1 PSC REF#: BEFORE THE PUBLIC SERVICE COMMISSION OF WISCONSIN Joint Application of Wisconsin Electric Power Company, as an Electric Public Utility, for Authority to Construct a New Distribution Substation and Related Electric Distribution Facilities in the City of Wauwatosa and American Transmission Company, LLC, as an Electric Public Utility, for Authority to Construct Related 138 kv Electric Transmission Facilities in the Cities of Milwaukee and Wauwatosa, all in Milwaukee County, Wisconsin (Western Milwaukee County Electric Reliability Project) Docket No. 05-CE-139 Public Service Commission of Wisconsin RECEIVED: 01/24/13, 11:36:07 AM CITY OF WAUWATOSA S REPLY POST-HEARING BRIEF The City of Wauwatosa, by undersigned counsel, submits this brief in reply to the Initial Brief of American Transmission Company LLC (ATC) pursuant to the scheduling orders in this case. INTRODUCTION The central issue for the Commission in this case is the location of the transmission lines in the one of the State s most dynamic urban corridors. For the City, its primary interest is the western routes. On this central issue, there is a remarkable degree of agreement. Unfortunately, ATC s initial brief spends so much of its time on extraneous issues, that it is critical to look back at the record as a whole and the positions of the parties in this proceeding. 1

2 I. THERE IS GENERAL CONSENSUS FOR A HYBRID ROUTE A. A. Areas Of Consensus. The City and ATC have worked collaboratively on reaching substantive agreement on the two issues concerning the location of Route A along Walnut Road the location of the transmission line under Walnut Road and the transition structures at Walnut Road and 120 th Street. ATC has acknowledged, ATC has addressed both of these concerns. 1 The Commission should adopt those changes. In addition, the co-applicants ATC and Wisconsin Electric, as well as the City, have indicated support for making portions of Route A east of Walnut Road an underground line. For its part, while the City would prefer an all underground Route A, it has supported a hybrid route, providing for a mix of above ground and underground transmission east of Walnut Road (Resolution Route). WE Energies, the co-applicant, agrees with the City that the most appropriate siting of this transmission line in the densely populated area of Wauwatosa is underground, 2 but it did not oppose a hybrid route. Finally, Mr. Holtz of ATC agreed that at least one hybrid route was a feasible route that should be given serious consideration: ATC s investigation determined that this is a feasible alternative which meets the system needs, is constructible at a more reasonable cost than an all-underground route, and also achieves Wauwatosa s objective of eliminating Segment 4 from the future business technology park development. Accordingly ATC believes it deserves serious consideration. 3 That remains ATC s position in its brief. 4 1 See ATC Initial Br. at 8, PSC REF#: See Ex. 3 B. Basis For Consensus On A Hybrid Route. Each of these parties have come to this consensus recognizing that the statutory standards in Wis. Stat (3)(d) require the Commission to balance several factors in determining the location of transmission routes. The City acknowledged that the Public Service Commission is charged with balancing the cost of transmission lines while ensuring that those lines will not unreasonably interfere with the orderly land use and development plans for the area involved. 5 ATC similarly acknowledged, selecting the routes for this Project requires a balancing of different types of impacts against each other, including the cost of using certain routes or construction techniques to avoid certain environmental or social impacts. 6 This case has illustrated why the statutory standards must be applied on a case-by-case basis and not as a universal one-size-fits-all set of rules. There is no dispute on the record that this corridor is a unique and vital area for economic development for the region and the State. The president of the City s Common Council, Mr. McBride, summarized the character of this area in his direct testimony as follows: The most valuable economic development sites in southeastern Wisconsin and perhaps Wisconsin are the four quadrants of land bisected by the Highway 45 and Watertown Plank Road intersection in Wauwatosa, one exit north of the Zoo Interchange. The Zoo Interchange is Wisconsin s busiest freeway interchange. The area within a one-mile radius of the intersection of Mayfair Road and Watertown Plank Road in Wauwatosa has been called metropolitan Milwaukee s second downtown. On the north of this area, Mayfair Road is a major retail corridor. As it extends south toward I-94, it becomes a major spine for health care and advanced research. A few blocks south of the Research Park on or near Mayfair Road are two campuses of Wheaton Franciscan Health Care the Wisconsin Heart Hospital and Wheaton Franciscan s Wauwatosa hospital campus as well as various medical office buildings related to the nearby Regional Medical Center. 7 5 See City Resolution R , Ex. 4 For this reason, the City s land use plans have slated the area for high end economic development. The Comprehensive Plan has identified this area for future land use to include office development. 