1 7000 Florida Street Punta Gorda FL Charlotte County Public Works Division Telephone: Fax: Application For Native Tree Replacement Fund PURPOSE The intent of the Native Tree Replacement Fund is to benefit citizens of Charlotte County by making monies available to replace native vegetation and enrich the tree canopy within public spaces. Funding for planting projects can include but is not limited to design costs, native trees and plants, mulch, irrigation, and installation on County-owned lands and easements. An approved list of the native vegetation covered by the Fund can be reviewed on pages 3-5 of this application. This program, administered by Charlotte County Public Works, uses revenues collected through new development of previously undisturbed lands. WHO CAN APPLY Community organizations (MSBU s, civic groups, homeowner associations, etc.) can apply annually, and County departments can apply as needed. FUNDING Applications must be approved by Charlotte County Public Works in order to receive funding. Community organizations are eligible to receive up to $50,000 per year and funding for County departments is unlimited. MAINTENANCE AGREEMENT A maintenance agreement must be executed between Charlotte County and the entity receiving the funding. This agreement ensures that the grantee will provide proper maintenance to guarantee the vegetation s viability in perpetuity. QUOTES Applicants shall provide two quotes from licensed landscape contractors, showing the cost of the proposed planting. Each quote should include details of the planting plan, including design cost, native trees and plants. SITE PLAN Applicants shall provide a site plan detailing the location of the irrigation system and vegetation the proposed planting plan. As a result of Public Works review, improvements such as curbing may be required, depending on the proposed plan. Those listed as part of a general species are required to be native to Florida and suitable for Charlotte County. Other Florida native subjects not listed, but suitable for Charlotte County conditions, will be considered. Selection of the right plant for the right place is still required. Should the County s designee deem a selection to be marginally appropriate for the project site, alternative selections will be required. To prevent process delays, it is recommended that plant availability is investigated prior to specification on plans. Some tree and palm selections may also serve as shrubs or ground cover. Some vine selections may also serve as ground cover and vice versa. 6 NATIVE TREE REPLACEMENT FUND MAINTENANCE AGREEMENT THIS MAINTENANCE AGREEMENT is entered into this day of, 20, by and between Charlotte County, a political subdivision of the State of Florida, Murdock Circle, Port Charlotte, Florida 33948, hereinafter referred to as COUNTY and hereinafter referred to as ENTITY. WITNESSETH WHEREAS, Ordinance Number established the payment of fees to the Native Tree Replacement Fund, hereinafter referred to as FUND, and the administration of FUND by COUNTY; and WHEREAS, the purpose of the FUND is to benefit the citizens of Charlotte County by granting funds to an MSBU/TU, civic group, homeowner association, or County department (ENTITY) to enhance and replace native vegetation within the public areas of unincorporated Charlotte County in order to protect and preserve the environment and community attractiveness; and WHEREAS, COUNTY owns or controls the property, described as and hereinafter referred to as SITE, upon which ENTITY requests to provide landscaping, and WHEREAS, ENTITY requests monies for said landscaping from FUND administered by COUNTY. NOW, THEREFORE, the parties agree as follows: I. ENTITY Shall: A. Submit the appropriate documentation to Charlotte County Public Works. 1. Completed Native Tree Replacement Fund application. 2. Two quotes from licensed landscape contractors, showing the cost of the proposed planting. Each quote should include details of the planting plan,

7 including design cost, irrigation system detail, and native trees and plants. Native trees and plants must be as per the Native Tree Fund Plant List. 3. A site plan detailing the location of the irrigation system and vegetation for the proposed planting plan. COUNTY may additionally require improvements, such as curbing, depending on the proposed plan. 4. Upon approval, a signed Native Tree Replacement Fund Maintenance Agreement. B. Install the proposed project according to the plans and specifications approved by COUNTY. Any deviation from specified plant selection, size, or spacing must be pre-approved by COUNTY. 1. Provide materials, equipment, tools, transportation, services, and labor to accomplish installation. 2. Assure that plant stock spacing, both on center and from bed edges, matches measurements on the scale drawing/plan provided. 3. Perform site analyses and preparatory work necessary to accommodate installation in accordance with current standards of the Florida Nursery Growers and Landscape Association (FNGLA). Work may entail removal of significant amounts of unsuitable soil and other materials and replacement with high-quality top soil, soil conditioners, and soil amendments. 4. Remove and dispose of, or relocate and transplant, any existing plant materials. Preservation and transplanting of such materials is to be done in a manner consistent with current recommendations of the University of Florida Institute of Food and Agricultural Sciences (UF/IFAS) and FNGLA. 5. Install all plants, trees, and palms in a manner consistent with current recommendations by the University of Florida Cooperative Extension 2

