Application rules were published on October 26, 2012 and will move through the rule process At the August meeting of the board, it was decided to allow foreign trained physical therapist applying by endorsement to submit their original credential evaluation that was originally used to gain licensure in the state they would be endorsing from. Ms. Clark presented the proposed draft language: 64B Licensure by Endorsement. (1) An applicant filing DOH Form #DH-MQA 1142 Application for Licensure, Revised Page 1 of 29

2 02/10, which is available through and demonstrating that he or she meets the requirements of Rule 64B , F.A.C., may be licensed to practice physical therapy by endorsement by presenting evidence satisfactory to the Board that the applicant has active licensure in another jurisdiction and has passed an examination before a similar, lawful, authorized examining board in physical therapy in such other jurisdiction if their standards for licensure are as high as those maintained in Florida. The standard for determining whether the standards of another jurisdiction are as high as the standards in Florida shall be whether the written examination taken for licensure in such other jurisdiction by applicants meeting Florida s minimum educational qualifications was through the national physical therapy examination provider certified by the Department. (2) An applicant who has been educated in a foreign country shall demonstrate minimum qualifications by providing the following: a. A certified copy of the credential evaluation used by the physical therapy licensing board of another state. The evaluation must be on the appropriate coursework tool (CWT) adopted by the Federation of State Boards of Physical Therapy (FSBPT); b. Proof of 1000 clinical practice hours each year in the United States for five (5) out of the last ten (10) years; 1. Full-time teaching of physical therapy education may count toward 250 of the 1000 required practice hours per year; and; c. A written statement from the applicant s most recent employer stating that the applicant practiced safely and competently. (3) An applicant who has failed to pass the National Physical Therapy Examination for Physical Therapists by or on the fifth attempt, regardless of the jurisdiction through which the examination was taken, is precluded from licensure. 64B Licensure by Endorsement. The Board agreed to remove proposed section (c): A written statement from the applicant s most recent employer stating that the applicant practiced safely and competently. The Board agreed to revise the propsed language in section (2)(a) to read: A certified copy of the credential evaluation used by the physical therapy licensing board of another state. The evaluation must be on the appropriate coursework tool (CWT) adopted by the Federation of State Boards of Physical Therapy (FSBPT) and reflect the education criteria in place at the time of graduation The Board made the correction to proposed 4.003(2)(a) to read adopted by the Federation of State Boards of Physical Therapy (FSBPT). MOTION: Mr. Lohr made a motion to approve the verbal revision noted above. The motion was seconded by Dr. Petraglia and carried 4/0. MOTION: Mr. Lohr made a motion to open Rules and for development. The motion was seconded by Dr. Petraglia and carried 4/0. Tab 2 Chair/Vice Chair Report Clint Lohr Mr. Lohr gave a brief overview of FSBPT annual meeting. Mr. Lohr presented Mr. Rust with a plaque of service appreciation. The Board thanked Mr. Rust for his service. Tab 3 Executive Director Report Cash Balance Report Board Expenditures Mr. Hall gave a brief overview of the board s current cash balance. Since Mr. Rust has recently resigned from the board, Dr. Hellman will serve on the December 11 th PCP panel. APPLICANT/LICENSEE RATIFICATION LISTS Tab 4 CAPTE Accredited Applicants Examination/Endorsement Applicants PT MOTION: Dr. Petraglia made a motion to ratify the list of physical therapists for licensure by examination/endorsement (Exhibit A), 212 in number starting with Jasper Adcock and ending with Viviana Zuniga. Upon successful completion of the National Physical Page 3 of 29

