Bentz A KCMBA Response to Homelessness in Kansas City Lawyers in Kansas City, particularly our members at the Kansas City Metropolitan Bar Association, are in a unique position. We are in a position that allows us to identify problems facing our community and, more importantly, to then use our skills and training to solve those problems. Such a problem was identified last year and has become the focus of a dedicated group of KCMBA members. The problem is Homelessness in Kansas City. It has been estimated that there are approximately 8,000 homeless persons in Kansas City at any given time. According to MAACLink, our community s homeless information management system, there were about 14,000 different homeless people who resided in Kansas City at some point during The MAACLink numbers are believed to vastly understate the true extent of homelessness in Kansas City because not all homeless servicing agencies enter data into MAACLink. The homeless population is diverse and exhibits these demographics: 41 percent are single men and 14% are single women; 5% are unaccompanied children and 40% are families with children; 67% are single-parent families; 23% are mentally ill and 30 % are drug or alcohol dependent; and 20% are veterans. The issues of homelessness, mental illness and the criminal justice system frequently are intertwined. Untreated mental illness and substance abuse in Kansas City have created a population whose illegal activities and symptoms lead to a cycle of homelessness, petty crime and incarceration. This cycle has led to Kansas City s Municipal Corrections Institute (MCI) becoming the second largest mental health facility in northwest Missouri. MCI houses 8,000 inmates per year, of whom: Over 80% are homeless; 50-60% have mental illness; More than 80% have drug and alcohol addictions; 70% have been imprisoned before; and 55% have been incarcerated at MCI three or more times. While some crisis-driven mental health services are provided at MCI, most mentally ill inmates do not receive any services. Many inmates want treatment but do not know how to access services or need significant assistance due to their situation. To further complicate a successful transition from incarceration to the community, many of these individuals have outstanding arrest warrants, lack proper identification and have lost benefits due to incarceration or the outstanding warrants. These legal issues, and the lack of a lawyer to assist with them, often preclude access to the very services these homeless individuals need to break the cycle of homelessness and jail. This cycle of homelessness and jail clog the municipal court system, consume enormous court resources and cost taxpayers millions of dollars. In response to the homelessness problem, the Association has formed the KCMBA Homelessness Project. The mission of the Homelessness Project is to work collaboratively with other professionals and groups toward the prevention of homelessness, advocacy on behalf of the homeless and the creation of lasting solutions for homeless families, children and individuals throughout the Kansas City metropolitan area. Beginning last July, a group of KCMBA lawyers, judges and mental health professionals began meeting to formulate a response to the cycle of homelessness in Kansas City. This group was led by then President, Charley German, KCMBA board member Janeen devries, Gregg Lombardi, acting Executive Director of LAWMO, Judge Elena Franco of the Kansas City Municipal Court and Dr. Bruce Eddy, the Chief Administrator of the Jackson County Mental Health Levy. The initial group was subsequently expanded to add the Superintendent of MCI, two other municipal court judges, the board chair of the Homeless Services Coalition, representatives of the City Prosecutor s office, the Executive Director of restart (a homeless shelter), a representative from Kansas Legal Services and more members of KCMBA. The KCMBA Homeless Project has developed a three-prong approach to try to break the cycle of homelessness, mental illness, petty crime and the criminal justice system. First, a Warrant Relief Project has been created. This project involves volunteers from KCMBA working in conjunction with 2 KC Counselor May 2008

5 the Volunteer Attorney Project to obtain relief for people who are homeless and cannot obtain access to social services because of their outstanding warrants. For example, an individual may not be able to qualify for Section 8 housing or get a job because they have an outstanding city warrant. To qualify for the project, an individual must be referred by an agency such as Rose Brooks, Operation Breakthrough, MCI, Community Link or Corrections to Success. The referring organization must certify that the client is living in the shelter and cannot access services because of an outstanding warrant. Latricia Scott Adams at the Volunteer Attorney Project is responsible for matching referrals with KCMBA volunteers. A pilot project that took place in February and March 2008 was extremely successful, leading Ms. Adams to state, The Warrant Relief Project has been one of the most effective programs since VAP s inception. It is so energizing to see legal problems resolved so efficiently while having such an important impact on the lives of the clients. Because of the outstanding collaborative efforts of the court and the attorneys providing