In the Senate, Senator Magalei Logovi i pointed out it raises a question about people s rights, and if they have been violated given that ASG employees should be able to chose between paper checks and direct deposit the government cannot make demands. The senator noted he has received numerous calls from his constituents about the issue. In the House, Representative Va amua Henry Sesepasara stated his constituents have complained to him about this move, and noted, The question that arises does the Treasurer have the authority to enforce government employees to get bank accounts for the direct deposits of their paychecks? The Pago Pago faipule said some people do not have much on their paycheck after deductions, so they would rather get their paychecks themselves than to have them directed to the bank. Va amua stated there are lot of changes the current Treasurer is implementing yet the affect takes a toll on the people who suffer from this. He said the Treasurer should be questioned. Alailima- Utu has submitted an advance notice under his Employment Contract to terminate his employment with DBAS if the bank is unwilling to convert his employment to career service at the earliest opportunity for reasons he cites as compelling in a letter sent to DBAS Chairman Nuanuaolefeagaiga Saoluaga Nua, DBAS board members and Acting DBAS President Ruth Matagi Fa atili. The letter, which is dated January 30, 2014, was leaked to Samoa News. According to the DBAS attorney the termination of his employment would be effective on Mar. 14, 2014, but also notes at the end of his letter, If the Board decides to convert me to career service, I will be more than glad to continue serving DBAS Board and DBAS and especially our people and to continue to work hard to attain the goals DBAS and our Legal/1602 compliance monitoring team have set for Fainu ulelei s letter to the board explains the compelling reasons for his request for career service employment status. COMPELLING REASONS The DBAS Legal Counsel in his letter states that in 2012, the Board asked him to convert from career service to contract employment like other DBAS officers, i.e President, Vice President and DBAS CFO. Even though I was not required to agree to such Board request because the DBAS Personnel Manual did not require all DBAS officers to be contract employees, out of respect for the Board s wishes I agreed with the board s request. Fainu ulelei then points out that while the DBAS board reviewed and approved his employment contract with benefits and provisions similar to other DBAS officers employment contracts, he was recently informed the 5% annual increment he s entitled to since December 28, 2013 was not paid. He says this is because the new Acting President informed him that DBAS Chairman Nua wanted to discuss his contract before the Board (Continued on page 14) C Y M K OIA calls Buy American Tuna policy in new law a potential disaster by Fili Sagapolutele, Samoa News Correspondent The U.S. Department of Interior s Office of Insular Affairs is aware of the Buy American provision, which deals with the U.S. Department of Agriculture s canned tuna product for the school lunch program and says DOI is concerned about changes that would impact the tuna canning industry in the territory. Some people enjoy novelty when dining out, but restaurateurs take a big risk when adding new items to a menu; it seems that less than a third of diners will actually try a new menu item. Two-thirds of all Tony award-winning composers and lyricists have been Jewish. Everyone knows you should not drive while under the influence of alcohol, but riding a bike? A stationary bike? It seems that in Tennessee in 2007, a woman was arrested at her gym while riding an exercise bicycle while drunk. BUI, or simply disorderly conduct? The record isn t clear. If insects give you the creepy-crawlies, you might not want to read the following tidbit: Researchers have discovered a kind of caterpillar that emits a sound eerily like a human scream. This particular species is often a victim of predatory wasps. When the wasps approach, the caterpillar rubs two special organs together to produce the sound. The scream calls a troop of ants that protect the caterpillar, and in return the caterpillar secretes an amino acid that the ants need. The name of the state of Vermont comes from the French mont vert, which means green mountain. (If the explorers who named the state saw green mountains, they obviously were not there in the winter.) Thought for the Day I don t trust a man who uses the word evil 18 times in 10 minutes. If you re half evil, nothing soothes you more than to think the person you are opposed to is totally evil. Norman Mailer NEWS BRIEFS 2 shot in Ga. store busy with storm customers LAWRENCEVILLE, Ga. (AP) Two women were shot Monday inside a suburban Atlanta supermarket that was busy with customers trying to stock up before a winter storm that s widely predicted to hit the area, police said. Lawrenceville police spokesman Greg Vaughn told local news outlets the shooting happened at a Kroger and that two people of interest were taken into custody. Vaughn said the shooting came after some sort of fight or argument but didn t have details. The scene is a little chaotic, Vaughn told the Atlanta Journal-Constitution. You can probably imagine with everybody stocking up on bread and milk, he said. Several shoppers said they hid in freezers while police cleared the store. Vaughn said the women were hospitalized with non-life threatening injuries. Kroger officials said in a statement that no store employees were injured in the noon shooting, and the store was evacuated and will reopen at a later date. On Monday, officials were quick to act as the winter weather zeroed in, determined not be the butt of jokes like the Saturday Night Live parody that referred to the devil s dandruff and Yankee s slush. Before a single drop of freezing rain or snow fell, Georgia Gov. Nathan Deal had declared a state of emergency for nearly a third of the state, schools canceled classes and workers were told to stay home. The area is expected to see a combination of ice and snow this week. Student shot, wounded at NC high school SALISBURY, N.C. (AP) Police in North Carolina say they will seek warrants against two people after a high school student was shot and wounded. The Salisbury Post reports police identified the victim as 16-year-old Salisbury High School freshman Shaleek Williams. He was shot around 3 p.m. Monday, after classes dismissed. Rowan County Emergency Services Director Frank Thomason says the victim was taken to a hospital in a private car. It was expected that he would be released from the hospital Monday