1 REQUEST FOR PROPOSALS BRIDGEPORT ISD PROPOSAL TITLE: Heating/Air Conditioning Service/Repair SEALED PROPOSALS WILL BE RECEIVED UNTIL 10:00 A.M., WEDNESDAY, JULY 10, RETURN PROPOSALS TO: Bridgeport ISD th Street Bridgeport, TX All proposals must be submitted in a sealed envelope on the enclosed proposal form and received on or before the time specified above. The proposal envelope must be clearly marked Heating/Air Conditioning Service/Repair Proposal July 10, SCOPE Bridgeport ISD is now accepting formal sealed proposals for the repair and service of the BISD Heating/Air Conditioning Units. This contract will be effective from August 1, 2013 through August 31, SPECIFICATIONS The service will be for an on-call basis for all Bridgeport ISD Facilities except Bridgeport High School. Selected vendor will be on-call to BISD with a same day response time for emergency breakdowns to service and/or repair BISD s HVAC units as necessary. Work shall be done in a timely and orderly manner and all work areas shall be kept free from any safety hazards. Work areas shall be left clean and as close to original condition as possible. Any work that is required will be cleared with one of the following persons: Bill , Rocky , or designee. All work must be approved by one of the above named persons prior to commencement of any work. The hourly rate for the service call will commence when the Contractor arrives at the specified location and contacts the appropriate BISD personnel. Any units that need replacing will be replaced with an energy efficient unit with a SEER minimum of no less than 13. Any gas-fired units needing to be replaced will be replaced with electric units at the District s discretion.

2 The selected vendor will supply all necessary personnel, tools, and equipment to accomplish installation, service, and/or repair of Heating, Ventilating, and Air Conditioning (HVAC) units and systems. All costs associated with the installation, service, and/or repair of HVAC units and systems must be included in the hourly rate. The selected vendor will propose a regular hourly rate (hours from 8:00 a.m. to 5:00 p.m. Monday through Friday) and an after hours/weekend/holidays hourly rate (hours from 5:00 p.m. to 8:00 a.m., weekends, and school designated holidays). The selected vendor will propose repair parts and materials (including replacement units) as a separate expense priced on a cost plus % price. All repair parts and materials (including replacement units) will include the standard manufacturer s warranty. All installations of new equipment must include a 1-year warranty on labor. The selected vendor must be fully licensed to perform HVAC work in the State of Texas. The license must include endorsements for both environmental air conditioning and commercial refrigeration and process cooling and heating. Contractor and technicians must each have EPA certification. A copy of licenses and certifications shall be furnished upon request. Inability to furnish copies of these licenses and certifications will result in non-payment and termination of contract. Any equipment/repairs currently under warranty will be excluded from this proposal until the warranty expires. INSURANCE BISD will require proof of Workers Compensation Insurance. Selected vendor shall provide BISD with a Certificate of Insurance evidencing general liability coverage of no less than $500, Inability to provide proof of either insurance will result in non-payment and termination of contract. CRIMINAL HISTORY Before entering into a contract with the District, the selected vendor must give notice to the District if an employee, owner or operator of the business has been convicted of a felony. The District may terminate the contract if the District determines that an employee or business failed to give such notice or misrepresented the conduct resulting in a conviction. The District will obtain criminal history record information that relates to the selected vendor and his employees. CONTRACT The selected vendor reserves the right to charge any price desired as long as it does not exceed the proposal price.

3 All invoices will be paid on a net 30 day basis. No late fees are to be accessed against the District. INVOICES Invoices must show the address where the service was required. Invoices must be sent to: Bridgeport ISD th Street Bridgeport, TX The undersigned affirms they have familiarized themselves with the local conditions under which the work is to be performed and have satisfied themselves of matters that may be incidental to the work before submitting a proposal. Selected vendor must submit their proposals on the attached forms and they must be originally signed. Faxed or ed proposals will not be accepted. By submitting and signing the attached proposal forms, each vendor is indicating that he has read and understood the instructions, terms, conditions, specifications, and invitation to proposal and agrees to comply with and be bound by its precepts. Submission of a proposal form shall constitute an offer on such terms that shall remain open and irrevocable until such time as a proposal submitted on same has been accepted by the BISD. Continuing non-performance of the vendor in terms of specifications shall be basis for termination of the contract by BISD. BISD shall not pay for work, equipment, or supplies that are unsatisfactory. Vendors will be given a reasonable opportunity before termination to correct the deficiencies. However, this shall in no way be construed as negating the basis for non-performance termination. The Conflict of Interest Questionnaire shall be filed as addressed in the questionnaire. Bridgeport ISD reserves the right to accept and/or reject any and all proposals for any reason whatsoever. APPLICABLE DATES AND TIMES The proposals will be opened in the Bridgeport ISD Business Office, th Street, Bridgeport, TX 76426, at 10:00 a.m., Wednesday, July 10, Proposals are expected to be considered for award at the regularly scheduled Board of Trustees Meeting on Monday, July 15, 2013, beginning at 7:00 p.m. All vendors submitting a proposal are encouraged to be present at the proposal opening and the proposal awarding to defend and answer questions about their proposal.

6 Felony Conviction Notice State of Texas Legislative Senate Bill No. 1, Section , Notification of Criminal History, Subsection (a), states "a person or business entity that enters into a contract with a school district must give advance notice to the district if the person or an owner or operator of the business entity has been convicted of a felony. The notice must include a general description of the conduct resulting in the conviction of a felony." Subsection (b) states "a school district may terminate a contract with a person or business entity if the district determines that the person or business entity failed to give notice as required by Subsection (a) or misrepresented the conduct resulting in the conviction. The district must compensate the person or business entity for services performed before the termination of the contract."
