1 NORTHWEST JUSTICE PROJECT SIGNIFICANT CASE WORK AND COMMUNITY DEVELOPMENT ACTIVITIES SECOND HALF, 2008

2 INTRODUCTION The Nrthwest Justice Prject (NJP) is a publicly funded statewide legal assistance rganizatin serving lw incme persns and grups in Washingtn. Thrugh its 17 field ffice lcatins and a centralized telephnic intake, advice and referral system (CLEAR), NJP prvides free legal infrmatin, advice, limited assistance, representatin, cmmunity educatin, utreach and ther cmmunity based advcacy. NJP fcuses its limited resurces n high pririty cases and emergent needs related t husing, family safety, prtectin frm predatry lending and ther unfair r fraudulent practices, discriminatin in husing, educatin, and emplyment, access t health care r subsistence benefits, r issues related t disabilities r ther barriers that lw incme persns might experience in accessing services r the justice system itself. NJP seeks t ensure that its limited resurces address issues in ways that prtect the client cmmunity as a whle. NEW MEDICAL LEGAL PARTNERSHIP PROJECT During the latter half f 2008, NJP implemented a new three-year Medical Legal Partnership fr Children pilt prject. The prject is a cllabratin between NJP and Seattle Children s Hspital, the Odessa Brwn Children s Clinic and the Harbrview Children and Teens Clinic in Seattle t help imprve the health status f lw incme children and families by addressing their legal and health care needs hlistically. Thrugh a generus grant frm the Rbert Wd Jhnsn Fundatin, NJP has been able t place a lawyer n-site at the medical clinics t prvide legal educatin and technical supprt t the medical clinicians, scial wrkers and case managers t help them t identify legal issues and refer families and children they serve fr legal assistance. T date, the prject lawyer has develped infrmatinal materials, presented trainings fr the clinicians and prvided legal assistance and representatin t families with legal issues related t health care access/medicaid, husing, and immigratin law. PROTECTING CONSUMERS Financial hardship ften results when lw incme peple experience serius illness r unlawful business practices. NJP clients recently helped with cnsumer prblems include: A mnlingual Spanish speaking father f five wh needed emergency rm care was sued fr payment f the cst thugh it shuld have been allcated t the hspital s Charity Care bligatin. NJP s Walla Walla ffice defended the case and helped him t apply fr the Charity Care benefit, which the hspital fully accepted. The lawsuit was dismissed and his limited incme t meet the family s needs was preserved. A Clville tribal member s car (laded with fd fr a traditinal feast) was repssessed frm tribal land very early ne mrning. The client had nt missed a car payment and Tribal Law des nt allw repssessin n the reservatin withut an rder f the Tribal Curt. When the client tried t pay the dealer t redeem the car, the dealer wuld nt disclse the NJP Significant Advcacy Secnd Half,

3 price fr redemptin. NJP s Omak ffice sued the dealer and btained a judgment fr the client fr the value f the car and lst fd. A family wh was victimized in a freclsure rescue scam and lst the hme that had been in the family ver several generatins. The family had been tricked int a deal in which several parties cnspired t steal a substantial amunt f hme equity and then rdered the family t leave the hme. The scammers then flipped the huse thrugh multiple sales and realized significant prfit. NJP sued the cnspiratrs and recvered $40,000 frm sme defendants and then went t trial against the ther parties and wn a $164,000 judgment fr the family. MEETING BASIC NEEDS Lw incme persns ften are frced t resrt t the legal system t enfrce their rights t receive financial supprt fr basic human needs. Recent clients NJP has helped t secure their incme and medical needs include: An elderly disabled wman wh had been struggling fr mnths t remain living independently in her wn hme and suffering greatly after DSHS terminated her state prvided in-hme persnal care services. NJP negtiated t have her care needs reassessed. Upn reassessment, DSHS reversed the terminatin and mre than dubled the number f hurs it pays fr her in-hme care, allwing the wman t safely stay in her hme. A yung man gravely disabled by gastr paresis (a disease which causes persistent vmiting) needed help t get Medicare cverage fr gastric bypass