If the college is closed on the bid open date, the bid will be opened on the college s next business day. Mandatory Pre-Bid Meeting And Site Inspection: The College will hold a mandatory pre-bid meeting and site inspection as a pre-requisite for accepting bids for this request for proposal. The College will only accept bids from contractors that are present at the meeting and inspection. The mandatory pre-bid meeting and site inspection is scheduled for Wednesday, June 11, 2014 at 10:00 A.M. in the Trustees Pavilion room 1 on the campus of Ramapo College. Bid Proposal Forms are available at the Ramapo College Purchasing Office website. Go to: Proposals must be made upon and in accordance with the form of bid to be supplied by the Purchasing Agent and no bidder may withdraw his bid within sixty (60) days after the actual bid opening thereof. The Board of Trustees of Ramapo College reserves the right to waive any informality or to reject any or all bids. Bidders are required to comply with requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27. Bid envelopes must be marked with Bid No A and indicate a Sealed Bid in the lower left hand corner. 4 1. INFORMATION FOR BIDDERS 1.1. PURPOSE AND INTENT PURPOSE: The purpose of this Request for Proposal (RFP) is to solicit bid proposals for services to be performed on the campus of Ramapo College of New Jersey, 505 Ramapo Valley Road, Mahwah, NJ INTENT: Based on this RFP, Ramapo College intends to award a contract to the responsible bidder whose bid proposal, conforming to this RFP, is most advantageous to the College, price and other factors considered. The College reserves the right to separately procure individual requirements that are the subject of the contract during the contract term, when deemed by the College to be in its best interest TERMS: Ramapo College standard Terms & Conditions (see attachment marked Terms & Conditions) will apply to all contracts or purchase agreements. These terms are in addition to the terms and conditions set forth in this RFP and should be read in conjunction with them unless the RFP specifically indicates otherwise BACKGROUND CURRENT CONTRACT: The services outlined in this request for proposal are a reprocurement of services previously under contract with the College KEY EVENTS PRE-BID MEETING AND SITE INSPECTION: The College requires that interested bidders attend a pre-bid meeting and or a site inspection. The purpose of this meeting or inspection is to provide the interested bidder the opportunity to present questions and see the College facilities where the services are to be performed. The College requires mandatory attendance at the meeting or inspection as a pre-requisite for submitting a proposal. The College will not accept a proposal from a bidder that failed to attend a mandatory pre-bid meeting or a mandatory site inspection QUESTION AND ANSWER PERIOD: Ramapo College will accept only written questions from all potential bidders in accordance with the procedure outlined in this RFP SUBMISSION OF BID PROPOSAL: In order to be considered for award, the bid proposal must be received by the Ramapo College Purchasing Department before or at the submission due date and time. Any bid proposal NOT received on time at the location indicated below will be rejected. The ONLY location for bid response receipt is: Ramapo College Purchasing Department Academic Complex Wing D, Room D Ramapo Valley Road Mahwah, NJ Please note that all USPS and all private carrier mail, regular and overnight, is delivered to the Ramapo College Mail and Receiving Services and then is distributed across campus by College staff. Ramapo College is not responsible for any delays in the College s mail distribution process. 5 1.4. ADDITIONAL INFORMATION ADDENDA: All addenda to this RFP will become part of the RFP and part of any contract awarded as a result of this RFP BIDDER RESPONSIBILITY: The bidder assumes sole responsibility for the complete effort required in submitting a bid proposal in response to this RFP. No special consideration will be given after bid proposals are opened because of a bidder s failure to be knowledgeable as to all of the requirements of this RFP COST LIABILITY: Ramapo College assumes no responsibility and bears no liability for costs incurred by a bidder in the preparation and submittal of a bid proposal in response to this RFP CONTENTS OF BID PROPOSAL: Subsequent to bid opening, all information submitted by bidders is response to the RFP is considered public information, except as may be exempted from public disclosure by the Open Public Records Act, N.J.S.A. 47:1A-1 et seq., and common law. A bidder may designate specific information as not subject to disclosure when the bidder has a good faith legal/factual basis for such assertion. The College reserves the right to make the determination and will advise the bidder accordingly. The location in the bid proposal of any such designation should be clearly stated in a cover letter. The College will not honor any attempt by a bidder either to designate its entire bid proposal as proprietary and/or to claim copyright protection for its entire proposal. By signing this RFP response, the bidder waives any claims of copyright protection set forth within the manufacturer s price list and/or catalogs. The price lists and/or