4 Dear Conference Participants: NLADA welcomes you to the Centennial Conference, Blueprint for Justice: Rethink. Retool. Rebuild. For 100 years, NLADA s mission has been to improve America s justice system by working to extend the right to counsel to all people regardless of income. The Centennial is a historic milestone, and brings a unique opportunity to reflect on the enormous impact our organization has made over the years towards balancing the scales of justice. NLADA drove the expansion of public defender systems after the landmark Supreme Court decision Gideon v. Wainwright; we were instrumental in the creation of the Legal Services Corporation; and we helped develop clinical legal education at our nation s law schools. NLADA has provided unflagging support to thousands of front-line attorneys across the country for 100 years. Although our conference honors these achievements, we must also focus on the significant challenges facing legal services providers and the clients they represent. Not only has the severe economic downturn had a devastating impact on moderate and low-income people, many of whom required the assistance of the legal aid or public defense community, but the law offices that provided this assistance saw their funding levels significantly reduced in the face of increased need for services. For some programs, that resulted in staff layoffs, untenable caseloads, and the elimination of attorney and staff training resources. In these times of crisis, we must develop and implement new strategies to address these challenges, create new alliances to ensure the delivery of high quality legal services to the poor, and engage the next generation of equal justice leaders. The theme of this year s conference, Blueprint for Justice: Rethink. Retool. Rebuild. reflects NLADA s strategic vision to establish well-funded, high-quality civil and defender justice systems across America. Our Centennial Conference opens on a reflective and inspirational note with a powerful presentation by Harvard Law Professor Charles Ogletree and the keynote address by Dr. Michael Eric Dyson. It offers over 100 sessions on specialty tracks civil, defender, client and board, technology and communication - that highlight our history and propose new and innovative ways of shaping justice in America for the next 100 years. Our faculty consists of many of the most brilliant and inspiring leaders in equal justice. On December 9, we will recognize the historic contributions of U.S. Supreme Court Justice Stephen Breyer and U.S. Representative John Lewis during Friday s Awards Luncheon. Conference programming also includes a concert by the award winning group SwEET HONEy IN THE ROCk and several networking opportunities for attendees. As you attend the many sessions and events at this year s conference you will be among the brightest and most dedicated, not to mention the largest cadre, of equal justice advocates in this country, whose passion and commitment is reflected every day in the thousands of lives and communities that are improved by our efforts. 8 GENERAL INFORMATION AWARDS LUNCHEON TICKETS Tickets for the Awards Luncheon on Friday are required. One ticket is included with each full conference registration if you confirmed your intention to attend this event when registering for the conference. A luncheon ticket is indicated on your registration badge. Additional tickets may be available for purchase at the registration desk. Limited tickets are available. A vegan alternative will be available. You will need to inform your waiter during lunch that you have requested a vegan entree. BADGES Badges must be worn to gain entrance to all sessions, meetings and meal functions as well as the exhibit area. CELL PHONES AND PAGERS Please be respectful and turn your cell phones and pagers off during plenary and workshop sessions. CENTENNIAL CONFERENCE CONCIERGE During the conference, should you have any questions related to special events or would like to bid on a silent auction item, please visit the concierge located in our registration area. CONCERT SWEET HONEY IN THE ROCK tickets were made available on a first-come, first-serve basis to the first 300 attendees registered for the conference. If you received a ticket, it will be included with your badge/materials. This ticket is required to gain access to the concert. Due to the high number of guests, seating will begin at 7:30 P.M. CONTINUING LEGAL EDUCATION It is a licensing requirement in most states that attorneys attend training each year. A CLE instruction sheet, general information and three-part certificate of attendance can be found in your conference bag. Please complete the NLADA CLE form and return it to the registration desk or mail to NLADA so that we may maintain a record of your attendance. Individual state forms are available in the Marriott Foyer at the conference registration desk. These forms must be completed onsite. Otherwise the completed forms, if possible should be returned to NLADA by December 16, 2011 in order to be processed. Please be familiar with the CLE requirements in your state. If you are an attorney from Oklahoma or California, please remember to stop by the registration desk to sign the mandatory sign-in sheets. Oklahoma attorneys must sign in each day and California attorneys must sign in one time during the conference. In order to receive CLE credit, Delaware attorneys must sign-in each time they arrive for training sessions and sign out each time they leave. If there are no breaks in attendance, the attorney must, at a minimum, sign in at the first of the day and sign out at the end of the day. 4 NLADA CENTENNIAL CONFERENCE

