2 DRI S Construction Law Seminar is designed to enhance the practice of all construction industry professionals from experienced defense attorneys, to risk managers, to construction executives and even to those who are new to construction litigation. This year s seminar will focus on the experienced litigator seeking to develop advanced skills for getting a case to resolution. Topics include effective voir dire, jury persuasion, mediation and negotiation. Each will be presented by a well known authority on that subject. There will also be in-depth presentations on evolving strategies for risk transfer and an update on the latest court decisions affecting insurance coverage for construction defects. DRI is proud to present a number of nationally known speakers on all of these timely topics. The seminar will also include a hands-on presentation showcasing a construction technique to provide insight into the actual construction work that underlies the claims. In addition, the American Institute of Architects (AIA) promulgates contract forms for construction that are widely used. These contracts also include very favorable terms for the design professionals. Being merely aware of the provisions is not enough; you need advanced knowledge of theses defenses, whether you defend design professionals or contractors. Accreditation has been requested from every state with mandatory continuing legal education (CLE) requirements. Certificates of attendance will be provided to each attendee. She is a seasoned insurance and litigation defense attorney, handling a variety of trial and appellate litigation in both federal and New York state courts. Ms. Black specializes in New York labor law and construction related matters, premises liability, insurance coverage litigation and general negligence matters. Previously, she worked for the New York City Law Department Special Federal Division defending the NYPD in federal civil rights matters. John P. Cahill, Jr., is a shareholder with Hays McConn Rice & Pickering PC in Houston. His practice focuses on the representation of architects, engineers, surveyors and real estate brokers and agents. Mr. Cahill is a member of DRI s Construction Law Committee (Design Professional Subcommittee) and the State Bar of Texas (Construction Law Section). Robert C. Ms. Gerstberger has 11 years experience in the insurance industry as a claims adjuster and insurance defense counsel. Robert B. Hirschhorn is an attorney and jury consultant with Cathy E. Bennett & Associates Inc. in Lewisville, Texas. He travels around the United States, conducting research and picking juries. Mr. Hirschhorn lectures nationwide to lawyers and judges on effective jury selection techniques. He has appeared on Good Morning America, America s Talking, Cochran and Company, Court TV, CNN Morning News, Dateline NBC, MSNBC, 48-Hours, Live, the Nancy Grace Show, the Joy Behar Show, the Oprah Winfrey Show and many other television and radio stations. Edward G. Hochuli is a founding partner in the Phoenix law firm of Jones Skelton & Hochuli PLC. His practice focuses on personal injury defense, including retail and product liability, professional liability and the defense of the transportation and trucking industries. Kasdan is the senior litigation partner of Kasdan Simonds Weber & Vaughan LLP, which has offices in Irvine and Walnut Creek, California, and in Phoenix, Arizona. Mr. Kasdan specializes in construction defect litigation, representing high-rise and mid-rise condominium associations, loft and conventional condominium associations, single-family homes and homeowners associations. He is recognized as one of the nation s top legal experts on construction defects. Mr. Kasdan is a member of the Construction Industry Forum. Toyja E. Kelley is a partner in the law firm of Tydings & Rosenberg LLP in Baltimore, where he is a member of the litigation department. His areas of concentration include construction, commercial and insurance coverage litigation, and the defense of manufacturers in product liability litigation. Mr. Kelley is a member of DRI s Board of Directors and the past chair of DRI s Diversity Committee. He is also a member of the executive committee of the Maryland Defense Counsel Inc. John S. Kenefick is a shareholder in Macdonald Devin PC, a Dallas law firm. He represents companies and individuals in commercial litigation matters, with an emphasis on construction and construction defect claims. Over the course of his career, Mr. Kenefick has tried over 50 cases to verdict. He is a member of the Texas and Illinois bars, the Texas Association of Defense Counsel, and actively serves on DRI s Construction Law Committee. He is the program chair for this seminar. Jack Laffey, a shareholder in the Milwaukee office of Whyte Hirschboeck Dudek SC, focuses his practice on product liability, transportation litigation, toxic tort, catastrophic injury defense and insurance and commercial litigation matters. He represents corporations and insurers involved in these areas. Mr. Laffey is a member of DRI s Law Institute and is a former chair of its Trucking Law Committee. Robin D. Leibrock is the vice president of claims for Century Insurance Group in Westerville, Ohio, a division of Meadowbrook Insurance Group. She is the head of the construction and professional liability units. Ms. Leibrock is a member of DRI s Construction Law, Insurance Law, Women in the Law and Corporate Counsel Committees. She is also a member of the State Bar of Ohio. Sean W. Martin is a member of Leitner Williams Dooley & Napolitan PLLC in Chattanooga, Tennessee. His practice focuses on commercial litigation, construction, professional liability, transportation and workers compensation. An active DRI member, Mr. Martin is the publications chair for the Construction Law Committee and the program vice chair of this seminar. He is a member of the Chattanooga, Tennessee and Georgia Bar Associations. Josh M. McMorrow, the general counsel for Air Liquide Process & Construction Inc. in Houston, oversees all legal matters for the company within the Americas zone (North, Central and South America and the Caribbean). Air Liquide Process & Construction Inc. designs and builds production units for the Air Liquide Group and its customers (oxygen, nitrogen and hydrogen plants; clean conversion technologies; and CO2 purification). As assistant general counsel for Air Liquide USA LLC, Mr. McMorrow oversees all dispute resolution and litigation matters for its U.S. subsidiaries, directs the government relations efforts and supports Air Liquide s health care subsidiary. Kamy Molavi is a partner in the construction law practice group of Freeman Mathis & Gary LLP in Atlanta, where he practices construction and surety law and commercial litigation. Mr. Molavi has extensive experience representing owners, general contractors, subcontractors and design professionals before the state and federal courts, as well as the U.S. Court of Federal Claims. He holds a graduate degree in civil engineering and worked in construction management before turning to the law. Mr. Molavi is a DRI member. Lee H. Shidlofsky, a founding partner of Shidlofsky Law Firm PLLC in Austin, Texas, heads his firm s insurance law practice group, representing corporate policyholders involved in disputes with their insurance companies, providing advice to plaintiffs in complex litigation on how to maximize an insurance recovery and offering risk management consultation in connection with contractual risk transfer issues. Mr. Shidlofsky is a former chair of the Insurance Law Section of the State Bar of Texas and served on the council for the Construction Law Section of the State Bar of Texas.

9 S E P T E M B E R , The Honorable Christopher M. Skelly (retired), a partner with Scott & Skelly LLC in Phoenix, conducts mediations and arbitrations and serves as a special master in civil cases. Previously, he served as a judge on the Arizona Superior Court in Maricopa County. He is listed in Best Lawyers in America for alternative dispute resolution (2011 Phoenix Area ADR Lawyer of the Year and 2012 Phoenix Area Arbitration Lawyer of the Year), the Lawdragon 500 Leading Judges in America and similar publications. Timothy B. Walker is a senior vice president, regional technical director construction claims with Willis of New York. He has extensive experience in New York labor laws, contractual risk, claim program design and cost containment strategies. Mr. Walker is a resource for senior level advocacy and consulting on high severity or otherwise critical claims, including exposure analysis, disposition strategy and coverage dispute resolution. He has more than 20 years of experience in the insurance industry and 10 years in the construction insurance industry. Nicole Whyte is the founding principal of Bremer Whyte Brown & O Meara LLP, which has offices throughout California, Nevada, Arizona and Colorado. Ms. Whyte practices in all areas of complex civil, business and insurance litigation. She has tried hundreds of bench and jury trials in her 25 years of legal practice in the United States and abroad.