4 Therapy Exam and/or the Florida Laws and Rules Exam, shall be licensed. The motion was seconded by Mr. Lohr and carried 4/0. Examination/Endorsement Applicants PTA MOTION: Dr. Petraglia made a motion to ratify the list of physical therapist assistants for licensure by examination/endorsement (Exhibit B), 228 in number starting with Marie Abraham and ending with Diana Zuniga Upon successful completion of the National Physical Therapy Exam and/or the Florida Laws and Rules Exam, shall be licensed. The motion was seconded by Mr. Lohr and carried 4/0. Tab 5 Foreign Trained Applicants Examination Applicants MOTION: Dr. Petraglia made a motion to ratify the list of foreign trained candidates for licensure by examination (Exhibit C), 44 in number starting with Donna Alinsunurin and ending with Sheryl Zantua Upon successful completion of the National Physical Therapy Exam and the Florida Laws and Rules Exam, shall be licensed. The motion was seconded by Mr. Lohr and carried 4/0. Endorsement Applicants MOTION: Dr. Petraglia made a motion to ratify the list of foreign trained candidates for licensure by endorsement (Exhibit D), 22 in number starting with Maneya Bureros and ending with Wilbur Tabamo. Upon successful completion of the Florida Laws and Rules Exam, shall be licensed. The motion was seconded by Mr. Lohr and carried 4/0. NEW BUSINESS Tab 6 Proposed Early NPTE Testing In an effort to streamline the licensure process, board staff requested the board consider allowing applicants to sit for the exams prior to completing their respective program. The Federation of State Boards of Physical Therapy (FSBPT) has a policy which requires the jurisdiction to approve a candidate that is a graduate of or graduating from an accredited PT or PTA program. The policy allows a candidate to sit for the NPTE no more than 90 days prior to their graduation date and exam may only be used for administration to a bona fide candidate. FSBPT NPTE Policy: 12. Approval for Candidates to Sit for the NPTE The licensing authority of the jurisdiction to which the candidate is applying must approve the candidate to sit for the examination. At a minimum, the licensing authority must require the candidate is a graduate of or graduating from a PT or a PTA program that meets the accreditation standards of the Commission on Accreditation in Physical Therapy Education (CAPTE) or is deemed substantially equivalent. Candidates may sit for the NPTE no more than 90 days prior to their graduation. The FSBPT is the final authority on access to the NPTE and issuance of scores on the NPTE. The FSBPT will Page 4 of 29

5 not grant a candidate access to the NPTE unless the candidate has first been approved by a licensing authority or authorized designee to sit for the examination. An examination may only be used for administration to bona fide candidates for initial licensure, reinstatement or reactivation, or to candidates who are not licensed in a jurisdiction and do not have a qualifying examination score for that jurisdiction. In the case of reinstatement or reactivation, the licensing authority must notify the Federation that the candidate is taking the NPTE and provide the reason the examination is required. Currently, board staff approves applicants for testing once a Letter of Completion is received from their school confirming all academic and clinical requirements are complete. A license is not issued until official transcripts are received confirming the conferred degree. This requirement will not change. Sections (PT) and (PTA) require an applicant to have passed the appropriate examination to be eligible for licensure. The law remains silent on exam eligibility requirements. MOTION: After discussion, Dr. Petraglia made a motion to not accept the proposal. The motion was seconded by Dr. Hellman and carried 4/0. Tab 7 Proposed Employment Exemption Delegation Board staff is proposing a revision to the current review process of Employment Exemptions for current licensees. This revision includes the use of the current conviction record guidelines which are in place for new licensure applications. The proposed request would allow board staff to approve a level 2 exemption if the licensee s criminal history falls within the clearable parameters as established by the Board for new applicants. Currently the Board has delegated board staff to approve level 2 exemptions if the licensee holds a level 1 screening and no new history is present. Board staff feels this revision will speed up the process for eligible licensees to continue their employment or to seek employment at AHCA regulated facilities and will reduce the number of additional conference calls requested of the Board members. MOTION: After discussion, Dr. Hellman made a motion to approve the proposal and the revised Delegation of Authority. The motion was seconded by Mr. Lohr and carried 4/0. Tab 8 Update on Continuing Education at Renewal Mr. Hall discussed the upcoming changes to renewal. There will be ongoing information regarding the new process and the way continuing education (CE) will be monitored. A representative from the CE auditing unit will be attending our next Board meeting to help answer any questions regarding the change. Tab 9 Financial Reports Mr. Hall gave an overview of the current cash balance and financial reports. Page 5 of 29

