2 Business Development and Marketing Curriculum September 2005 Successful Business Development Styles Are you a rainmaker, a point person, a hired gun, or a brain surgeon? Each attorney approaches business development with a unique combination of skills, experiences, and personal style. In this program, we will discuss how law firm partners use their assets to successfully develop and sustain their practice. How do attorneys using these approaches differ in building their profiles, networking, and making and managing relationships? October 2005 Building Your Practice Through Groundwork, Construction, and Renovation Each day of your legal career is the time to build your legal skills and focus on marketing and personal advancement. Finding and cultivating one or more mentoring relationships, marketing yourself both inside and outside the firm, keeping current on the firm s diverse capabilities, and creating a professional development plan are among the activities that will be discussed in this program. Although all attorneys are welcome, this program is most appropriate for associates. November 2005 Creating, Implementing, and Updating a Personal Marketing Strategy and Action Plan Planning is essential to successful business development. In this program, you will learn how to: assess your practice, skill sets, and existing clients; set realistic goals for marketing; and create, implement, and update a personal action plan with one-month, two-month, and three-month objectives. This program is most appropriate for senior associates, counsel, and partners. December 2005 Developing and Strengthening Your Professional Identity You ve worked hard to develop an expertise, but are you marketing your skills effectively? This program will cover new strategies for the time-tested methods of building professional credibility and increasing visibility, such as writing articles, attending industry conferences, and speaking at CLE programs, as well as other activities that have proven fruitful for firm rainmakers. January 2006 Excelling in Delivering Client Service The legal profession is a service business, and developing and nurturing relationships is critical to the success of business development. In this program, Hogan & Hartson partners will share their secrets for exceeding client expectations, developing a loyal clientele, and winning new business. February 2006 Playing to Your Strengths In a previous session, we learned about four different marketing styles: the rainmaker, the point person, the hired gun, and the brain surgeon. This session will help you understand how you can best focus on developing client relationships within your own marketing style. Recognizing that each of us possesses attributes of all four styles, we ll further discuss how you can consciously draw on specific attributes that may fall outside of your marketing style preference. How do you put together a response or pitch book? And, if you re lucky enough to get called to make a client pitch or participate in a beauty contest, how do you deliver a winning presentation? These and other similar questions will be answered in this program. April 2006 Getting Comfortable Asking for Business You have identified prospective clients through planning your marketing strategy, networking, or referrals from existing clients. Learn techniques in this program for converting these efforts into actual new business. May 2006 Marshalling the Nuts and Bolts of Bringing New Clients to the Firm Congratulations! Your marketing efforts have finally paid off and a prospective client would like to hire the firm. This program will cover the nuts and bolts of conflicts checks, proper supervision of client work, billing responsibilities, origination credit, engagement letters, and retainers. This program is especially appropriate for associates. June 2006 International Business Protocol Knowing the appropriate business protocol in any situation is critical in avoiding embarrassing faux pas that could cost you valuable business. In this program, you will learn the etiquette of different cultures regarding greetings, introductions, meetings with clients in your office, body language, business card usage, and telephone calls. July 2006 Rainmaking in a Global and Multicultural Society In this program, we have gathered a diverse panel of some of the firm s most highly successful rainmakers and leaders in the legal profession to discuss their experiences and share tips for connecting with prospective clients who are of a different gender, race, or culture. Smith, Jr. Walter Smith is the Executive Director of DC Appleseed Center for Law and Justice, Inc., a nonprofit organization dedicated to addressing important public policy questions facing the Washington, DC metropolitan area. Mr. Smith previously was Deputy Corporation Counsel for the District of Columbia, and from 1976 to 1992, he was a partner at Hogan & Hartson, serving as head of the Community Services Department for his last four years with the firm. 6 Core Curriculum September 2005 and December 2005 Presentation Skills If you are not a naturally relaxed and confident speaker, this program will help you master the physical, mental, and verbal challenges of speaking well to a group. Learn to control your breathing, use effective gestures, make appropriate eye contact, how to use your notes, where to place emphasis, and when to pause. This program will be held in the New York office in September and the Washington office in December. October 2005 Using in a Business or Legal Context In our age of ever advancing technology, attorneys have become increasingly dependent upon in their communications with each other and with clients because of its immediacy and spontaneity. What you may not be aware of is how can get you and your client into trouble. This program will teach you when it is safe to use in your practice and when it is better to pick up the phone or write a letter. October 2005 New Associate Orientation Among the topics to be discussed at this one and one-half day program in the Washington office will be the role of the firm s Practice Area Administrators, the evaluation process, the firm s investment and employment policies, ethics and professional responsibility, the ten commandments of billing, associate success skills, and an introduction to the Community Services Department. All U.S. office associates who have joined the firm since the preceding new associate orientation will be invited to attend this program. November 2005 Rules & Tools: Fundamentals of Business and Finance Practice This two-day program serves as a basic introduction to the skills and concepts that business and finance lawyers should master. Topics covered will include the different types of entities, due diligence, private equity, bank debt, initial public offerings, public company financings, mergers and acquisitions, public company obligations, opinions, and certain specialized areas of the law. This program is considered mandatory for all U.S. office first-year Business and Finance Area associates. January 2006 Delegation and Supervision This program is designed to help attorneys develop team leadership and project management skills. Particular attention will be paid to managing different personality types, defining goals as a motivation technique, creating accountability, and providing timely reinforcement and correction through feedback. February 2006 Learning to Litigate This two-day program serves as a basic introduction to the firm s litigation practice and the skills that litigators use every day. Topics covered will include practical aspects of handling litigation matters, an examination of the elements of a trial, written and fact discovery, document review and production, and dealing with experts. There also will be an opportunity to hear firm alumni judges perspectives on how they decide their cases. This program is considered mandatory for all U.S. office first-year Litigation Area associates. CLE credit will be awarded for all qualifying programs.