pro bono services, it is my belief that this project will prove to be an invaluable community asset. Any KCMBA lawyer who is willing to volunteer for the Warrant Relief Project should contact Charley German or Janeen devries. A second aspect of the response by the KCMBA Homelessness Project involves support of the many not-for-profit agencies serving the homeless of Kansas City. KCMBA volunteers will assist homelessness service providers with legal advice related to corporate issues facing the providers. These issues range from standard issues facing all not-for-profits to funding compliance and reporting issues. Go Green with Greg Tip 3: Paper or Plastic? Neither. How many times have you gone to the grocery store and been asked the question: "Paper or plastic?" Although a seemingly simple question, your decision has an impact on the environment greater than you might imagine. In recognition of Earth Day that was held on April 22, 2008 consider trading those paper and plastic bags for a reusable bag available at many grocery stores for a small fee. A Victoria Schatz, from Great Plains Energy, is leading the effort to gather volunteers for this portion of the Project. A final aspect of the KCMBA Homelessness Project involves public advocacy for the homeless and homeless service providers. A recent example of this advocacy occurred when the City, as part of its budget process, announced that it would close MCI. Advocacy with the City allowed this potential disaster to be averted. Providing pro bono services is an important responsibility and obligation that attaches to the privilege of being an attorney. The expectation of service and public-spirited action is not limited to a particular type of practice, but instead to all attorneys. Whether a litigator, a corporate lawyer, a specialist in seemingly simple change can produce a big impact. Consider these statistics: One reusable bag replaces an estimated 1,000 single-use bags. Americans alone use over 380-billion plastic bags used each year. In 1999, 14 million trees were cut down to produce the 10 billion paper grocery bags used that year alone. The petroleum use to make just 14 plastic bags can drive car for one mile. Only 1-3% of all plastic bags and only 10-15% of all paper bags are recycled. administrative hearings, a noted transactional guru, a master at mediation or a leader of IPO s, every attorney has skills that can be used to assist individuals in the community to vindicate rights and realize benefits that otherwise might elude them. These words, stated by Ronald M. George, Chief Justice of the California Supreme Court, go to the very heart of the KCMBA Homelessness Project. Giving back to the community and improving the administration of justice through pro bono contributions is at the heart of styling oneself a professional. The KCMBA Homelessness Project has a place for any type of volunteer. I hope you will strongly consider giving back to your community. May 2008 KC Counselor 3

6 KCMBA Honors the Congenial Counselor Award Winners Congenial Counselors John Cowden and Elaine Drodge Koch are the 2008 recipients of the Congenial Counselor Award. Created in 1998, this award is presented annually to one or more members of the Kansas City Metropolitan Bar Association who their peers believe to exemplify professional gallantry, peacemaking, harmony and friendship. This year s honorees were recognized at an awards dinner on May 2 in conjunction with the Bench-Bar & Boardroom Conference at Tan-Tar-A Resort. John Cowden As a trial lawyer for more than 35 years, John Cowden has tried numerous major lawsuits involving product liability claims, aircraft accidents, commercial disputes, and aircraft coverage issues. He has served as National Coordinating Counsel for various products and as Special Product Liability Counsel in Chapter 11 litigation. Cowden has served as lead trial counsel in precedent setting cases involving aircraft and insurance agent contracts. Cowden was born and raised in the Ozarks region of Southwest Missouri. After attending public schools in the small community of Morrisville, Missouri, he received a B.A. degree in 1967 from Southwest Missouri State College, and a J.D. degree in 1970 from the University of Missouri at Columbia School of Law. Upon obtaining his law license, Cowden was hired by John C. Danforth as an Assistant Attorney General for the State of Missouri. His private practice was interrupted by service in the U.S. Army where he was assigned to the JAG Branch. After completing his Army duty, Cowden was hired as an associate with the Kansas City firm of Morrison, Hecker, Curtis, Kuder & Parrish where he practiced in the litigation department for 18 years. Since 1989, he has been a member of Baker Sterchi Cowden & Rice where he serves as a member of the firm s Executive Committee and maintains an active litigation docket. I had the privilege of working with several excellent trial attorneys at the firm of Morrison, Hecker, Curtis, Kuder & Parrish (where I first practiced in Kansas City) that served as my mentors including William Curtis and John R. Gibson who later became a Federal Judge, said Cowden. After having many mentors from whom he learned during stages of his career, Cowden now offers his own advice to other attorneys starting out in the legal profession. Watch, listen and learn from