1 FINAL 2016 FIFA REFORM COMMITTEE STATUS OF REVIEW AND PRELIMINARY RECOMMENDATIONS (OCTOBER 20, 2015) In rder t restre cnfidence in FIFA, significant changes t FIFA s institutinal structure and peratinal prcesses are necessary t make them mre transparent and accuntable. Essential changes t the culture f FIFA are necessary t effect lasting change n the rganizatin and t restre FIFA s reputatin s that it can fcus n its missin: t prmte ftball thrughut the wrld FIFA REFORM COMMITTEE Members f the 2016 FIFA Refrm Cmmittee were appinted by the six Cnfederatins f FIFA in August f 2015 and have been led by an independent chairman, Dr. Francis Carrard. The Refrm Cmmittee met in Bern, Switzerland n September 2 and 3, 2015 and again frm Octber 16 thrugh 18, Further meetings are planned fr mid-nvember The Refrm Cmmittee plans t issue its reprt t the Executive Cmmittee f FIFA at its December 2015 meeting in rder t recmmend relevant and apprpriate changes t the statutes and regulatins f FIFA t address this crisis in cnfidence with the gal t imprve the gvernance, transparency and culture f FIFA. It is expected that these recmmendatins and prpsed changes t the statutes, if apprved by the Executive Cmmittee, will be submitted fr cnsideratin by the FIFA Cngress in February The status f the wrk in prgress is set frth belw: REFORM PRINCIPLES At this stage tw sets f principles are prpsed: Principles f gvernance refrm Principles f leadership fr FIFA t effect cultural change. Each are as imprtant as the ther. The Refrm Cmmittee expects t make additinal recmmendatins t change FIFA s gvernance and further detail its recmmendatins thrugh a draft f the prpsed statutes fr cnsideratin by the Executive Cmmittee in December PRINCIPLES OF GOVERNANCE REFORM Belw are refrm principles that, when implemented in the frm f revised statutes and regulatins, attempt t address deficiencies in the gvernance and peratins f FIFA that have put FIFA s reputatin and ultimately, its missin at risk. The Refrm Cmmittee s preliminary recmmendatins prpse that FIFA, its Executive Cmmittee and Cngress enact changes t its gvernance structure, cntract prcesses and peratins t imprve efficiency, prevent fraud and cnflicts f interest and increase transparency in the rganisatin. Clear separatin between plitical and management functins f FIFA The Executive Cmmittee f FIFA shuld versee strategic matters and have a supervisry rle ver standing cmmittees and FIFA administratin. It shuld nt have
2 executive pwers ver plicies f FIFA. T reflect its mre apprpriate functin, the name f the cmmittee shuld be changed t the FIFA Cuncil. The President f FIFA shall chair the FIFA Cuncil and shall be accuntable t the FIFA Cuncil and shall supervise the wrk f the FIFA administratin. The General Secretary shall be the Chief Executive Officer f FIFA. FIFA administratin cmprising the ffice f the General Secretary shall execute day t day peratins by implementing plicies and strategy f the rganizatin as defined and directed by the FIFA Cuncil. The General Secretary may nly be dismissed by actin f the FIFA Cuncil. Strengthen the rganisatin s cmpliance functin further thrugh the creatin f a Directrship f Cmpliance. Greater financial transparency and cntrl Revised rle f FIFA Cuncil t define plicy and strategies t generate revenue, t prescribe the criteria fr the distributin f funds t member assciatins generally and t apprve the FIFA budget and annual financial accunts. The FIFA Cuncil shall have n decisin-making rle ver the executin f plicies t generate r allcate funds. Revenues ( Mney-In ) FIFA administratin t execute all effrts t generate revenue (marketing, spnsrship, Wrld Cup revenues etc.) and is accuntable and respnsible t the FIFA Cuncil. Develpment and Expenses ( Mney-Out ) Develpment Cmmittee t include nt less than three independent members t decide n specific grants f funds t member assciatins r prjects with administrative assistance frm FIFA administratin. Finance Cmmittee cnsisting f a majrity f independent members (including members cmpetent in financial matters) t create and prpse budgets and apprving annual financial accunts with administrative assistance frm FIFA administratin fr apprval by the FIFA Cuncil and submissin t the FIFA Cngress. Fully-independent Audit and Cmpliance Cmmittee (having members with expertise in auditing and financial statement matters) t versee prcesses f generating and allcating funds by FIFA administratin. Electins and terms f members f the FIFA Cuncil and the President Term Limits Maximum f 12 years fr the FIFA President. Age Limits 74 years f age. FIFA Cuncil members shall be elected by FIFA member assciatins at their Cnfederatin cngresses in accrdance with FIFA electral regulatins t be mnitred 2
