By opening a new account with DMM FX Australia Pty Ltd (DMM FX) under this Offer (100% +30 % Deposit Bonus or Offer ), the applicant acknowledges they have read and agreed to be bound by these terms and conditions (Terms) and DMM FX s Account Terms. Any capitalized words not defined in these Terms will have the same meaning given to them in DMM FX s Account Terms. 2. To be eligible you must be an Existing Client or a genuine new applicant of DMM FX that opens a live trading account (meaning, not a demo account) via the relevant banner on the Company s website or any other link(s) as specified by DMM FX between 26 September 2015 and 26 December 2015 inclusive (unless the Offer is closed earlier) (Offer Period) and satisfy the other criteria contained in these Terms. Existing Client means a client of DMM FX that already has an active open account prior to 26 September A new applicant means that the applicant who has never registered to apply for a live account with DMM FX and is accepted by DMM FX as a client. 3. You must be over 18 years of age to register to apply for an account. 4. All references to AUD or $ means to Australian dollars (or the equivalent amount of the denominated currency in your Account). 5. Only transactions in FX Contracts apply to this Offer. Trading on the Expert Advisors (EAs) platform and trading during news releases will not be permitted under this Offer. DMM FX may deny, cancel or withdraw the Offer or any later credits or participation if DMM FX suspects a client has breached these Terms. 6. DMM FX will in its sole discretion determine whether an applicant is a genuine new applicant by assessing (including among other things, assessing the IP address of the applicant and the close affiliate) whether the applicant is associated or affiliated with any other existing account holder with DMM FX, including those with previously closed accounts. 7. DMM FX in its sole discretion may assess any affiliation, having regard to (among other things) the intention of the Offer and any information we request that you provide to us. 1 P a g e

The offer (100% + 30% Deposit Bonus) cannot be (i) transferred to any other person; (ii) transferred to another account holder or account; or (iii) exchanged for other financial services or benefits provided by DMM FX. 9. The applicant acknowledges and agrees that for an account to be established and accepted by DMM FX, DMM FX is required to perform identification checks in accordance with anti-money laundering and counter-terrorism financing laws and regulations (AML/CTF Laws). DMM FX may, in its sole discretion, choose to reject an application if it is not satisfied as to the applicant s identity or if it suspects on reasonable grounds that by accepting an application, DMM FX may breach the AML/CTF Laws. 10. AUD200 is the minimum required deposit amount for genuine new clients and AUD50 is the minimum required deposit amount for existing client, the offer (100% + 30% Deposit Bonus) will be automatically posted to your FX mt4 trading account in the Account s denominated currency as elected by you on Account establishment. It usually takes within one business day to be credited to your FX mt4 trading account. Once the offer (100% + 30% Deposit Bonus) has been credited to your FX mt4 trading account, you may use the credited amount as margin to begin trading. 11. This offer applies to your initial and subsequent deposits made within 60 calendar days from your initial deposited date made within the campaign eligibility period. 12. The maximum bonus amount that can be credited to you is 5,000 credit in your denominated currency (i.e. AUD, USD, NZD, GBP, EUR). 13. The maximum bonus of 5,000 credit is a two-tier bonus offering 100% up to 500 credit and 30% up to 4,500 credit to a maximum combined bonus of 5,000 credit. 3 How to claim: 14. This offer entitles you to receive real balance based on your trading volumes during the Offer period. The conditions to be eligible and to receive the real balance are as follows: for every 1 standard lot that is traded on your FX mt4 trading account, DMM FX will convert 1 credit to real balance of AUD1.00 (or the equivalent amount of the denominated currency in your Account); for every 1 mini lot that is traded on your FX mt4 trading account, DMM FX will convert 1 credit to real balance of AUD0.10 (or the equivalent amount of the denominated currency in your Account); for every 1 micro lot that is traded on your FX mt4 trading account, DMM FX will convert 1 credit to real balance of AUD0.01 (or the equivalent amount of the denominated currency in your Account). Please note: 1 standard lot = 100,000 units of the first named currency (i.e. the base currency) of the currency pair; 1 mini lot = 10,000 units of the first named currency (i.e. the base currency) of the currency pair; and 1 micro lot = 1,000 units of the first named currency (i.e. the base currency) of the currency pair. For example: 500 (standard) lots x AUD1.00 = AUD Real balance; 200 (mini) lots x AUD0.10 = AUD20.00 Real balance; 500 (micro) lots x AUD0.01 = AUD5.00 Real balance. 15. Any open positions prior to participating in your offer are counted towards lot calculations. Additional Conditions 16. Under the following conditions, bonus credit balance will be reset to zero: If your FX Trading account balance is zero; If your FX Trading account balance is negative; If you transfer any amount from your FX trading account balance (and associated profits) to any other accounts; 3 P a g e

If your Account is closed or suspended, DMM FX may cancel the offer (100% + 30% Deposit Bonus) posted to your Account, along with any profits made from the offer. 18. DMM FX will not be liable for any costs, expenses or damages which may be suffered as a result of DMM FX re-setting or adjusting your Account as contemplated by these Terms, including but not limited to losses attributable to automatically Closed Out Open Positions. 19. You will be liable to DMM FX for any negative Account balance in your FX mt4 trading account. It is your sole responsibility to monitor your FX mt4 trading account balance. DMM FX may from time to time review (but is under no obligation to review) your Account balance and credit amounts posted to your Amount. 20. During volatile or illiquid circumstances in the market, you may incur a loss that exceeds your initial investment in your Account. Investing in over-the-counter derivatives carries significant risks and is not suitable for all investors. You could lose substantially more than your initial investment. When acquiring our derivative products you have no entitlement, right or obligation to the underlying financial asset. DMM FX recommends that you seek your own independent personal financial advice before you decide to invest in our products. 21. You are liable for losses that exceed your initial investment amount and DMM FX will require you to pay the equivalent amount of those losses into the DMM FX client money trust account (so that it can be withdrawn and paid to DMM FX). 22. This Offer is limited to one applicant per IP address. If DMM FX suspects that the Client has more than one account under this Offer, then DMM FX reserves the right, without the Client s consent to withdraw the offer (and any applicable profits attributable to this offer ) from the Client s mt4 trading account. If any losses are incurred as a result of such withdrawal by DMM FX, DMM FX will not be held liable for any loss, costs, expense or damage which may be suffered in connection with you participating in the Offer and which by law may not be excluded by these terms. 4 P a g e

5 23. DMM FX may amend or discontinue this Offer without any prior notice to current Clients or prospective applicants and without having to compensate anyone for that. 24. If DMM FX suspects a Client has abused or attempted to abuse this Offer to the detriment of DMM FX beyond the intention of the Offer, then DMM FX may deny, cancel or withdraw the Offer to that Client, and either temporarily or permanently terminate that Client s access to the online services and suspend or close the Client s account. This may also apply if the Client has breached DMM FX s Account Terms. 25. The provider of this Offer is DMM FX Australia Pty Ltd (ACN , AFSL ), trading name DMM FX. 26. The client understands and agrees that this promotional Offer is not an inducement to begin transacting with DMM FX. 27. Transacting in over the counter leveraged financial products carries significant risks and can result in substantial losses. You may lose more than your initial deposit so the financial product may not be suitable for all investors.
