1 .my DOMAIN REGISTRY SENSITIVE DOMAIN NAME DISPUTE RESOLUTION THE COMPLAINANT Rule 19 5 WORKING DAYS Complainant must pay the Provider the Fees SUBMISSION OF COMPLAINT TO THE PROVIDER ( & hard copy) Rule 4 REVIEWS THE COMPLAINT (To make sure that it is in compliance with Policy & Rules) Rule 5.4 If the Provider finds that Complaint is incomplete or not in accordance with the Policy & Rules, it will notify the Complainant. The Complainant has 5 WORKING DAYS to rectify the Complaint Rule WORKING DAYS After the Provider has received payment of the Fees (non-refundable) Rule 5.1 THEPROVIDER WILL APPOINT THE CHAIRMAN OF THE REFERENCE PANEL TO REVIEW THE COMPLAINT (to ensure it falls within scope of If the Complainant does so within 5 working days Rule 5.4 If the Complainant does not complete the Complaint or amend it to be in compliance with Policy & Rules within the 5 working days or where the payment of the Fees is not made, the Complaint shall be considered withdrawn Rule 5.2 WILL SEND THE COMPLAINT TO THE RESPONDENT (If the compliant is complete & in compliance with Policy & Rules and Complaint is within If the Complaint is not within the scope of the SNDRP, the Chairman will inform the Provider. The Provider will inform the Complainant of this and the Complaint shall be considered withdrawn. THE RESPONDENT Rule 5.6 The proceeding will commence when the Respondent is considered to have received the Complaint from the Provider
2 15 WORKING DAYS (from the date of commencement of proceeding ) Rule 6.1 SUBMISSION OF RESPONSE TO THE PROVIDER ( & hard copy) Rule 6.6 WILL SEND THE RESPONSE TO THE COMPLAINANT (KLRCA) 5 WORKING DAYS (extend no of days) -Authority letter by KLRCA to Chairman for Chairman to appoint 2 members Chairman to appoint2 members - 15 working days (Reference Panel discretion to extend time period for formation of three-member Panel) Rule 7 FORMATION OF THREE-MEMBER REFERENCE PANEL Rule 10.1 TRANSMISSION OF FILE TO THE REFERENCE PANEL Once the Panel is formed, the Provider will inform the Parties of the names of the three member Panel If at anytime after the Panel is appointed: (i) the Complainant withdraws the Complaint, the Complainant must inform the Panel and supply the Panel with letter of withdrawal and thereafter, the Panel will terminate the Proceeding (ii) the Panel finds that it is unnecessary or impossible to continue with the Proceeding, the Panel will terminate the Proceeding (if no objection are raised by the Parties) Note: If Reference Panel reqyest for Prohibited List in writing from KLRCA Non-Disclosure must be signed by each member Rule 15 REFERENCE PANEL DECIDES THE PROCEEDING Rule 15 DECISION OF REFERENCE PANEL The Panel's decision must be in writing and must state the reasons on which the Panel's decision is based, the date of the decision and the names of For the purpose of (i) above, if the Complainant withdraws the Complaint before the Panel is appointed, the Complainant must inform the Provider accordingly
3 the decision and the names of the Panellists deciding the Proceeding 15 WORKING DAYS (Rule 15.8) (start from date of receipt of docs from panellist that last receives the docs ) Barring any exceptional Circumstances REFERENCE PANEL INFORMS PROVIDER OF THE DECISION 3 WORKING DAYS INFORMS.my DOMAIN REGISTRY & THE PARTIES OF THE DECISION The Provider will also inform.my DOMAIN REGISTRY and Parties of the date when the decision is to be implemented 20 WORKING DAYS (align with SNDRP module) - automate the implementation date (paragraph 12 SNDRP) Rule 17.1 IMPLEMENTATION OF THE DECISION.my DOMAIN REGISTRY will neither take any further action in the Proceeding nor proceed to implement the Panel's decision, unless it receives official court documentation or proceeding papers from MCMC Add six (6) calender months for providing Affidavit of Service of official court documentation (Para 12.3 SNDRP)