3 by FIFA and all candidates shall be subject t eligibility checks (including integrity tests) cnducted by FIFA. Review Number and Cmpsitin f Standing Cmmittees Review the number f standing cmmittees t imprve efficiency yet ensure that member assciatins are invlved in a mre meaningful and efficient way in the decisin-making prcesses f FIFA. The rganizatin shuld devte resurces t invlve all its member assciatins thrugh annual r biannual cnferences t prmte the cre values and missin f FIFA such as ftball develpment, integrity, scial respnsibility, gvernance and human rights and address current and future challenges such as matchfixing, security issues and racism. Audit and Cmpliance, Cmpensatin and Nminatins cmmittee t be fully independent. Organising, Ftball, Assciatins, Players Status, Referee and Medical cmmittees t be cmprised f representatives f member assciatins, subject matter experts and relevant stakehlders as needed. Transparency Disclsure f individual cmpensatin n an annual basis f the FIFA President, all FIFA Cuncil members, the General Secretary and all chairman f independent standing and judicial cmmittees. Cmpensatin f these individuals t be reviewed and apprved by fully independent Cmpensatin Cmmittee relying n third party cmpensatin analysis. Greater Recgnitin f the Rle and Prmtin f Wmen in Ftball FIFA shuld recgnize that wmen represent the biggest grwth and develpment pprtunity t ftball and that ftball s gvernance, internatinally and at the reginal levels, need t include mre wmen t create a mre diverse decisin-making envirnment and culture. Each Cnfederatin shall have at least ne vting FIFA Cuncil seat fr wmen Review statutry and regulatin changes t encurage and enhance gender equality in the game. PRINCIPLES OF LEADERSHIP FOR FIFA TO EFFECT CULTURAL CHANGE Strng rganizatins are distinguished nt nly by their prducts and services, but by their leaders. Leaders take respnsibility when things g awry and when the rganizatin is at risk. FIFA and its member assciatins must unite arund a cre set f principles that cmmunicate its seriusness f purpse t the public as well as enfrce meaningful cultural refrm t truly change the rganizatin fr the better. 3
4 These principles are as fllws: Respnsibility. It is easy t place blame n thers wh have clearly caused great harm t ur sprt, but it is n lnger an ptin fr leaders f FIFA. We must accept that FIFA bears the burden f righting its wn ship. N ne is abslved frm recgnizing FIFA s prblems r accepting that it must be transfrmed t survive. Humility. FIFA s leaders must recgnize and accept that the errrs f the past were real, and they were unacceptable. N individual r rganizatin is perfect. Sund refrms are nly ne cmpnent f a larger cultural shift needed t truly create psitive change thrughut FIFA. This prcess is bigger than any ne persn r than any ne f the Cnfederatins r member assciatins that we represent. Tne at the Tp. FIFA s leaders must set the tne t encurage an ethical culture frm its executives, its staff, the FIFA Cuncil, Cnfederatins, member assciatins and stakehlders such as bradcasting and marketing partners, spnsrs and ther vendrs. Unethical behavir cannt be tlerated and must be cndemned and acted upn, ludly and vertly by FIFA s leaders. Individuals must feel that FIFA s leaders encurage identifying wrngding and unethical behavir and that reprting such behavir is nt discuraged but rewarded. Respect. The issues we have cmmitted t slve have a lng and cmplicated histry. There will be vigrus debate amng FIFA s leaders, member assciatins, stakehlders, the media and ther critics. In these debates, we must remember t shw respect fr each ther. The prpsed refrms will be heavily scrutinized, and all f us will have t stand by them. The respect we give each ther, and the integrity we use in ur language abut each ther and the imprtance f these refrms, will have an enrmus impact n hw the refrms themselves are received and perceived. Candr. It is abundantly clear that ftball fans and ur cmmercial partners will n lnger accept anything shrt f full transparency in hw ftball is gverned at the glbal, reginal, and lcal level. We shuld expect nthing less frm each ther. Each f us has perspectives n refrm and it is critical that FIFA remains a frum fr hnest and pen discussins.
