1 A Glance at the Trade Adjustment Assistance Reauthrizatin Act f 2015 The infrmatin cntained in this guide applies t petitins filed n r after January 1, 2014 (identified by petitin numbers that are 85,000 and higher. The Trade Adjustment Assistance Reauthrizatin Act f 2015 (TAARA 2015) was signed int law by President Barack Obama n June 29, TAARA 2015 repeals the sunset prvisin f the Trade Adjustment Assistance Extensin Act f 2011 (TAAEA), and reauthrizes the Health Cverage Tax Credit (HCTC) retractive back t January These guide cards are fr reference nly. Please refer t yur Trade manuals fr mre specific infrmatin. Fr the mst up-t-date plicies, please visit:

2 Training THE SIX CRITERIA: There is n suitable emplyment The wrker wuld benefit frm apprpriate training There is reasnable expectatin f emplyment fllwing cmpletin f such training Training is reasnably available t the wrker The wrker is qualified t undertake and cmplete such training Such training is suitable fr the wrker and available at a reasnable cst MAX COSTS: Tuitin, fees, bks, tls, supplies, etc. $10,000 fr remedial training $20,000 fr vcatinal training $28,000 fr degree prgrams $35,000 max including travel and subsistence FOR TRA: Must attend training full-time Training must be apprved by 26 th week after cmpany certificatin r layff, whichever is later FOR RTAA: Must be enrlled full-time and wrk at least 20 hurs per week (ex. if nt TRA eligible) Cannt cllect RTAA and TRA at the same time MAX LENGTH: Up t 130 weeks PART-TIME TRAINING: May be apprved, but n TRA eligibility OTHER: Other types f apprvable training include apprenticeship, OJT, and incumbent wrker training

3 Waivers THE THREE TYPES OF WAIVERS: Health Wrker is unable t participate in training due t health, but can wrk Enrllment Unavailable Training des nt start within 30 days f apprval Training nt Available N training funds r n suitable training at reasnable csts DURATION AND REVIEW: Initially apprved fr three mnths Must review after initial 90 days and every 30 days thereafter TRA: Can nly cllect Basic TRA Waiver must be apprved by 26 weeks after certificatin r layff, whichever is later TRAINING: If the criteria under which the waiver was apprved n lnger exists, training may be apprved Apprval must ccur by the Mnday f the 1 st week ccurring 30 days after the waiver ends JOB SEARCH: Wrkers must cnduct jb search while n waivers Jb search effrts must be dcumented in MOSES when submitting waivers

4 TRA GENERAL REQUIREMENTS: Must be apprved fr training r a waiver by 26 weeks after certificatin f layff, whichever is later Must have exhausted all UI (n the claim filed fr the wrker s mst recent separatin frm the Trade-apprved cmpany) BASIC : Basic + UI (and any EUC) = up t 52 weeks Must be n a waiver r in training full-time Can cllect the balance f Basic TRA after training ends if wrker is nt suitably emplyed and cnducting jb search ADDITIONAL : Up t 65 weeks Must be enrlled in training full-time Wrker has 78 weeks t cllect up t 65 weeks f TRA (t accmmdate fr breaks in training) Additinal TRA ends when Training ends PART-TIME WORK: Wrker must reprt wages n TRA frms; hwever, their weekly TRA amunt may be reduced due t part-time wages (1/3 rule applies) RTAA: Can g frm TRA t RTAA Cannt g frm RTAA t TRA if TRA has been cllected COMPLETION : Up t 13 weeks within a 20 week perid if established benchmarks are met and still in training Must cmplete training within the authrized perid UI: Weekly amunts f TRA may be less than what wrker was receiving as UI If a new claim is filed with a new benefit year, the wrker may chse t cllect TRA instead f UI

5 RTAA GENERAL REQUIREMENTS: Must be at least age 50 at the time f RTAA applicatin r within the individual s eligibility perid Cannt earn mre than $50,000 annually in grss wages Cannt return t emplyment at the firm frm which the wrker was separated N 26-week deadline fr reemplyment REEMPLOYMENT & TRAINING: Must be reemplyed full-time and nt enrlled in training r Must be reemplyed fr at least 20 hurs per week and enrlled in training full-time ELIGIBILITY PERIOD: If wrker has nt received TRA - Tw years frm the date wrker exhausts UI (and any EUC) r tw years frm the date f reemplyment, whichever is earlier If wrker has received TRA Tw years frm the date f reemplyment, minus the number f weeks the wrker received TRA MAX BENEFIT: Wrkers may receive up t $10,000 ver the curse f the eligibility perid If wrker has received TRA, this max benefit will be dependent n hw much TRA was received TRA: Can g frm TRA t RTAA Cannt g frm RTAA t TRA nce TRA has been cllected

6 Travel & Subsistence Allwances TRAVEL AMOUNTS: Wrker is reimbursed the lesser f: a per mileage rate r per diem rate based n the federal GSA rates r reasnably available public transprtatin (bus, train, etc.) Only travel t required classes will be reimbursed TRAVEL REQUIREMENTS: Must be requested in advance (submit with training package) Carpling ptins must be cnsidered Available nly if wrker s rund-trip cmmute t training is 30 miles greater than his/her rund-trip cmmute t previus wrk lcatin. Example: Wrker s RT cmmute frm hme t wrk was 10 miles. Wrker s RT cmmute frm hme t training is 35 miles = 25 miles nt eligible Example: Wrker s RT cmmute frm hme t wrk was 10 miles. Wrker s RT cmmute frm hme t training is 61 miles = 51 miles eligible SUBSISTENCE AMOUNTS: Wrker will be reimbursed the lesser f 100% f allwable subsistence csts (eg, ldging, meals, etc) up t the maximum allwed r 50% f the per diem rate fr the area in which training is cmmenced Only subsistence required fr training will be reimbursed SUBSISTENCE REQUIREMENTS: Must be requested in advance (submit with training package) Available nly if the training is ut f the wrker s nrmal cmmuting area, and a daily cmmute t and frm the training lcatin is nt reasnable. Example: Wrker lives in Greenfield, MA and will be attending training in Chicpee, MA nt eligible Example: Wrker lives in Fall River, MA and will be attending training in Hamptn, NH eligible