catalogs must be accessible to the College and cooperative purchasing partners and thus have to be made public to allow eligible purchasing entities access to the pricing information. All bid proposals, with the exception of information determined by the College or the Court to be proprietary, are available for public inspection after the Letter of Intent to Award is issued. At such time, interested parties can contact the Ramapo College Purchasing Department to inspect bid proposals received in response to this RFP BID OPENING: Not applicable to this RFP PRICE ALTERATION: Bid prices must be typed or written in ink. Any price change (including white-outs ) must be initialed. Failure to initial price changes shall preclude a contract award from being made to the bidder. The bidder must complete and sign all price sheets leaving no blank or empty fields. If applicable, the bidder shall enter No Charge or zero (0). Failure to provide an entry in any price sheet field will result in rejection of the bid BID WITHDRAWAL: A bidder may request that its bid be withdrawn prior to bid opening. Such request must be made in writing to the Ramapo College Director of Purchasing. If the request is granted, the bidder may submit a revised bid as long as the bid is received prior to the announced date and time for bid opening and at the place designated. DEFINITIONS VALIDITY OF BID: Submitted bids shall be valid for a period of ninety (90) days to allow for sufficient time for bid evaluation and contract award RIGHT TO CANCEL: The College reserves the right, in its sole discretion, to cancel this RFP without obligation and for any reason, in part or in its entirety GENERAL DEFINITIONS: The following definitions will be part of any contract awarded or order placed as result of this RFP. Addendum Written clarification or revision to this RFP issued by Ramapo College Purchasing Department. Bidder An individual or business entity submitting a bid proposal in response to this RFP. The College or College or RCNJ Ramapo College of New Jersey Contract This RFP, any addendum to this RFP, and the bidder s proposal submitted in response to this RFP, as accepted by Ramapo College. Contractor The bidder awarded a contract resulting from this RFP. May Denotes that which is permissible, not mandatory. Shall or Must Denotes that which is a mandatory requirement. Failure to meet a mandatory requirement will result in the rejection of a bid proposal as materially non-responsive. Should Denotes that which is recommended, not mandatory. State State of New Jersey 3. SCOPE OF WORK 3.1. GENERAL This section outlines the requirements for snow removal services at Ramapo College of New Jersey including the main parking lots and roadways, the College Park and Village Apartment areas, Pine, Laurel, Linden, Bischoff, Mackin and Overlook Hall parking lots, Student Center Parking Lot, all Academic Buildings and Bradley Sports and Recreation, Center, Tennis Court lots and all Roads and Walking paths throughout the campus as designated by the College The contract to be awarded as a result of this proposal will be for the snow season to begin on or about November 1, If agreeable to both parties, the contract entered into as a result of this bid may be extended up to four (4) additional seasons in increments of one (1) season. All of the original terms and conditions of the contract will remain in effect for the extended periods. RCNJ _RFP#15-001A 05/30/14 Page 6 of 24

7 3.2. METHOD OF INSPECTION OF WORK AND LIQUIDATION FOR NON- PERFORMANCE: In the event that the Contractor shall fail to comply with any of the conditions herein provided and as covered by the Contract, the College shall notify the Contractor of such failure or default and demand that the same be remedied within twenty four (24) hours. In the event of the failure of the Contractor to remedy the same within said period, the College shall take steps to terminate the contract. In this event, the College will authorize the service to be performed by any available means, the difference between the actual cost paid and the bid of the defaulting Contractor to be deducted from any monies due. It shall also be incumbent upon the Contractor to continue operations until relieved by a newly selected Contractor PROCEDURAL REQUIREMENTS AND AMENDMENTS During the period of the Contract the College reserves the right to add or delete specific services and/or locations at the prevailing contract The Contractor, or its authorized representatives, may be required to meet periodically with College representatives, to discuss all services There will be a meeting with the successful Contractor and the College prior to the start of the Contract PROPOSAL SUBMISSION AND EVALUATION Bidders are requested to hold prices firm for a minimum of sixty (60) days in order that an award can be made Site Inspection: See cover page and Section Evaluation of the proposal by the College may include, but may not be limited to, the following criteria: The experience of the bidding firm in snow plowing services The bidder's past performance in similar jobs Whether the Contractor is responsive to all specification requirements in sufficient detail for the evaluator(s) to analyze the bid and make sound judgments Price: The College reserves the right to evaluate prices and award contracts, based on present worth analysis when it is determined to be in the best interest of the College Price Comparison: The College will evaluate prices based on weighted average price per hour for machinery and personnel for a typical storm (per year) per section 10 price sheet(s) The College reserves the right to request all bidders to explain the method used to arrive at any or all figures. 