8 In 2004, the City adopted a master plan for the northeast quadrant of the Milwaukee County Grounds which identified buildable parcels, conservation zones, and the preservation of historic buildings on or eligible for the national, state or local registers of historic places. 9 The City has developed an economic development strategy entitled, Wauwatosa Innovation Parkway, which focuses on existing development, redevelopment, and new development particularly in the areas along U.S. Highway 45 and the Mayfair Corridor. 10 There is also no dispute that the placement of the transmission line as originally proposed will have adverse impacts on the development potential of these areas. The only dispute was exactly how much those impacts would be. For example, as originally proposed, the overhead transmission line would physically bisect the Milwaukee County property creating an unbuildable swath 70 feet wide through the middle of the property and several smaller parcels instead of one large parcel. As a result, the transmission line would compromise the development of that parcel for higher valued development. 11 C. The Dispute Over The Location Of The Transition Of The Hybrid Route. The only substantive dispute on a Route A hybrid is whether the hybrid route should transition back to overhead line at Watertown Plank Road (Resolution Route) or whether it should transition at the eastern terminus of Segment 3 and run along Underwood Creek Parkway 8 See Ex. 5 Road above ground to cross Watertown Plank Road (Wauwatosa Alt-1.) ATC cites two reasons for rejecting the Resolution Route: constructability and cost. Neither warrant its rejection. Although there are some additional constructability considerations associated with crossing Watertown Plank Road underground, there is no dispute that the Resolution Route is constructible. 12 The constructability issues simply result in a higher cost. Thus, the real question is whether the higher cost is warranted. The City believes that it is, for two reasons. First, running the transmission line along Underwood Creek Parkway places the line between one of the premier office buildings and the proposed new development in the County Grounds Area. It is still inconsistent with the land use plans and development and creates barriers for the marketing and development of the commercial property immediately to the east. 13 Second, keeping the route underground until Watertown Plank Road would only add approximately $2.3 to $2.6 million to the cost of construction of the proposed transmission line. This is not more than a 2- to 4-cent of impact to rate payers which is not an unreasonable cost. It is not unreasonable for the these costs to be spread out among ATC ratepayers given the fact that the primary benefits of this project are for the regional medical complex that provides one of two level one trauma centers in the State. 14 The benefits of the project are regional if not statewide and the negligible increase in rates associated with minimizing local impacts is not unreasonable. D. ATC s Generic Arguments About Underground Line On Route A Are Misplaced. 6 Wauwatosa Alt That argument is largely irrelevant given the willingness of the City and ATC to consider a hybrid route. ATC then ends its brief with another generic attack on underground routes because of its precedential impact and because siting should not be about aesthetics. 16 This argument is wrong on several levels. First, Wis. Stat (d) provides for a case-by-case analysis of each project on specified criteria. In this case, the criteria at issue include not just economics, but an evaluation of whether the facility will have undue adverse impacts on environmental values and whether it will unreasonably interfere with the orderly land use and development plans for the City. This project should be determined based upon its own merits not based upon some potential hypothetical impact it may have on future projects. Second, ATC s claims that this case is about aesthetics is misplaced with respect to Route A. The Commission is directed by Wis. Stat (d) to examine the impacts of proposed routes on the land use and development plans. Aesthetics are clearly a part of both these factors. ATC cites to testimony from the Rockdale proceeding 17 but that is irrelevant to the testimony in this case. In this case, the actual testimony is not just about aesthetics, it addresses the economic and land use impacts that the transmission line would create by, among other things, creating a physical barrier to developing highly valued property. Additionally, the City has not simply requested that the line does not go through the City, as did the communities in the Rockdale proceeding. It has actively worked with ATC to find a common solution to providing more reliable energy to the regional level one trauma centers which benefits not only the City of 15 See ATC Initial Br. at 9, PSC REF#: See ATC Initial Br. at 26-29, PSC REF#: See ATC Initial Br. at 27, PSC REF#:

