USE our Services and DO NOT PAY any issued invoice. Any registered service may be deleted by us in such a case within 24hrs IF WE DO NOT RECEIVE YOUR CONSENT AND APPROVAL OR A PAYMENT RELATED TO AN ISSUED INVOICE. If you have used our services or paid our invoice you fully consent to this AUP and fully accept its restrictions along with our Policy and Terms of Use. If you have registered for a Trial Service you will receive your Service login information along with all 3 Legal Documents in a preview-able format along with a download able file. You have to read and fully accept these Legal documents in order to register and start using a Service. Once a service is Paid these 3 documents will constitute inherent parts of a Contract between M.D EURONETCOM LTD, the SUPPLIER(S) and You the invoiced Customer and your Users. This Acceptable Use Policy (the "AUP Guidelines") specifies the actions prohibited by M.D EURONETCOM LTD. All Users of M.D EURONETCOM LTD services (also referred to as the Distributor in this AUP) are expected to comply with this policy. M.D EURONETCOM LTD reserves the right to investigate suspected violations of the AUP Guidelines. When M.D EURONETCOM LTD becomes aware of possible violations, it may initiate an investigation which may include gathering information from Users or Peers involved and the Complaining Party. If M.D EURONETCOM LTD believes, in its sole discretion, that a violation of these Guidelines has occurred, it may take responsive action. Such action may include, but is not limited to : 1. Temporary or Permanent blocking of access to M.D EURONETCOM LTD Services 2. Suspension or Termination of the Users service. 3. Inform the Authorities without informing the Customer or User prior to this action. M.D EURONETCOM LTD, in its sole discretion, will determine what action will be taken in response to a violation on a case-by-case basis. Violations of these AUP Guidelines could also subject the User or Peer to criminal or civil liability in Cyprus and wherever claims against are made against Customer or a Customer's user. Since all data is managed and stored by everyone.net Inc. USA or SOFTLAYER-IBM EUROPE both referred to this AUP as SUPPLIER(S),SUPPLIERS may also take their own preventive or investigative or responsive action without Customer, User or even M.D EURONETCOM LTD consent, authorization or approval in order to protect the ip's and network which SUPPLIER(S) provides to Distributor, Customer and its Users. SUPPLIER(S) and in this case Everyone.net Inc. USA. Terms of Use 1 must be red and fully accepted by all Customers and Users before using M.D EURONETCOM LTD services. If a Customer or User does not accept SUPPLIER(S) Terms and Conditions, he must not register or use our services under any condition. Everyone.net Inc. USA Terms of Use are linked here for reading. M.D EURONETCOM LTD reserves the right to modify this AUP Guidelines at any time without notice. 2. Definitions As used in this AUP Guideline, the terms shall have the respective meanings set forth below: Customer(s) or User(s)" means without limitation, customers and their own users or member(s) or end clients or any entity which uses or accesses the M.D EURONETCOM LTD Transit Data Network which in case of service belongs and is being managed by everyone.net Inc. USA, a Proofpoint Inc. USA Company. During Trial Period the Term User(s)" will apply to anyone that enters into a Trial Plan. "Peer" means without limitation, any network or autonomous system which is directly interconnected with the or WEB hosting services delivered or in Use by the User. 1
2 "Distributor" means without limitation, M.D EURONETCOM LTD and any licensed agent that hold the right to provide support services to the User. " Supplier" ( The Software as a Service Internet Service Provider) means without limitation the Everyone.net Inc. USA and Proofpoint Inc. USA providers along with SoftLayer-IBM and any other Third Party Supplier that provide services to M.D EURONETCOM LTD directly or indirectly. " Spam" :By "spam," we mean the definition on the Spamhaus website. In short, spam is "unsolicited bulk ." Scope This policy applies to all systems and hosting services Managed to the applicable level and Distributed by M.D EURONETCOM LTD and its SUPPLIERS. This policy also applies to Services provided through the M.D EURONECTOM LTD own servers, with SOFTLAYER-IBM being the SUPPLIER. Account Activation/Termination access at M.D EURONECTOM LTD services is controlled through individual accounts and passwords. Each user of our system is required to read and accept this