1 Philippines Philippines Philippinen Report Q173 in the name of the Philippine Group Issues of co-existence of trademarks and domain names: public versus private international registration systems 1. Analysis of current domain name registration procedures 1.1 Nature of signs What is the status of a domain name in your country? Does the registration of a domain name confer exclusive rights to the proprietor? Can domain names be the subject of dealings such as assignment, mortgage and the like? In the Philippines, domain names like trademarks, are also treated as property over which the registrant has the right to exclusive use. The right to exclusive use of a domain name is global in nature and the standard for granting such right is principally on a "first-paid, first-served" basis, subject to yearly maintenance fees for use. This is not the same with the right to exclusive use of a trademark as such is territorial in nature and the principal standard is ownership and use of the mark. Domain names can be sold, assigned, mortgaged or otherwise transferred in the same manner that trademarks are sold, assigned or transferred, with specific qualified exceptions. Ideally, there should be a public office to keep a record of the transaction, payment of taxes, and other incidents of transfer and/or disposition of a domain name. However, no such public office keeps a record of transfers of domain name ownership. It is the domain name registry kept by private entities which keeps a listing of domain name owners and their contact information. 1.2 Legislation Is there any legislation in your country dealing specifically with domain names and the domain name registry? If so, please describe it. In the Philippines, there exists no specific law regulating domain name registration. There are also no pending bills on the matter. There is, however, IPO Memo Circular BT Y2k-9-05 issued by the Philippine Intellectual Property Office (IPO), which provides that domain names are registrable with the IPO in the same manner that service marks are. For registration of domain names with the IPO, Sec. 123 of RA 8293 on registrability of marks shall be used as the standard to determine the registrability of domain names to afford protection under the Intellectual Property Code. 1.3 Type of registry Which organisation has been assigned responsibility for the cctld domain in your country? Is this organisation a public or a private entity? If it is a private entity is it subject 1
2 to a regulator? Is the registry's conduct of business (e.g. the setting of registration fees) subject to judicial or independent review? In the Philippines, ICANN granted exclusive rights to facilitate registration of cctlds to "DotPH Inc.". "DotPH" authorizes and/or licenses other private corporations/entities to offer domain name registration services to the public. 1.4 National treatment Does the applicant require legal or natural status in your country to register a domain name? As there is no law governing domain name registration in the country and the registration process is unregulated, there is no requirement of presence/conduct of business in the Philippines for registration of domain name with registries based in the Philippines. The sole requirement for registration is the payment of registration fees. 1.5 Bars to registration Is the domain name registry in your country entitled to reject applications on public policy grounds? If so, on which grounds (e.g. immorality or generic terms)? With respect to domain name registration, the very basic policy of "first-paid, firstserved", governs registration with registries based in the Philippines. The registry displays a listing of warranties supposedly made by every registrant with every application for domain name registration. In the event, however, that a domain name owner seeks protection of its ownership of a domain name, it shall go through the registration procedures prescribed under RA Appeals Does the applicant for a domain name have the right to appeal against the refusal of the registry to register a domain name? If so, to which entity and based on what kind of procedure (e.g. arbitration or administrative procedure)? It is unlikely that suit against a domain name registry for refusal to allow registration can prosper in the Philippines. The registry is a private corporation with its own set of rules for an applicant to qualify for domain name registration. Unqualified applicants can seek registration with other entities that offer the same services. However, by the nature of domain names, there can only be one entity in the world that can own a specific domain name. 1.7 Publication, opposition and cancellation Is the application for or registration of a domain name made public in your country? Is there any procedure available to third parties to oppose such application (prior to registration) or registration? If so, on what (relative or absolute) grounds (e.g. prior trademark registration or generic term) and based on what kind of procedure (e.g. arbitration or administrative procedure)? Is it possible for a registered domain name to be cancelled? If so, by whom and on what (relative or absolute) grounds (e.g. prior trademark registration or generic term)? Is it possible to request cancellation of a domain name based on general statutory law (e.g. unfair competition law)? Which procedure is followed, in the case that cancellation is required? Is the cctld registry liable for domain names which infringe trademarks? Entities that facilitate registration which are based in the Philippines make available to the public information regarding the name and contact details of the owner of a domain name. The said entities inform their clients that the rules of the UDNDRP apply to all domain name registrant. They also formulate supplementary rules which apply to domain 2
3 name owners who register through them. Hence, any opposition to domain name registrations shall be in accordance with the UDNDRP procedures and the supplementary rules of the registry which facilitated the registration. It is possible to sue through the regular courts for unfair competition or trademark infringement when a registered trademark is being used as another entity's domain name in order to sell the latter's goods. The difficulty in such a suit is the court's obtaining jurisdiction over an entity which is not based in the Philippines and has no business in the country. Moreover, enforcement of any judgment also becomes a difficulty. 1.8 Maintaining the registration Must use requirements be satisfied in order to maintain the domain name registration? If so, is there any definition of what constitutes use? Is a renewal fee payable, in addition to, or in place of, a maintenance fee? To maintain a domain name registration, no actual use and development of the web site is necessary. The owner needs to pay the fees as required by the registry. 1.9 Generic Top-Level Domains (gtlds) Are gtlds subject to regulatory control in your country? If so, in what ways? Are there any differences to the treatment of cctlds? If so, what are they? In the Philippines, there is no law regulating gtlds. 2. Proposals for adoption of uniform rules 2.1 Nature of signs Should the registration of a domain name confer exclusive rights to the proprietor? Should domain names be subject of dealings such as assignment, mortgage and the like? The nature of domain names is not exactly the same as the nature of trademarks. The reach of a domain name is global and each domain name only has one owner. This is opposed to a trademark which is territorial in nature. Registration and/or ownership of a domain name should not be viewed as a "right" but rather a "privilege". Abuse or unlawful use should be a ground to revoke registration of a domain name. A domain name, when seen as a privilege, can still be assigned, mortgaged or otherwise transferred but under regulation of a licensing authority. 2.2 Legislation Should legislation be enacted to deal specifically with domain names and domain name registries? AIPPI, WIPO, with the participation of ICANN should endeavor to work for the formulation and adoption of a multilateral treaty which governs use of domain names. Domain names can only be regulated on the global level because of its nature. A licensing authority would be very useful for regulation purposes. Local legislation in member countries should be made to support the international treaty. 2.3 Type of registry Do you think the domain name system should be administered by public or private entities? If you think that the DNS should be administered by private entities should they only perform technical functions or should they also perform policy functions? If you think that 3