surgery. By prviding legal memranda in supprt f the cverage request, NJP was able t quickly gain apprval fr the needed surgery. A wman wh lng ag during a but f depressin and drug abuse neglected her child, but fr the last several years has been successfully treated, stpped abusing drugs, btained her GED, and excelled in classes that trained her fr wrk with children. A respected child care/educatin facility fr children with disabilities ffered her a jb and supprted her request t clear her recrd and allwing her t wrk with children. NJP represented her befre the Department f Early Learning (DEL) and negtiated a six mnth trial perid after which DEL wuld declare her rehabilitated, making her fully eligible t care fr children. A hme day care prvider wh DEL charged with running an unlicensed day care and fined her $3,000. NJP challenged the DEL fine claiming that the prvider was exempt frm licensure under the licensing statute. An administrative law judge agreed that several statutry exemptins applied t the particular day care circumstances and dismissed the fine. A wman wh was remved frm the Basic Health Plan because she allegedly failed t prvide dcuments t re-certify her incme. When she tried t challenge the remval because she had in fact prvided the NJP Significant Advcacy Secnd Half,

4 dcuments, she was denied a hearing. After substantial litigatin, NJP and the Nrthwest Health Law Advcates negtiated with the Health Care Authrity (HCA) t establish apprpriate appeal and re-enrllment prcedures that include advance written ntice f re-certificatin requirements; imprved infrmatin abut the prcess; and autmatic reenrllment when qualifying dcuments are submitted t prevent waiting perids caused by intervening pre-existing cnditins. A disabled man wh faced evictin frm his assisted living facility when he was frced t cnvert frm being a private pay resident t Medicaid. The facility sught t evict him even thugh his lease agreement allwed fr Medicaid cnversin and a statute prhibits evictins based n cnverting frm private pay t Medicaid. NJP s Yakima ffice stpped the evictin and negtiated his mve t a cmparable facility that accepts Medicaid. The case received significant media attentin as it highlights the plight f disabled persns wh run ut f private funding t meet their medical care needs. PROTECTING CHILDREN AND PREVENTING FAMILY VIOLENCE NJP assists clients wh have experienced the tragedy f intra-family vilence. Intra-family vilence arises in many settings and creates multi-faceted family law issues. Recent clients prtected frm vilence and securing their safety include: An Aberdeen wman with a histry f dmestic abuse including death threats and attempted strangulatin. Her husband has bth alchl and drug abuse prblems in additin t his vilent behavir. When he was served with the wman s Prtectin Order, he abscnded with their tw children fr ver a mnth. NJP was able a restraining rder against him and t gain the children s return after he was arrested and charged with DUI and having a laded firearm in a vehicle with his children. The mther was awarded full custdy f the children and child supprt. A Spanish speaking dmestic vilence survivr with three children wh in the curse f the marriage survived being sht at in the presence f the children and culd nt get plice respnse thrugh 211 because she did nt speak English. NJP s Everett ffice helped her get a Prtectin Order. After the husband was served, the plice fund the family s hme dused with gasline, a lighter n a table inside, and a laded firearm under a seat cushin. The wman was awarded custdy with very restricted visits with the husband required t relinquish his firearms, and ther prtectins. A mther lst custdy f her three yung children when her abusive husband btained a curt rder withut prir ntice t her having alleged that her teen-aged children bullied the yunger children. NJP s Lngview ffice demnstrated that the father manipulated the yunger children and had an increasingly abusive drug habit. When a hair fllicle NJP Significant Advcacy Secnd Half,