night. Investigators say the shooting happened during a fight between two groups, including some Salisbury High students. Williams was punched in the face and then shot in the stomach. Chief Rory Collins said two suspects ran from the scene. Salisbury is about 40 miles northeast of Charlotte. Girl, 10, crashes SUV into colo. DMV office DENVER (AP) A 10-year-old girl has been cited for reckless driving after her mother s SUV crashed into a Division of Motor Vehicles office in the Denver suburb of Parker. Police Sgt. Andy Coleman says a woman parked outside the office Monday and left her 12- and 10-year-old daughters in the vehicle. That s when the younger girl apparently started the car and put the vehicle in gear. Coleman says the SUV rolled slowly through the office s front window until the mother jumped in to stop it from causing more damage. No one was injured. Anyone 10 or older can be charged with a crime in Colorado, so police gave the girl a ticket for reckless driving. The mother wasn t ticketed because she says she didn t leave the car running. New name, same as old name, still means state of security WASHINGTON (AP) The White House s National Security Council staff has regained its team name. President Barack Obama signed an executive order Monday restoring the designation the NSC staff had operated under since the NSC s creation in The NSC advises and assists the president on national security and foreign policy matters. Obama changed the name nearly five years ago when he combined the functions of the NSC and the Homeland Security Council into one entity, calling it simply the National Security Staff. That name had not been popular with national security staffers, however. The change back to the original Truman-era name was seen as a morale booster. The NSC staff operates under the leadership of National Security Adviser Susan Rice. two California chefs plead guilty to serving whale meat LOS ANGELES (AP) Two chefs have pleaded guilty to serving whale meat at a Southern California restaurant that has since closed. City News Service reports Kiyoshiro Yamamoto and Susumu Ueda entered pleas Monday to conspiracy and other charges involving meat from endangered sei (say) whales. Each faces up to three years in federal prison, along with fines and community service. Prosecutors say the chefs got the meat in 2009 from a fish importer in Gardena who wrote a false invoice describing it as fatty tuna. The chefs served it as whale sushi to activists posing as customers at The Hump restaurant in Santa Monica. The restaurant closed in 2010, but its parent company, Typhoon Restaurant Inc., still faces federal charges. The importer pleaded guilty to a misdemeanor charge earlier. (Continued on page 5)

3 samoa news, Tuesday, February 11, 2014 Page 3 by Joyetter Feagaimaali i-luamanu Samoa News Reporter FATU VAGANA ADMITS TO SMUGGLING DRUGS FROM APIA Fatu Vagana, who was charged along with a Lady Naomi crew member with smuggling marijuana into the territory last year has admitted to bringing marijuana in to the territory, with intent to sell. Vagana and his co-defendant Kerisimasi were each charged with unlawful possession of marijuana, and unlawful possession with intent to distribute. Last month, Kerisimasi pleaded guilty to the unlawful possession of controlled substance while the more serious charge of intent to distribute was dismissed. Last week, Vagana pled guilty to the unlawful possession of marijuana with intent to distribute charge, and in return for his plea the government moved to dismiss the lesser charge. The intent to distribute count is a felony punishable by up to 20 years in jail, a fine of up to $20,000 or both. According to the plea agreement, Vagana admitted he had 471 marijuana joints, which he received from the Lady Naomi Crew member from Samoa. The defendant also admitted he met with the Lady Naomi Crew member to arrange the delivery of the marijuana joints from Samoa. According to the government s case, Vice and Narcotics were informed of alleged illegal activities going on at Vagana s residence in Aoloau. The informant said Vagana would come to work with loose marijuana and hand rolled marijuana joints and during breaks Vagana allegedly sold the marijuana to people at his work place. A search warrant was executed on Vagana and police began surveillance on him when the Lady Naomi arrived in Port. It s alleged Vagana picked up Kerisimasi at the wharf when all the passengers were through with clearance from Immigration and Customs. Police found in the vehicle three bundles which tested positive as marijuana. According to the government s case, when police questioned Kerisimasi he said he came from Apia with the package to be delivered to someone in American Samoa who would be calling him. Chief Justice Michael Kruse accepted the plea agreement and scheduled sentencing for the pair on March 21, BAKER SENTENCED TO TIME SERVED OF THREE DAYS The baker who failed to deliver a wedding cake she was paid to bake, which led to her arrest and criminal charges, was sentenced to time served of three days and fined $500. The baker, Sianini Foster of Pago Pago was charged with stealing, a class C; however, in a plea agreement with the government, she pled guilty to misdemeanor stealing, amended from the felony count. According to the government s case, on Dec. 15, 2012 a woman filed a complaint with the police, where she told police she had paid Foster $920 to make a wedding cake, but on the wedding day the family was told there was no cake and the defendant could not be reached. The defendant during sentencing apologized for her actions noting she s remorseful over what occurred and noted it will not happen again. PLEA DEAL OFFERED IN SEX ABUSE CASE INVOLVING YOUNG BOY A man arrested on Christmas day and charged with sexual abuse after allegations were lodged that he touched a young man inappropriately, was before the court yesterday for his change of plea hearing. Sivai Te o is charged with sexual abuse and endangering the welfare of a child. The change of plea was scheduled for yesterday, however the court was informed the defendant s lawyer was in the hospital. According to the government s case, the incident came to light when a woman contacted police that the defendant had touched her son in a sexual manner. Court filings say police spoke to the 15-year old boy (who is the complaining witness in the case) and he stated that he heard a knock at the front door and when he opened it, it was the defendant who had come asking for his mom, however it is alleged the defendant touched the boy inappropriately, and made lewd gestures and remarks to the boy. Court filings say Te o told police he was drunk when he went to the victim s house. The defendant will be in court later this week for his change of plea hearing. 