1 The Lawyers Summer Annual Report 20th Anniversary Edition Campaign for e qua l justice We re In It For The Long Haul This year, we celebrate the 75th anniversary of legal aid in Oregon and the 20th anniversary of the Campaign for Equal Justice. In 1935, Portland lawyer Gus Solomon persuaded the newly formed Oregon State Bar to approve a legal aid office for Portland funded by the Works Progress Administration (WPA) and local lawyers. On February 15, 1936, the office opened with three lawyers and two stenographers. On that first day, 30 clients needing legal help came to the new office. More than 1,700 people sought help in the first six months. Janet Starkey was the Executive Director of the office for the first 25 years it was open. After WPA funding ended in 1937, legal aid operated as a two or three person office until the 1960s, relying on the support of charitable organizations and small donations from a few lawyers. In 1966, the Office of Economic Opportunity funded legal services programs in Multnomah, Marion, and Lane Counties. That expansion continued in the 1970s, with Congress starting the Legal Services Corporation in Celebrating the 75th Anniversary of Legal Aid & the 20th Anniversary of the Campaign for Equal Justice! In 1971 Governor Tom McCall called for a study to assess The founders of the Campaign for Equal Justice around the time of the founding: Ira Zarov, Lou Savage, Linda Clingan, and Henry Hewitt the civil legal needs of the poor in rural Oregon. The study committee was co-chaired by Don Marmaduke and Steve Lowenstein, with staff attorneys Doug Green and Charlie Williamson. This Statewide Legal Aid Feasibility Study concluded that Oregonians in rural parts of the state needed legal aid. Even in the face of a tough economy, you once again answered with a resounding YES! In our annual fund drive, which ended March 31, 2011, Oregon lawyers raised over $1 million for statewide legal aid programs. Over 250 attorneys from all corners of the state pitched in to raise money for the annual fund drive, and about 2,500 lawyers contributed to the Campaign. The Portland Large Firm Committee, chaired by Joel Mullin, Stoel Rives; Beth Skillern, Bullivant Houser Bailey; and Larry Reichman, Perkins Coie, raised almost $370,000 close to their goal of funding the equivalent of eight legal aid lawyer positions. The Mid-Sized Firm Committee, co-chaired by Mark Wada, Farleigh Wada Witt and Mike Silvey, Roberts Kaplan (now Lane Powell), raised close to $84,500. Oregon was the second state to direct filing fee funding to legal aid, and now 32 states have this source of funding. New challenges emerged in the 1980s, including a recession, a new administration in Washington, and federal funding cuts. In response, the Oregon State Bar established the Oregon Law Foundation, and IOLTA was created to capture the interest on lawyer trust accounts for legal aid. Also, the legislature directed more filing fee money to legal aid. In 1991, Lou Savage, Ira Zarov, Linda Clingan and Henry Hewitt launched the first Annual Campaign of the Campaign for Equal Justice. With the help of a $250,000 matching grant from the Meyer Memorial Trust and the involvement of Ernie Bonyhadi, Oregon lawyers raised $250,000 to meet the match. Government and private funding for legal aid are in constant flux. The Chair of the Board of Directors of the federal Legal Services Corporation has noted that Much work remains to be done if our nation is to fulfill its promise of equal justice for all Americans. The Campaign for Equal Justice continues to advocate for increased state, federal, and private funding for legal aid. Oregon lawyers have embraced the ideal of equal justice for all and have shown that we are in it for the long haul. Since 1991, you have helped us raise $20 million for legal aid and helped to increase access to justice in Oregon. For an update on current funding issues, please see page 22. 7 Lawyers Gather Around the State This past fall lawyers around the state gathered for lunch to learn more about legal aid and to build support for their local programs. Record numbers of lawyers gathered in Salem, Eugene, and Medford. Table captains in each region invited their colleagues to lunch. Generous corporate sponsors covered the costs of the luncheons. Marion-Polk Luncheon The Marion-Polk CEJ Luncheon has now become a model for other counties around the state. Over 315 lawyers gathered at the Mission Mill in Salem for the 14th Annual Marion-Polk County CEJ luncheon on September 15, Former Attorney General Hardy Myers presented the Public Access to Justice Award to Oregon Senate President Peter Courtney. Carla Mikkelson from Legal Aid Services of Oregon and Fred Boss from the Oregon Department of Justice presented the Partner in Access to Justice Award to Tom Elden, a long-time supporter of legal