8 3.5. QUALIFICATION OF BIDDERS Bidders shall be of known reputation and shall have sufficient qualified personnel and equipment to perform adequately the prescribed service as per specifications. Bidders shall submit evidence of qualifications The College reserves the right to visit locations now serviced by the bidder(s) The number of years the firm has been performing large scale Snow Plowing Service Contractor must provide the name of the individual who can be contacted at all times if service or information is requested by the College. Name(s) and a 24-hour telephone number(s) that is answered by management personnel to be contacted if problems or emergencies occur, 24 hours a day, 7 days per week List of names of all employees, whom will be operating vehicles, including on-site supervisor is required at start of contract. This list must include telephone number of contractor or contractor's designee who will be called by Facilities personnel to respond and begin snow removal work. List must include telephone numbers, and cellular phone numbers A list of New Jersey State Agencies, US Governmental Agencies, private sector institutions, industries and commercial buildings now under Contract with the bidding firm. Include the length of time each Contract has been in force and the name(s) and telephone numbers of person(s) the College may contact for reference Name of insurance firm from which bidder intends to purchase insurance required pursuant to these specifications, and a person to contact at the firm, including telephone number(s). Insurance must be specific for snow removal operations Ramapo College Office of Facilities personnel reserves the right to visit the contractor's place of business to inspect equipment cited on the price sheet before bid is awarded. If Facilities personnel do not believe that contractor's vehicles are capable of servicing the snow removal needs, the College reserves the right to bypass the bid Vendor must provide one (1)-hour emergency response at no additional fee. Contractor must submit their contact name by which the College representative can call for emergency response PROPER COMMUNICATIONS: If the contractor uses a telephone answering machine or an answering service, the following procedure must be used to confirm your receipt of the College s call for service A person-to-person telephone call ("call back") confirming the original requestor's service call, must be made within one hour after the answering machine records the requestor's message or the answering service takes the College s call. Specifically, a representative, preferably the company dispatcher, must call within one hour after the College makes its original call requesting service, stating the time that snow removal personnel will arrive on campus It is important that the Contractor clearly understands the College s need for verbal confirmation of our service requests throughout the duration of the contract, and RCNJ _RFP#15-001A 05/30/14 Page 8 of 24

9 returns the requestor's original call within one hour so that we can anticipate your arrival. Ramapo College requires that the Contractor respond to all calls as noted above This one hour call-back confirmation serves to ensure that the Contractor received the original call and notifies RCNJ personnel of the Contractor s imminent arrival on campus Contractor must call the snow removal operations manager and/or designee(s) and leave a detailed message. Any message should state the following: Date and time of call, Name of person calling RCNJ, Estimated time of arrival, to whom the message is directed The College s snow removal operations manager will to the contractor s designee a list of requested equipment and labor for each snow or ice event, this will include the expected time of arrival. Subsequent Time, Equipment and labor invoices must correspond to this to ensure proper payment justification CONTRACTOR PERSONNEL All personnel shall be physically able to do their assigned work and shall be free from any communicable disease All personnel must be experienced and thoroughly trained and qualified for the work assigned to them All personnel must observe all regulations in effect at the College. While on College property employees shall be subject to control of the College but under no circumstances shall such persons be deemed to be employees of the College. Contractor and the Contractor s employees shall not represent themselves as employees of the College The College s designee may request the Contractor to transfer from the work crew employees who are found to be incompetent, prone to excessive tardiness, absenteeism, theft, or who exhibit lewd or inappropriate behavior, or who verbally, physically or sexually harass any member of the Ramapo College Community All personnel must be able to read, write, speak, understand and communicate in the English language sufficiently to perform the duties of the position Contractor shall provide a replacement crew of Laborers/Shovelers when an event is in excess of 12 hours. Note: Contractor is responsible to monitor drivers/equipment operators for fitness for duty/fatigue during snow removal operations to ensure safety. Ramapo College reserves the right to dismiss Contractor personnel if the RCNJ designee feels the employee is unfit for duty The College shall not be billed for contractor employee lunch breaks. Contractor employee lunch breaks should be taken in shifts to maintain adequate coverage and to ensure the progress of snow removal operations. No more than one third of the snow laborers on duty should be on any lunch break shift at any given time A valid driver's license is required to operate the contracted vehicles. 