8 Service and the FNGLA. Sod and sodding are to meet current standards of the Florida Turf Grass Association. 6. Supply shop drawings, product specimen labels, and analysis reports of all non-plant materials to be utilized (i.e., soils, soil additives, mulch, pesticides, irrigation system components, and tree and palm supports). 7. If applicable, install an irrigation system according to current standards of the Florida Irrigation Society. 8. Provide a Maintenance of Traffic Plan, according to current Charlotte County policy standards. 9. Precipitate utilities location service prior to beginning excavation work and as required thereafter. 10. Obtain necessary permits for performing work in the public right-of-way. 11. Perform initial, thorough watering-in of all plant materials, alleviating all air pockets in backfill soil. 12. Support trees and palms according to current FNGLA and UF/IFAS recommendations. Ascertain that all staking materials are installed within beds or rings, and that they do not interfere with turf grass maintenance. A patented product such as ArborBrace, Brook s Tree Brace, Arbor Tie, or Earth Wing is preferred. 13. Assure that all plant materials are Florida #1 grade or better (per current Florida Department of Agriculture and Consumer Services, Division of Plant Industry Grades and Standards for Nursery Stock) and free of plant pests and diseases. Upon County inspection at the time of final acceptance, all plant materials are to appear viable and healthy. 14. Protect plant materials, in transport and on site, from desiccation, wilting, and breakage. 3

9 15. Create mulch berms around all tree and palm planting holes, including those within beds, to direct water to root masses. 16. Mulch beds and rings uniformly with 3 (after settling) of a high-quality mulch product, keeping mulch away from all stems and trunks. 17. Remove all nursery tags, labels, wires, ties, fasteners, containers, fabrics, ropes, strings, nursery stakes, and other unnecessary, deleterious materials from all parts of all plant stock, both above and underground. 18. Repair or precipitate repair, at no expense to COUNTY, of any property damaged in the process of performing work related to the project. 19. Remove all equipment and uninstalled supplies from County property upon completion of each day s work. 20. Remove all soil and debris from pavement upon completion of each day s work. 21. Effectively employ best management practices as related to storm water, erosion, sedimentation, and turbidity control in accordance with current Florida Department of Environmental Protection guidelines. 22. Load, haul, and dispose of surplus sod, soil, and debris at no additional expense to COUNTY. 23. Restore all turf grass, disturbed incidentally in performance of the work, adjacent to the landscape planting area. 24. Provide a one-year replacement warranty on all plant materials; all maintenance associated with the plantings (i.e., establishment watering, weed control, plant pest and disease/disorder control, fertilization, pruning, tree/palm support maintenance, edging, and other tasks necessary for protection of the perishable asset); and, if applicable, irrigation equipment. 4

10 25. Promptly address any punch list items that have been noted during inspection. ENTITY has 14 days to satisfy/rectify all items determined to require attention. C. Maintain landscape planting investments in the public right-of-way for the first year after installation and thereafter in perpetuity. 1. Conduct establishment watering of new plantings. a. Frequency of watering after initial thorough watering-in. Weeks 1 through 4 every other day. Weeks 5 through 8 twice weekly at 3 to 4-day intervals. Remainder of establishment period once every 7 days. b. Determine establishment periods. A plant is considered established in its transplanted site if and when its root system extends into, and is fully developed in, the surrounding soil. Only then can it be expected to perform at its maximum drought tolerance. Establishment is delayed by underwatering. Trees and palms 3 to 6 months per inch of trunk diameter. One-gallon plants 3 to 6 months. Three-gallon plants 6 to 12 months. Sod 30 days. c. Gauge watering frequency and quantity based on factors such as nursery growing medium, soil, drainage, type of plant, and weather conditions. Recognize that even the most droughttolerant or drought-loving plants require establishment watering and that overwatering, causing root or stem rot, is possible. d. Be familiar with the degree of drought tolerance of various plant types. 5