aid who is credited with early fundraising efforts in Marion County. Secretary of State Kate Brown addressed the attendees about the importance of access to justice. Salem legal aid attorney Michael Keeney spoke about his client Lucy, a mentally disabled adult and domestic violence survivor who was able to receive SSI benefits through legal aid s help and, for the first time in her adult life, was not at risk of homelessness. In accepting the Public Access to Justice Award, Senator Courtney called legal aid lawyers the heroes of the legal profession. John Gartland, CEJ statewide co-chair, emceed the event. Oregon Court of Appeals Chief Judge David Brewer spoke about the importance of providing access to justice to low-income Oregonians. Erika Hente, regional director of Lane County LASO, told attendees about her client Doris. Legal aid was able to help Doris, a mentally disabled adult, keep her SSI benefits. Gerry Gaydos closed the luncheon by asking lawyers to give generously to the Campaign to help address the increasing need. Lane County lawyers answered the call. By the close of the annual fund drive, Lane County lawyers had contributed over $80,000. Medford On December 1, 2010, over 115 lawyers packed the jury room at the Jackson County Courthouse for lunch. 12 The Campaign for Equal Justice The Campaign for Equal Justice (CEJ) was established in 1991 by Oregon lawyers with the mission of ensuring that equal access to justice becomes a reality for all Oregonians. CEJ accomplishes its mission by: Operating an Annual Fund drive with the help of 200 volunteer lawyers; Educating lawyers and the community about the importance of access to justice and how legal services are delivered in Oregon; Working with lawyer volunteers and bar organizations to increase state and federal funding for legal aid; Assisting legal aid programs in increasing revenue through foundation support; and Operating an Endowment to preserve the future of legal aid. Since 1991, the Oregon legal community has helped the Campaign raise $20 million for legal aid. Despite the tremendous efforts of our volunteers and contributors, we still meet less than 20% of the legitimate legal needs of Oregon s poor. With your help, we can do better than 20%. What You H LEGAL AID Because of limited resources, legal aid offices in each community work to set priorities in order to serve the most dire needs of low-income clients. In addition to direct client service and self-help materials, legal aid lawyers work with community organizations that serve low-income clients. Oregon s legal aid programs do not engage in separate annual fund activities, but rely on the work of the Campaign for Equal Justice to have a collaborative statewide effort to support legal aid statewide. The following organizations provide support for the operating expenses of the Campaign: The Oregon State Bar, The Oregon Law Foundation, and the Rose Tucker Charitable Trust. MAINTAINING HOUSING Marcie was a single working mother living with her two young children in a rental apartment. Late on a Friday afternoon the city building inspector showed up unannounced and asked to inspect the premises. Marcie didn t mind an inspection, but wanted her landlord there. The inspector immediately posted the apartment as unlawful to occupy, forcing Marcie and her children out on the street; they were not allowed back into their home until the middle of the next week. Legal aid helped Marcie resolve disputes with the city. The city has since changed how it goes about posting residential buildings as unlawful to occupy. 12

13 Help Fund Legal Aid Offices PROTECTING CHILDREN Amanda, the mother of a fiveyear-old child (Taylor), applied pro se for a restraining order against her husband. The judge granted the restraining order but allowed the husband unsupervised visitation with the child. Amanda contacted legal aid for help because unsupervised visitation was not safe for the child due to her husband s addiction. Legal aid represented Amanda and was successful in having visitation modified to protect Taylor. St. Helens Hillsboro McMinnville Newport Coos Bay Portland Oregon City Woodburn Salem Albany Eugene Roseburg Grants Pass Medford Bend Klamath Falls Pendleton Ontario Legal aid currently has offices in 18 communities and provides services to low-income clients in all 36 Oregon counties. Legal aid directly serves about 25,000 lowincome clients, and works to stretch its limited resources with pro se materials, self-help programs and pro bono programs. Many of those materials are on legal aid s website, which received more than 400,000 page views last year. 80% of legal aid s clients are women and most of them have children. 