2 REQUEST FOR PROPOSAL (RFP) ASBESTOS ABATEMENT FOR RESIDENTIAL STRUCTURES BACKGROUND Communities across the country have been severely impacted by mortgage foreclosures and declining property values. In response, the U.S. Department of Housing and Urban Development (HUD) developed and funded the Neighborhood Stabilization Program (NSP) to help revitalize and stabilize particularly impacted communities. The purpose of NSP is to provide targeted assistance to state and local governments to acquire and redevelop abandoned and/or foreclosed homes and residential properties that might otherwise become sources of blight within their communities. Through the NSP, HUD has allocated $3.92 billion in Community Development Block Grant (CDBG) monies to communities and states nationwide, $98,653,915 of which was allocated to the State of Michigan. The Michigan State Housing Development Authority (MSHDA) has allocated $1.8 million to the City of Dearborn Heights. HUD requires that 25% of funds must be used for serving individuals/families 50% or below Area Median Income. Therefore, a minimum of $450,000 of NSP funds is available in the creation of housing opportunities for households whose incomes do not exceed 50 percent of area median income. The plan for distributing the total grant allocation is included in the City of Dearborn Heights NSP Action Plan submitted to MSHDA on January 30, 2009 by the City of Dearborn Heights. NSP is a federally funded project. The Contractor(s) and Subcontractor(s) on this project must comply with HUD contract provisions 24CFR part 85.36(i), the Davis-Bacon Act, Nondiscrimination, Equal Employment Opportunity, Affirmative Action, Section 3 Requirements, Anti-Kickback Act, Federal Occupational Safety and Health Act and Department of Labor Standards and Regulations as set forth in Contract Bid Documents. 3 The sealed bid envelope shall be endorsed on the outside with the CONTRACTOR S name and return address. If a bid is sent by mail or other delivery system, the mailing container or envelope shall be plainly marked on the outside with the notation: SEALED BID ENCLOSED-ASBESTOS ABATEMENT FOR RESIDENTIAL STRUCTURES NSP Colonial, Dearborn Heights, MI McDonald, Dearborn Heights, MI SCOPE OF WORK The City of Dearborn Heights is issuing this Request for Proposals to obtain asbestos abatement services in accordance with the specifications contained herein. The City reserves the right to reject any proposal that does not meet the requirements of this RFP. You are invited to submit a sealed bid for the abatement of asbestos for two structures with the Federal and Local guidelines. All abatement work shall be completed within 25 calendar days following execution of contract. Contractor is to provide all material, labor, and equipment necessary to complete the project. Hazardous materials testing has been completed and the findings are attached. Abatement and disposal of all hazardous materials will be completed by a licensed and certified professional in accordance with Federal and State law. In addition the Contractor is responsible for completing the following: All permits and inspections required to complete work Obtaining and providing the City of Dearborn Heights with a clearance report postabatement Bidder Qualifications Firm(s) selected to perform Asbestos Abatement Services shall have the required skills, knowledge and be able demonstrate knowledge and experience in the following areas: 1. Knowledge, experience, and the ability to interpret and apply the U.S. Department of Housing and Urban Development (HUD) related to NSP regulations. 2. Knowledge, experience, and skills involving abatement practices as required by applicable federal regulations and local codes. 3. Respondent must possess AND SUBMIT WITH THIS BID all valid certification and/or licenses as required by federal, state and local laws at the time of submittal and for the length of the project. Bidders must be licensed contractors in the State of MI. Each Bidder must be prepared to submit upon request such written evidence as may be requested to demonstrate the Bidders qualifications to perform the Work. Such evidence may include financial data, previous experience and references, present commitments, and proposed contractors and suppliers. By submitting a bid, the Bidder certifies that he has the City of Dearborn Heights, MI 2 June 22, 2010
4 proper license to do the work within and/or for the City of Dearborn Heights, including contractors and business license. Contractor will ensure that its employees observe and exercise all necessary caution and discretion so as to avoid injury to person or damage to property of any and all kinds. All neighboring buildings, equipment, and furnishings shall be protected by the bidder from damage, which might be done or caused by work performed under this contract. Such damages to the foregoing shall be repaired and/or replaced by approved methods so as to restore the damaged areas to their original condition at the expense of the bidder. The contractor shall erect, install, and maintain all temporary public walks, warning signs, barricades, and other protective means as may be necessary for the protection of the public from injury. SAFETY EQUIPMENT The bidder certifies that all items or service delivered herein comply with all ANSI Standards and with the Federal Occupational Safety and Health Act of 1970, as applicable. WASTE DISPOSAL CLEAN-UP Removal and off-site disposal of construction waste will be the responsibility of the bidder and shall be included in the bid price. Upon completion, the work area shall be left clean of debris and trash associated with the work. There shall be no additional charges to the City for removal and/or disposal of demolished materials. WORKMANSHIP, MATERIALS & EQUIPMENT Unless otherwise provided in the contract requirements and specification, the contractor shall furnish all labor, materials, and equipment for satisfactory contract performance. When not specifically identified in the specifications, such materials and equipment shall be of suitable type and grade for the purpose. BID BOND Bid Bond, Certified Check or Cashier s Check in the amount of at least five (5%) percent of the submitted proposal, drawn payable to the City of Dearborn Heights, as security for proper execution of the Contract. TERM OF PAYMENT Payment will be made within thirty (30) days after the City has received a clearance report from a certified testing company stating that the structures are free from asbestos hazards and the site has been satisfactorily inspected and accepted by the City of Dearborn Heights Building Department. 