5 test prved the father s methamphetamine use, the curt rdered the children s immediate safe return t the mther. A dmestic vilence survivr whse abusive husband was granted custdy f their newbrn baby by a curt rder issued withut prir ntice t her. The curt entered the rder even thugh the father was then n prbatin fr dmestic vilence against the mther. NJP s Olympia ffice was able t get the rder vacated and the infant safely returned t the mther s care with safety prtectins in place fr the mther and baby. A dmestic vilence victim and her children wh fr years had been physically, sexually and emtinally assaulted by her husband, at times visibly waiving guns and a machete and threatening t kill the entire family. NJP s Wenatchee ffice secured prtectin rders granting the wman custdy f the children and restricting the husband s cntact with the family and ther safety prtectins. A mther f five wh suffered beatings and sexual abuse frm the father until they separated. While the father was represented and the mther was nt, the mther lst custdy in tribal curt prceedings, even after the daughter disclsed abuse and an expert bserved bruising n the girl. After the father was arrested fr abusing a recent girlfriend, the children returned t their mther s care. NJP s Omak ffice represents the client t gain permanent custdy f the children in the tribal curt. HOUSING AND HOMELESS PREVENTION Preventing hmelessness and preserving lw incme husing ptins is ne f NJP s highest service pririties. Adequate husing is critical t family stability, health, educatinal success, and emplyment. Recent husing cases include: An Aberdeen wman with disabilities cntracted fr repairs n her hme that had been damaged by fire. The cntractr cashed $40,000 in insurance checks withut the mrtgage cmpany s endrsement and then walked ff the jb, leaving the hme uninhabitable. The family had lived in temprary husing while the repairs were t be made, but became hmeless when their mney ran ut. The family was split up when the grandchildren were taken in by friends and the wman lived in different places day-t-day, including her car. NJP and a private pr bn law firm represented the wman and sued the cntractr and bank that cashed the unendrsed checks. The case settled prviding the wman $30,000 with which t cmplete the hme repairs. Lng-term residents f a mbile hme park were threatened with evictin and lss f their hmes when new park wners illegally increased lt rentals 26% during the curse f their ne-year leases, creating financial hardship fr the cmmunity. NJP s Bellingham ffice intervened and negtiated a reinstatement f the lwer rent leases with the new wners, preserving affrdable rent fr the lw-incme cmmunity. NJP Significant Advcacy Secnd Half,

6 A subsidized husing tenant suffered frm severe dyslexia and had difficulty cmprehending written materials had signed a lease with a reasnable rental amunt apprved by the lcal Husing Authrity. She was then given a secnd cpy f the lease t sign which included a significantly higher rent. The first lease was sent t the Husing Authrity, while the landlrd kept the secnd versin. Fr tw years, the tenant paid the higher rent. The building was sld and the new wner discvered the discrepancy and ntified the Husing Authrity, wh referred the tenant t NJP. NJP recvered the full value f the verpaid funds. An elderly disabled wman was denied access t a senir husing cmmunity because she had been evicted frm her prir husing. The wman had been living with her ex-husband because her disability precluded her frm being able t live n her wn. His hme had gne thrugh freclsure and as a result she was subject t a curt-rdered evictin. NJP was able t demnstrate that she was nt at fault in the freclsure. The senir cmmunity waived the evictin and accepted her int the husing cmplex. A visually impaired wman was nearly evicted frm subsidized husing after the manager taped a ntice t vacate t her dr, knwing she was visually impaired. The ntice, which she learned f nly later frm a neighbr, was psted shrtly after the wman caught the manager entering her unit at 11:00 pm ne night. This frightened her terribly, especially since several items had disappeared frm her unit ver the past several mnths and the manager had refused her request t install a dr chain r sliding lck fr her use while she was hme. The landlrd filed an evictin actin alleging her failure t leave pursuant t the ntice t vacate. NJP s Olympia ffice negtiated dismissal f the case and, based n her wishes and fr her prtectin, time t mve t safer husing. A disabled senir wh lst his hme t freclsure, cmpunded by the fact that after the freclsure sale the lender claimed that it had a secnd lien n the hme allwing it t keep the surplus prceeds