2 The City of Blaine invites proposals for phone service from qualified vendors serving this area. The purpose of this RFP is to obtain reliable services from a qualified vendor at a competitive price. Proposal timeline: Proposal release date June 26 Last date to receive (by 4:30 pm) July 15 Evaluation complete July 25 Council approval August 7 Award August 8 Services start September 8 During the evaluation process, the City reserves the right, where it may serve the City s best interest, to request additional information or clarifications from proposing firms, or to allow corrections of errors or omissions. At the discretion of the City, firms submitting proposals may be requested to make oral presentations as part of the evaluation process. To submit a response, or if questions about this RFP, contact: Dennis Peters dpeters@ci.blaine.mn.us Information Services Director Evaluation of Proposals The contract will be awarded to the provider that best meets the needs of the City, provided the fee is reasonable and it is in the best interest of the City to accept it. In evaluating the proposals, the following criteria will be utilized: Responsiveness of the proposal. Responses of client references. The quality, availability and adaptability of the Services to the particular needs required. Demonstrated support capability, minimal response times for problems, effective solutions to problems when they occur, as reflected in the SLA provided by the prospective vendor. The reputation, financial stability, and longevity of the proposer, as well as established presence in the market in the general area of the City. Cost of the services provided.

DID Blocks & #s) 1 T1 Services PRI-T1 (23B+D) Trunk 1 DID Blocks and Numbers (blocks of 20) 15 Additional Services/Features Call Forwarding 2 Caller ID 1 Directory Services (PS/ALI, C911, etc.) Surcharges/Fees Please include all Federal Access charges, Extended Area Service (EAS) charges, 911, TDD, TAP, TACIP, USF Surcharges. Long Distance Rates Cost per minute Intrastate and Interstate rates for long distance service. Technology Changes The City will be replacing the current (traditional PBX) phone system soon, as a technology migration. Vendor must allow trunking upgrade for improved products (ex: managed or native SIP trunking) with no termination charges for the existing agreement if required, and at competitive rates. Also give example of SIP trunk pricing. The respondents are encouraged to include any additional relevant information that the respondents feel may be beneficial to the City, including technology directions, new offerings, etc.

4 Contract Term Contract terms requested are for 3 years, with the option to renew for an additional 3 year period. Contract Termination The City may cancel the contract upon 30 days written notice, with or without cause. The vendor may cancel the contract upon 181 days written notice, with or without cause. Liability Contractor agrees to indemnify and save and hold the City, its agents and employees harmless from any and all claims or causes of action arising from the performance of this agreement by Contractor or Contractor s agents of employees. This clause shall not be construed to bar any legal remedies Contractor may have for the City s failure to fulfill its obligations pursuant to this agreement. Accessibility: Compliance with Americans with Disabilities Act (ADA) The CONTRACTOR agrees that in occupying the premises as described herein, it is responsible for complying with the Americans with Disabilities Act, 42 U.S.C. section 12101, et seq., and any regulations promulgated pursuant to the Act. The City IS NOT responsible for issues or challenges related to compliance with the ADA beyond its own routine use of facilities, services, or other areas covered by the ADA. Minnesota Data Practices Act The CONTRACTOR must comply with the Minnesota Government Data Practices Act, Minnesota Statutes Chapter 13, as it applies to all data provided by the STATE in accordance with this contract, and as it applies to all data created, collected, received, stored, used, maintained, or disseminated by the CONTRACTOR in accordance with this contract. The Civil remedies of Minnesota Statutes Section apply to the release of the data referred to in this Article by either the CONTRACTOR or the STATE. In the event the CONTRACTOR receives a request to release the data referred to in this Article, the CONTRACTOR must immediately notify the STATE. The STATE will give the CONTRACTOR instructions concerning the release of the data to the requesting party before the data is released.

5 Insurance Requirements Insurance Limits. During the Term, each party shall obtain and maintain not less than the insurance set forth below: Worker s Compensation: Part A: Statutory Part B: Employers Liability Bodily Injury by Accident - each accident $500,000. Bodily Injury by Disease - each employee $500,000. Bodily Injury by Disease - policy limit $500,000. Contractor shall obtain from its insurers a waiver of subrogation in favor of the City of Blaine with respect to losses arising out of or in connection with the Work. Automotive Liability: Such policy will include coverage for all vehicles owned, hired, non-hired, non-owned and borrowed by party in the performance of the obligations covered under this Agreement. Combined Single Limit: $1,500, Commercial General Liability and/or Umbrella Liability: All liability insurance must meet the requirements of Minn. Stat Subdivision 1 (a) (7) or $4,000,000 minimum liability for any number of claims arising out of a single occurrence, whichever is greater. All umbrella insurance must meet the requirements of Minn. Stat Subd. 1 (a) (8). The above minimum requirements as to insurance coverage shall not limit the liability of either party under this agreement. The above limits may be satisfied using a combination of primary and excess coverage, self insurance as provided by Minn. Stats Each Party shall obtain and maintain the insurance policies required above with insurance and/or reinsurance companies authorized to insure risks in Minnesota. With the exception of Worker s Compensation, each party, its Affiliates, and their directors and employees and any other person entitled to indemnification hereunder, the City of Blaine shall be named as additional insured to the extent of such indemnification. Each Party shall provide the other party with a certificate of insurance showing that the party has complied with the insurance requirements of this Attachment. Each insurance policy shall contain a provision providing such other party with thirty days advanced notice of any cancellation or material change in coverage at which time such party will notify the other party immediately of such cancellation or material change in coverage. Deductible/Self Insured Retentions: All proof of insurance shall clearly set forth deductible or self insured retentions. Each Party shall be responsible for its deductible and/or self insured retentions.
