2 Thursday, February 24, 2011 Page 2 At Last Week s Meeting Greeters Carl Greenwood and Pat Koval Invocation: President Ali Danta Flag Pledge: Cindy Speer 4-Way Test: Olmstead Wayne Dave Wilson, Tustin Parks and Recreation Director expressed the City s appreciation to the Rotary Club for it s support of the Citrus Park. The Board and individual members donated $1,125.00, the largest group donation received. Gerry Aust accepted on behalf of the Club. Cherrill Cady, who runs the Miss Tustin Contest brought your Club s candidate Jennifer Arteaga, a Tustin High School Student Cindy Speer gave us an update on our Interact Club. They have a book drive this week and need money for Doughnuts which will be given to each book donor. Debbie Reines, Club Training Officer, asked for sign ups for the Arbor Day program which kicks off on Monday, March 7th. Also, the Lobsterfest, April 2nd, and the Elwyn Bowlathon on March 26th. Alice LeDoux told of an opportunity to win double credits for RI Foundations made by on February 23rd. For details, call Alice.

3 LAST WEEK S SPEAKER RAE SHIRER SPOKE ON HEALTH CARE REFORM AND 2011 LAWS AFFECTING CA BUSINESSES In his introduction of Rae Shirer, Wayne Olmsted made a comparison between Rae and himself, both lawyers. In reading her resume, he found that Rae worked her way through school, as did he; she got a Bachelors Degree Business Administration, and he also earned his BA. Then she was in business with a small firm, and he did that too. Next she put out her own shingle, and she was admitted to the California Bar, as was Wayne. Then he noted her volunteer work with teenagers and noted that he did volunteer work as an Ombudsman with seniors! Then he surrendered the rostrum to Rae. Rae thanked Wayne for his introduction and then thanked the Club for their support of the Elwyn Annual Bowlathon. In 2009 the Tustin-Santa Ana Rotary club took the Rotary Challenge Trophy. Last year the Orange Sunrise took the trophy So, on March 26th, join us at Fountain Valley Lanes. You club has grown since I was here last year to 51 members! But I understand that your new Interact Club may be even larger! So, good for you! I am here as a business lawyer and will cover recent legislation state and federal. Much of this new legislation tries to cope with financial caused by California s budget deficit and with health care plan. In March 2010, President Obama signed federal health reform into law. It is made up of two bills; Patient Protection and Affordable Care Act (the larger of the two) and Health Care & Education Reconciliation Act. These contain many provisions which affect both public health insurance programs such as Medicaid and Medicare, and private health insurance. The provisions of the health care reform laws go into effect on a staggered basis, some going into effect immediately, but most going into effect in Health reform builds upon our current health insurance system to provide more people with access to health insurance coverage, establish legal protections for consumers and set up mechanisms for consumers Thursday February 24, 2011 Page 3 to shop knowledgeably for insurance. Small business employers may obtain tax credits to help them cover the cost of health coverage. There is a provision for a Temporary Reinsurance Program, also starting in 2010, to help employers who provide early retiree coverage. Also there are two temporary programs which help fill the gap between now and 2014 when all the health care provisions take effect; temporary highrisk pools for people with Pre-Existing Conditions and the reinsurance program mentioned above. Consumer Protections that are now in effect: Preventative services must be covered without copayments, coinsurance or deductibles. Health insurance policies sold to groups and individuals must have an appeals process for coverage determination. Primary Care Provider choice is guaranteed. Direct access to OB/GYN service is guaranteed; there may be no requirement of authorization or referral for obstetric or gynecological care from any provider in the plan s network. Discrimination based on salary is banned; separate benefits for higher salaried Continued page four

4 Thuursday, February 24, 2011 Page 4 Continued from page three NEW LAWS/2011 employees is forbidden. Children up to 26 years of age can stay on their parent s group insurance. Health insurance providers are prohibited from placing lifetime caps on the total amount of insurance an individual or a family may receive. Rescissions are banned. Insurance companies cannot drop people from insurance after they become sick due to an unintentional mistake in their paperwork Pre-existing conditions: Children under the age of 19 may not be denied coverage or required to submit to waiting periods. (These protections will apply to all people after 2014) Annual limits on insurance coverage are regulated, greatly restricting insurance companies from placing annual limits on policies. (After 2014, use of any limits would be prohibited.} Health Insurance Exchange: This is intended to be a one stop shopping option to shop for and/or purchase insurance. California has enacted a two-bill package that will create an independent government agency to give individuals the same buying clout as larger companies Student Loan Reform Attached to the Health Care reform bill passed in March 2010 is legislation which overhauls the federal loan process. The new legislation eliminated banks as originators of these loans, which will now be originated directly through the federal student loan program. After 2014 the recipients of student loans will qualify for better re-payment terms. Their payments will be capped at 10% of a student s disposable income (down from 15%) and any debt remaining after 20 years will be forgiven. For public servants - including teachers, nurses or members of the armed forces - the cap will be 10 years. Regulations for colleges and private trade and technical schools require the disclosure of statistics on their graduates in their career programs, including the on-time graduation rate, the placement rate for students completing their programs as well as the total tuition, fees and cost of books and supplies Employment Law As of January 1, 2011, all California employers will be required to report Unemployment Insurance, State Disability and personal income withholding quarterly on a new form: Quarterly Contribution Return and Report of Wages. Revised Heat Illness Prevention standards from Cal-OSHA effective last November 10th. The revised standard includes: High heat procedure requirements for 5 industries, additional shade requirements with greater flexibility and specifics on temperature triggers for heat safety procedures. Organ donor and bone marrow donors for employees who have used all of their sick and vacation tme can qualify for up to 30 days paid protected leave to donate an organ, or up to 5 days for a bone marrow donation. These leaves are not to run concurrently with the Family Medical Leave Act or the California Family Rights Act Exemption from the 30 minute off-duty meal break: AB 569 exempts construction workers, commercial drivers, certain security officers and employees of electric, gas and other utilities from California required meal breaks IF those employees are covered by a valid collective bargaining agreement that provides the employe with the option of a paid on duty meal period Rae suggested that you should be very careful not to overpay your state taxes. With the financial problems state treasury faces, a rebate could be delayed.