DISCIPLINARY PROCEEDINGS MOTION FOR SETTLEMENT AGREEMENT Tab 1 Kerry Fitzgerald, PTA15531, Case No (PCP - Dr. Gina Petraglia, Amy Babb and Nancy Watson) Dr. Petraglia was recused due to participation in the Probable Cause Panel. Respondent was not present nor represented by legal counsel. Ms. Shah summarized the case for the Board. Respondent was charged with the following violation: Count I: Section (1)(h), Florida Statutes (2010) by violating a

8 Final Order of the Board, by failing to pass the Florida Laws and Rules Examination by November 25, The case was presented as a Settlement Agreement that would impose the following: Reprimand $ fine to be paid within two (2) years of the Final Order date $ costs to be paid within two (2) years of the Final Order date Indefinite suspension from practice until she complies with the Final Order, by successfully completing and passing the Florida Laws and Rules Examination. MOTION: After discussion, Mr. Lohr made a motion to accept the Settlement Agreement. The motion was seconded by Dr. Hellman and carried 3/0. Tab 2 Eduardo Salas, PTA21778, Case No (PCP Violet Acuna-Parker, Rolf Kuhns, Sandy Davis) Respondent was not present nor represented by legal counsel. Ms. Shah summarized the case for the Board. Respondent was charged with the following violation: Count I: Section (1)(e), Florida Statutes (2010) and Rule 64B (2)(g), Florida Administrative Code (2010), by failing to maintain acceptable standards of physical therapy practice by failing to communicate with a staff member and review a patients chart before commencing the physical therapy session. The case was presented as a Settlement Agreement that would impose the following: Letter of Concern- the Settlement Agreement serves as the letter of concern $ fine to be paid within two (2) years of the Final Order date $ costs to be paid within two (2) years of the Final Order date Laws and Rules Exam: Within 90 days of the Final Order date, Respondent must register for the exam. Within 2 years of the Final Order date, Respondent must successfully pass the exam. MOTION: After discussion, Mr. Lohr made a motion to accept the Settlement Agreement. The motion was seconded by Dr. Hellman and carried 3/1. Dr. Petraglia opposed. MOTION FOR VOLUNTARY RELINQUISHMENT Tab 3 Nasim Hashmi, PT2867, Case No (PCP Dr. Gina Petraglia, Amy Babb and Nancy Watson) Dr. Petraglia was recused due to participation in the Probable Cause Panel. Respondent was not present nor represented by legal counsel. Ms. Shah summarized the case for the Board. Respondent was charged with the following violations: Count I: Section (1)(c), Florida Statutes (2011) by entering a plea of nolo contendere which directly relates to the practice of physical therapy. 9 Count II: Sections (1)(k) and (1)(x), Florida Statutes (2001), by failing to report to the board in writing within 30 days after the licensee has been convicted or found guilty of, or entered a plea of nolo contendere to, regardless of adjudication, a crime in any jurisdiction. Count III: Sections (1)(k) and (1)(II), Florida Statutes (2011) by being convicted of, or entering a plea of guilty or nolo contendere to any misdemeanor or felony, regardless of adjudication, a crime in any jurisdiction which related to health care fraud. MOTION: Mr. Lohr made a motion to accept the Voluntary Relinquishment. The motion was seconded by Dr. Hellman and passed with a 3/0 vote. MOTION FOR DETERMINATION OF WAIVER AND ENTRY OF FINAL ORDER Tab 4 John Mulfinger, PT18909, Case No (PCP Dr. Gina Petraglia, Amy Babb and Nancy Watson) Dr. Petraglia was recused due to participation in the Probable Cause Panel Respondent was not present nor represented by legal counsel. Ms. Shah summarized the case for the Board. Respondent was charged with the following violations: Count I: Section (1)(h), Florida Statutes (2010) by violating a Final Order of the Board, by failing to pay the fines and costs associated with Case No , totaling $1,774.19, by September 10, 2011 MOTION: Mr. Lohr made a motion to find respondent was properly notified of the Administrative Compliant and failed to timely respond thus, making a waiver of his rights to choose or elect the manner in which this case proceeds. The motion was seconded by Dr. Hellman and carried 3/0. MOTION: Mr. Lohr