9 EVALUATIONS NLADA is very interested in your feedback on the conference. A general conference evaluation form is included in your registration packet and extra forms are available at the registration desk. Additionally, each training session will have a proctor who will distribute session evaluations. Please take a few minutes immediately following your session to fill out these evaluations and return them to your session proctor. We appreciate you taking the time to complete these forms, as they are useful tools for NLADA in our effort to provide the highest quality training events and conferences for you. INTERNET ACCESS Internet access is free in the hotel lobby. Unfortunately there is no wireless conference code for the entire conference. SMOKING POLICY This hotel has a smoke-free policy. WASHINGTON ROOM The Centennial Conference Opening Celebration will offer presentations that will not only celebrate NLADA s role in the struggle to achieve equal justice but look ahead to future challenges. NLADA is pleased to present two leading thinkers and distinguished members of the equal justice community, Charles J. Ogletree, Jesse Climenko Professor of Law at Harvard Law School and director Dr. Michael Eric Dyson Professor Charles Ogletree of Charles Hamilton Houston Institute for Race and Justice, and our keynote speaker, prolific author, noted scholar and media commentator, Dr. Michael Eric Dyson. The Portrayal of Equal Justice Issues in the Arts and Mass Media SALON 2, MARRIOTT BALLROOM The impact of the civil and criminal justice systems on the lives of the poor in America can been found on televisions, movie screens, MP3 players, and bookshelves everywhere including television series such as Perry Mason, Law and Order and The Wire, movies such as To Kill a Mockingbird, My Cousin Vinny, The Verdict and Norma Rae and songs such as Blowin in the Wind, Strange Fruit and Living for the City. This session will look at how media and the arts have been used (or underused/misused) in portraying public defense and legal aid clients, attorneys, and issues as well as what role media and arts can play in advancing the cause of equal justice in the future. Panelists include: Paul Butler, George Washington School of Law professor, former Assistant U.S. Attorney, and author of Let s Get Free: A Hip Hop Theory of Justice. Katy Chevigny, documentary filmmaker, entrepreneur, and co-founder of Arts Engine. Regina Kelly, NLADA Board member whose story was featured in the film American Violet. James H. McComas, attorney, trainer and author who has frequently provided commentary and analysis of legal issues in the media. 13 NLADA Centennial Awards Luncheon - December 9, 12:15 P.M. Featuring Duke Ellington School of the Arts SALON 1/2, MARRIOTT BALLROOM NLADA s Centennial Awards recognize the principle that America was founded on the promise of justice and that achieving justice is not the responsibility of the legal profession alone; it requires work across all disciplines and sectors of society. Justice John Paul Stevens Lifetime Achievement Award: JUSTICE STEPHEN BREYER Stephen Gerald Breyer is an Associate Justice of the U.S. Supreme Court. Appointed by President Bill Clinton in 1994, and known for his pragmatic approach to constitutional law, Breyer is generally associated with the more liberal side of the Court. Following a clerkship with Supreme Court Associate Justice Arthur Goldberg in 1964, Breyer became well known as a law professor and lecturer at Harvard Law School. There he specialized in the area of administrative law, writing a number of influential text books that remain in use today. He held other prominent positions before being nominated for the Supreme Court, including special assistant to the U.S. Assistant Attorney General for Antitrust, and assistant special prosecutor on the Watergate Special Prosecution Force in NLADA Centennial Award for Justice through Activism: CONGRESSMAN JOHN LEWIS John Robert Lewis is the U.S. Representative for Georgia s 5th congressional district, serving since He was a leader in the American Civil Rights Movement and chaired the Student Nonviolent Coordinating Committee (SNCC), playing a key role in the struggle to end segregation. Lewis has won the Lincoln Medal from the historic Ford s Theatre, the Martin Luther King, Jr. Non-Violent Peace Prize, the President s Medal of Georgetown University, the NACCP s Spingarn Medal and the John F. 14 CENTENNIAL CONFERENCE TRACK INFORMATION CLIENT TRACK The Courage to Lead: Client Advocates Working Together Despite a historic, prolonged economic downturn, low-income communities are facing today s challenges with courage and strength. Effective client and community leaders are equipping themselves with the knowledge, skills and abilities to be powerful advocates in their communities. This year s Client Track will challenge participants to find the courage necessary to take small and large steps toward justice. Participants will explore strategies for working effectively with the media and expanding legal services funding. Join us for this year s interactive and inspiring Client Track as we share and grow together as creative, courageous leaders for justice. DEFENDER TRACK The Next 100 Years: Rethinking, Rebuilding and Retooling Indigent Defense As NLADA commemorates 100 years of equal justice leadership, it is critical that the indigent defense community focus on the challenges facing the right to counsel and access to justice, including: State and federal budget cuts to indigent defense programs have resulted in restrictions on hiring and training and have even led to staff layoffs; Crushing caseloads make compliance with national performance and practice standards increasingly difficult if not impossible; The Supreme Court decision in Padilla v. Kentucky has