1 MEMO Attached is a Default/Delinquency/Foreclosure Intake Packet, and a brochure on "How to Help Yourself Avoid Foreclosure". Please fill out all of the forms in the attached intake packet completely, and sign and date where applicable. After you have completed the packet and written a "Hardship Letter", please return both to Piedmont Housing Alliance (PHA) by fax, regular mail, or bring it to our office and drop it off. The fax number and address are listed on the third page of the intake packet. Once your intake packet has been received, you will be assigned a housing counselor who will contact you within twenty-four (24) to forty-eight (48) hours of receipt of your intake packet to schedule an appointment to meet with you. It is important that you follow-up by calling our office at (434) to find out if your intake packet was received. P.S. Please gather and copy all the documents listed on Page 2, but do NOT include them when you return your intake packet and hardship letter, unless you are in foreclosure and have a sale or auction date. 2 Instructions for Piedmont Housing Alliance (PHA) Intake Read the attached brochure Fill out all forms in the Intake Packet Sign and date where appropriate ( all borrowers need to sign) Write a 1 page hardship letter using the sample on page 10 Return intake packet and hardship letter to PHA via fax, mail, or only if can scan in the documents because we require signatures. Make a copy of and bring the following documents to first appointment. Please no originals. o 2013 IRS tax returns and corresponding W-2s o If self employed, year to date Profit and Loss statement (P&L) o Latest 30 day pay stubs and/or proof of alternative income (Disability/SSI Benefit Letter, child or spousal support, etc.)other than employment (if applicable) o 3 most recent months of bank statements for every account o Divorce decree (if applicable) o Bankruptcy documents ( if applicable) o All mortgage loan correspondence, loan documents and current mortgage statement o Deed of trust/note/ Deed o All bills (credit cards, personal loans, cable, telephones, etc.) o We will copy your Driver License/Photo ID A Housing Counselor will contact you to make the 1 st appointment once intake the packet is processed. Our goal through one-on-one confidential counseling is to listen to you to determine your concerns, motivations and capability to analyze the available options. Default counseling is a cooperative process where the counselor acts as a facilitator and educator rather than a lending expert. Rev Responsibilities of the Housing Counselor Educate homeowner about the loss mitigation process and foreclosure. Explain the different workout options that exist. Educate homeowner about how to communicate with the lender about mortgage payments. Review hardship documents before they are submitted to lender. Fax paperwork if the homeowner does not have access to a fax machine. Responsibilities of the Homeowner It is ESSENTIAL that the homeowner remains in contact with the lender. Calling the lender to update them on your financial status and properly documenting your phone calls. Opening and responding to all written correspondence from the lender in a timely manner. Keeping all related paperwork in order. Tracking your income and expenses. Lowering your expenses as much as possible. Pursuing all potential income and assets. Submitting requested documents to lender. Contacting housing counselor with updates and questions. Piedmont Housing Alliance does not have any special negotiating powers with the lenders. As a HUD-approved housing counseling agency, we are here to educate homeowners about the general loss mitigation process. If an agency/company has promised to save your house by negotiating on your behalf, you should exercise caution. Please see the enclosed foreclosure brochure for more information about scams. 10 Foreclosure Mitigation & Housing Counseling Agreement 1. I understand that Piedmont Housing Alliance (PHA) provides foreclosure mitigation counseling after which I will receive a written action plan consisting of recommendations for handling my finances, possibly including referrals to other housing agencies as appropriate. 2. I understand that Piedmont Housing Alliance receives Congressional funds through the National Foreclosure Mitigation Counseling (NFMC) program and funds from other entities such as the U.S. Dept of Housing and Urban Development (HUD), Virginia Housing Development Authority (VHDA), NeighborWorks, and/or Treasury, local governments, foundations, etc., or their agents for purposes of program monitoring, compliance and evaluation. In addition, the agencies and organizations which provided funding to Piedmont Housing Alliance are often required to monitor our performance in accordance with their funding agreements. This monitoring may require that we release client files, in whole or part for their review. In order to release the client information to our agency or organizations, we must have a signed Authorization Form from our clients. Piedmont Housing Alliance currently receives funding from the following agencies: HUD, VHDA, NFMC, Emergency Home Loan Program (EHLP) and Making Home Affordable (MHA) 3. I give permission for program administrators/funders and/or their agents to follow up with me between now and three years following the close-out of my counseling file for the purposes of program evaluation. 4. I understand and give permission for Piedmont Housing Alliance to: (a) Submit client-level information to Counselor Max (CM) database, Hope Loan Portal (HLP) for projects, (b) allow NeighborWorks and Treasury to open files to be reviewed for program monitoring and compliance purposes, and (c) allow NeighborWorks and Treasury to conduct follow up with the client related to program evaluation, if they choose to. 5. We realize that the concerns you bring to us are highly personal in nature. We assure you that all information shared both orally and in writing will be managed within legal and ethical considerations. Your nonpublic personal information, such as your financial circumstances such as your total debt information, income, living expe4nse, and personal information concerning your financial circumstances, will be provided to creditors, program monitors, and others only with your authorization and signature on the Foreclosure Mitigation Counseling Agreement. All funding routinely require compliance monitoring and access to client files. We may also use anonymous aggregated case file information for the purpose of evaluating our services, gathering valuable research information and designing future programs. Types of information that we gather about you Information we receive from you orally, on applications or other forms, such as your name, address, social security number, assets, and income; Information about your transactions with us, your creditors, or others, such as your account balance, payment history, parties to transaction and credit card usage; and Information we receive from a credit reporting agency, such as your credit history. You may opt-out of certain disclosures You have the opportunity to opt-out of disclosures of your nonpublic personal information to third parties (such as your creditors), that is, direct us not to make those disclosures. If you choose to opt-out, we will not be able to answer questions from your creditors. If at any time, you wish to change your decision with regard to your opt-out, you may call us at and do so. Release of your information to third parties So long as you have not opted-out, we may disclose some or all of the information that we collect, as described above, to your creditors or third parties where we have determined that it would be helpful to you, would aid us in counseling you, or is a requirement of grant awards which make our services possible. I have contacted a HUD-certified housing counseling agency, Piedmont Housing Alliance, to ask for their assistance in evaluating my financial problems.
