2 L Requirement Act 1963 requires that any person s The Motor Vehicle Drivers Instructors who for money, reward, other remuneration or any consideration whatsoever gives another person advice, instruction or demonstration in order to teach that person to drive a vehicle must hold a Driving Instructor s Licence. Prerequisites In order to obtain an Instructor s Licence, you must: hold a current Western Australian Motor Driver s Licence; have held, for a minimum of three continuous years, the class of driver s licence for which you wish to provide instruction; is a fit and proper person which includes medical fitness be of a good character (based on information obtained through the police certificate and, if required, character references); and be 21 years of age or over. page2

3 What You Must Submit Upon application you must: Pay $87.30 non refundable application fee complete an Instructor s Licence Application Form (MDL 23); produce a three part National Police Certificate, which is made up of a criminal convictions check and a traffic conviction report and an infringements report (this must be an original or certified copy and not be more than 3 months old); and produce an original or certified copy of a relevant Certificate IV in lieu of the Theory Test/s and Practical Driving Assessment if you are seeking exemption from the requirement to undergo tests of your competence to instruct and knowledge of the Road Traffic Act 1974 (see Methodology: Option Two) If your police certificate shows any convictions, you are also required to provide the names and addresses of two (2) people who have known you personally for at least twelve months to whom reference can be made as to your character. The names of relatives may not be given. page 3 3

4 Methodology Option One - DOT Theory and Practical Assessment (see page 4) or Option Two - Recognition of Prior Learning (see page 5). Option One: Department of Transport (DoT) Theory and Practical Assessment This method must be followed if you you do not possess a relevant Certificate Certificate IV. 1. Attend at any Licensing Centre or Department of Transport (DoT) agency to sit the written Theory Test, which consists of 150 questions. This is mandatory irrespective of the class of licence in which you intend to be qualified to instruct. You must answer 140 questions correctly to pass the Theory Test. 2 If you wish to provide instruction on motorcycles or in heavy vehicles, you must also sit the Theory Test for these classes. Pass marks for these classes vary, depending upon which one you undertake. 3. If you are a licensed Instructor seeking to add an additional class of vehicle to your Licence, refer to Adding Additional Classes to your Licence on page If you pass the Theory Test(s), you will then complete an application form to become a Driving Instructor. Application forms are available online at or at Licensing Centres and regional licensing agencies, such as Shire Offices, Police Stations and Post Offices. You must also attach to your application original or certified copies of a three part criminal and traffic certificate. This includes a National Police Clearance, a Traffic Conviction Certificate and a Traffic Infringement Certificate that must not be older than 3 months. Certificates must remain valid throughout the application process. If any of the certificates expire, you will be required to obtain current certificates. If your police certificate shows any convictions, you are also required to provide the names, addresses and contact numbers of two (2) people who have known you personally for at least twelve months to whom reference can be made as to your character. The names of relatives may not be given. 5. You will then be issued a medical to take to your doctor. Once completed, it is your doctor s responsibility to send the form to the DoT Driver Assessment Section. Upon receipt of your completed application, the usual processing time is approximately ten working days. After this time has passed, you can contact to ascertain the progress of your application. 6. Once the application has been approved, an officer from DoT will contact you to arrange a Practical Driving Assessment. page4

5 The Practical Driving Assessment is similar to the original driver s licence test, though a higher standard is required to pass. The Instructor s Practical Test will assess your ability to provide instruction to a learner driver. In country areas, these are arranged through the local licensing authority. A fee of $ is payable immediately prior to the Practical Driving Assessment. If you are unsuccessful in your first attempt, an additional fee of $ must be paid immediately prior to any subsequent assessments. Please note that as of 31 December 2007, the Certificates III in Motor Vehicle Driver Instruction and Certificate IV in Driving Instruction have been replaced with the Certificate IV in Transport and Logistics (Road Transport - Driving Instruction). The certificates III in Motor Vehicle Driver Instruction and Certificate IV in Driver Instruction will still be accepted with application but these courses are no longer available. 7. On successful completion of the assessment, you will have qualified to become a Driving Instructor. Once you have paid the annual fee of $4.90 at any licensing authority, arrangements will be made to have your Driving Instructor s Licence mailed to you. This process usually takes five working days. On receipt of the Driving Instructor s Licence, you can commence to instruct clients for hire and reward. Option Two: Recognition of Prior Learning Certificate IV in Transport & Logistics (Road Transport - Driving Instruction) If you hold a Certificate IV in Transport & Logistics (Road Transport - Driving Instruction) issued by a prescribed body as listed in Schedule 2 of the Motor Vehicle Driver Instructor Regulations 1964, the Department of transport will exempt you from having to pass the Theory and Practical assessments associated with your Driving Instructor s licence. You will have to pay all associated course costs before the institution will issue the Certificate. page5