4 Page 4 samoa news, Tuesday, February 11, shows effort to shield Osama bin Laden photos WASHINGTON (AP) A newly-released shows that 11 days after the killing of terror leader Osama bin Laden in 2011, the U.S. military s top special operations officer ordered subordinates to destroy any photographs of the al-qaida founder s corpse or turn them over to the CIA. The was obtained under a freedom of information request by the conservative legal group Judicial Watch. The document, released Monday by the group, shows that Adm. William McRaven, who heads the U.S. Special Operations Command, told military officers on May 13, 2011 that photos of bin Laden s remains should have been sent to the CIA or already destroyed. Bin Laden was killed by a special operations team in Pakistan on May 2, McRaven s order to purge the bin Laden material came 10 days after The Associated Press asked for the photos and other documents under the U.S. Freedom of Information Act. Typically, when a freedom of information request is filed to a government agency under the Federal Records Act, the agency is obliged to preserve the material sought even if the agency later denies the request. On May 3, 2011, the AP asked Special Operations Command s Freedom of Information/Privacy Act Division office for copies of all s sent from and to the U.S. government account or accounts of McRaven referencing bin Laden. McRaven was then vice admiral. A May 4, 2011 response from the command s FOIA office to the AP acknowledged the bin Laden document request and said it had been assigned for processing. AP did not receive a copy of the McRaven obtained by Judicial Watch. The Department of Defense FOIA office told the AP in a Feb. 29, 2012 letter that it could find no McRaven s responsive to your request for communications about the bin Laden material. The Special Operations Command is required to comply with rules established by the chairman of the Joint Chiefs of Staff that dictate how long records must be retained. Its July 2012 manual requires that records about military operations and planning are to be considered permanent and after 25 years, following a declassification review, transferred to the National Archives. Last July, a draft report by the Pentagon s inspector general first disclosed McRaven s secret order, but the reference was not contained in the inspector general s final report. The that surfaced Monday was the first evidence showing the actual order. In a heavily blacked-out addressed to gentlemen, McRaven told his unnamed subordinates: One particular item that I want to emphasize is photos; particularly UBLs remains. At this point - all photos should have been turned over to the CIA; if you still have them destroy them immediately or get them a blacked-out location. UBL refers to bin Laden. At the time the inspector general s report came out, a spokesman for the Special Operations Command referred questions back to the inspector general. A CIA spokesman said at the time that documents related to the raid were handled in a manner consistent with the fact that the operation was conducted under the direction of the CIA director, then Leon Panetta. The CIA statement also said records of a CIA operation such as the raid, which were created during the conduct of the operation by persons acting under the authority of the CIA director, are CIA records. In a Jan. 31, 2014 letter to Judicial Watch in response to its request for all records relating to McRaven s directive to purge, the Pentagon s office of general counsel said it had been able to locate only document Raven s redacted . Judicial Watch president Tom Fitton said Monday that the is a smoking gun, revealing both contempt for the rule of law and the American people s right to know. 5 NEWS IN BRIEF Continued from page 2 Puerto Rico teacher arrested on enticement charges SAN JUAN, Puerto Rico (AP) A gym teacher in Puerto Rico faces federal charges for allegedly using social media to entice a 15-year-old girl into unlawful sexual conduct. The U.S. Immigration and Customs Enforcement agency on Monday identified the man as 27-year-old Melvin Rivera Gonzalez. He works at an elementary school in the northern town of Toa Baja. The agency is handling the case under an initiative to track down sex predators. U.S. agents say they began investigating Rivera after school officials reported he was using the popular Kik application for messaging and sharing video on smartphones to sexually entice a student. Agents allege he later engaged in sexually explicit conversations with an undercover agent posing as a minor. A judge ordered Rivera held. It wasn t clear if he has a lawyer. Man who threatened Prince Harry s life is sentenced LONDON (AP) A man who threatened the life of Prince Harry has been sentenced to three years in prison. A judge said Monday that 31-year-old Ashraf Islam presented a risk to the public. He had pleaded guilty last year to threatening the prince. Islam was arrested after walking into a police station and making threats a day after a British soldier was killed on a London street on May 22. He was investigated by counter-terrorist police but was not charged with any terrorist offenses. Judge Richard McGregor-Johnson says investigators found that Islam had been tracking Harry s whereabouts and travel plans. The judge says Islam had given considerable thought to his plot against the prince. Harry was third in line for the British throne at the time of the threat. Spain court signs Chinese leaders arrest warrants MADRID (AP) A Spanish court has issued international arrest warrants for several former Chinese leaders, including retired President Jiang Zemin, as part of an investigation into alleged genocide in Tibet. Judge Ismael Moreno signed the warrants Monday. They were ordered by the court in 2013, but delayed by legal technicalities. The Spanish National Court is acting on the principal of universal justice in a case brought by Spanish pro-tibetan groups. The warrants mean the Chinese leaders face possible arrest if they travel abroad. The case has angered the Chinese and Spanish governments. The latter is expected to propose a reform that would restrict the court s powers to handle such investigations. International human rights and pro-tibetan groups have accused China of using oppressive policies in Tibetan regions, especially against protests of Beijing s rule. Michigan college offers literature course in zombies, the apocalypse MOUNT PLEASANT, Mich. (AP) Some Central Michigan University students are getting schooled in the undead this semester, thanks to a religion course that s