3% Health Pro Bono Programs 11% Income Maintenance 40% Family (Domestic Violence) HELPING FAMILIES At 3:30 p.m. on a Friday, when temperatures were predicted to be below freezing for the weekend, the power was shut off to an eastern Oregon apartment building that housed ten low-income families. The landlord had breached the rental agreements by failing to pay the electric bill. Legal aid intervened and power was restored later that day, just in time to ensure that the residents would not be without heat over the weekend. Volunteer lawyers help legal aid meet the needs of the poor by working with legal aid offices around the state. Legal aid s pro bono programs are tailored to the needs of low-income clients and the available resources in the particular community, and are not identical statewide. The Multnomah County legal aid office operates the Volunteer Lawyers Project and legal aid offices around the state offer a variety of subject matter and population-specific clinics such as the Domestic Violence Project, the Senior Law Project, the Bankruptcy Clinic, ELVIS (Emeritus Lawyer Volunteers in Service), the Statewide Tax Clinic, and a clinic for Spanish speaking clients. In some regions, volunteer lawyers assist with intake, or provide mentoring on specific cases or subject areas. The Pro Bono Oregon listserv is a weekly listserv of pro bono cases around the state, providing easy matching of pro bono lawyers to low-income clients. 17 Senator Merkley Receives ABA s Congressional Award For Preserving IOLTA Funding For Legal Aid OSB President Steve Piucci, OSB Executive Director Sylvia Stevens and Senator Jeff Merkley at ABA Lobby Day Equal justice is not a blue value or a red value. It is an American value that goes deep into our hearts, certainly deep into our history. On April 12, 2011, Oregon Senator Jeff Merkely received the American Bar Association s Congressional Award for his support of legislation to protect funds that help low-income families who need legal assistance. The legislation, which was signed into law in December 2010, requires the Federal Deposit Insurance Corp. (FDIC) to insure Interest on Lawyers Trust Accounts (IOLTA), fixing the unintended exclusion of IOLTA accounts from the Dodd-Frank Wall Street Reform and Consumer Protection Act. The interest generated from IOLTA provides funding for civil legal services for the poor. Requiring the FDIC to continue insuring IOLTA protects critical funding for legal aid. Senator Merkley credited a last-minute push from a bipartisan group of senators with the success of the legislation. He stated Thankfully, we were able to preserve access to essential legal services for multitudes of low-income Americans. The ABA s Congressional Awards are given as part of the ABA s annual effort to connect policymakers with constituents in the legal profession. The awards were given as part of ABA Day 2011, which brought distinguished lawyers from 43 states to Washington, D.C., to discuss issues like funding for legal services for the poor. Senator Merkley said Equal justice is not a blue value or a red value. It is an American value that goes deep into our hearts, certainly deep into our history. We cannot conceive of a nation that has a rule of law with equal opportunity unless people have access to the court system. In Oregon, the interest generated by IOLTA is collected and distributed by the Oregon Law Foundation to make grants to legal aid and to other programs that support access to justice, promote diversity in the legal profession, and educate the public about the law. While IOLTA revenues have declined in recent years due to low interest rates, it is anticipated that interest rates will recover and IOLTA will once again become a larger source of funding for legal aid. OTLA Lawyers continued their tradition of support for the Campaign by contributing more than $118,000. Linda Eyerman, Gaylord Eyerman Bradley; Phil Goldsmith; Linda Love, Williams Love O Leary Powers; Steve Piucci; and N Robert Stoll, Stoll Berne, wrote letters to their colleagues to ask for support. Linda Love, Linda Eyerman, and Mark Friel, Stoll Berne, made calls to their OTLA colleagues in support of legal aid. Circuit Court judge); Eric Foster, Foster Denman, and Debra Lee, Center for NonProfit Legal Services, helped to raise more than $21,000 in Jackson and Josephine Counties. Larry Brisbee, Brisbee & Stockton, and Matt Kehoe wrote letters and made phone calls in Washington County and increased the amount of contributions there to over $58,913 almost double what Washington County raised last year! Thank you to our donors and volunteers for the success of the annual campaign and for your deep commitment to providing access to justice in Oregon. OWLS members used their statewide list-serv with the help of OWLS members Norma Freitas, Willamette Law School; Susan Marmaduke, Harrang Long; and Sarah Crooks, Perkins Coie and also a CEJ Board Member, to urge OWLS members to contribute almost $157,000 a new record for OWLS members. Rod Lewis; Frank Langfitt, Ater Wynne; Ira Zarov, Professional Liability Fund; and Ed Harnden, Barran Liebman, worked hard on increasing funds from all past Campaign contributors. 