7 Wauwatosa but the numerous individuals from eastern Wisconsin in need of emergency services. Undergrounding the transmission line in a densely populated area is cost effective and reasonable when taking into account the total costs of the negative externalities associated with high voltage transmission line. II. ROUTE B REMAINS UNACCEPTABLE. The City understands that ATC is required to propose two viable alternative routes and as a result continues to claim Route B is viable. 18 Whether Route B is viable, is at best questionable; but even if it is technically viable, it is an unacceptable route that should be rejected. ATC relies on DNR s testimony that Route B is permitable under ch. NR It discredits the testimony of Dr. Gonwa regarding the impacts to the wetland by stating that he is not even a lawyer and then further supports its assertion that the Route is permitable based upon DNR s testimony by Mr. Callan, who is also not a lawyer. 20 The general standards for wetland in Wis. Admin. Code ch. NR 103 require that wetland impacts be avoided if there is a practicable alternative or if there are significant adverse impacts to wetland functional values. 21 While Mr. Callan indicated that a segment in Route B is permitable, his testimony indicated major problems with both of the criteria in ch. Stat provides that the Commission only approve a permit if it is consistent with the DNR s assessment and information. 7

8 First, the hybrid routes present practicable alternatives to Route B that would avoid the impacts to the wetland along Underwood Creek Parkway. Mr. Callan clearly stated that the impacts are avoidable through the selection of an alternate route. 23 Second, it is undisputed that Route B will have permanent negative impacts on the urban forested wetland along Underwood Creek Parkway that no amount of mitigation will be able to alleviate. Although the impacts to the wetland on an acreage basis may be less than other projects, the relatively uniqueness of an urban forested wetland means that permanent destruction of this wetland is more acute. The PSC acknowledged this importance in the EA stating: These corridors provide habitat and opportunities for movement for many birds, animals, and plant species, as well as education and recreational opportunities for local residents. Such a corridor is even more highly valued in the very urbanized Milwaukee Metropolitan where less than 0.5 percent of the total land area in the county supports natural vegetation and critical species habitat. 24 It is clear that filling the urban forested wetland will have significant detrimental impacts upon the wetland s functional values, in effect destroying it and segmenting the remaining wetlands along the Underwood Parkway. The transmission line will create a 70-foot wide corridor of cleared vegetation eliminating the urban wetland that is so prized in this area. Finally, apart from legal issues under Wis. Admin. Code NR , Route B is also at the bottom of the list of routing priorities in Wis. Stat. 1.12(6). Route B presents the development of a new transmission corridor along a recreational trail, that is above ground and that impacts an environmentally sensitive area. Underwood Creek Parkway has been designated as a primary environmental corridor by the Southeastern Wisconsin Regional Planning 23 See Hearing Transcript, Vol. 2, November 27, 2012, p. 266:9-19, PSC REF#: See Ex. 9 Commission 25 and the DNR has identified this area as a Natural Heritage Inventory waterway and considers it an Area of Special Natural Resource Interest. 26 This, in conjunction with the permanent impacts to the wetland, makes Route B an unsuitable route and it should be rejected. III. JACKSON S TESTIMONY IS IRRELEVENT AND AN UNWARRANTED MISCHARACTERIZATION OF MINER S TESTIMONY. The primary purpose of Dr. Jackson s testimony was to attack the testimony of the City Appraiser, Mr. Miner. But that attack is misplaced for several reasons. First, comparing the testimony of Dr. Jackson to the testimony of Mr. Miner is comparing apples to oranges. Dr. Jackson assails Mr. Miner s testimony for not being an appraisal. Mr. Miner never claimed to present a formal appraisal. Rather, Mr. Miner was providing an estimate of economic impacts based on his experiences as an assessor (five years for the City and for 20 years in Wisconsin). Through these years of experience, he has gained an understanding of the types of local development proposals that have been discussed for the properties along Segments 4 and 5. In addition, he has seen the impacts from the overhead lines on development patterns in the City and has reduced assessments of properties due to their location next to transmission lines and structures. Second, just because Mr. Miner did not use an appraisal does not mean his estimations regarding the impacts on the properties in the City should be disregarded. Requiring a side-byside comparison and individual appraisals for all of the properties along miles of transmission line is simply unrealistic. 27 What Mr. Miner did was use a methodology that resulted in an approximation of impacts assuming that transmission line resulted in a lower land use. 10 not unreasonable given his knowledge of development patterns in the City. He ran those calculations on a parcel-by-parcel basis. The use of an approximation is not inconsistent with Dr. Jackson s own work. Dr. Jackson stated in an article listed on his qualifications 28 that impact of power lines on residential properties are varied and difficult to measure. The impacts from power lines, as well as other negative externalities, depend on many factors, including market condition, location and personal preference. 