PURPOSE The purpose of this preliminary guidance is to provide support to agency Chief Financial Officers and Chief Information Officers for consideration in the preparation of ICT investment proposals for the financial year. 2. BACKGROUND Historically NSW Government has owned and operated its own IT systems Historically, agencies have generally procured highly specified ICT solutions and managed them internally. Accordingly, Treasury and agencies have primarily employed capex funding models for ICT projects in line with well-established processes. CFOs manage funding within their own capital and operating expenditure allocation. The NSW ICT Strategy The NSW Government ICT Strategy enables ICT as-a-service sourcing for the evaluation and increased adoption of as-a-service solutions. Government s shift to a service orientation will take advantage of the increasing commoditisation of ICT and the rapidly developing cloud computing industry, and offers a number of financial and non-financial benefits. Under the NSW Government Cloud Services Policy and Guidelines and the NSW Government ICT Investment Policy and Guidelines, agencies are required to evaluate cloud-based and other as-a-service models when undertaking ICT procurement. The Fiscal Responsibility Act constrains agency operating budgets Government policy and the objectives of the Fiscal Responsibility Act 2012 focus on constraining recurrent expense growth. Agencies are largely expected to manage pressures on recurrent expenditure by reprioritising within existing budgets and forward estimates. Agencies have reported barriers to as-a-service solutions However, a number of agencies have reported a combination of cultural, technical, and financial challenges in implementing the government s agreed policy position on these matters, which this guidance seeks to address. 3. AS-A-SERVICE FUNDING CONSIDERATIONS Cloud-based and other as-a-service ICT offerings have the potential to offer increased value for money and better ICT outcomes. The Office of Finance and Services and NSW Treasury are committed to ensuring that perceived bias in the funding environment does not adversely impact the decision to procure the optimal value for money solution and will work collaboratively with agencies to deliver the benefits envisaged from the implementation of the NSW ICT Strategy. ICT solutions vary significantly in size, complexity, and sourcing type. Depending on business requirements, the solution may have different funding requirements, and provide different value for government. The majority of solutions will likely fall into 3

4 the hybrid category with both capex and opex funding components within the one project. Agencies are aware that all expenditure must be affordable and within the agency s existing aggregate fiscal position. Any increase to an agency budget requires approval through the Cabinet Standing Committee on Expenditure Review (ERC). It is the role of agencies to advise ERC on the approach that delivers best value to government. In many cases as-a-service solutions have similar net consumption profiles to capital projects over the life of the investment, and the resulting impact on a department s budget result is similar in the long-term. Cloud-based and other as-a-service ICT offerings have the potential to improve value for money outcomes. It is important to note that some agencies have indicated that they have obtained approval to convert capex for additional opex, after reconsideration that the funded activities were more appropriately progressed as operating expenditure. 4. CONSIDERATIONS FOR COMPARATIVE ASSESSMENT OF OPTIONS IN BUSINESS CASES The business case process exists to ensure resources are allocated to the best outcome. Current guidelines provided by NSW Treasury emphasise that business cases must clearly demonstrate: rationale, priority and benefits of the service need, through documentation of the case for change identification of a preferred option that achieves the best value for money outcomes compared to alternatives over the whole life of the investment analysis of economic costs and benefits, financial impacts, and assessments of risk, sustainability and technical standards and legislative requirements agency capacity to realise the proposed benefits of preferred option. Agencies should carefully consider the nature of all costs incurred, or any rights or obligations arising under a proposed contracting mechanism, to ensure the correct accounting treatment is determined, documented and applied to the financial impact statements prepared in the business case. Flexibility in contracts and built-in agility in service or licencing models should be considered when comparing options within business cases. For example, would there be a financial penalty if the business need for services or software licences was reduced by half? It should not be assumed that accounting for projects under a solution with as-aservice components means that all costs incurred are to be accounted for as recurrent in nature. For example, design, configuration and implementation costs may be appropriately capitalised subject to a detailed assessment of the nature of the costs and relevant accounting pronouncements (AASB 138). Agencies should be supported to shift to ICT solutions and funding that offer optimal value for money. If reallocation within an agency s budget allocation is not an option, a case to ERC could be made. In submitting a case to re-profile expenditure, an agency should demonstrate: 4

5 strategic fit with departmental objectives strategic fit with the NSW Government policy, including the NSW Government ICT Strategy, Cloud Services Policy and Guidelines and ICT Investment Policy and Guidelines comparable profile of consumption against NCOS between build-own and asa-service options (as set out in the financial impact statement) capability to manage the solution and contract effectively agreement to convert capital budget cover previously allocated for a specific ICT solution. 5. COMPARISON BETWEEN AS-A-SERVICE AND AGENCY-SPECIFIC MODELS It is critical that options analysis includes fair estimates of the full whole of life costs. This should include an estimate of maintenance, refresh, decommissioning and replacement costs for build-own options, and any costs that may be associated with as-a-service solutions. Some considerations are reflected in the table on the next page. 5

This may include (but is not limited to): Business continuity Data location and retrieval Legal and regulatory Information governance Privacy Security Licensing Speed of implementation Organisational capability Technical risks Business Risk Bankable savings Procurement costs Fast service delivery and utility Flexibility, Ability to avoid/reduce sunk costs Agility Innovation Standardisation Built-in upgrades Design costs for any customisation Implementation and integration costs Ongoing licence costs and service charges Change management costs Costs for data storage 6