exploring apocalyptic themes in biblical texts, literature and pop culture. Philosophy and religion faculty member Kelly Murphy says she always wanted to teach a course on apocalyptic literature, and she is a fan of AMC s TV show The Walking Dead. The result is Murphy s class, which is called From Revelation to The Walking Dead. Murphy s class will discuss biblical texts, review popular novels and watch clips from movies such as Shaun of the Dead and 28 Days Later. Students also will discuss hypothetical ethical and theological problems that people could encounter in a post-apocalyptic world. The prevalence of apocalyptic stories in various media gives us a window into what people are worrying about, what they hope for and how they imagine they would react in the face of a cataclysmic event, Murphy said. In the same way, we can read the Book of Revelation... and learn what ancient Jewish and Christian groups were concerned about. Marshall Islands President Christopher Loeak bid Jose Salvador Alvarenga farewell at the airport. Thank you for the support, the support by your people, Alvarenga told him in Spanish in a soft voice. Alvarenga, clean-shaven and walking without assistance, said he was doing very well. He told officials during his two-week recuperation at a hospital and a hotel in the capital, Majuro, that he left Mexico in late 2012 with another fisherman, who later died, when a storm threw them off course and he drifted across 6,500 miles (10,500 kilometers) of open ocean. He said he survived on fish, birds and turtles. About 50 officials, volunteers and reporters gathered at the airport to see him off. He was flying first to Hawaii and then on to El Salvador be reunited with his family. Alvarenga, accompanied by Diego Dalton, an official from El Salvador s embassy in Tokyo, said that people of the Marshall Islands were very good to him, and called them my very good friends. Alvarenga s spritely appearance a week ago while greeting hundreds of well-wishers in Majuro had many questioning his story. But he looked much weaker Thursday during a brief public appearance at the hotel, and had to be assisted into the room by two people while others stood by ready to help. His family in El Salvador has spoken to him by phone since the story broke out. Alvarenga s 14-year-old daughter, Fatima, said last week that she didn t remember ever seeing her father, who left El Salvador when she was just over a year old. DIAMOND BAR, Calif. Witnesses said Culbreath s car may have been traveling at up to 100 mph eastbound in the westbound lanes of State Route 60 when it collided head-on with a Ford Explorer, hurling wreckage and bodies onto the freeway. The Explorer was then hit by a Ford Freestyle. Culbreath, the mother of a newborn, suffered a broken femur and ruptured bladder. Her older sister was among those killed. Authorities said they found an alcoholic beverage at the scene of the crash, which happened in Diamond Bar, a bedroom community 35 miles east of downtown Los Angeles. Two people in the Explorer Gregorio Mejia-Martinez, 47, and Ester Delgado died at the scene, county coroner s Lt. Fred Corral said. Two other family members in the vehicle Leticia Ibarra, 42, and Jessica Jasmine Mejia, 20 were declared dead at a hospital. All four were from Huntington Park. Delgado s age was not available. Culbreath s sister, Maya Louise Culbreath, 24, of Rialto, and another Camaro passenger, Kristin Melissa Young, 24, of Chino, died at the scene, Corral said. The Ford Freestyle s driver, Joel Cortez, 57, of La Puente, was treated for minor injuries. Culbreath s family was still trying to cope with the tragedy, her grandmother, Carole Phillips, told The Associated Press on Monday evening. They won t let us see her, Phillips said by telephone. We re just devastated because of the loss of the others, too. It s just too much. Wendell Johnson of Rancho Cucamonga, a friend, told the San Gabriel Valley Tribune that the group in the Camaro had been on a girls night out in Fullerton. Neighbors in Fontana told the paper that Culbreath had given birth to a son in late January. Culbreath had a 2010 conviction for driving under the influence of alcohol stemming from a 2009 incident when she was 17. Her license was pulled, but it was reinstated in 2011, according to DMV records. However, Octavio Castellanos, a neighbor of Culbreath, told the Tribune he rarely saw her drinking before she became pregnant and added that she didn t drink at all during the pregnancy. You wouldn t think she would do something like that, said his brother, Andretti Castellanos. She was the type of girl that never got into trouble. Study finds Media everywhere, bathroom included LOS ANGELES (AP) TV viewers increasingly are watching programs on their own schedule, according to a Nielsen company media study released Monday. In the past year, time-shifting of television content grew by almost two hours, averaging 13 hours per month, the study found. Viewers averaged nearly 134 hours of live TV viewing a month in 2013, down nearly three hours from Television still remains central to media consumption, the study found, despite the increase in time-shifted viewing and streaming video through a computer or smartphone. On average, American consumers own four digital devices, the report found. The majority of U.S. households own high-definition TV sets, Internet-connected computers and smartphones, while nearly half also own digital video recorders and gaming consoles. The average consumer spends about 60 hours a week viewing content across various platforms, Nielsen found. Multitasking is common; 84 percent of smartphone and tablet owners say they use their devices as second screens while watching TV. It s an incredibly exciting evolution in the ways people are using devices to get media, said Megan Clarken, Nielsen executive vice president. While sports events generated the most Twitter postings last year, more than 400 million, TV series also had impressive numbers. The top three: Breaking Bad with 6 million tweets, The Walking Dead with 4.9 million and American Horror Story: Coven with 2.9 million. An offbeat survey finding: 40 percent of adults between the ages of 18 and 24 use social media in the bathroom.