f the freclsure sale. NJP claimed that the lender had defrauded the senir verstating its claim and secured recvery f $27,000 fr the man. Several hmeless persns wh were denied access t public husing under tenant-selectin criteria that unfairly require a histry f having been a tenant in gd standing, effectively excluding thse wh have limited t n rental histry. NJP s Seattle ffice wn several reversals f these public husing denials, gaining access t husing fr the hmeless while als redressing plicies that negatively impact thse mst in need. A single mther f tw wh was threatened with evictin when she btained a small service dg fr her disabled child. NJP s Walla Walla ffice negtiated a reslutin allwing the family t remain in the hme and fr the child t keep the service dg. NJP Significant Advcacy Secnd Half,

7 NJP CLIENTS HAVE A RANGE OF LEGAL NEEDS NJP uses a creative advcacy tls t address a brad range f legal needs. Fr example, NJP helps crdinate free tax preparatin sites fr lw wage wrkers in Okangan cunty, hlds estate planning clinics fr lw incme tribal elders with Indian trust land interests, and wrks with law enfrcement, gvernmental agencies and curt staff t develp language access resurces fr lw incme limited English prficient ppulatins thrughut the state. NJP als assists many clients wh experience barriers due t disability, limited English, cultural r ther persnal issues, t negtiate slutins t prblems ften caused r aggravated by the individual barrier. During the latter half f 2008 examples include: A mnlingual Spanish speaking cuple wh were accused by their landlrd s insurance cmpany f having started a fire in their rental huse. The firefighters had cncluded that n human factr cntributed t the fire, and ruled it accidental. The insurance cmpany sent them a letter demanding payment f $25,000 fr damage t the huse. NJP intervened and after several cmmunicatins with the cmpany, it abandned the claim against the cuple. A cgnitively impaired illiterate Washingtn State Hspital patient lst several hundred dllars when the hspital tk his Scial Security funds frm his hspital-administered patient savings accunt t pay fr his cst f care. The hspital prvided ntice f its intent t take the funds nly t the patient and t itself, serving as the patient s prtective payee. NJP was able t get the funds restred after raised due prcess and ther claims at the administrative hearing t review the taking. NJP S SPECIALIZED FARM WORKER AND NATIVE AMERICAN SERVICES NJP has tw specialized units that serve Washingtn s farm wrkers and Indian cmmunities statewide. Tgether with field staff, NJP s Farm Wrker Unit cnducts utreach and cmmunity educatin prgrams t agricultural wrkers and represents these wrkers, wh are critical t Washingtn s agricultural ecnmy, t prtect their legal rights. NJP s Native American Unit engages in utreach t tribal cmmunities and, tgether with field staff, prvides specialized assistance in tribal curts and n legal issues arising under federal Indian Law and/r related t Indian status. NJP s specialized Native American CLEAR line prvides culturally apprpriate, ready access t an attrney fr intake, advice, limited assistance and referral. Clients recently served by these specialized units include: A Native American mther wh was denied access t her yung daughter by the child s father and aunt. The aunt filed a nn-parental custdy actin against the mther. NJP established that the child was eligible fr tribal membership and the custdy prceeding was subject t the federal Indian Child Welfare Act. Sn after, the child was returned t the mther and the custdy actin was dismissed. NJP Significant Advcacy Secnd Half,

8 Five farm wrker wmen wh were fired frm a fruit packing warehuse after raising wrkplace health and safety cncerns. NJP filed claims n their behalf with the State Department f Labr and Industries and then btained a satisfactry reslutin thrugh mediatin. Several immigrant farm wrkers with temprary wrk visas under the H2-A prgram wh suffered n the jb injuries. NJP has helped the wrkers navigate the wrkers cmpensatin claim prcess, establish their injuries and receive medical and wage lss benefits t which they are fully entitled t H2-A wrkers. CLEAR COORDINATED LEGAL EDUCATION, ADVICE AND REFERRAL NJP cases ften riginate with CLEAR-the Crdinated Legal Educatin, Advice and Referral system. If due t limited resurces, the client cannt