made a motion to adopt the findings of fact and the conclusions of laws as set forth in the Administrative Complaint. The motion was seconded by Dr. Hellman and carried 3/0. MOTION: Mr. Lohr made a motion to find the respondent in violation of Florida Statutes as charged in the Administrative Complaint. The motion was seconded by Dr. Hellman and carried 3/0. MOTION: Mr. Lohr made a motion to accept into the record and evidence the Department s investigative file inclusive of all documentation provided to the Board through their material as provided as for the purposes of determining penalties. The motion was seconded by Dr. Hellman and carried 3/0. MOTION: After discussion, Mr. Lohr made a motion to impose a Reprimand. The motion was seconded by Mr. Rust and carried 3/0. Case No : An Administrative Complaint (AC) was filed on July 20, 2005 against Mr. Okoye for having had disciplinary action taken against him by Arizona. The Arizona case claims he made fraudulent representations and failed to maintain adequate patient records. Mr. Okoye and the Department entered into a Settlement Agreement which required: $1, fine and costs of $ due February 16, hours of continuing education on Documentation due November 17, 2006 Pass the laws and rules exam by November 17, 2006 Probation with a Board approved monitor for a period of 1 year The terms include a tolling provision for Mr. Okoye s probation until such time as the Board approves a monitor or Mr. Okoye leaves Florida for more than 30 days. At this time, no monitor has been approved. Case No : An AC was filed on April 27, 2007 against Mr. Okoye for non compliance of his previous order. The Board ordered: Costs of $ due October 27, 2007 Suspension until he appears before the Board with a passing score on the Florida laws and rules exam Page 10 of 29

11 Mr. Okoye appeared before the board in May 2012 to request his suspension be lifted, which the board granted. He is now before the board to have his Chair approved monitor formally approved by the board. MOTION: After discussion, Dr. Petraglia made a motion to formally approve Ms. Leigh Delgado, PT 5330, as Mr. Okoye s monitor. The motion was seconded by Mr. Lohr and carried 4/0. REQUEST FOR MODIFICATION OF FINAL ORDER Tab 7 Anita Oramas, PT3341 Case No An Administrative Complaint (AC) was filed on February 28, 2007 against Ms. Oramas for violating Section (1)(c), Florida Statutes, by entering a plea of a crime that directly relates to the ability to practice physical therapy; and Section (2), which requires a licensee to be of good moral character. Ms. Oramas and the Department entered into a Settlement Agreement on June 15, 2007 which required: Costs of $ Fine of $ Successful completion of the Florida laws and rules exam within 1 year Six hours of board approved CE in the areas of documentation, billing, record keeping, and ethics. 1 year of probation Case Nos , An AC was filed on December 16, 2008 against Ms. Oramas for non compliance of her previous order. The Board ordered: Fine of $ Costs of $ Suspension until compliance with this Final Order and previous Final Order To this date, all terms of both Final Orders remain outstanding. Ms. Oramas has submitted a request to the board to lift the suspension. MOTION: After discussion, Dr. Petraglia made a motion to deny Mr. Oramas request. The motion was seconded by Mr. Rust and carried 4/0. REQUEST FOR BOARD ACTION Tab 8 Glenn Peterson, PTA by Endorsement Mr. Peterson was arrested for Driving Under the Influence (DUI) on April 10, He was found Guilty of DUI on December 12, 2011 and his driver license was placed on restricted status. The Board approved his application with conditions of a PRN evaluation and compliance with their recommendations on June 15, As of this date, Mr. Peterson has not complied with the board s order. 12 MOTION: After discussion, Dr. Petraglia made a motion to deny Mr. Peterson s application for licensure for failure to comply with the order of the board. The motion was seconded by Mr. Lohr and carried 4/0. Tab 9 Hue Melody Johnson, PTA by Examination Ms. Johnson was present and sworn in by the court reporter. Dr. Martha Brown, PRN was present to advocate for Ms. Johnson. Ms. Johnson appeared at the May 2012 board meeting to discuss her criminal history. At this meeting, the Board approved her application for licensure with the following conditions: PRN evaluation to be completed within 90 days If PRN requires a monitoring contract, Ms. Johnson is required to appear at the next regularly scheduled Board meeting Per her Final Order, Ms. Johnson had 90 days to comply with