4 they should only perform technical functions who should perform the policy functions? What do you think Government's involvement in a privately administered DNS should be? If the DNS is administered by private entities do you think that their actions should be subject to a regulator and to an independent review? If so, which institutions should perform these functions? If you think that the DNS should be administered by public entities which institutions should perform the technical and policy functions? Should the assignment of gtlds and the key internet co-ordination functions (e.g. the stable operation of the Internet's root server system) be performed by a treaty based multi-governmental organisation? If so, should an existing organisation such as WIPO or ITU be tasked with these functions or should a new one be created? In view of the nature of a gtld, a single global registry is suitable. For cctlds, however, each country should have a public or private entity designated to regulate registration thereof. 2.4 National treatment Do you think domain name registries should be entitled to impose restrictions on the application process based on the nationality of the applicant? The domain name system should be administered by a public entity with a structure similar to trademark offices. 2.5 Bars to registration Do you think domain name registries should be entitled to reject applications on public policy grounds? If so, on which grounds (e.g. immorality or generic terms)? Domain name registrations should be regulated. There has to be a fixed standard to determine whether or not registration is allowed. Generic terms can be used as domain names as not all entities with domain names are involved in businesses. Note that there are several private individuals who register domain names for personal purposes, for instance family tree records and easy correspondence with relatives and close friends. Immorality of domain name should bar registration. There are, however, major issues to resolve on the conflict between immorality and right to free expression so that a definite standard may be created. This is a difficulty as each country has its own laws that definite immorality, obscenity, indecency which are not covered by free expression. A domain name which goes "ninewestsucks.com" or "kleenexsucks.com" becomes a problem. The same is registrable as a domain name when not in use by any other entity. There, is however, a direct attack on the integrity and business reputation of a known company. In the event such sites are registered, the attacked corporation can go to local courts for remedy. To prevent such, however, guidelines must be set on which domain names are actually registrable. 2.6 Appeals Do you think that the applicant for a domain name should have the right to appeal against the refusal of the registry to register a domain name? If so, to which entity and based on what kind of procedure (e.g. arbitration or administrative procedure)? In the event of disputes regarding domain name registration, arbitration appears to be the best remedy. Similar to other disputes where parties are based on different states/countries, international arbitration should be institutionalized. 4
5 2.7 Publication, opposition and cancellation Do you think that the application for or registration of a domain name should be made public? Do you think that there should be a procedure available to third parties to oppose such application (prior to registration) or registration? If so, on what (relative or absolute) grounds (e.g. prior trademark registration or generic term) and based on what kind of procedure (e.g. arbitration or administrative procedure)? Do you think that it should be possible for a registered domain name to be cancelled? If so, by whom and on what (relative or absolute) grounds (e.g. prior trademark registration or generic term)? Do you think it should be possible to request cancellation of a domain name based on general statutory law (e.g. unfair competition law)? If so, which procedure should be followed? Do you think domain name registries should be liable for domain names which infringe trademarks? Domain name application for registration should be made public to allow opposition. Note, however, that several entities can qualify for seeking to register their trademarks as domain names. In such a case of equally qualified applicants, a rule similar to the "first to file" rule must be applied to determine priority in grant of domain name. Cancellation of a registered domain name should be made possible for failure to comply with, primarily use requirements. There should be a criteria for what "actual use" of a domain name is. At present, there are several sites which, when accessed, display the words "this site is for sale". Such should not be deemed as actual use of a domain name. Standards can be made to include the number of visitors to a site, the date of last update of the contents of a site, etc. The trademark standards of non-registrability of generic terms, confusing terms, etc. cannot be applied to domain name registration. Any generic term can be used as a domain name as the cyberspace address is specific only to one entity. The main criteria should be use of the domain name. 2.8 Maintaining the registration Do you think that use requirements should be satisfied in order to maintain the domain name registration? If so, what should constitute use? Should a renewal fee be payable, in addition to, or in place of, a maintenance fee? Use should be the main factor to consider in maintaining a registration of a domain name. As mentioned above, there must be a standard on what constitutes use such as frequency of visits to the site and updates made on the site. Renewal fees should also be charged in order to encourage people to enter into business endeavors via the internet so they can pay off the renewal and maintenance fees of their domain names. 3. Assessment of the trademark registration system Do you think that the publicly administered trademark registration system is adequate and sufficiently efficient as compared with the privately administered system of domain name registration? If not, please explain. The publicly administered trademark registration system is effective and more efficient than the privately administered domain name registration. The former has structure and concrete policies and rules. The latter needs to be developed and made subject of multilateral treaties and local registration. 5