be referred fr extended representatin, CLEAR advcates are ften able t help reslve the client s prblem with limited scpe legal assistance. Recent cases include: An 85 year ld wman n limited incme purchased hearing aids with interest-free financing ffered by the seller. The wman made several payments ver the 18-mnth perid f n interest, but was nt able t pay ff the entire amunt in that time. After the 18 mnth perid lapsed, the seller charged interest and finance fees fr the entire 18 mnth perid in excess f $1,000. NJP intervened and the lender frgave the entire amunt f past finance and interest charges, relieving the wman f significant stress ver her inability t pay the debt. A mnlingual Spanish speaking cuple was charged late fees fr payment f their rent after a new management cmpany tk ver at their apartment building. The prir management cmpany had agreed t allw their rent t be paid n the 8 th f each mnth when they received their paychecks. The new cmpany charged fr late payments after the 5 th f the mnth. NJP s CLEAR cntacted the new management cmpany, explained the situatin, advcated fr reimbursement f all late fees paid and negtiated bth reimbursement and an agreement cnsistent with the prir rent payment arrangement. NJP s CLEAR helped a yung mther get her water service restred after it was terminated due t the landlrd s failure t pay the bill. NJP s CLEAR helped a vulnerable senir btain in-hme care and fd stamps after her husband, wh had been her caregiver, had t mve t a care facility, leaving her withut care r adequate incme. CONTRACT ATTORNEY PROGRAM In additin t its staffed field ffices and CLEAR, NJP als cllabrates with private attrneys in several rural cmmunities t represent t NJP eligible clients NJP Significant Advcacy Secnd Half,

9 thrugh paid reduced fee cntracts under its Cntract Attrney Prgram (CAP). Clients the CAP assisted in the latter part f 2008 include: A physically disabled and cgnitively impaired yung man wh wanted t develp wrk skills and find wrk, but was unable t get assistance needed frm the state Department f Vcatinal Rehabilitatin (DVR). When DVR terminated his services an NJP CAP attrney represented the man in an administrative hearing and wn reinstatement f apprpriate services thrugh a negtiated settlement. A wman with a yung child wh was living in a dmestic vilence shelter after she was physically battered and sexually assaulted by the child s father. An NJP CAP attrney helped her t btain a restraining rder, child supprt and a highly restricted supervised visitatin plan pending his cmpliance with an anger evaluatin and treatment plan. A physically and mentally disabled wman wh was abused and sexually assaulted by her husband. An NJP CAP attrney helped her t respnd t the husband s disslutin actin, t btain several mnths f maintenance and a lump sum award fr her supprt, and t file a claim fr Scial Security Disability Insurance. COMMUNITY ENGAGEMENT NJP is deeply engaged with client cmmunities. Staff regularly participate in cmmunity events, cllabrate with ther scial and legal services prviders, and serve in leadership psitins with cmmunity and prfessinal rganizatins. A few examples fllw: NJP s Aberdeen ffice is presenting regular educatinal presentatins n the Earned Incme Tax Credit t lcal service prviders, Grays Harbr Cllege classes and at Wrksurce client meetings. NJP s Bellingham ffice cnducted a webinar presentatin fr service prviders in the Washingtn State Calitin n Dmestic Vilence n the scpe and effectiveness f lay assistance fr victims and survivrs. NJP s Everett ffice trained the Snhmish Cunty Indian Child Welfare Act cmmittee n the state curt nn-parental custdy prcess. NJP s Farm Wrker Unit actively participated with the Yakima Asset Building Calitin t publicize and expand access f lw incme persns t the Earned Incme Tax Credit and lcal free tax preparatin services.. NJP s Native American Unit and the Yakima Office assisted the Yakama Tribal Curt by updating its directry f attrneys licensed t practice in its curt and made available t litigants seeking representatin in that curt. NJP s Lngview ffice gave a cmmunity educatin presentatin n fair husing laws, reasnable accmmdatin and bligatins regarding service animals at an apartment cmplex fr persns with disabilities. NJP s Olympia ffice presented at a cnference n Civil Rights in Indian Cuntry NJP Significant Advcacy Secnd Half,
