1 Regular Meeting of the Township Board Tuesday, November 10, 2015 Cleveland Township Hall Supervisor Stein called the meeting to order at 7:00 pm. Present on roll call were Dan Klimaszewski, Bill Olsen, Tim Stein, Jan Nowak and Taryn Anderson-Budd. Present from the public were Eric Carlson, Ruth Shaffran, Bob Kraemer, Audrey Kraemer, and Michael Kelley. Motion by Bill Olsen and seconded by Taryn Anderson-Budd to approve October 13, 2015 regular meeting minutes. Ayes: 5, Nays: 0. Motion carried. Supervisor s Report Tim received an from with Forester Kama Ross from the District Forest office for Benzie, Grand Traverse and Leelanau Counties regarding a federal program to help restore our wind damaged forests. The program administered by the Farm Services agency (FSA) may be available to township residents with eligible forested property damaged by the August 2 nd windstorm. The Emergency Forest Restoration Program (EFRP) helps private forest landowners restore forest health damaged by natural disasters. Clerk Report None Treasurer s Report Revenue $20, Disbursements $ 8, Bank Balance $249, Motion by Dan Klimaswewski and seconded by Jan Nowak to accept Treasurer s report as presented. Ayes: 5, Nays: 0. Motion carried. Planning Commission Report Dan stated that he was unable to attend the Planning Commission but that they did meet with three members were present. The training section went very well with lots of great information and handouts. Zoning Administrator s Report Bruce stated that one land use permit was issued which was fairly complicated. Two permit applications are on his desk just waiting for checks before working on them. New builds this year are about the mid-20s.

2 Zoning Board of Appeals Report Bill stated that a continuation hearing has been scheduled for November 24. Maintenance Report None Assessor Report Tim stated that a Board of Review meeting is scheduled for December regarding errors and omissions. If there are no errors and omissions to be discussed then that meeting will be canceled. Other members None Old Business Update on 4 Township Cedar Fire Department Action Panning/Meetings. Dan stated that the main thing that came up at the Cedar Area Fire Board meeting was how to get this thing organized and how to pay for expenses such as a lawyer. It was discussed that it would be better to have a bank account for Cedar Area to put it into but the board is not prepared to do that yet. The board asked that each township be invoiced $1,000 which will be deposited into the Solon-Centerville Fire Department account and listed on their budget as a separate line item. This money will help pay expense such as lawyer, recording secretary and account. The board hopes to have everything up and running by April 1. Dan spoke with Dick Figura regarding getting a list together to help the board figure out what needs to be done and in what order. Tim asked when that when the current board of Solon/Centerville can be dissolved is there a mechanism where all the applicable funds that are still retained in that account can be put into Cedar Area Fire. Dan stated things will be moving prior to that. Tim asked regarding inventory, etc. Dan stated that we will be moving forward with things. Bill asked if the grievance would slow things down. Dan stated that it shouldn t affect the new board but he wants a legal opinion. Update on Lake Study by Little Traverse Lake Property Owners Association lake level readings/beaver plan. Tim stated that Lou Gurthet sent him an regarding having a meeting in December with Gosling Czubak as to how Association moves ahead with the beaver dam control with the park service s cooperation.

3 Tim stated that the Little Traverse Lake Property Owners Association did ask him to contract tribe. Tim talked to the tribe and they have no interest in participating. Lake is holding steady right now. Review November 6, 2015, Sugar Loaf Summit Meeting at Leelanau County Building. Tim was invited along with a number of other people to a meeting regarding Sugar Loaf on November 6 put on by Chet Janet regarding the Sugar Loaf Townhouse LLC losing their fire insurance due to abandonment of Sugar Loaf Resort. We discussed the issues at hand with the Sugar Loaf property and Steve Haugen from the Leelanau County Building Code office took the lead. Number of code violations which the owner has been cited for and has to December 1 to correct these violations. The Leelanau County Building Code office is required to upload the law and the prosecutor s office could start with a civil proceeding regarding the building code violations and the law. The Leelanau County Building Code office is in charge in of these violations not the township. The only drawback with that is if on December 1 st the owner does have the option of boarding it up and securing it. The violations go away. Tim had further conversations with Dick Figura after the meeting and other than offering support at the meeting (which Tim did) and urge the Building Code office to write tickets regarding the violations to be fined. The action that Tim would ask from the board tonight would be a motion authorizing Tim as supervisor to work with the township attorney to draft a letter of support that Cleveland Township will support or join with the county in any action necessary to move forward with action against Sugar Loaf Resort. Motion by Dan Klimaswewski and seconded by Bill Olsen to authorizing Tim Stein and Dick Figura to work on a letter of support to Leelanau County urging the county to enforce the laws of the Building Code Authority. Ayes: 5, Nays: 0. Motion carried. Dan asked regarding our responsibility. Tim stated that the township is not in a position to enforce the Michigan Building Code statues. That is the county s responsibility. For example, the Saffell property was brought up but that is different that was a zoning issue where we asked for the county to join the township. In this case, there are no zoning issues to enforce. Dan wanted to make sure that the Leelanau County Commissions are aware that the township has no authority to do anything. Tim stated that there was confusion but it is cleared up.

4 New Business Motion by Dan Klimaszewski for payment of the bills and seconded by Bill Olsen. Ayes: 5, Nays: 0. Motion carried. Correspondence Tim received correspondence from DTE regarding a survey for natural gas. Tim will fill it out for the township. Public forum public comment was held Tim received some good news this evening from Eric Carlson. The township will be getting additional PILT money which is a pleasant surprise. Michael Kelley stated that he is a property owner in Cleveland Township and owns two units at the Sugar Loaf Townhouses. He would like to voice his concerns and that of seventy plus tenants at the townhouses. (1) No one at the Leelanau County Register of Deeds seems to be able to determine who the legal owner is; (2) the townhouse association has asked numerous times that doors and windows be secured; and (3) the lawns continue to be unmowed. He understands the township s position regarding zoning. He is on the board and the townhouse owners have secured insurance which isn t 100%. They had to go through a lot of bells and whistles to secure insurance which they have no control of the adjacent property that is in disrepair. Please continue to put pressure on the county to get something resolved. The townhouses don t own the water rights but have spent a significant amount of money keep the water system in proper running condition. Ruth Saffron stated that regarding Sugar Loaf that she is in agreement that we don t know who the owner is. If more people helped out by going to the county meetings expressing their concern maybe it would help do some good. Tim stated that he came away from the November 6 meeting feeling like the gauntlet was thrown and something has to happen. Motion by Bill Olson and seconded by Taryn Anderson-Budd to adjourn meeting at 7:45 pm. Ayes: 5, Nays: 0. Motion carried.
