Cancellation Terms Cancellation of monthly or annual memberships must be made in writing and received by Magnolia Park Golf Club at least 14 working days before the end of the current month you are cancelling in. You are still liable for the current full months/years membership payment, plus the 1 months notice cancellation fee. 4 Gym Guidelines DO S Wear clean clothes and footwear whilst using the gym. Dry, closed-top athletic shoes are required. No dress shoes, boots, sandals or flip-flops are permitted. Warm up before exercising. Drink plenty of water before, during and after exercise to make sure you don t get dehydrated. Stop if you feel uncomfortable. Be considerate to others when using the music system as your choice of music may not be agreeable to others. Be courteous to other members whilst working out. Make sure you cool down with some stretches at the end of your work-out. Return all equipment to its designated place. Clean the machines, using the paper towels/wipes provided, after use. Dispose of plastic cups and paper towels in the waste bin provided and keep the area tidy. Use the telephone in emergencies only. In the event of an emergency, please call the Main Reception. The internal extension number is clearly displayed next to the phone. External calls cannot be made from this extension. Remember to switch off lights and other electrical equipment i.e. fans and music systems, if you are the last person to leave. Exit the Gym promptly before closing time. DONT S Linger on equipment. Members should not monopolise the equipment. Take food or drink (except water) into the Gym. Glass (i.e. bottles) is prohibited. You are encouraged to bring water in plastic containers although plastic bottled drinks are available from the Pro Shop. Be overly noisy. You must give due consideration to other members in the gym. Misuse equipment as this can result in injury and/or damage to the equipment. STRICTLY PROHIBITED No alcohol, drugs, or smoking are permitted. You are prohibited to use the facility or engage in any activity while under the influence of drugs or alcohol. Whilst in the Gym, inappropriate conduct will not be tolerated. Such conduct includes, and is not limited to, using loud, abusive, offensive, insulting, demeaning language, profanity, lewd conduct or any conduct that harasses or is bothersome to members. Unauthorised access is not allowed. It is imperative that only Magnolia Park Gym members are admitted to the Gym. Admitting non-members may lead to the loss of membership. No exceptions will be tolerated. Members are not permitted to invite guests and/or demonstrate equipment for said guests to use. MEMBERS NOT ADHERING TO THESE RULES MAY BE ASKED TO LEAVE. MAGNOLIA PARK RESERVES THE RIGHT TO REVOKE THE MEMBERSHIP OF ANYONE WHO VIOLATES THE RULES.

5 Gym Membership Terms & Conditions Magnolia Park Golf & Country Club is a business operated by Brill Links Sports Management Ltd. Except where expressly agreed otherwise by us in writing every Member of the Gym shall be subject to these terms and conditions. Brill Links Sports Management Ltd reserves the right to use discretion in all matters relating to membership. TERMS & CONDITIONS 1. Members must be 18 years of age or over to be accepted for a Gym Membership 2. Membership is continuous until revoked in writing and acknowledged. The membership year begins on the day your membership was approved and renewal subscription payments are due on the first day of the relevant subscription year. If not paid in full in cleared funds, or if the first standing order payment has not been received by this date, then you will be deemed to have not renewed and all membership rights will cease immediately. Should you wish to become a member subsequently you will have to reapply for membership, rather than renew. 3. A member may join on a monthly basis with a minimum of 1 months membership, or on an annual basis for a minimum period of one year. The member is responsible for his/her membership fees up to the end of the monthly / yearly membership period. 4. Payment Options: Membership Fees are payable by credit/debit card, cheque or cash. Cheques should be made payable to Brill Links. Annual Membership Fees are also payable on a monthly instalment basis by direct debit. Members wishing to pay by instalments must do so through our designated direct debit company Golf Plus Direct. An administration fee will apply as set by Golf Plus Direct. In choosing to pay your annual membership by instalments you are agreeing to pay the full annual membership fee and all charges applied by Golf Plus Direct ( 5. Any membership payments made by credit card are subject to a 3% charge 5. Non-payment of any fees will result in the membership being cancelled and all services suspended. If a membership is cancelled due to non payment, that member will still be liable for the full month s/year s subscription and will be charged for all outstanding months up until the last day of the relevant subscription month/year. In becoming a member of Magnolia Park Golf & Country Club Gym, the member agrees to payment of a full months/years membership, even if they cancel the membership part-way during the membership period or if the membership is cancelled by the company due to non payment. 6. A member should inform us by letter or , no less than 14 working days before the end of the current membership period if he no longer wishes to continue with his membership. If we do not receive notification of this then the membership will be deemed to be continuing and you will be liable for the full subscription amount for the next membership month/year. 7. In the event of resignation or termination of membership within the membership month/year, for whatever reason, there will be no refund of membership subscription payments received unless there are exceptional and legitimate medical grounds for such termination. Brill Links Sport Management Ltd reserves the right to request written

6 documentation from a Medical Doctor to confirm such grounds. The final decision on whether a refund is granted rests entirely with Brill Links Sport Management Ltd. 8. Members will be notified in writing of any changes to subscription fees; the website will detail other changes. The club can t be held responsible for postal errors, the website will issue the next years subscription costs at least 50 days ahead of them being due. 9. Terms and conditions of membership may be revised from time to time and members should be aware of the terms and conditions posted on the website. (Last revision January 2014) 11. The Club will maintain an up-to-date list of members. Use of the Gym by non-members is strictly forbidden. Any member who becomes aware that a non-member is using the Gym has a duty to report this matter to the General Manager. 12. Use of the Facility. The Gym opening hours will be determined by the Club (currently 07:00am 19:00pm). Members must wear the correct footwear in the Gym at all times dry, closed-top athletic shoes are required. No dress shoes, boots, sandals or flip-flops are permitted. 13. The Equipment. Members must follow the posted instructions using Gym equipment. Any equipment failures must be reported to the General Manager immediately. The Club endeavours to provide the gym facilities in the best condition possible. This may, from time to time, result in closure of the facility to make improvements considered to be in the best long term interest. 14. Limitations of Liability. The member acknowledges that the Club s obligations and liabilities in respect of the Facility are exhaustively defined in this agreement. The Club accepts liability for repairing the equipment. The member is responsible for the consequences of any use of the Facility. The member is responsible for checking the equipment of the Facility for damage prior to use. The Club accepts no responsibility for any loss or damage to members or their personal belongings whilst using the Facility. 15. Brill Links Sports Management Ltd reserves the right, at any time, to modify, alter, or update these Terms and Conditions, and you agree to be bound by such modifications, alterations, or updates. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by any means including, but not limited to posting on the website at or by electronic or conventional mail. 16. These Terms & Conditions are the latest available and those that are currently in force. They may be updated from time to time in accordance with clause 15 above.