[photo: BC] 35 local young men and women commit to become Army Strong 3250 Airport Road Pago Pago AS DAILY RATES WEEKLY RATES MONTHLY RATES by B. Chen, Samoa News Correspondent A total of 35 local young men and women (19 females and 16 males) took the Oath of Enlistment last Friday to become members of the United States Army. Of that number, 28 have committed to going on active duty while the remaining seven will join the Army Reserve. Eleven of the new recruits are high school seniors five from Faga itua, two from Tafuna and four from Samoana. There was also a brother/sister team, Jayne and Jarred Tuvale. Jayne is a 2013 graduate of Marist Fa asao High School and her brother Jarred is currently a senior at Faga itua. The two are the children of Patrick and Lolenese Vaina Tuvale of Laulii. The swearing-in ceremony was held at the SFC Konelio Pele Army Reserve Center in Tafuna, in the presence of family, friends, and supporters of the future soldiers. US Navy Officer, Lieutenant Commander (LCD) Ubina, Commander of the Honolulu MEPS (Military Entrance Processing Station) administered the Oath of Enlistment. Other off island dignitaries who were in attendance included First Sergeant (1SG) Borne (Honolulu MEPS First Sergeant), Master Sergeant (MSG) Delancey and Sergeant First Class (SFC) Bracero, Guidance Counselors for the US Army. All of the enlistees are on the Delayed Entry Program (DEP), meaning they will not depart for basic training right away but they are still required to fulfill certain responsibilities and duties prior to leaving for boot camp things like passing the physical fitness assessment, maintaining the right weight, upholding moral qualifications, refraining from any violations of the law, and participating in training programs which are held once a week, in addition to physical training (PT) twice a week. The DEP allows recruits to sign up, but delays their actual entry date for up to 365 days (one year). The first soldier from the group is set to fly out in two weeks. The new recruits will be dispersed and attending one of four boot camps held at Ft. Benning, Georgia; Fort Sill, Oklahoma; Fort Jackson, South Carolina, or Ft. Leonard Wood, Missouri. After the Oath of Enlistment was administered last week, parents and guardians had to sit through a Future Soldiers Orientation session, which provided an overview of what to expect during basic training and what is expected from the recruits from now until they fly out for boot camp. Local recruiter SSG Lauie Laban-Ilalio said the orientation gave parents and attendees the chance to ask questions and discuss the status of their sons and daughters. The new recruits will be working in different MOS (Military Occupational Specialties) including Information Technology, Paralegal, Aircraft Pneudralics Repair, Radar Repair Specialist, Automated Logistics Specialist, and Mortuary Affairs Specialist. The next test dates for the Armed Services Vocational Aptitude Battery (ASVAB), which is the initial step of recruitment into any branch of the US military, will be Feb. 19, and March 5, 12, and 19. Those who attain ASVAB scores of 31 or higher (total score for the ASVAB is 99) may be eligible to fly to Hawai i to carry out the physical enlistment process at the Honolulu MEPS. The next physical enlistment process for the US Army in the territory is set for the first week of May. Pre-screening for the ASVAB takes place every day at the Army Recruiting Station on the second floor of the Laufou Shopping Center from 9 a.m. - 5 p.m. Monday - Thursday, and 9 a.m. - 3 p.m. on Friday. Garcia said he expects to reform the tax system within a year and evaluate whether a current 7 percent sales-and-use tax is effective. He also plans to reduce government spending by at least $800 million, crack down on tax evaders and reduce government agencies budgets by 2 percent, except for the education department. Garcia also said he would present a balanced budget for the upcoming fiscal year and has submitted legislation to cut an additional $170 million from the current budget. He pledged that layoffs would not occur. This is not going to be easy, but we have to do what s right, he said. There are no magic wands for this task. Jaime Perello, president of the island s House of Representatives, said legislators are already working on some of the measures and noted that government agencies are ineffective at tax collection. Puerto Rico has a 56 percent capture rate and loses some $800 million in revenue annually as a result, economist Gustavo Velez said. He said the government should aim to increase its rate to 75 percent to collect an additional $391 million a year. He also said the government should slash its payroll, which is its greatest expenditure, and reduce its $820 million deficit by at least $500 million. Rep. Ricardo Llerandi Cruz of the opposition New Progressive Party said he worried that tax reform would harm the island s working poor and warned that the island might not see any public work projects completed in the near future. LUCKNOW, India (AP) A tiger prowling near villages in northern India killed its 10th person in six weeks, a day after eluding a trap set by hunters with a live calf as bait. The female tiger is believed to have strayed from Jim Corbett National Park, India s oldest national park, which was established in 1936 to provide endangered Bengal tigers with safe territory. The big cat s latest victim was a 50-year-old man who was collecting firewood Sunday night in the forest outside Kalgarh village in Uttarakhand state, according to Saket Badola, deputy director of the national park. The animal ate parts of the man s leg and abdomen before being scared away by villagers waving shovels and metal rods. Hunters had almost nabbed the tiger a day earlier with a bovine calf. On Saturday night the tigress almost fell in trap and was close to the calf, Badola said. But she did not attack the bait and left silently. Reports that a killer tiger was on the loose began circulating Dec. 29, when a 65-year-old man was mauled in Sambhal district of Uttar Pradesh state, across the border from Uttarakhand. Since then, thousands of terrified villagers have been told to watch out for the animal and to avoid the forests. The tiger has been on the prowl across an area spanning some 80 miles (130 kilometers). The animal has started attacking humans because it is not getting its natural prey, said Rupek De, chief wildlife warden of Uttar Pradesh. The tigress must be tired because it is not getting adequate rest. He said the hunters hired to kill the animal were having trouble tracking it in dense forests. The team also was understaffed; only three of the six hunters hired for the job showed up for work, De said. De said he asked wildlife officials in Uttarakhand for help, saying there seems to be lack of co-ordination. On Sunday, angry villagers seized a national forestry office, demanding protection and compensation for the families of the dead. We can understand the predicament of the villagers, Badola said. The villagers do not have toilets in their homes. They go out in the open or forest areas to answer nature s call. In this scenario it is difficult to give protection to each and every villager. We have advised them to move in groups. India s wild tigers are considered endangered because of rampant poaching and shrinking habitat as India undergoes breakneck development to accommodate the staggering growth of its 1.2 billion people. India today has more than half of the 3,200 tigers estimated to be left in the wild. Despite dozens of tiger reserves across the country, however, the numbers have sunk from an estimated 5,000-7,000 in the 1990s, when the big cats habitat was twice as large. 