7 Mutual Recognition Act There is potential for other types of certificates or employment qualifications (for example, a Driving Instructor s licence held in another State of Territory) to be recognised in part or full within the qualifications framework of the Western Australian Driving Instructor s Licence. Under the principles of the Commonwealth Mutual Recognition Act 1992, licensed Driving Instructors from other States/ Territories of Australia may be entitled to be registered in Western Australia also. In such instances, you are required to lodge a Mutual Recognition form with your application which includes the information: in which other State(s) you are a licensed Driving Instructor; you are seeking to be registered in Western Australia under the mutual recognition principle; you are not currently subject to any disciplinary proceedings in relation to your Driving Instructor s Licence; any Instructor s Licence you hold is not cancelled or suspended; you are not prohibited from being an Instructor in any State nor have special conditions on your Licence as a result of disciplinary proceedings; any other conditions that your Instructor s Licence is subject to; and, that you give consent for DOT to make enquiries with the other State(s) regarding matters relevant to the notice. The Mutual Recognition form must be accompanied by a certified copy of each Instructor s Licence that you hold, a National Police Clearance, a Traffic Conviction Certificate and a Traffic Infringement Certificate that must not be older than 3 months. Application must be made in a Western Australian Licensing centre and the application fee of $87.30 must be paid and an application form must be submitted. In all other instances, in order to be exempted from DoT s Theory and Practical Assessment requirements, only the specific Certificates listed on page 5 will be accepted. Other forms of certification or experience may; however, count towards those required Certificates. In these cases, any Recognition of Prior Learning will be decided by the authorised providers of those Certificates. These providers will determine whether other qualifications can be used to shorten the time required to obtain the relevant Certificate qualifications. page7

8 M a in ta in in g a n In s tr u c to r s L ic e n c e In order to maintain your Licence, there are a number of things you need to be aware of. In addition to abiding by any conditions attached to your Licence, you must observe the following: When you receive your Driving Instructor s Licence booklet in the mail, you must sign your name on the inside first page immediately. All other information to be entered into the booklet must only be done by licensing staff. This information is in regard to renewal updates, retest dates (if applicable), medical assessments (see Renewing your Instructor s Licence on page 9), and any additional licence class you acquire (see Adding Additional Classes to your Licence on page 11). The booklet also includes your address. If you change your address, you are required, under the Motor Vehicle Drivers Instructors Regulations 1964, to notify the officer at the Driver Assessments Section of DoT (details on page 8) within seven (7) days of your move so that your booklet can be updated. You must also notify the officer at the Driver Assessments Section (contact details appear on the back page of this booklet) of DoT if your booklet is lost, mutilated or destroyed. You will have to sign a Statutory Declaration so that you can be issued with a new booklet and have the old one declared void. A replacement fee of $7.30 must be paid. When your Instructor s booklet is full, you must hand it in with your next renewal payment. A new booklet will be mailed to you free of charge. Once again, you must sign the front of the booklet as soon as you receive it. Unless otherwise approved, any vehicle you provide for the purposes of instruction must be fitted with dual controls for the front passenger seat. These controls must enable you to disengage the transmission or switch off the engine and you must also be able to effectively brake the vehicle. An additional rear vision mirror for your use is also required. A vanity mirror on a sun visor is not sufficient for this purpose. page8