10 All contractor personnel that operate a vehicle must have a working two-way communication device by which to communicate with the site supervisor All contractor personnel shall check-in at a centralized location via an electronic signin system. During electronic sign-in personnel will be on camera and all personnel must be uniquely identifiable, their face must be visible and they should not wear a hat, scarf, sunglasses or other items to disguise their identity. Contractor personnel must have their ID available and must present it upon request at all times When contractor personnel leave campus, each person must electronically sign out. When the operator returns to campus, s/he must electronically sign in All contractor personnel who will be operating a motorized vehicle must have a picture ID issued by RCNJ prior to the start of the snow season. All contractor vehicles must have a unique number and a photo ID issued by RCNJ prior to the start of the snow season On-site Supervisor: On-site supervisor must have a vehicle conducive for safely traveling on pathways throughout campus and have a reasonable means of communication through which s/he is accessible during the entire snow event On-site supervisor must know which vehicles are currently being used and must have that information within 15 minutes at all times On-Site Supervisor must be able to locate all personnel and equipment who are electronically signed in within 15 minutes at all times The On-site supervisor is not a working supervisor Unless otherwise requested, a non-working supervisor is expected when the contractor s crew size is over ten (10) people. For end-of-storm cleanup operations where only a few individuals are needed, for example, the site supervisor should be a working supervisor Eligibility to Work: The successful bidder shall, within 15 days of the beginning of the Contract, certify, in writing, that all employees working under this Contract are legally able to work in the United States. The certification shall include language that during the term of the contract the successful bidder shall not employ any person legally unable to work in the United States. The obligation to determine eligibility shall rest with the successful bidder, and the College shall have the right to request the production of relevant records (e.g. U.S. Citizenship and Immigration Service Form I-9, Employment Eligibility Verification Forms) for review Criminal Background Checks: Prior to commencing performance on this contract, the successful bidder shall certify to the College that it has conducted a criminal records check in accordance with federal and State law of all of its employees that will be assigned to the campus. The successful bidder shall keep criminal background check documentation on each assigned employee, and the College shall have the right to request production of such records for review. Should the successful bidder hire and assign to the College an employee with a criminal record, it shall so certify with an explanation of why the particular individual's criminal conviction would pose no threat RCNJ _RFP#15-001A 05/30/14 Page 10 of 24

11 to the College. The College retains the right to review such statement and request that the individual not work at the College CONTRACTOR VEHICLES AND EQUIPMENT All contractor vehicles must have a unique number that is easily visible in a snow storm and have amber warning light beacons or strobes installed to increase visibility All contractor equipment must be photographed with the unique number before the first snow event, photos provided to the College. A photo ID will be issued by the College for each vehicle for the purposes of electronic sign-in and identification during snow storms All contractor vehicles must be registered and insured The College reserves the right to remove any contractor vehicle or equipment that poses an excess safety hazard, at the discretion of the College The College reserves the right to remove from active use any equipment that is being used in an unsafe manner, or in an application that the manufacturer did not designate as appropriate Contractor equipment must be mobilized and on site by November 1 st of each snow season After each snow season all contractor equipment must be removed by April 30 th, or it becomes the property of the college When a vehicle leaves campus, to be fueled or otherwise, both the vehicle operator and the vehicle must electronically sign out. When the operator and vehicle return to campus, they both should electronically