5 REFERENCES The City may require references from firms who have purchased similar services from the bidder. The City will notify bidders if references are necessary. REGULATORY AGENCY COMPLIANCE Compliance with laws and regulations set forth by regulatory agencies is required. These agencies include, but are not limited to, OSHA Occupational Safety & Health Agency, EPA Environmental Protection Agency, ICC Interstate Commerce Commission, DNR Department of Natural Resources, and DOT Department of Transportation. The City expects that bidders will offer expertise on conformance of regulations applying to the products they sell. CITY ORDINANCES The contractor shall comply with all ordinances, other laws and rules and regulations of the City. AWARD No bids will be considered which have not been received by the deadline set forth. The City is not responsible for delays occasioned by the U.S. Postal Service or any other means of delivery employed by the bidder. Bids will be evaluated promptly after opening and a bid tabulation summary will be provided upon request. Bid results will not be given over the telephone. No bid may be withdrawn for a period of thirty (30) calendar days after the bid opening date. Award of bid shall be made to the lowest responsible bidder meeting the specifications set forth herein. In addition to the quoted price, the following criteria may be used in the award: past experience, and service provided by Contractor, quality of work and other factors found in the Dearborn Heights City Code. 27 1.0 Introduction The City of Dearborn Heights contracted Environmental Testing and Consulting, Inc. (ETC) to perform a survey of the residential dwelling located at McDonald. This survey was conducted on March 16, The EPA under the National Emission Standards for Hazardous Air Pollutants (NESHAPs) asbestos rule requires that prior to the start of a renovation and/or demolition project, the building must be inspected for asbestos containing materials (ACM s). The purpose of this survey was to determine the presence of friable or potentially friable ACM s. Depending on the ACM and the condition that it is in, removal of the material may be necessary before work is to begin. Prior to the start of a demolition project, it is necessary that friable or potentially friable ACM s be removed. ETC's certified inspector, George Watkins, conducted the ACBM survey and identified materials suspected of containing asbestos. Mr. Watkins s State of Michigan Asbestos Building Inspector s certification number is A Wherever such materials were found, data was collected and recorded regarding quantities and observed conditions of the suspect material. As required by the Environmental Protection Agency (EPA), 3 samples of each type of material were taken in different locations to determine actual asbestos content. Sample results are included in Appendix A Included with this report (in Appendix B) is a copy of the State of Michigan Notification of Intent to Renovate/Demolish. This information will be necessary for the asbestos abatement contractor selected to perform asbestos abatement activities in the house. ETC has included its information on the second page. In addition to the ACBM survey, ETC was to visually inspect the house for miscellaneous hazard materials. These materials are part of a basic group of building materials used in the construction of the house. They include but are not limited to Mercury switches and thermostats, electrical components that can include PCB s (such as transformers, fluorescent light, etc) air conditioning and or refrigeration equipment or evidence of underground or above ground storage tanks. A list is included in the next section identifying material quantities and locations for easy access for the contractor to remove prior to demolition. 2.0 Summary and Conclusions Asbestos Containing Building Materials Survey Asbestos material that is positive has been bolded to make identification easier. Quantities that are listed are estimates only. It is the contractor s job to be responsible for their own numbers.
28 Below is a list of asbestos materials that were collected during this survey: Plaster (Homogenous Material # 01) There were three samples taken of this material and all tested negative for asbestos content and therefore will not affect the demolition of this building. 12 x 12 Gold Floor Tile(Homogenous Material # 02) There were three samples taken of this material and all tested negative for asbestos content and therefore will not affect the demolition of this building. Yellow Linoleum (Homogenous Material # 03) There were three samples taken of this material and all tested negative for asbestos content and therefore will not affect the demolition of this building. Exterior Sheeting (Homogenous Material # 04) There were three samples taken of this material and all tested negative for asbestos content and therefore will not affect the demolition of this building. Window Caulking (Homogenous Material # 05) There were three samples taken of this material. The material was analyzed and tested positive for asbestos content. The asbestos content of this material is 5%. Approximately 160 linear foot of this material was located on the exterior of the building. This material must be removed prior to the demotion of this building by a licensed asbestos abatement contractor trained in the handling and disposal of asbestos containing materials. Window Glazing (Homogenous Material # 06) There were three samples taken of this material and all tested negative for asbestos content and therefore will not affect the demolition of this building. Duct Insulation (Homogenous Material # 07) There were three samples taken of this material. The material was analyzed and tested positive for asbestos content. The asbestos content of this material is 70%. Approximately 75 linear foot of this material was located in the basement of the building. This material must be removed prior to the demotion of this building by a licensed asbestos abatement contractor trained in the handling and disposal of asbestos containing materials.
29 Cold Air Return Insulation (Homogenous Material # 08) There were three samples taken of this material. The material was analyzed and tested positive for asbestos content. The asbestos content of this material is 50%. Approximately 260 square foot of this material was located in the basement of the building. This material must be removed prior to the demotion of this building by a licensed asbestos abatement contractor trained in the handling and disposal of asbestos containing materials. Duct Sealant (Homogenous Material # 09) There were three samples taken of this material. The material was analyzed and tested positive for asbestos content. The asbestos content of this material is 60%. Approximately 12 square foot of this material was located in the basement of the building. This material must be removed prior to the demotion of this building by a licensed asbestos abatement contractor trained in the handling and disposal of asbestos containing materials. Window Glazing (Homogenous Material # 10) There were three samples taken of this material and all tested negative for asbestos content and therefore will not affect the demolition of this building. Fire Brick (Homogenous Material # 11) There were three samples taken of this material and all tested negative for asbestos content and therefore will not affect the demolition of this building.