13 NEWS IN BRIEF Continued from page 5 4 Latin America powers sign trade pact CARTAGENA, Colombia (AP) The presidents of four nations collectively responsible for half of Latin America s economic output have signed an accord to eliminate tariffs on 92 percent of the products they trade. The presidents of Colombia, Chile, Mexico and Peru signed the accord in Cartagena, Colombia, on Monday. Together they form the nearly two-year-old Pacific Alliance. The accord is expected to take effect next year after approval by institutions within the member nations. Tariffs on agricultural goods such corn and beef will be gradually reduced. The four partners count 212 million inhabitants among them and their economies are worth a combined $2 trillion a year. Heavy security in Guyana after unusual US warning GEORGETOWN, Guyana (AP) International flights departed from Guyana under heavier than normal security Monday following an unusual threat alert from the U.S. government. Police and soldiers joined regular airport security at the main international airport in the South American country to conduct security screenings of all travelers, Transport Minister Robeson Benn said. We have really heightened the level of security in the face of the threat, Benn said in an interview. Three Caribbean Airlines flights departed for New York without incident. The transportation minister told parliament that there were 13 fewer passengers than on a typical day because of the warning. The U.S. Embassy said on its website Sunday that it had received unconfirmed threat information relating to Caribbean Airlines flights bound for the U.S. It advised U.S. citizens in Guyana with plans to return home that they should make alternate travel arrangements through Wednesday. U.S. officials provided no details on the threat. Missing college student froze to death GRANVILLE, Ohio (AP) An official at a central Ohio college says a student who was the subject of intensive search over the weekend apparently died of hypothermia after falling asleep outside. Denison University student David Hallman III was last seen leaving a downtown Granville restaurant early Saturday. The 21-year-old Erie, Pa., native was found Saturday night outside a garage in a condo complex about a half mile away. The Columbus Dispatch reports that Laurel Kennedy, vice president for student development, wrote in a memo to the university community it appears he had fallen asleep and then succumbed to hypothermia. Police said alcohol may be a factor. Hallman was a history major who was well-known on the campus of about 2,100 students. He was a former member of the swimming team. Search halted at village hit by mudslide CHULLPA KHASA, Bolivia (AP) Persistent heavy rains have forced Bolivians to suspend the search for victims in a mudslide that buried half of a village in the central part of the country. Fears that more loose earth and rock could further overwhelm the hillside Quechua-speaking village of Chullpa Khasa in Cochabamba state halted the rescue effort Monday. Families buried three victims of the Saturday night slide, but 11 others are still missing, most of them children. The slide also swallowed up crops and sheep. Large swaths of Bolivia have been soaked by heavy downpours that have sent rivers over the banks in the country s Amazon. Authorities say more than 47,000 families have been affected and 42 deaths since the rainy season began at the end of November. florida senator marco Rubio dodges question on his past use of marijuana MIAMI (AP) Sen. Marco Rubio is declining to say whether he ever smoked marijuana. The Florida Republican and potential presidential candidate dodged a direct question at an education forum Monday, saying his own drug experience is irrelevant. In his words: If I tell you that I haven t, you won t believe me. And if I tell you that I did, then kids will look up to me and say, Well, I can smoke marijuana because look how he made it. Rubio opposes legalizing the recreational use of marijuana. He said like most teenagers he made dumb decisions when he was younger, and he said he didn t need the help of marijuana or alcohol to further that. Florida voters will decide a ballot initiative in November on legalizing medical marijuana. CA. man pleads no contest to sex crimes SALINAS, Calif. (AP) A California man has pleaded no contest to two counts of felony lewd and lascivious acts against Monterey Peninsula Unified School District students. Monterey County Chief Assistant District Attorney Terry Spitz says 31-year-old Carlos Domingo Rodriguez III, who was a school bus driver at the time, was arrested in October. The Salinas Californian reports that on Monday, the day he was scheduled to go to trial, Rodriguez entered a plea of no contest to two counts of lewd and lascivious acts against two 12- and 13-year-old girls, and threats to commit further acts against one of them. Rodriguez will be sentenced in March. The agreedupon sentence is a suspended 4-year prison term. Rodriguez will also be required to register as a sex offender, Spitz said. The Environment Agency has issued 14 severe flood warnings meaning there s a danger to life along the Thames east of Windsor, about 20 miles (32 kilometers) from London. There were no flood alerts for the part of the river that flows through London. 