7 February 2006 Audit Inquiry and Audit Response Letters Just in time for audit season, this program will provide a general survey of the firm s practices and procedures for responding to audit inquiries from clients. Topics covered will include an explanation of how the audit letter evolved, a discussion of the issues that recur in audit response letters, the firm s approach to the undertaking regarding unasserted claims and assessments, and procedures and practical tips for streamlining the audit response process. March 2006 Introduction to Contract Drafting This program is designed for transactional attorneys who would like to improve their drafting technique. By focusing on the elements of good drafting, words and phrases to use and those to avoid, sentence structure, structuring complex provisions, document organization, and editing, this program will help drafters produce clear, precise, and authoritative documents. This program is considered mandatory for all U.S. office first, second, and third-year Business and Finance Area associates. All other attorneys are invited to attend. March 2006 Using Technology to Your Advantage This program will be offered in two sessions. The first, focusing on litigation technology, will demonstrate tools for case administration, electronic discovery, document management, knowledge management, and presentations. In the second session, transactional lawyers will be introduced to knowledge management and software to assist in drafting documents. April 2006 Law Firm Economics How does a law firm make money? How do your billable hours contribute to the firm s bottom line? Do you know how to read the monthly reports that you receive? This program will answer these and other questions relating to the basics of law firm profitability, each attorney s contribution to the bottom line, the billing and management of receivables, and attorney compensation. June 2006 Negotiation This program will give you the knowledge, skills, and power to deal with the negotiation issues you encounter every day. Learn the five golden rules of negotiation, strategies to get past no if all appears lost, ways to gain leverage when you are seemingly powerless, agenda control techniques, and more. July 2006 Time Management Are you effectively managing your time? In this program, you will learn specific skills and techniques that will help you gain control over your time by focusing more effectively, developing a daily action plan, becoming proactive and controlling interruptions, taking small daily steps towards long term goals, and establishing systems that will save time. September 2005 Second Annual Supreme Court Review The Supreme Court s 2004 Term included numerous highly significant cases involving clashes between individual and governmental interests and the balance of power between the federal government and the states. The Court s docket included several important criminal procedural issues, free speech and religion cases, takings issues, and important issues of federalism. Anyone concerned with the development of constitutional law and the work of the Supreme Court will find this program highly informative. September 2005 Arbitration: Debunking the Myths In the midst of negotiating a deal, there is little focus on dispute resolution. As a result, the relevant language often is added at the last minute, with little thought or negotiation. In this program, learn the advantages and disadvantages of arbitration and analyze the key components of a well-drafted arbitration provision. October 2005 Ending Conflict Through International Prosecution What are the potential effects of prosecution by the International Criminal Court of the atrocities committed in three of the most destructive conflicts in the 21st century: Sudan s Darfur region, Uganda, and DR Congo? In this program, a representative from the International Crisis Group, a high-profile human rights advocacy organization, will analyze the political dimension of the conflicts, review the nature of atrocities being committed in these three African countries, and explore how prosecution could positively influence a resolution of the conflicts. November 2005 The Rotation System This program will explain the associate practice group rotation assignment process as it operates in the Washington office. Practice Area Administrators will address associate concerns, such as how many times an associate can rotate and what to do when you are ready to settle in a practice group. January 2006 New Developments in Media Law Illegal music downloads, blogging, cybersquatting. These are examples of issues that have arisen in the context of the new media. This program will address these and other issues in both old and new media contexts and will review the law that is developing in response. June 2006 Legal Ethics 2006 In this annual ethics program, the year s hot topics in the area of ethics and professionalism will be addressed. Additional hot topics programs will be presented as issues arise during the year.