sign in All contractor equipment must been in good working condition. Under no circumstances should equipment over ten (10) years old be used. The college reserves the right to exclude equipment that does not meet our expectations of condition The Contractor shall not park snow removal vehicles in the vicinity of the Student Center or surrounding areas during lunch breaks The contractor is responsible for supplying two lockable shipping containers for storing snow removal supplies and tools at no cost to the College. Tools and supplies shall not be kept outside these containers or in College buildings SNOW REMOVAL SERVICES The work to be performed by the Contractor under the specifications shall consist of furnishing all vehicles, labor, supervision and other equipment and supplies necessary to provide snow removal services for the vehicle parking lots and roadways and pedestrian pathways throughout the entire campus as designated by the College. 12 The College expects the quantities of personnel and vehicles in the bid section 10.1 will be available at request at the start of snow storm All fire exits and fire department connections (hydrants, standpipes, etc.), and other means of egress shall be clear within 24 hours after the completion of the storm Snow shall not be stockpiled at the end of parking rows in the main lots. All snow in the main lots must be moved to a pre-designated stockpile location determined by the college at the end of each snow event. It is the College s goal to lose zero (0) spaces due to snow accumulation Contractor will assume full responsibility for any damage to College, student, staff, or other property while plowing. Those damages will be documented and deducted from any outstanding invoice(s). Any damage to equipment used during plowing operations will also be the Contractors responsibility. At the conclusion of the snow season the contractor and the College will tour the site and agree upon a list of repairs and restorations that resulted from snow removal operations. These will include but are not limited to: signs, curb lines, lawn damage, benches etc.. These reapairs will be completed in a timely fashion at no cost to the college Contractor must be on site within one (1) hour of the initial call from the college's designated official Contractor shall provide an inventory of equipment to be used, including trucks, loaders, etc. All equipment must be registered, licensed and insured and have current inspection sticker where applicable. See Bid sheet for Minimum equipment requirements. In addition, Contractors equipment, used to address the scope of work shall be uniquely numbered using two digit stick on numbers or equivalent All equipment listed in inventory must be made available for visual inspection by a College representative at the contractor's business location, prior to October 1. Snow removal equipment must not be stored at the College prior to October Snow plowing will begin when the on-site supervisor checks in with the designated College official, and when contractor personnel and vehicles are electronically signed in. Plowing will be from curb to curb, completely across paved areas that are without curbs and down to bare road top. Snow will be pushed back from corners The priority for pathways, stairs, hydrants, fire exits, curb cut-outs, roads, etc., will be determined by the College. Generally all areas are addressed at the start of the storm, simultaneously Only those items bid upon within this contract, including equipment listed on the bid pricing sheet, may be invoiced for payment. Each invoice must cover only one (24 hour) day from 12:00 am until 11:59 pm. A time, equipment and labor sheet must be completed for each day, signed by the Contractor and College representative and a copy submitted with each invoice (see copy attached) Ramapo College of New Jersey is not responsible to pay overtime rates for Contractor personnel. The Contractor is responsible to the overseeing authorities, including the Department of Labor for issues including salary and wage. RCNJ _RFP#15-001A 05/30/14 Page 12 of 24

13 While on campus, Ramapo College will not be responsible for fuel or repairs to Contractors equipment. Should it be necessary for the Contractor to leave campus for any reason, he must sign out via the electronic system at the designated location. If it becomes necessary, in the case of extreme need, for the Contractor to refuel its equipment, using the fuel pumps of Ramapo College, the cost of that fuel will be deducted from the invoice If equipment breaks down during use at the College, it is the contractor s responsibility to electronically sign out that machinery within 15 minutes. The vehicle operator should also electronically sign out with the machine if s/he is not able to immediately operate another snow removal vehicle Salt, sand and /or other ice melt product will be provided by RCNJ. The College will determine who loads this product on to contractor vehicles. RCNJ may request the contractor to provide this product at additional cost that must be approved prior to delivery Any damage to College or student property or expenses related to negligence caused by the Bidder(s) will be immediately repaired, restored or remedied within 30 days of the incident at no cost to Ramapo College of New