14 Page 14 samoa news, Tuesday, February 11, 2014 DBAS legal counsel Continued from page 1 in light of the Board s policy in mid-2103 to suspend annual increments for DBAS employees unless approved by the DBAS board. The DBAS legal counsel said he did not think the reason was related to my job performance because former Acting President Jason Betham gave me high marks for my job performance in my written employment evaluation for the period 12/28/12 until 12/ 28/13. It appears that my employment contract benefits are being targeted even though they were reviewed in two board meetings and unanimously approved by the board according to the minutes of those board meetings, Fainu ulelei says. He said, If the objective of the Board review of my contract is to cut DBAS personnel costs, I volunteer even if I am not legally obligated to do so to have the contract employment converted back to career service at my present annual salary, with health insurance coverage and other regular benefits for a career service employee. The Legal Counsel for DBAS then points out, conversion of my employment back to career service is also justified because I am concerned about retaliation against my contract employment because as part of my duties, I signed and sent notices since late 2013 to many 1602 projects owners which include the DBAS Board Chairman and DBAS Facilities Manager and other government and community leaders, asking them to finish construction of their 1602 projects and correct their non-compliance or DBAS will file recapture suits against them. (See article in Monday s edition on the litigation claims filed in HIgh Court.) Fainu ulelei states, as the DBAS official authorized by the DBAS board to oversee DBAS cooperation with the Federal criminal investigation of the 1602 program, I am concerned that persons of authority will retaliate against my contract employment if they themselves or persons they are close to, become targets of the 1602 federal criminal investigation since I have been encouraging DBAS management and employees to fully cooperate with the federal 1602 criminal investigation. If the Board chooses NOT to convert me to career service employment, I will respect the Buy American Tuna Continued from page 1 dated Appropriations Act of In the past several days, Samoa News has received public inquiries asking if DOI/OIA was aware of this provision as the issue was going through Congress last year and when it had been included in the Consolidated Act, which was signed into law last month. One person alleged that DOI was not aware of this provision at all. Responding to Samoa News questions, OIA executive director Pula says an official letter dated Feb. 4, 2014, from Congressman Faleomavaega to Interior Secretary Sally Jewell regarding the USDA s Buy America domestic tuna requirements issue was received by the ASG direct deposit Continued from page 1 Speaker of the House Savali Talavou Ale also concurred with Va amua, saying people in his District have also contacted him on this issue and the Treasurer should not force people to have bank accounts if they don t want to. He also said that Treasurer Falema o should come before the House to explain the reasons behind this move. Falema o will be in the House today, however it was made clear to Representatives that the Treasurer is present today on the issue of overtime. In the meantime the Senate has called a hearing on this matter on Wednesday, Feb. 12, following the regular session at 10:30a.m. BACKGROUND Late last month Treasurer Dr. Falema o Phil Pili told Samoa News the Treasury Department is phasing out paper paychecks for employees of ASG in the executive, legislative and judicial branches and they will be replaced with Board s decision, he states and notes he has worked for DBAS, as In-House Legal Counsel for over 11 years since Jan. 27, My ties with DBAS through my father are even longer since my father was Speaker of the House of Representatives when he helped to formulate and the sign the original legislation in 1969 and legislative amendments that established and strengthened by law the Development Bank of American Samoa and the DBAS Board of Directors. Fainu ulelei said in particular he wished to note my gratitude for the hard work of my Legal/1602 compliance monitoring team, the DBAS management and staff in serving our people and fulfilling the DBAS mission and he hopes he has made a positive difference in his work as the legal counsel for DBAS. In conclusion, Fainu ulelei stated if the board chooses not to convert his contract to career service he will respect the board s decision and asked that he work until March 18, 2014 to file legal collection suits and 1602 recapture suits to protect DBAS from liability to the US Treasury, oversee submission of owner s annual reports to Spectrum to be forwarded to HUD and to provide certain information already requested by the U.S. Department of Justice for the federal criminal 1602 investigation which will require my travel to Washington DC. He writes, I respectfully request that DBAS pay all the benefits and severance pay that I am entitled to under section VI of my employment contract as is the case with the termination of employment of other DBAS officers in the past. The DBAS in-house attorney also asked the bank to deduct the costs of the laptop assigned to him from his severance pay since I will need important records stored in the laptop for the federal government s 1602 criminal investigation. and writes, I understand that the former DBAS president took his DBAS computer with him when he left DBAS in Fainu ulelei s laptop has been the subject of media reports, and Samoa News understands it is currently still in his possession. DBAS board members who did not wish to be named, told Samoa News they are calling an Emergency meeting this week to discuss many issues, including Fainu ulelei s letter and other sensitive issues recently uncovered. The board members did not specify the sensitive issues. Department late afternoon, Feb. 5. The Office of Insular Affairs received a copy of that letter Feb. 7. However, my staff and I had already received substantial information on the subject through folks who contacted our office and the media, including Samoa News, Pula said. This particular issue is not an Obama Administration driven initiative; it emanated from Congress. Moreover, it is directed at a program managed by the US Department of Agriculture, not Interior. Asked if there is anything that DOI-OIA can do to help American Samoa s fight on this issue? Pula said the Office of Insular Affairs will communicate with appropriate officials in USDA regarding the facts and consequences of Buy America Tuna policy for American Samoa. a mandatory direct deposit into the employee s bank account, as Zions Bank fully takes over the processing of ASG s payroll. This move, according to the Treasurer, would be implemented later this month, and employees without direct deposit were urged to set it up as soon as possible. In a letter dated Friday, Feb. 8, 2014, to the ASG Workforce, from the Treasurer, and released to the media over the weekend, Falema o said there were some problems with the submission of the Electronic Funds Transfer (EFT) files to banking institutes and as a result there was no guarantee that an early deposit to reflect on your respective accounts as usual or on the Saturday before the standard payday would occur. He went on to specify in the Treasury Press Release that as mentioned in the prior notification, all other banking institutes direct deposits will be posted in your accounts on Monday, January 10, Payroll check distribution will also occur on Monday, January 10, 2014 as regularly scheduled.