9 Your dual-controlled instruction vehicle(s) must be inspected once a year at a DoT vehicle examination centre or, an Authorised Inspection Centre. Please contact DoT via any of the methods listed on the final page of this information pack for the location of your nearest centre. Any advertisements of your abilities to provide driving instruction need to specify the class or classes of motor vehicle in which you are licensed to provide instruction. This is a requirement under the Motor Vehicle Drivers Instructors Act You must by law carry your Driving Instructor s Licence with you whenever you are instructing, as you are required by law to produce it to: a police officer on demand; anyone who wishes to receive, or who has received, driving lessons from you; any authorised DoT officer on request. Failure to abide by any of the above rules may result in your Driving Instructor s Licence being cancelled or suspended and you could be fined up to $1000. If your Instructor s Licence is cancelled or suspended, you must return it to DoT within three (3) days. Failure to return the Licence in this time period could result in further action being taken. R e n e w in g y o u r In s tr u c to r s L ic e n c e A Driving Instructor s Licence is only valid for one year from the date it was issued. If you do not wish to continue instructing, the Licence must be returned to a licensing authority. Expired Licences must be returned to DoT within three (3) days of the expiry date. Failure to return the Licence in this time period could result in further action being taken. If you wish to continue instructing after your Instructor s Licence is due to expire, you must be aware of the following points: In order to renew your Instructor s Licence, you must attend at a Licensing Centre or DoT regional agency and pay the annual fee of $4.90. Information about your Licence s upcoming expiry and a renewal letter will be mailed to you approximately two (2) months prior to the expiry date. However, it remains your responsibility to be aware of your Licence s expiry and arrange renewal in a timely fashion if a renewal letter is lost in transit. Once renewed, your Instructor s Licence will be valid for another year. You may continue to renew your Instructor s Licence in this way, so long as you continue to meet the requirements for holding the Licence. page9

10 R e n e w in g y o u r In s tr u c to r s L ic e n c e (c o n tin u e d ) If you fail to renew the Licence before the expiry date and wish to continue instructing, you will not be permitted to renew the Instructor s Licence and must return the licence and go through the entire application process again (including passing all required assessments). If you do not hold a relevant Certificate IV and obtained your Instructor s licence via the first method, you are required to re-sit DoT s Theory and Practical assessments every three (3) years. When you are due for reassessment, you will receive a letter detailing this requirement. The assessments must be passed satisfactorily with all necessary fees paid before the Instructor s Licence will be renewed. If you already have an Instructor s Licence when you obtain a relevant Certificate, you will generally be exempted from future DoT Theory and Practical Reassessments. Simply show your Certificate to licensing staff when you next go to renew your Instructor s Licence and they will attach a certified copy to your renewal application. It will also be noted or stamped in your Instructor s booklet that your Certificate exempts you from any regular retesting. However, in circumstances where the Director General of DoT is no longer satisfied that you meet the licensing requirements, you may be required to demonstrate your competence. All Driving Instructor Licence holders are required to have regular Medical Assessments. If you have a pre-existing medical condition and are required to undertake regular testing as part of your ordinary driver s licence, those tests will generally be sufficient for your Instructor s Licence. For all other Instructors, the timeframes for medical reassessments are as follows. Instructors who are: > under 45 years of age are required to be assessed every five years; > 45 years of age or more but under 65 years of age are required to be assessed every two years; or > 65 years of age or more are required to be assessed every year. Information about any required medical assessments will be mailed to you with your Instructor s Licence renewal information. Your doctor must state that you are still fit to drive any and all classes of motor vehicle you instruct in before the Instructor s Licence may be renewed. page10

11 A d d in g A d d itio n a l C la s s e s to y o u r L ic e n c e If you wish to instruct in additional classes of vehicles to the class for which you currently hold an Instructor s Licence, you will be required to sit additional DoT tests in that class or obtain a relevant Certificate qualification for that class. If you choose to obtain the additional classes by passing DoT assessments, you will not be required to undertake the initial 150 theory questions unless you are already due for your reassessment (required every third year). The same applies to medical assessments - you are not required to pass another one unless it is due on your existing Instructor s Licence. Also, you do not need to resubmit a police certificate. You will only be required to pass a Theory Test on the new class and demonstrate your practical driving competence in that class. If you wish to obtain a Certificate qualification for the additional class, and you already hold a Certificate for your original classification, the authorised providers will be able to inform you if any of the learning modules you have completed for one course are applicable as Recognition of Prior Learning for the additional class.