mentors, opponents, paralegals, legal secretaries and judges. Resist the urge to engage in criticism of another lawyer, a judge or the judicial system. And be patient and persistent in client development. Success means developing and maintaining a good reputation, consistently obtaining good John and his wife Carol. results for clients at a reasonable cost, and developing and maintaining a good client base. Always a loyal alumnus, Cowden is an Honorary Initiate of the Order of Barristers University of Missouri at Columbia, and is a member of that school s Law Society. Cowden s active participation in organizations includes membership in the American College of Trial Lawyers, American Board of Trial Advocates and International Association of Defense Counsel. He has been a faculty member of the IADC Trial Academy and is a current Master of the Ross T. Roberts Inn of Court. When I was asked to identify potential Congenial Counselors, the first person to come to mind was John Cowden, said Greg Bentz, KCMBA President. John is a tremendous lawyer who is always professional. He is a strong advocate, while remaining totally civil in his dealings with other counsel. John has mastered the art of representing his client without being disagreeable in the process. 4 KC Counselor May 2008

7 John and his grandson Ben Cowden enjoy some golf in Keystone, Colorado where John has a mountain home. When asked what his proudest career accomplishment might be, Cowden had two completely different things come to mind. My most satisfying case result was in a courtappointed matter, where I helped a Nigerian family obtain a substantial recovery in a wrongful death action. A village in Africa had collected money to send the family s oldest son to the USA to obtain a college education. He was beaten to death while in jail in Northwest Missouri. The recovery in the lawsuit allowed another son to come to the USA to complete his education. My most satisfying personal career accomplishment was election as a Fellow of the American College of Trial Lawyers. Outside of the office, Cowden s favorite pastime and source of relaxation is golf. I have been very fortunate to be able to play many of the world s best golf courses and I hope to play many more. Also, my wife Carol and I enjoy international travel, especially to Italy to visit our daughter Jennifer and her family (Danielle and two grandchildren) in Tuscany. We also love to spend time with our son John and his family (Emily and three grandsons) who live within a mile of our house. Family plays an important role in Cowden s life. He says that having the pleasure of watching his children develop and mature into successful professionals and strong and effective parents is the proudest accomplishment in his personal life. A surprising fact about Cowden is that he had only 16 classmates in his graduating public high school class and only two of them attended college. He also thought he might have ended up with a career in sales had the legal career not come a calling. Cowden is honored to be chosen as a Congenial Counselor Award recipient, and thought it is a good reminder to all members of KCMBA of the importance of civility and professionalism in the day-to-day practice of law. We can all be very proud of our local bar. I have been involved in cases throughout the country and routinely deal with attorneys from many different state and federal bars. None compare with our bar from the standpoint of quality, effectiveness, civility, professionalism and a positive culture for the practice of law. Elaine Drodge Koch Elaine Koch grew up in small towns in Tennessee where she kept busy playing basketball and with church youth groups. In 7th grade, Koch s mother got called to serve on jury duty. Koch used to go to court after school to watch the trial and it was that experience that got her interested in the legal profession. Koch attended the University of Tennessee as a College Scholar, and she obtained a B.A. in She then attended a Masters course in International Studies at The University of Southampton in England, while on a Rotary International Award. It was in England where she met her Nebraska farm boy husband, Steve Koch. She went on to receive her J.D. from Columbia University School of Law in New York in 1984 as a Harlan Fiske Stone Scholar. After getting married, Koch became an associate with Vinson and Elkins in Houston, Texas where she served as a litigator. Her experience at Vinson and Elkins included being part of the trial team on what is still the largest individual taxpayer case in Eric, Elaine, Steve and Sarah visit Pearl Harbor. history. In 1988, her husband convinced her to move to the Midwest, where she began practice at Spencer Fane Britt and Browne. There she handled everything from products liability to environmental litigation to employment litigation. In 2003, Koch joined the international law firm of Bryan Cave LLP as a trial lawyer where she continues to handle different types of litigation, but specializes in employment litigation. Recently, Koch became global leader of Bryan Cave s Labor and Employment Client Service Group. My mentors during my legal career have been Judge Ewing Werlein in Houston, Texas and Jim Willard at Spencer Fane, said Koch. Judge Werlein was a partner I worked for in my first law firm in Houston. He was such a great trial lawyer and great professional. He