15 NEWS IN BRIEF Car bombing in kabul kills 2 contractors KABUL, Afghanistan (AP) A suicide attacker rammed a car bomb into a NATO convoy in the Afghan capital and killed two foreign civilian contractors, authorities said Monday, while a coalition soldier was killed in a separate attack in eastern Afghanistan. The Islamic militant group Hizb-i- Islami claimed responsibility for the attack in eastern Kabul, saying it would drive all foreign forces from Afghanistan. Taliban insurgents and other militants like Hizb-i- Islami have stepped up attacks in the final year of the international coalition s 13-year combat mission in Afghanistan, seeking to shake confidence in the Kabul government s ability to keep order after they assumed full security responsibility last year. Police spokesman Hashmat Stanikzai said the attacker struck the convoy near the capital s Pul-i- Charkhi prison. He said at least seven Afghan civilians were wounded, including a child. Stockton police shoot, kill suspect STOCKTON, Calif. (AP) Stockton police say an officer shot and killed a 45-year-old domestic violence suspect who refused to drop a bayonet. The shooting occurred around 11 a.m. Sunday after officers stopped a vehicle of interest. Police say the suspect, Donald Haynes, was in the backseat and got out and confronted an approaching officer with a 19 ½ inch bayonet. He allegedly refused orders to drop the bayonet, and an officer, identified as Robert Johnson III, fired at him three times. Haynes was struck at least once and died at a hospital. Police say officers encountered Haynes attacking a woman at a home the previous night, but he was able to break free from them and escape. Canadian couple killed in Mexico retirement city MEXICO CITY (AP) Officials in Mexico say a Canadian couple was killed in an apparent robbery at their lakeside home in a popular retirement spot for U.S. and Canadian citizens. Chapala city spokesman Roberto Arroyo said Monday the couple was found by their gardener in a pool of blood in the living room of the house where they d lived for at least six months. Arroyo says robbery is the main motive behind the Sunday attack on the pair, both aged around mid-70s. Some belongings were stolen, including a TV and an SUV. He says the man was beaten on the head with a small statue and the woman was stabbed in the stomach with a kitchen knife. Their identities were not released. Canadian officials didn t immediately respond to a request for information. 16 die as truck collides with jeeps on road KOLKATA, India (AP) Police say all 16 occupants of two jeeps returning from a wedding were killed in a head-on collision with a speeding truck on a highway in eastern India. Police officer Kalyan Mukhopadhyay says the victims in the jeeps were returning home early Tuesday after attending a wedding at Sahapur, a village nearly 250 miles north of Kolkata, the capital of West Bengal state. He says 13 people died on the spot and three later in a hospital. He added the truck driver had been arrested. India has the world s deadliest roads, with more than 110,000 people killed annually. Most crashes are blamed on reckless driving, poorly maintained roads and aging vehicles. Calif. man kills suspect in home invasion robbery HAYWARD, Calif. (AP) Police say the San Francisco Bay Area homeowner who shot and killed a man during a home invasion robbery knew the suspect. The homeowner told officers who were called to his Hayward residence on Sunday evening that he shot at least two people. Hayward police Sgt. Eric Melendez says he also said he met the man he shot dead a long time ago. Police believe the other person who was shot is a woman who later turned up at a hospital. A second woman may also have been involved in the incident. The suspects have not been identified. The San Francisco Chronicle reports that police declined to discuss what may have led the alleged robbers to go to the home. The homeowner says a similar attack occurred at his home in October. Brazil journalist brain-dead after protest injury RIO DE JANEIRO (AP) A Brazilian television station said one of its cameramen was declared brain-dead Monday after being injured during a violent protest last week in Rio de Janeiro. Band TV said in a statement that Santiago Andrade, 49, remained in a coma on life support, but that doctors declared him brain-dead. Andrade was hit in the head by a powerful flare fired during a Thursday protest against a 10-cent hike in bus fares in Rio. Video footage seems to show that the flare was shot by protesters. A demonstrator has since turned himself into police, saying he didn t shoot the flare but provided it to another young man who did. Police are investigating. A small group of protesters gathered Monday evening in central Rio, again demonstrating against the bus fare increase. Continued from page 13 Explosion at NH ball bearings plant injures 15 PETERBOROUGH, N.H. (AP) An explosion rocked a small-town ball bearings plant on Monday, shaking walls, shattering windows and sending at least 15 people to the hospital, but a company spokeswoman said none of their injuries appeared to be life-threatening. Hazardous-materials teams responded after Monday afternoon s explosion at the New Hampshire Ball Bearings Inc. plant in Peterborough, but firefighters said there didn t appear to be any environmental damage. The blast blew out windows on the three-story building s ground floor, Peterborough Fire Department spokesman Eric Bowman said. There was heavy explosion damage, and the first arriving firefighters saw a column of smoke, he said. The cause of the explosion was under investigation, but all indications were that it was an industrial-related incident, Bowman said. First responders will try to determine the extent of the damage to the facility, company spokeswoman Kathy Gerrity said. It was unknown when the facility will be back in operation because it would need to be inspected and deemed safe first, she said. samoa news, Tuesday, February 11, 2014 Page 15 American Samoa Government OFFICE OF PROCUREMENT REQUEST FOR PROPOSALS (RFP) RFP No: RFP RFP No: RFP Date & Time Due: March 31, 2014 Issuance Date: February 03, 2014 No later than 2:00 p.m. local time The American Samoa Government (ASG) issues a Request For Proposals (RFP) from qualified firms or individuals to provide: Network Support for the DOH Helping Hands & EHDI Programs Submission: Original and five copies of the Proposal must be submitted in a sealed envelope marked: Network Support for the DOH Helping Hands & EHDI Programs.
