PUBLIC QUESTIONS Any member of the public wishing to ask a question at the above meeting can do so only if a written copy of the question is submitted to the Contact officer by 12 Noon on Tuesday, 31 March FILMING - The Council, members of the public and the press may record / film / photograph or broadcast this meeting when the public and the press are not lawfully excluded. Any member of the public who attends a meeting and objects to being filmed should advise the Constitutional Services Officer who will instruct that they are not included in the filming. Please note that anyone using recording equipment both audio and visual will not be permitted to leave the equipment in the room where a private meeting is held. Recording and reporting the Council s meetings is subject to the law including the law of defamation, the Human Rights Act, the Data Protection Act and the law on public order offences. 2 Urgent business, if any, introduced by the Chair 3 Declarations of Interest To Receive Declarations of Interest in any Contract or matter to be discussed at the meeting. 4 Public Question Time To receive Questions from the Public, in accordance with the Council s Constitution. 5 Minutes of Previous Meeting (Pages 1-6) The Minutes of the Licensing Driver Panels held on 3 rd and 4 th March 2014 are attached for approval. 6 Exclusion of the Press and Public That, in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they contain exempt information under paragraphs 1 and 2 of Part 1 of Schedule 12A of the Act, and it would not, on balance, be in the public interest to disclose the reports. 7 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/12/2015) (Pages 7-32) The purpose of this report is to ask Members whether, in light of revised conviction guidelines, the previous history of a current licensed driver means that driver is not a fit and proper person to hold a private hire / hackney carriage drivers licence with the Council. 8 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/07/2015) (Pages 33-38) The purpose of this report is to ask Members whether, in light of revised conviction guidelines, the previous history of a current licensed driver means that driver is not a fit and proper person to hold a private hire / hackney carriage drivers licence with the Council. 9 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/13/2015) (Pages 39-44) The purpose of this report is to inform Members of the circumstances surrounding a current driver s offences, who has now been invited to attend today s meeting to show cause why the application to renew their licence should not be refused in light of those offences. 10 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/14/2015) (Pages 45-50)
3 The purpose of this report is to inform Members of the circumstances surrounding a current driver s offences, who has now been invited to attend today s meeting to show cause why the application to renew their licence should not be refused in light of those offences. 11 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/15/2015) (Pages 51-58) The purpose of this report is to inform Members about the behaviour of an existing driver, which calls into question whether that driver is a fit and proper person to hold a licence; and who has been invited to attend today s meeting to show cause why their licence should not be suspended or revoked as result of that behaviour. 12 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/16/2015) (Pages 59-64) The purpose of this report is to inform Members about the behaviour of an existing driver, which calls into question whether that driver is a fit and proper person to hold a licence; and who has been invited to attend today s meeting to show cause why their licence should not be suspended or revoked as result of that behaviour. 13 Licensing Drivers Panel Appeals Update (Pages 65-66) The purpose of this report is to provide Members with an update on any appeals against the decisions of the Council s Licensing Drivers Panel

6 NOTE: The Driver and his representative attended the meeting and addressed the Panel. 8 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/05/2015) RESOLVED that the Private Hire / Hackney Carriage Driver s Licence be REVOKED with immediate effect. NOTE: The Driver and a relative attended the meeting and addressed the Panel. 9 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/06/2015) Councillor Azad left the meeting during consideration of this item and took no part in the discussion or vote. RESOLVED that the Private Hire / Hackney Carriage Driver s Licence be REVOKED with immediate effect. NOTE: The Driver attended the meeting and addressed the Panel and was accompanied by a relative. At this point in the meeting members requested a short adjournment. Following a short adjournment the panel was reconvened and Councillor Azad returned to the meeting. 10 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/07/2015) RESOLVED that consideration of this item be DEFERRED pending further information. NOTE: The Driver and a relative attended the meeting and addressed the Panel. 11 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/08/2015) RESOLVED that NO ACTION be taken. NOTE: The Driver and his representative attended the meeting and addressed the Panel. 12 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/09/2015) On being put to a vote 6 VOTES were cast IN FAVOUR and 1 VOTE was cast AGAINST Licence revocation with 1 ABSTENTION. RESOLVED that the Private Hire / Hackney Carriage Driver s Licence be REVOKED with immediate effect. Page 2

All parties were able to view the video. RESOLVED that, based on the information before the Panel today, on the grounds of public safety, the Private Hire / Hackney Carriage Driver s Licence be revoked with immediate effect. Page 5
10 NOTE: The Driver attended the meeting and addressed the Panel. 7 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 SECTION 61 (S61/11/2015) RESOLVED that no action be taken on this occasion but a warning be given to the Driver as to his future conduct.