taught me that winning is important, but that it was more important to be ethical and professional. Jim Willard also taught me so much as a partner at Spencer Fane, but most of all he taught me to keep the practice of law and life in perspective and that meant so much. Long active in the local Bar, Koch is the past chairman of the KCMBA Public Service Committee, where she started the Summer Law Internship Program for inner city youth. Koch has served as President of the National Conference for Community and Justice, an organization which seeks to rid the world of bias, bigotry and racism. She also serves on the Steering Committee of the Nelson Art Gallery Business Council and served as the chair of the W.D. Month Federal Practice Advisory Committee. Koch has been very active in the American Bar Association Labor Section, speaking frequently at national conferences on trial techniques and employment litigation issues. In 2006, she was inducted as a Fellow of The College of Labor and Employment Lawyers. Koch has also received the KCMBA continued on page 6 May 2008 KC Counselor 5

8 continued from page 5 President s Award in 1993, and the David Dixon Appellate Advocacy Award from The Missouri Bar. Elaine Koch is a consummate Congenial Counselor, said Bentz. Elaine has been involved in numerous complex and pressurefilled cases. No matter what the situation or Elaine and her husband Steve enjoy some time together on a trip to Hawaii. circumstance, she has always remained friendly, calm and, most importantly, professional. Elaine is truly a good person. She is always even-tempered and remembers that the client is best served through professional advocacy. Creating the KCMBA Summer Law Internship Program for inner city youth is what Koch says is her proudest accomplishment of her career. I had heard there was a similar program in St. Louis and I thought that we needed that here in Kansas City. I knew it could change the life of individuals, and give inner city kids opportunities they couldn t get through their families. It was also a great way to get lawyers, firms and corporations involved in doing something good for a school district that needed our help. To this day, I still run into students that went through the SLIP Program who are leading great professional lives. Koch has seen this profession become more competitive and demanding. We deal with each other less in person. My advice would be to tell attorneys that in addition to working hard at their job, to remember we are part of a profession. Make sure to take time to be involved in the community. Outside of the office, Koch enjoys art, reading and spending time with her husband Steve, 13 year-old daughter Sarah and 11 yearold son Eric. Having two wonderful children is by far my proudest personal accomplishment of my life. Becoming an artist is what Koch might have become if she had not become an attorney and did you know that she also likes to boogie board in the ocean? My idea of success in this business is gaining the trust of my clients and the respect of my colleagues. Receiving the Congenial Counselor Award is such a nice recognition I am honored to be recognized for professionalism. Bryan Cave LLP is the proud recipient of the prestigious Robert C. 10 Nikki Cannezzaro: 2008 Young Lawyer of the Year By Joselyn Verschelden, Chair of the YLS Public Relations Committee The Young Lawyers Section of KCMBA is pleased to announce that Nikki Cannezzaro, a partner with the law firm of Franke Schultz & Mullen, PC, is the recipient of the 2008 Young Lawyer of the Year award. Each year, the Young Lawyer of the Year is chosen from a group of deserving candidates, and this year is certainly no exception. Though there were many excellent nominees, Nikki s extensive litigation experience and dedication to public service led to her selection. The Young Lawyer of the Year is someone who contributes significant work toward public service programs; promotes the highest standards of professionalism, competence and ethical conduct; improves the image and promotes positive public awareness of the legal profession in the community; and has achieved substantial success and accomplishment in the legal profession. Nikki exhibits each of these four characteristics to the highest degree. A Kansas-City area native, Nikki graduated from Shawnee Mission Northwest High School where she played soccer, and then went on to the University of Kansas. From a very young age Nikki knew she wanted a career involving the law. Desiring to stay in the Kansas-City area and to begin building connections with the local legal community, Nikki chose to attend the University of Missouri-Kansas City School of Law. It s no surprise that Nikki excelled in law school. She was the UMKC Law Review Literary Editor and a member of the Dean s List all semesters. But what is surprising is that she managed to maintain such high academic standards while working at both the Jackson County Prosecutor s Office and the U.S. Attorney s Office for the Western District of Missouri. While Nikki enjoyed working during law school and gained valuable experience, she realized that neither job was the right fit. As a result, Nikki decided to clerk for the Honorable Robert G. Ulrich of the Missouri Court of Appeals, Western District after graduation. At the Court of Appeals Nikki was exposed to many different