29 Those comments are revealing because they note that overhead transmission lines are a negative externality which contradicts his testimony that transmission lines may increase the value of the property. Moreover, he concedes that the impacts of transmission lines are difficult to measure and vary depending on local factors. Consideration of such local factors is just what Mr. Miner did. In this regard, it should also be noted that the same comment is true for Ms. Enders. While she based her specific numbers on Mr. Miner estimations, her basic testimony that there would be adverse economic impacts was not based on Mr. Miner. Her testimony was not rebutted by Dr. Jackson or anyone else. Both Mr. Miner and Ms. Enders have a wealth of knowledge regarding the locations of the properties that would be impacted and the current market conditions in Wauwatosa. 30 Third, Dr. Jackson s testimony is irrelevant because it is undisputed that he did not visit the properties in question and has given no indication why he would have any local expertise in 28 See Rebuttal-ATC-Jackson-3:8-10, PSC REF#:175765; Ex. 11 the area of property in the Wauwatosa area. 31 Finally, the assertion by ATC that Mr. Miner s calculations are double counting the impacts is not correct. Dr. Jackson claims that Mr. Miner double counted the diminution to land and to the structures. There is an impact to the undeveloped land where the property is no longer used for what has been its highest best use. For instance, the property value of the undeveloped land goes from being valued for potential Class A office to warehouse property. In addition, the improvements that are placed on the property are the lower valued improvements, such that Class A office space is a higher valued improvement than warehouse space. The reduction in the land value and the improvements to the land value result in a total reduction in the property value such as Mr. Miner has calculated. In conclusion, Mr. Miner and Ms. Enders testified there would be adverse impacts on property value given their knowledge of the market. To quantify that impact, Mr. Miner used a methodology to provide an estimate based on what he has seen in other properties in the City. A similar methodology was used by another municipality in attempting to quantify transmission line impacts. 32 Even if Mr. Miner is off by 50%, there is still a substantial economic impact in the millions of dollars. This is an unique impact given the unique location of this project. The City is not advocating that underground lines are warranted in every urban area, but they are warranted here so as to avoid or minimize real adverse impacts to the City s development and lands use plans for this vital economic corridor. 31 See Rebuttal-ATC-Jackson-4:7-8, PSC REF#: See Surrebuttal-W-Miner-13:10-16, PSC REF#:

12 IV. TRANSITION STRUCTURES. If a hybrid route (either Wauwatosa Alt-1 or Resolution Route) is selected, there will be three transition structures. Considerable testimony has been submitted regarding the transition structure around 120 th and Walnut Road and there have been a number of different proposals presented by the City, ATC and residents to address these concerns. As stated in the City s initial brief, the newest alternative proposed by ATC would be a significant improvement but there is room for additional improvement with more screening and making the transition structure less prominent, if possible, where it impacts the neighbors the most. There are two other transition structures associated with the hybrid routes, one transitioning from where Segment 1UG transitions to Segment 2 overhead and another where Segment 3 transitions to underground to connect to 23UG. The locations of these transition structures has not been determined. Transition from Segment 1UG to Segment 2 is on the City s public works yard and given the industrial nature of this property, screening would not be a major concern to the City. The City requests that ATC be directed to work with the City on the location as well as the minimal, if any, screening for this transition structure. The transition of Segment 3 to 23UG is somewhat different depending on which hybrid route is chosen. The Resolution Route has the transition where limited screening may be appropriate depending on the final location of the structure. The transition location for Wauwatosa Alt-1 is proposed to occur on the south side of Watertown Plank Road at Innovation Drive where there is a hotel and a fire station. The City requests that if this location is selected that screening, similar to the Walnut Road transition structure, be used to minimize the visual and physical impacts. 12

13 CONCLUSION The Commission has the affirmative duty to issue a CPCN for a transmission line only if it finds that the proposed route does not have an undue adverse environmental impact or an unreasonable interference with the orderly land use in the community. If it is not able to make this finding, the Commission must either reject the application or it may approve the application with modifications. 33 This line will provide reliable electricity to the level one trauma centers. This is a unique project in a unique urban area. Therefore, the City respectfully requests that the Commission grant the application but with modifications to Route A based upon the Resolution Route proposed by the City or the Wauwatosa Alt-1 route as discussed by ATC.
