13 HAZARD INSURANCE REQUIREMENTS The following insurance requirements must be maintained at the expense of the Borrower for fire, flood and other types of insurance as may be required by San Diego Private ( Bank ) for all real property pledged as collateral for a loan. All insurance must be in form and content satisfactory to Bank. This notice is intended to assist you during the application portion of your loan request. Once your loan is closed, should any conflicts occur between this form and your loan documents, the loan documents will prevail. 1. The policy amount on for improvements that are identified as collateral for your loan, with loss payable in favor of Lender and must be equal to the principal balance of the loan together with any senior loans OR 100% of replacement cost of the improvements on the subject property, whichever is less. The total deductible applicable to all policies covering the collateral cannot exceed 2,500. All policies must be for a minimum of 12 months and must be paid in full at the time of each renewal. On refinance transactions, at the time the loan is originated the remaining term on your policy cannot be less than 6-months. 2. If applicable, the amount of flood insurance required is the lower of a) the outstanding principal balance of the loan or b) the maximum amount of coverage available under the NFIP for the particular type of improvements; or c) full insurable value of the improvements equal to 100% of the replacement cost value. 3. The insurer must be licensed to do business in California and must have a rating of B, Class V or better in current Best s Key Rating guide, For non-admitted carriers, a rating of A, Class V or better is required. Policies received from Companies rated below the specified requirements will be accepted only if they are accompanied by 100% reinsurance endorsement from a company rated as indicated above. Said reinsurance endorsement must provide for a 90-day written notice before cancellation or termination. 4. Insurance policies must reflect Lender s Loss Payee as follows: San Diego Private Bank, its successors and assigns 9404 Genesee Avenue, Ste #100 La Jolla, CA For commercial and five or more residential unit properties, a minimum of twelve months loss of rents coverage must be included in the policy. 6. General liability in the amount of 1,000,000 per occurrence and 2,000,000 aggregate. 7. When personal property and/or fixtures are included in the security of a loan, insurance coverage is required to the extent of their value as determined by Lender. 8. Binders are acceptable as temporary proof of insurance, up to maximum of 30 days. Certificates of insurance are not acceptable as proof of insurance. 9. Verification of renewal insurance policies must be in the Lender s office at least thirty days prior to expiration of the existing policy. In the event Lender receives notice of cancellation, non-renewal, or any other lapse in coverage of any required policy, and Borrowers have not provided Lender with evidence of a replacement policy, Lender may obtain insurance, (interim coverage) at Borrower s expense, protecting Lender s interest only, such interest being limited to the unpaid principal balance of the loan. Lender will have no responsibility for maintaining that insurance protection, liability, theft, or other special risk not required by the Bank. 16 Please Keep For Your Records Summary USA PATRIOT ACT AND CUSTOMER IDENTIFICATION PROGRAM (CIP) In response to the events of September 11, 2001, President Bush signed into law on October 26, 2001 the USA Patriot (Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism) Act of The act is comprised of several broad and wide-ranging anti-terrorism initiatives, including measures financial institutions must follow to detect, prevent, and assist in the prosecution of persons involved in money laundering and/or financing terrorism. What is San Diego Private Bank doing to comply with the USA Patriot Act? San Diego Private Bank is committed to comply with the provisions of the Act, including the required implementation of a Customer Identification Program, or CIP.