AUP ( Accepted User Policy ) and Terms of Use and Agreement as all three are viewable in every page as a link. It is the responsibility of each user to protect the confidentiality of their CEP ( Control Panel) or cpanel hosting account and their login and password information. It is the responsibility of each user to change regularly and protect the CEP ( Control Panel) login info along with the FTP, MySQL and account(s) included. The password generator should be used inside cpanel for changing passwords. Always use more than 9 characters as a password with all kinds of symbols,numbers and letters included. Do no store password in any browser for easy login. Use a password manager when possible. A full internet security protection software should always be used next to a malware detection software. Whenever possible use a a PAID private VPN to connect to the internet, such as Private Tunnel. Please note that any protective software you will be using it is used under your own full responsibility and here we are only making suggestions that we have tried and used with success.we can not undetake any responsibility for installing or using third party software on your pc. 3. policy M.D EURONECTOM LTD ltd has zero tolerance for Unsolicited Broadcast and Unsolicited Commercial ("UBE/UCE") commonly known as "Spam". M.D EURONECTOM LTD defines UBE/UCE as unsolicited broadcast or commercial that is sent to addresses that do not affirmatively and verifiably request such material from that specific sender, including but not limited to advertising, surveys, information pieces, third party spamming, website addresses, sales, and auctions. Users are expected to comply with the following: M.D EURONECTOM LTD Users, Peers and any downstream customers of either are prohibited from sending and shall not allow their connection to TDN ( Transit Data Network) to be used for sending UBE/UCE. Mail senders are required to maintain records that verify, on a case by case basis, that explicit affirmative permission was obtained from recipients before mailing. Lack of such records can be considered, at M.D EURONETCOM LTD sole discretion, proof that permission was not obtained and services may be suspended of terminated. M.D EURONETCOM LTD Users are responsible for ensuring that they directly, their end- Customers or Users, and their respective Agents and Contractors abide by this policy. M.D EURONETCOM LTD Users and Peers will be held responsible for all traffic either sent via their connection to M.D EURONETCOM LTD or sent elsewhere using WEB services provided via their connection to M.D EURONETCOM LTD. "WEB Services" includes hosting websites, electronic mailboxes, IP telephony gateways, IRC servers, sale of spamming software,sharing or even promoting illegal software or digital material such as music,videos,movies or other similar services. Users and Peers are also responsible for ensuring that they do not advertise or promote themselves through UBE/UCE. If M.D EURONETCOM LTD or a SUPPLIER, receives a complaint, it will be forwarded to the Customer and to its User for a response and complete resolution. If within twelve (12) hours there is no response or a received response indicating incomplete resolution, M.D EURONETCOM LTD may block traffic to and from the CEP (Customer Panel), FTP, Mailbox or the Website cpanel involved in the UBE/UCE complaint until M.D EURONETCOM LTD or SUPPLIER is convinced that the problem is resolved and preventative measures have been implemented to prevent the violation from recurring. If M.D EURONETCOM LTD or SUPPLIER receives complaints twice, indicating that a problem has not been resolved, M.D EURONETCOM LTD or SUPPLIER will block traffic to and from the IP address(es) or Mailbox or ECP or WEBSITE or FTP etc, in its sole discretion, to the User, Peer or downstream customer of either, involved in the UBE/UCE complaint until M.D EURONETCOM LTD and SUPPLIER is convinced that the problem is resolved. Customer is responsible for all UBE/UCE that passes through its CEP ACCOUNTS, website and connection to M.D EURONETCOM LTD or SUPPLIER or both together. M.D EURONETCOM LTD also reserves the right to suspend or terminate services or block traffic to and from the services involved in : packet flooding, port scanning
