What is this course about? 1.1 Course description Criminal Law: An Introduction provides an introduction to substantive and procedural law in relation to criminal offences in Queensland. Criminal law in Queensland is placed in its historical context and in relation to our federal system. The course introduces you to the constituent physical and mental legal elements of crimes in general, and examines issues in relation to proof of these elements through an examination of particular offences. Crimes studied include homicide, assault, sexual offences, property offences and drug related offences. 1.2 Course content Criminal responsibility crime defined Homicide and defences to charges relating to homicide Assault and defences to charges relating to assault Sexual offences Property offences Drug offences 2. Individual 45% N/A Posted on Friday Week 12, 4.00 pm and due on Friday Week 13, pm 100% Hardcopy via FAB Assignment Box Assessment Task 1: Mini-essays Goal: This task is designed to keep you up to date with the material covered for the course and to develop your critical writing skills. You will research and critically analyse five topics. Product: Essays Format: Each student must complete five (5) mini-essays during the semester. The combined marks of the five mini-essays will comprise the total value of this assessment task. You choose your five mini-essays from a choice of ten mini-essay questions provided during the semester, with a total of 10 opportunities to submit a mini-essay. Each mini-essay topic will explore relevant aspects of criminal law and will directly relate to the course readings. Mini-essay questions will be posted on Blackboard. Each mini-essay will be due at 5.00 pm on the Thursday before the lecture and must be sent by to the coordinator at It is specifically a requirement that a hardcopy of the mini-essay be handed in at each lecture or it will not be graded. It is the hardcopy of the mini-essay which is marked. Each mini-essay is a maximum of 400 words +/- 10%. Further clarifications and topics will be provided in week one. Criteria Demonstration of knowledge: A systematic presentation of relevant knowledge addressing the nature and scope of the question posed. Demonstration of understanding: A logical application and evaluation of relevant knowledge to the assignment question. Demonstration of academic research skills: Evidence of sound research and accurate and appropriate referencing of sources. Demonstration of academic writing skills: Appropriate and effective structuring of arguments, clarity of expression and correct use of grammar, punctuation and spelling. 4 Assessment Task 2: Class Test Page 4 Goal: Demonstration of your knowledge of the general principals of the Australian criminal law system. This test will cover all material to week 5. Product: Test Format: The test will be held during the lecture/tutorial in Week 6. You must attend this week. Questions will be drawn from all areas of the course considered up to the date of the test. The test is worth a total of 25%. The test is closed book and will consist of a number of legal problem or case study questions, with the possible inclusion of multiple choice and/or short answers questions. More details on the class test will be provided in the introduction lecture in Week One. Criteria Demonstration of knowledge of the law, as evidenced by accurate statement of relevant legal principles. Demonstration of understanding of the law, as evidenced by cogent and coherent application of legal principles to the fact situation as stated. Demonstration of requisite academic communication skills, as evidenced by logical structure of arguments, appropriateness of conclusions, inclusion of case authorities and legislative references, and use of accurate and appropriate expression. Generic skill assessed Skill assessment level Communication Problem solving Assessment Task 3: Take home final examination (Open book) Goal: Questions in the exam are designed to allow you to demonstrate your understanding of the complexities of criminal law. Arguments presented in the answers to questions will need to be justified by references to journal articles, criminal code, other legislation or relevant cases, as applicable. You will demonstrate your understanding of the complexities of the Australian criminal law system. Product: Examination Format: Please note that as this is an examination and not an essay assessment, if for whatever reason you cannot complete the examination by the due date, then a deferred examination will need to be applied for, with supporting documentation. As this is not a centrally scheduled examination, application for the deferred examination must be made directly to the Course Coordinator. Any deferred examinations will be held within the official University deferred examination period in late January (This applies even if you have partially completed the exam and become ill). 5 Page Additional assessment requirements SafeAssign In order to minimise incidents of plagiarism and collusion, this course may require that some of its assessment tasks are submitted electronically via SafeAssign. This software allows for text comparisons to be made between your submitted assessment item and all other work that SafeAssign has access to. If required, details of how to submit via SafeAssign will be provided on the Blackboard site of the course. Eligibility for Supplementary Assessment Your eligibility for supplementary assessment in a course is dependent of the following conditions applying: a) The final mark is in the percentage range 47% to 49.4% b) The course is graded using the Standard Grading scale c) You have not failed an assessment task in the course due to academic misconduct 5.4 Submission penalties Late submission of assessment tasks will be penalised at the following maximum rate: 5% (of the assessment task s identified value) per day for the first two days from the date identified as the due date for the assessment task. 10% (of the assessment task s identified value) for the third day 20% (of the assessment task s identified value) for the fourth day and subsequent days up to and including seven days from the date identified as the due date for the assessment task. A result of zero is awarded for an assessment task submitted after seven days from the date identified as the due date for the assessment task. Weekdays and weekends are included in the calculation of days late. To request an extension you must contact your course coordinator to negotiate an outcome. 6.