Jersey. The College reserves the right to repair the damage or remedy the negligence and deduct the documented cost from the next invoice At the consclusion of the snow season the contractor shall sweep all walkways and pathways campus wide to remove any residual grit or sand used during the snow season Invoices must be submitted and received before a maximum of thirty (30) days from the date of service to be considered for payment. If discrepancies arise, RCNJ will notify the contractor via . If the requested modification(s) are not remedied within ten (10) business days from notification, RCNJ will revise the invoice based upon available information and will consider the invoice a final revision for payment Each invoice must detail, by line item, hours, rate and extended total. All invoices must be sent to: Ramapo College of New Jersey Office of Facilities Management 505 Ramapo Valley Road Mahwah NJ BID PROPOSAL PREPARATION AND SUBMISSION 4.1. GENERAL: The bidder is advised to thoroughly read and follow all instructions contained in this RFP, in preparing and submitting its bid proposal BID PROPOSAL DELIVERY AND IDENTIFICATION: In order to be considered, a bid proposal must arrive at the Ramapo College Purchasing Department before or at the date and time indicated in the RFP. The exterior of all bid proposal envelopes/package should be labeled with the bid identification number and the final bid opening date and time NUMBER OF BID PROPOSAL COPIES: The bidder must submit one (1) complete original bid proposal, clearly marked as the original bid proposal. The copy request is necessary in the evaluation of the bid proposal BID PROPOSAL CONTENT: The bid proposal must be submitted in writing as one complete package with all of the required documentation and completed forms as specified in the RFP DOCUMENTS THAT MUST BE SUBMITTED WITH BID PROPOSAL: The following must be submitted with all proposals SIGNATURE PAGE, PRICE SHEET(S), CONTACT INFORMATION, REFERENCES, TERMINATED CONTRACTS AND COOPERATIVE PURCHASING: The bidder shall complete and submit the following as provided in the RFP: Signature page, all Price Sheets, Contact Information page, Business References page and Terminated Contracts page. See attachment titled Terms and Conditions. 5. SPECIAL CONTRACTUAL TERMS & CONDITIONS 5.1. PRECIDENCE OF SPECIAL CONTRACTUAL TERMS AND CONDITIONS: The contract awarded as a result of this RFP shall consist of this RFP, addendum to this RFP, the contractor s bid proposal and the Notice of Award. Unless specifically stated in this RFP, the Special Contractual Terms and Conditions of the RFP and addenda take precedence over the Ramapo College Standard Terms and Conditions CONTRACT TERM AND EXTENSION OPTION: The term of this contract shall be for a period of one (1) year, beginning on or about November 01, If delays in the bid process result in an adjustment of the anticipated contract effective date, the bidder agrees to accept a contract for the full term of the contract. The contract may be extended for four (4) additional periods of up to one (1) year, by mutual written consent of the contractor and the College at the same terms, conditions and pricing CONTRACT TRANSITION: In the event that a new contract has not been awarded prior to the contract expiration date, as may be extended herein, it shall be incumbent upon the contractor to continue the contract under the same terms and conditions until a new contract can be completely operational. At no time shall this transition period extend more than ninety (90) days beyond the expiration of the contract CONTRACT AMENDMENT: Any changes or modifications to the terms of the contract shall be valid only when they have been reduced to writing and approved by both the contractor and the College CONTRACTOR RESPONSIBILITIES: The contractor is responsible for the professional quality, technical accuracy and timely completion and submission of all deliverables, services or commodities required to be provided under the contract. The contractor shall, without additional compensation, correct or revise any errors, omissions, or other deficiencies in its deliverables and other services. 16 payment for any service shall not be construed as a waiver of any rights that the College may have arising out of the contractor s performance of the contract SUBCONTRACTING OR ASSIGNMENT: The contract may not be subcontracted or assigned by the contractor in whole or in part without prior written consent of the College REMEDIES FOR FAILURE TO COMPLY WITH MATERIAL CONTRACT REQUIREMENTS: In the event that the Contractor shall fail to comply with any of the conditions herein provided and as covered by the Contract, the College shall notify the Contractor of such failure or default and demand that the same be remedied within a specific period of time. In the event of the failure of the Contractor to remedy the same within said period, the College shall take steps to terminate the contract. In this event, the College will authorize the service to be performed by any available means, the difference between the actual cost paid and the bid of the defaulting Contractor to be deducted from any monies due. It shall also be incumbent upon the contractor to continue operations until relieved by a newly selected Contractor COLLEGE S OPTION TO REDUCE