3 SYN flooding HTTP DoS attack flood of HTTP GET requests Access control exploitation Database flooding Cookie poisoning Session hijacking URL query-string tampering Cross-site scripting SQL injection Slow HTTP attack Users whose connection to M.D EURONETCOM LTD is used to provide services tosupport UBE/UCE are subject to suspension of services without prior notice. If you run a CEP for a domain name with us, you must maintain a mailbox or alias and read mail to postmaster@(your domain). In addition, from time to time, M.D EURONETCOM LTD blocks third party IP addresses that M.D EURONETCOM LTD believes are used for the distribution of UBE/UCE or are designated as open relays. Any blocking of such IP addresses shall prevent Users and Peers from sending or receiving traffic to and from such IP addresses. System and Network Security Violations of system or network security are prohibited. M.D EURONETCOM LTD or SUPPLIER, reserves the right to release the contact information of Users involved in violations of system security to system administrators at other sites, in order to assist them in resolving security incidents. M.D EURONETCOM LTD will also fully cooperate with law enforcement authorities in investigating suspected law breakers.this may take place without prior notice to the User and without the concent of the User if there is a formal law enforcement request to reveal such information. Examples of system or network security violations include, without limitation, the following: 1. Utilizing M.D EURONETCOM LTD services to compromise the security or tamper with system resources or accounts on computers at M.D EURONETCOM LTD or at any other site. Use or distribution of tools designed for compromising security. Examples of these tools include but are not limited to password guessing programs,brute Forcing tools, password cracking tools or network instrusion and probing tools. 2. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security through or with our services directly or indirectly. 3. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network; 4. Forging of any TCP/IP packet header or any part of the header information in an or newsgroup posting 5. Using the or Hosting Services for Social Media Postings or exchanging or Chat Services when there is a suspected violation of laws or ethics in a country from where the complaint has initiated and from where the investigating request originates. Broadcasting Pornography or other sexually explicit s/ s offering to sell illegal goods or services. By taking place or registering or posting or sharing with websites that are suspective of illegal activities you may be exposing your self to serious dangers. 6. Use for illegal or unlawful purposes, including copyright infringement, obscenity, libel, slander, fraud, defamation, plagiarism, harassment, intimidation, forgery,racism,religion insulting comments, impersonation, soliciting for illegal pyramid schemes, and computer tampering (e.g., spreading of computer viruses) 7. Share account passwords with another person, or attempt to obtain another person s account password. accounts are only to be used by the registered user; 8. Using M.D EURONETCOM LTD and SUPPLIER systems and services for unsolicited mass mailings, non-business related commercial activity, political campaigning, dissemination of chain letters, and use by non-employees of the User
4 Monitoring and Confidentiality The systems and services used by the User are owned by everyone.net Inc. USA ( A Proofpoint Inc. USA company) or SOFTLAYER-IBM EUROPE, both reffered here as the SUPPLIERS, and are therefore their property. The -systems are managed by M.D EURONETCOM LTD ONLY to a certain extent allowed by SUPPLIER(S) and This gives SUPPLIER(S) the right to monitor any and all traffic passing through THEIR system. This monitoring may include, but is not limited to, inadvertent reading by IT staff during the normal course of managing the System Spam Monitoring Software Antivirus and Firewall, review by the legal team during the discovery phase of litigation, and observation by management in cases of suspected abuse. M.D EURONETCOM LTD has absolutely no access to the headers or body of the of the Users when everyone.net Inc.USA is used by the Customer or its User(s) and as such can not monitor the password, header, sender, ip or contents of the .m.d EURONETCOM LTD can only change a password, which in such a case the Customer will notice this when trying to use the Mailbox. Further more inside the ECP a special application will show when a password was changed for the last time. Further actions are only possible to SUPPLIER level. For powered by SOFTLAYER-IBM servers, M.D EURONETCOM LTD, can only keep a brief and short logfile for transaction. Customer may authorize M.D EURONETCOM LTD to perform password changes under Customer sole responsibility. Customer is responsible to change