11 Xeric plants -- Those requiring no supplemental moisture to thrive, once established (e.g., Cabbage Palm). Moderately drought-tolerant plants Those requiring occasional supplemental moisture, once established (e.g., Hibiscus). Oasis plants Those requiring frequent supplemental moisture, even when established (e.g., Impatiens). 2. Maintain bed care. a. Keep mulch at a 3 uniform depth throughout plant beds. b. Keep mulch away from trunks and stems. c. Keep beds virtually free of weeds and litter. d. Keep bed edges delineated from turf grass areas. 3. Assure that all irrigation system components constantly serve their functions, keeping all plant materials turgid at all times. 4. Provide plant nutrition in constant fashion by way of granular products (such as landscape fertilizer, plus complete micronutrient package), broadcast over root systems uniformly at a rate suggested on the product label. 5. Achieve plant pest, insect, mite, disease, and disorder inspection and control in a timely manner, so that unacceptable plant damage does not occur. 6. Replace (with like materials) any plant materials deemed dead or unviable by the end of the one-year warranty period. Replacement plant materials must then receive initial care through establishment. 7. Prune only as necessary to maintain plant health, appeal, and public safety. 6

12 8. Keep tree and palm stakes, guys, and supports adjusted in order to serve their intended purpose for the entire first year, at which point they are to be removed. II. COUNTY Shall: A. Collect monies for the FUND from payments for tree removal authorization and in lieu of planting or preserving trees on developed properties. B. Provide interested parties with FUND information, including purpose, eligibility, application information, approved list of native vegetation covered by the FUND, and responsibilities associated with participation and receipt of FUND monies. C. Accept ENTITY applications for funding, consider applications based on compliance and public benefit, and notify ENTITY of approval/disapproval of application in a timely manner. D. Administer funding for native tree replacement, as per program guidelines. 1. MSBU/TU, civic group, homeowner association up to $50,000 per year. 2. County department unlimited. E. Conduct periodic inspections of planting areas, notifying ENTITY of any deficiencies or problems that need to be addressed. F. Provide insight, guidance, and support to ENTITY as needed and applicable. III. The COUNTY and ENTITY (hereinafter jointly referred to as the PARTIES) represent to each other that each has the power, authority, and legal right to enter into and perform its obligations as set forth in this Agreement. IV. COUNTY s Director of the Public Works Division, or his/her designee, shall serve as the representative for COUNTY, solely for the purposes of providing FUND information and applications, reviewing and approving applications, inspecting plant sites, sending or receiving notices or communications pertaining to the FUND s administration, and acting 7

13 as a contact between COUNTY and ENTITY to answer questions ENTITY may have regarding the FUND. V. Use of Contractor by ENTITY. A. The size and scope of most projects will necessitate that a private Contractor be retained to do the work. B. ENTITY shall assure that any Contractor retained is licensed by, and acceptable to, COUNTY. C. The Contractor may subcontract with such manufacturers, suppliers, and contractors as it deems desirable, so long as those subcontractors are acceptable to COUNTY. The Contractor shall, at all times, remain responsible for the performance of, and payment for, all work performed by all subcontractors. VI. ENTITY shall not assign this Agreement, in whole or in part, without the prior written consent of COUNTY. VII. ENTITY agrees that it will indemnify and hold harmless COUNTY and all of COUNTY s officers, agents, and employees from any liability, claim, loss, damage, cost, charge, or expense arising out of any act, action, neglect, or omission by ENTITY or by any third party during the performance of this Agreement, whether direct or indirect, and whether to any person or property to which COUNTY or said parties may be subject. VIII. This Agreement supersedes all prior negotiations, agreements, and understandings between the PARTIES with respect to the subject matter hereof and constitutes the entire agreement between the PARTIES with respect to the subject matter hereof. To be effective, any amendment or modification to this Agreement must be in writing and must be signed by the PARTIES. IX. In the event that any provision of this Agreement shall, for any reason, be determined to be invalid, illegal, or unenforceable in any respect, the PARTIES shall negotiate in good 8

14 faith and agree to such amendments, modifications, or supplements of or to this Agreement or such other appropriate actions as shall, to the maximum practicable in light of such determination, implement and give effect to the intentions of the PARTIES as reflected in this Agreement. The other provisions of this Agreement shall, as so amended, modified, supplemented, or otherwise affected by such actions, remain in full force and effect. X. This Agreement shall remain in effect for perpetuity or until such time as COUNTY shall deem it invalid. XI. Any notices/communications permitted or required to be given hereunder must be sent to the party intended to receive such notice/communication at the address listed below. A. ENTITY: B.