stirred controversy within the criminal defense community about how to meet obligations of defense counsel to advise their clients about immigration and other collateral consequences; The technology gap between defender offices and prosecutors and the courts place defenders at a functional and strategic disadvantage at trial and other critical stages of representation; and Mass incarceration resulting from aggressive criminal justice policies and law enforcement practices, including the war on drugs, has had a devastating, disparate and longterm impact on communities of color. In order to meet these and other challenges, it is clear that the defense community must embrace new and different strategies. Defenders must reach out to different constituencies, including private and corporate bars, public interest lawyers, prosecutors, judges, law enforcement, the ecumenical community and others, in order to find common ground on issues, forge new alliances, and foster a spirit of collaboration on critical indigent defense issues. 10 NLADA CENTENNIAL CONFERENCE

15 The Defender Track will offer sessions that will engage attendees to rethink strategies for addressing the current crisis in indigent defense; in rebuilding and expanding partnerships to meet these challenges, and retooling staff and developing the next generation of leaders and advocates so that the promise of Gideon can finally be fulfilled. The Chief Public Defender s Leadership Role in Juvenile Delinquency Practice and Juvenile Justice Policy Litigation Challenging Indigent Defense Systems Using Technology to Deliver Just in Time Resources CIVIL TRACK Beginning the Journey for the Next 100 Years Rethinking Civil Legal Aid and Delivery in Difficult Times In looking ahead to the next 100 years, NLADA civil members face new challenges and opportunities for reshaping the pursuit of justice for people living in poverty. The ongoing recession has devastated millions of moderate and low-income households, exacerbating the need for civil legal assistance. We continue to see record numbers of home foreclosures, enormously high rates of unemployment and incidents of domestic violence stemming from the troubled economy. Additionally, the changing demographics have resulted in new and shifting populations of poor people that have reconfigured census data and impacted legal services funding levels. The need for federal, state and public-private support for legal services has never been greater. The volatile political environment has made it difficult to rely upon federal and state support to safeguard funding for legal aid. With cuts in funding, legal aid programs are challenged in planning their future budgets and responding to increased client needs. New laws and national and state policies around immigration and health care have had an impact as well on low-income communities and may change how legal aid programs address the new legal problems arising from these laws and policies. There have been growing efforts to establish a civil right to counsel and preserve the rights to counsel that already exist as well as thinking about how this right fits within an overall anti-poverty strategy. 16 In this time of crisis, legal services must marshal its resources and think innovatively about how to maintain effective legal delivery systems. This year s civil sessions will provide a forum for civil legal aid leaders to strategize about a wide range of critical issues for the next century of NLADA and civil legal assistance. We will explore improvements in assessment and better evaluation tools and measures that expand our community s ability to both gauge our effectiveness and address areas where we need improvement. Quality assessments and outcome measures will in turn allow civil legal aid to showcase to federal, state and public-private partners the measurable impact of the work and the need for increased resources to support it. This year s Civil Track will engage the next generation of civil legal aid leaders in exploring what leadership looks like, how new leaders will need to respond to new management challenges and their role in assessing legal delivery systems that better respond to client needs and work toward reducing poverty. The civil sessions will cover a wide range of topics and issues. Among the areas we intend to address are: Leveraging the results of a legal needs assessment: updated priorities, new initiatives, more resources in tight time; New strategies for civil impact leadership for directors of advocacy; Attorney retention: rethinking the role of loan repayment in retaining attorney talent and how bar association partnerships can help; A True Sea Change: Civil Right to Counsel as an Anti-Poverty Strategy ; Emerging issues in poverty law; Perspectives and priorities from the president of LSC; The impact of the census on redistribution of LSC funding; State and federal funding opportunities for civil legal aid; and The implications on civil delivery from the decision in Turner v. Rogers. Board Track Holistic Governance for Sustainability: Boards Making a Difference in Difficult Times To navigate the ever-changing forces impacting organizational performance, boards must be prepared to take new approaches to evolving problems. Boards are moving beyond diversity to inclusion that maximizes teamwork and community connection. Intentional assessments can help boards identify even more effective strategies in a challenging economic environment. Bringing it all together into holistic governance moves the board beyond financial oversight toward organizational sustainability the ability to make programmatic decisions that both meet the emerging client needs and support the financial health of the organization.