areas of the law, which helped shape her current career path. Her relationship with Judge Ulrich, who Nikki describes as a mentor and friend, also helped shape her career. Judge Ulrich advised Nikki to find a firm where she liked the people. That advice, coupled with the opportunity for immediate hands-on experience, led Nikki to Franke Schultz & Mullen, PC. Nikki joined the firm in August The firm s promise of real hands-on experience materialized quickly as she found herself taking a deposition during the first week of her employment. Though some might shy away from the level of responsibility Nikki was offered, she embraced the opportunity as a way to develop trial and appellate skills early in her career. During the seven years Nikki has been with Franke Schultz & Mullen, she has participated in at least 20 trials and 24 appeals. Her passion for trial work and her willingness to accept responsibility have allowed Nikki to hone her skills and become a top-notch trial lawyer. Nikki s partner, Jill Frost, says she has seen Nikki blossom into a take no prisoners trial lawyer. I love the excitement, thrill, energy, adrenaline rush and competition, Nikki said. There is nothing better than trying a case against a great congenial lawyer. Nikki s hard work and entrepreneurial spirit were rewarded by her firm when she was elected to the partnership in 2005, just four years after joining the firm as an associate. Jill Frost says that very early on, Nikki gained a reputation in the firm for making well-reasoned decisions with the highest degree of professionalism. Her unique combination of intellect, common sense and sound judgment led to the firm s partnership invitation significantly earlier than normal. Nikki s reputation extends far beyond the members of her firm. YLS President, Jo Leigh W. Fischer, went to law school with Nikki and worked with her at the Jackson County Prosecutor s Office. Jo Leigh stated that she has always known Nikki to exhibit the highest level of ethical conduct and competence as a lawyer. Her well-known reputation as a trust-worthy professional ultimately led to her selection as this year s Young Lawyer of the Year. Though it is apparent from Nikki s long list of trials and appeals that she works very hard and has achieved a great deal of success at an early age, the list of public service projects she participates in is just as impressive. Focusing on bettering the legal community and its public perception, Nikki devotes significant time to the Association for Women Lawyers of Greater Kansas City and KCMBA. Nikki has served as a member of AWL s Board of Directors since She particularly enjoys the camaraderie and networking opportunities AWL provides. Mandy Ketchum, AWL s 2008 Awards Chair, says that Nikki is the type of Chris and Nikki hang out with Kevin, to whom they serve as the Big Couple to through Big Brothers Big Sisters of Kansas City. 8 KC Counselor May 2008

11 board member who is always willing to assist other committee members, even though her current role as the 2008 Judicial Chair carries a lot of responsibility itself. Nikki has also been heavily involved in the Young Lawyers Section of KCMBA for several years, regularly volunteering for events such as Read Across America and the Ask-A- Lawyer Telethon. Her willingness to volunteer for and coordinate such events led Jo Leigh Wagoner Fischer to recruit Nikki to serve as a Vice Chair for the Public Service Committee this year. Nikki says she particularly enjoys her work with KCMBA because it provides an opportunity to get out into the community in a way that helps promote a positive perception of lawyers. Nikki and her husband, Chris, also make public service a regular part of their family life. Together, Nikki and Chris volunteer as a Big Couple through Big Brothers and Big Sisters of Kansas City. For just over a year now, Nikki and Chris have been the Big Couple for a 10-year-old boy, Kevin, whose father passed away when he was very young. Nikki, Chris and Kevin enjoy playing miniature golf together and going bowling, but their main goal is to give Kevin support and structure in his life. Between work and volunteering, it is hard to imagine that Nikki has much time for anything else. When she does get some free time though, she enjoys playing golf with her husband and spending time at her parents lake house. Nikki and Chris also have two dogs that are like children to them Lucky, a Dalmatian, and Charlie, a Weimaraner. Nikki describes her selection as the 2008 Young Lawyer of the Year as extremely satisfying. She feels there are many great young lawyers in Kansas City who dedicate their time and efforts to improving the legal profession and surrounding communities. Being considered part of this group and being named Young Lawyer of the Year is a true honor for her. Nikki has certainly accomplished much in her relatively short eight-year career. And it s clear that she is happy about where her career path has led. Nikki thoroughly enjoys her job and the people with whom she practices. When asked what the best aspects of being a partner at Franke, Schultz & Mullen are, she responded, Everything. I work with great people... Probably the best aspect of being a partner in the firm is the relationships I have built among my partners. In addition to considering each one a colleague, I consider them true friends.
