Photos by Lynna Harrison The February 13, 2014 luncheon meeting of the Sacramento Claims Association was a very well attended gathering; especially by Claims personnel. Brad Balentine, Director of Special Investigations Unit for David Morse & Associates, shared many reasons to use the Internet and Social Media when investigating claims. Mr Balentine is a licensed private investigator in California and Florida, and certified as a continuing education instructor. He has provided testimony as an expert witness. He started his Presentation reminding us of an old movie with Edward G. Robinson in an office using only a pencil - no fax, computer, or "technology" as we know it today. I thought, "it's so true, it wasn t that long ago I told Bryan my typewriter works just fine." I am very thankful he made me use the computer. Mr Balentine went on to say that the legal precedence of navigating with Social Media has become an accepted tool. Facebook has 350 million active users, Twitter two million, and YouTube the 4th most visited site. He also said keep in mind everything on the Internet is not necessarily true. Information obtained through Social Media requires verification. The legal stuff for your own protection, he added, is to preserve a copy of web-page as evidence. Further, do not impersonate anyone on the web, he instructed. Whenever you can, get a screen shot of evidence. There are not a lot of laws for precident as yet. He also said that Google is not everything, and can be biased according to the history/info stored in your computer. 9 Sacramento Claims Association News Network March Re-Certification Presentation On The CDI Fair Claims Settlement Practices Act Regulations at March 13 SCA Luncheon Meeting The California Department of Insurance mandates that all insurance adjusters must re-certify themselves as having read and acknowledge to understand the Fair Claims Settlement Practices Act regulations annually. Blane Smith is a partner at the law firm of Farmer Smith & Lane, LLP. He holds a B.A., Western Washington University, 1977, and his J.D. from the University of the Pacific, McGeorge School of Law, Mr. Smith began the practice of law in 1980 and has devoted his career to the specialty of insurance law. His work includes consultation and litigation related to the duties of insurers to their insureds and bad faith claims. After eight years as a partner in the firm of Thompson Heller, he became a partner in Farmer Murphy Smith & Alliston in 1996 and founded Farmer Smith & Lane, LLP along with Craig Farmer and David Lane in The importance of knowing and following these regulations cannot be overstated. Multi-million dollar penalties and fines have been levied on carriers for infractions.