immediately the password used by M.D EURONETCOM upon Mailbox creation with one of its own. M.D EURONECTOM LTD does not have access to any logfiles of any kind, since all traffic is directly outsourced to everyone.net Inc USA through proper MX settings per User Domain. M.D EURONETCOM LTD simply manages the Users as an address and the storage / archiving or protective capacity of each User or the CEP OR Mailbox operational status. M.D EURONETCOM LTD Manages also the operational status of the ECP ( Control Center). Everyone.net Inc. USA preventive actions supersedes M.D EURONETCOM LTD actions in a context of Internet Service Provider to Distributor. A Mailbox has Antivirus+AntiSpam Protection only if it is stated on the Invoice.Otherwise the Mailbox has only Light Spam Protection and requires protective actions by the Customer or User. M.D EURONETCOM LTD will be notified for an Abuse by everyone.net Inc. USA and will have to enforce this AUP in its full extent. Retention M.D EURONETCOM LTD does not retain records or log files since this is technically impossible due to SUPPLIER software restrictions. In addition, archival and backup copies of messages may exist, despite end-user deletion, in compliance with SUPPLIER(S) various records retention policies in the USA or E.U. The goals of these backup and archiving procedures are to ensure system reliability, prevent business data loss, meet regulatory and litigation needs, and to provide business intelligence. Backup copies exist primarily to restore service in case of failure. Archival copies are designed for quick and accurate access by SUPPLIER,IT delegates for a variety of management and legal needs. Both backups and archives are governed by SUPPLIER retention policies. For such services User accepts that EVERYONE.NET Inc. USA holds and manages backups, logfiles and retention services for Customer and its Users. M.D EURONECTOM LTD offers through the SUPPLIER a 05 days archiving period for all services according to our Terms of Use Agreement and this AUP. Upgrades are also possible. Retrieval If SUPPLIER or M.D EURONECTOM LTD discovers or has good reason to suspect activities that do not comply with applicable laws or this policy, e- mail records may be retrieved from the SUPPLIER, and used to document the activity in accordance with due process. All reasonable efforts will be made to notify an account holder if his or her records are to be reviewed. Notification may not be possible, however, if the account holder cannot be contacted. Content Sensitivity and Disclosure Use extreme caution when communicating confidential or sensitive information via . Keep in mind that all messages sent outside of your MAILBOX become the property of the receiver. A good rule is to not communicate anything that you wouldn t feel comfortable being made public. Demonstrate particular care when using the Reply command during correspondence to ensure the resulting message is not delivered to unintended recipients. Always use our SSL or TLS servers for send-receive of . Text in is easily intercepted so it is more wise to use attachements locked with a password when sending low level sensitive info. For higher level sensitive info you have to use full encryption at your own responsibility.
5 Sanctions Sanctions for inappropriate use on ,ftp,mysql systems and services may include, but are not limited to, one or more of the following: 1.Temporary or permanent revocation of CEP, access,ftp,cpanel,mysql etc; 1.Termination of User MAILBOX or whole Domain Name Accounts 1.Legal action according to applicable laws and contractual agreements 5. Responsibilities of Users and Peers TDN ( Transit Data Networks) interconnects with other networks worldwide. All Users and Peers are expected to conform to the acceptable use policies of these networks. You must promptly investigate and deal satisfactorily with any UBE/UCE complaints forwarded to you by M.D EURONETCOM LTD or its SUPPLIER. When using a mailing list, you must confirm that the recipients on the mailing lists have requested or otherwise affirmatively accepted receipt of any materials to be sent by you. You agree to use M.D EURONETCOM LTD services for lawful purposes, in compliance with all applicable laws in your country and in the country of your recipients or end-users. Specific activities that are prohibited include, but are not limited to: Threatening harm to persons or property or otherwise harassing behavior. Violating U.S and E.U export control laws for software or technical information. Facilitating, aiding, or encouraging any of the above activities.