SCOPE OF WORK: The College has the option, in its sole discretion, to reduce the scope of work for any task or subtask called for under this contract. In such event, the College shall provide advance written notice to the contractor AVAILABILITY OF FUNDS: The College s obligation hereunder is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the College for payment of any money shall arise unless and until funds are made available for each fiscal year PREVAILING WAGE: Snow Removal (plowing, shoveling, etc..) is NOT subject to the New Jersey Prevailing Wage Act. See the State of New Jersey Department of Labor & Workforce Development Prevailing Wage Rate FAQ's for further clarification: PUBLIC WORKS CONTRACT ADDITIONAL AFFIRMATIVE ACTION REQUIREMENT: During the term of the contract the contractor agrees to comply with N.J.S.A 10:5-33 regarding anti-discrimination. PROPOSAL EVALUATION 6.1. PROPOSAL EVALUATION COMMITTEE: Bid proposals may be evaluated by a committee composed of members of the College Unit/Department responsible for managing the service, the College s Purchasing Department and other College employees. 17 6.2. ORAL PRESENTATION AND/OR CLARIFICATION OF BID PROPOSAL: A bidder may be required to give an oral presentation to the College concerning its bid proposal. The College may also require a bidder submit written responses to questions regarding the bid proposal. The purpose of such communication with bidder, either through an oral presentation or a letter of clarification, is to provide an opportunity for the bidder to clarify its bid. Original bid proposals submitted, however, cannot be supplemented, changed, or corrected in any way EVALUATION CRITERIA: The College may use, but is not limited to, the following evaluation criteria; A) The bidder s general approach and plans in meeting the requirements of the RFP, B) The bidders detailed approach and plans to perform the services required, C) The bidder s documented experience in successfully performing contracts of a similar size and scope, D) The qualifications and experience of the bidder s management, supervisory or other key personnel assigned to the contract and E) The overall ability of the bidder to mobilize, undertake and successfully complete the contract ERRORS AND OMISSIONS: If it is discovered that there is an arithmetic disparity between the unit price and the total extended price, the unit price shall prevail. If there is any other ambiguity in the pricing other than a disparity between unit price and extended price and the bidder s intention is not readily discernible from other parts of the bid proposal, the Director of Purchasing may seek clarification from the bidder to ascertain the true intent of the bid. Ramapo College reserves the right to waive any technical or format defects found in the RFP submission REJECTION OF PROPOSAL: The College reserves the right, in its sole discretion, to reject any or all bids, or to accept a proposal in whole or in part, if deemed to be in the best interest of the College to do so NEGOTIATION AND BEST AND FINAL OFFER (BAFO): Following the opening of bid proposals, the College, may, pursuant to N.J.S.A. 52:34-12(f), negotiate one or more of the following contractual issues: the technical services offered, the terms and conditions and/or the price of a proposed contract award with any bidder, and/or solicit a best and final offer (BAFO) from one or more of the bidders. Initially, the College will conduct a review of all the bids and select bidders to contact to negotiate and/or conduct a BAFO based on its evaluation and determination of the bid proposals that best satisfy the evaluation criteria and RFP requirements, and that are most advantageous to the College, price and other factors considered. The College may not contact all bidders to negotiate and/or to submit a BAFO. In response to the College s request to negotiate, bidders must continue to satisfy all mandatory RFP requirements but may improve upon their original technical proposal in any revised technical proposal. However, any revised technical proposal that does not continue to satisfy all mandatory requirements will be rejected as non-responsive and the original technical proposal will be used for any further evaluation purposes in accordance with the following procedure. In response to the College s request for a BAFO, bidders may submit a revised price proposal that is equal to or lower in price than their original submission, but must continue to satisfy all mandatory requirements. 18 the original will be rejected as non-responsive and the original bid will be used for any further evaluation purposes. After receipt of the results of the negotiation and/or the BAFO, the College will complete its evaluation and issue an award to the responsible bidder(s) whose bid proposal, conforming to this RFP, is most advantageous to the College, price and other factors considered. 7. CONTRACT AWARD 7.1. MULTIPLE AWARDS: The College reserves the right to award contracts as a result of this RFP to more than one bidder AWARD TO RESPONSIBLE BIDDER WHOSE BID IS MOST ADVANTAGEOUS: Pursuant to N.J.S.A. 18A:64-70, the College will award to the responsible bidder whose bid, conforming to the invitation to bid, will be most advantageous to the College, price and other factors considered. 8.