19 Among Us CHANGES IN THE HILLSBORO OFFICE Staff of the Hillsboro Regional Office of the Oregon Law Center As of January 1, 2011, the Hillsboro office of Legal Aid Services of Oregon has a new address (just a suite number), name, and office affiliation. The office continues to provide civil legal services to low-income Oregonians in five counties: Washington, Columbia, Clatsop, Tillamook, and Yamhill. The new name is the Hillsboro Regional Office of the Oregon Law Center. The new affiliation allows the office more flexibility in serving clients in the areas of domestic violence, housing, income maintenance, consumer law, and employment. Migrant and seasonal farm workers will still be served by existing LASO and OLC offices in the area. CURRENT AND FORMER LEGAL AID ATTORNEYS HONORED Sharon Brown Valerie Colas, OLC, was elected to the MBA YLS Board of Directors Class of Valerie has been a staff attorney at OLC since February Sharon Brown, Statewide Pro Bono Manager at OLC, was elected President of the Washington County Bar Association for the term. 20 Ed Harnden Receives Henry H. Hewitt Award Ed Harnden, Barran Liebman, CEJ volunteer and board chair from , received the Henry H. Hewitt Access to Justice Award at the 20th Annual Awards Luncheon on February 22, First awarded on the fifteenth anniversary of the Campaign for Equal Justice, the Henry H. Hewitt Award is reserved for recognition Henry Hewitt presenting of individuals who, though strong leadership, Ed Harnden with the Access to consistent effort, and commitment to the idea Justice Award at Annual of equal justice Awards Luncheon under the law, have made a substantial contribution to legal aid for low-income Oregonians. Senator Ron Wyden appeared by video at the Annual Luncheon and congratulated CEJ and Ed Harnden Since 2000, Ed has traveled the state to attend local bar meetings to talk about the importance of legal aid. Each year since then, at his own expense, he has traveled to Washington, D.C., for ABA Lobby Day to lobby for increased federal funding for legal aid. He has testified before the Oregon legislature, urged bar committees and sections to give to the Campaign, and has talked to colleagues and young lawyers about the need to give back to the community. Profile Of A Legal Aid Lawyer David Henretty is a staff attorney at the Oregon Law Center in Portland. He has been a legal aid lawyer in Oregon since The Oregon Law Center is part of the statewide network of legal aid programs that provide free legal services to low-income Oregonians. Ed Harnden has been a tireless advocate for legal services for low-income Oregonians since the Campaign began in 1991 as a member of the Advisory Committee and the Campaign s large firm Partners Committee. He served as a statewide co-chair of the annual fund drive from He was elected to the CEJ Board of Directors in 2004, became the board President in 2006, and served in that capacity until March 31, He remains on the board. Lucille Seyd, Senator Jeff Merkley, and Ed Harnden at Annual Awards Luncheon Prior to moving to Portland, David worked as a managing attorney at the Ontario, Oregon, office of the Oregon Law Center. He worked in the Ontario office for five years. Ontario is on Oregon s far eastern border with Idaho. With a staff of only five (an office manager, paralegal, and three attorneys), the Ontario office provides civil legal services to low-income Oregonians in Malheur, Harney, Grant, and Baker Counties an area larger than Massachusetts and Connecticut combined! The Ontario office serves its client community in a variety of ways from brief consultations to full representation in court and, like all legal aid offices, continuously strives to keep in touch with the legal needs of low income households in its service area. Since moving to Portland, David has worked primarily on employment-related cases. He reports that, in the past two years, he has seen a dramatic increase in the numbers of low-income workers who have worked for weeks at a time without being paid their wages. Their employers repeatedly tell them that their pay will come soon, and sometimes give them a small amount of money, so they continue to work. While waiting for their pay to arrive, the clients sometimes lose housing and are unable to pay for food. Legal aid works with the private bar and state agencies whenever possible, but for the cases legal aid ends up handling, the clients have nowhere else to turn for help. In addition to his busy practice, David has taken time out to help with the Campaign for Equal Justice s efforts to educate the legal community and the legislature about legal aid.