the Board s conditions. The deadline for compliance with her Board ordered terms was September 19, As she has not satisfied the terms of her conditional approval, Ms. Johnson s application has been placed on this agenda for final action by the Board. The board office was notified by PRN on October 10, 2012 that Ms. Johnson had completed her evaluation. A contract was required by PRN and as of October 29, 2012, Ms. Johnson has recently signed a monitoring contract. MOTION: After discussion, Dr. Petraglia made a motion to approve her application for licensure by examination and upon successful completion of the exams, shall be licensed. The motion was seconded by Mr. Lohr and carried 4/0. PETITION FOR DECLARATORY STATEMENT Tab 10 Diane Laurice, PTA (11), Florida Statutes Ms. Laurice has filed a petition for declaratory statement seeking clarification regarding the Florida Physical Therapy Practice Act and the scope practice of physical therapy as defined in (11), Florida Statutes. The board agreed that Section (11) is clear referencing the use of apparatus and equipment as appropriate use for the practice of physical therapy. The Board did not act on the Declaratory Statement. PETITION FOR VARIANCE OR WAIVER OF RULE Tab 11 Raphaella Zacche, PT by Examination Ms. Zacche was present and sworn in by the court reporter. Page 12 of 29

13 She has filed a petition for waiver of Rule 64B , F.A.C. She is requesting a waiver from the education requirement(s) for professional education. She has satisfied her general education requirement of 54 hours with CLEP exams and enrollment at Palm Beach State College. MOTION: After discussion, Dr. Petraglia made a motion to approve the Petition for Variance or Waiver of Rule 64B and approve her application for licensure and to certify her to sit for the National Physical Therapy Exam and the Florida Laws and Rules Exam. Upon a passing score on the exams shall be licensed. The motion was seconded by Mr. Lohr and carried 4/0. PERSONAL APPEARANCE PURSUANT TO (3)(c), F.S. Tab 12 Magaly Figueroa Antonetti, PTA by Endorsement Ms. Figueroa-Antonetti was present and sworn in by the court reporter. Ms. Figueroa-Antonetti is being requested to appear for disciplinary history on a prior Florida License, PTA Case No An Administrative Complaint was filed on November 6, 1996 against Ms. Figueroa- Antonetti for failing to provide documentation showing the completion of the required continuing education for the biennium. On July 28, 1997 Ms. Figueroa-Antonetti and the Department entered into a Settlement Agreement which required: A Reprimand Fine of $ due within 30 days Suspension until pending continuing education hours are completed Case No An Administrative complaint (AC) was filed on April 7, 2000 against Ms. Figueroa- Antonetti for the following: Count One: failing to reimburse the Department for the dishonored check for her 1999 license renewal. Count Two: failing to notify the board office of current mailing address. Count Three: by attempting to renew a license with fraudulent misrepresentation. 16 Case No : Mr. Roden held a previous Florida license which was revoked by the board in November His license to practice in Florida was subject to discipline pursuant to Section 125(1)(g), Florida Statutes, for having a license revoked or suspended; having had disciplinary action taken against him by the licensing authority of another state. Disciplinary action was taken against Mr. Roden s North Carolina license for engaging in conduct that could result in harm or injury to the public; engaging in any act or practice violative of the provisions of the North Carolina rules and regulations; recording false or misleading data, measurements or notes regarding a patient; failure to file a report, or filing a false report, required by law or by the board, or impeding or obstructing such filing or inducing another person to do so; and billing or charging for services or treatment not performed. Mr. Roden applied for a new Florida license which was considered by the board at their November 2004 meeting. The board ordered Mr. Roden to show proof of completion of a course in billing and professional ethics and one year of direct supervision by a board chair approved monitor. Mr. Roden also was ordered to agree to refrain from practicing in Florida in a home health setting and shall provide the board office with an annual affidavit attesting to that fact. Mr. Roden has submitted a request to remove the limitation of practicing in a home health setting. MOTION: After discussion, Mr. Rust made a motion to grant Mr. Roden s request.
