3 AGENTS DEFINITION OF AN AGENT Involvement with an agent could affect your son s eligibility. An agent is any individual who, directly or indirectly: Represents or attempts to represent an individual for the purpose of marketing his or her athletics ability or reputation for financial gain; or Seeks to obtain any type of financial gain or benefit from securing a prospective student-athlete s enrollment at an educational institution or from a student-athlete s potential earnings as a professional athlete. Student-athletes, their friends, or relatives should not become involved with agents in any way while the student-athlete has eligibility remaining. Studentathletes, their friends, or relatives may not: Accept money, transportation, or any other benefit from an agent, runner, or any other individual Agree orally or in writing to be represented by an agent now or in the future Agree orally or in writing to have an agent or runner market the student-athlete s athletic ability or reputation now or in the future NEED MORE INFORMATION? REAL WORLD VIOLATION EXAMPLE How Ohio State Can Help You: Contact the professional advisory group for projected draft status Assist in obtaining quotes for disability insurance through the NCAA or another provider Your Actions Can Affect Your Son: If you accept any benefit from an agent, runner, or other individual, your son s eligibility will be affected. This includes money, entertainment expenses, preferential or VIP treatment, transportation, etc. If you agree, orally or in writing, for your son to be represented by an agent now or in the future, your son s eligibility will be affected. In the summer of 1987, a former Ohio State football student-athlete secretly signed with an agent before his senior year. When the contract was discovered, the student-athlete was ruled ineligible and missed his entire senior year. His absence was widely blamed for the team s disappointing 1987 season. All agents must be registered with Ohio State s Athletic Department and the State of Ohio in order to contact you. If you have any questions or concerns about an agent please contact the Athletic Compliance Office. 4 5
4 EXTRA BENEFITS & PREFERENTIAL TREATMENT Taking a benefit will cost you. It is a violation of NCAA rules for student-athletes, their friends, or relatives to accept an extra benefit or receive preferential treatment. An extra benefit is considered any benefit that is not generally available to the student body as a whole. WHAT ARE EXAMPLES OF BENEFITS AND PREFERENTIAL TREATMENTS? Cash, loans of money, use of a credit card. Signing or cosigning a loan. Any tangible gifts, including birthday or holiday gifts. Free or discounted meals. Free or discounted goods (e.g., clothing, vehicles, electronics). Free or discounted services (e.g., dry cleaning, haircuts, cell phones, long distance calls). Free or discounted entertainment (e.g., movie tickets, professional sports tickets). Assistance paying bills (e.g., utility bills, rent payments, telephone or cell phone bills). Transportation or the use of an automobile. Special finance and/or credit arrangements Arranged employment for your family or friends. Admission to an event (e.g., movies, banquets, concerts, sporting events, clubs, special events/ parties, banquets, etc.) Free or reduced cost housing for any length of time Academic assistance of any kind (e.g., tutoring, editing papers/projects, assistance in completing classwork, use of a computer, etc.) 6 7
5 EXTRA BENEFITS & PREFERENTIAL TREATMENT CONTINUED EXTRA BENEFITS & PREFERENTIAL TREATMENT CONTINUED AUTOMOBILE REGISTRATION HOUSING Student-athletes, their friends or relatives may not receive any vehicle discounts or benefits that are not available to all customers. Student-athletes must complete the Automobile Registration form at the beginning of each academic year and provide proof of vehicle registration. Student-athletes must notify the Compliance Office prior to purchasing a vehicle. Student-athletes are required to notify and receive approval from the Compliance Office if they will be test driving a vehicle in excess of 12 hours or overnight or if they will have a loaner vehicle for a period of 48 hours or more because of maintenance/repairs being performed on a studentathlete s vehicle. Student-athletes, their friends or relatives may not receive free or reduced cost housing at any time. Student-athletes are required to submit housing information at the beginning of every year and provide a copy of their lease to the Compliance Office EMPLOYMENT AWARDS & MEMORABILIA BOOSTERS Student-athletes may only be paid for work actually performed, at the going rate in the locality for similar services Student-athletes may not be compensated in any manner based on the value they have for an employer because of any publicity, reputation, fame, or personal following that they have obtained because of their athletics ability Student-athletes must register all employment during the academic year and summer by completing the Student-Athlete Employment Registration form Student-athlete awards (i.e.: gold pants, Big Ten rings, etc.), equipment, or apparel may not be sold or exchanged for anything of value or perceived value. Student-athletes, their friends, or relatives may not receive any extra benefit or preferential treatment from any individual categorized as a booster. In general, a booster is any individual who supports Ohio State athletics. Once an individual is designated as a booster, they remain a booster forever. 8 9
6 EXTRA BENEFITS & PREFERENTIAL TREATMENT CONTINUED What happens if a student-athlete or their friends or relatives accept an extra benefit? The student-athlete is ineligible to compete Ohio State may request reinstatement of the student-athlete s eligibility, but the student-athlete may be withheld from competition Your Actions Can Affect Your Son: If you accept any benefit, including preferential or VIP treatment, discounts, assistance paying bills, or special payment arrangements, your son s eligibility will be affected. If you provide any benefit to your son s teammate that is not approved by compliance, the teammate s eligibility will be affected. REAL WORLD VIOLATION EXAMPLE REAL WORLD VIOLATION EXAMPLE In October 2007, several parents of Ohio State football student-athletes received preferential treatment when they received transportation to an away game at a rate less than renting a similar bus. The parents studentathlete sons were deemed ineligible by the NCAA until their parents repaid the value of the transportation. Dating back to June 2009, an Ohio State booster employed five Ohio State football student-athletes and paid them more than the number of hours they actually worked. The NCAA ruled that each studentathlete was ineligible until they repaid the value of the impermissible money they had received
7 GAMBLING & POINT SHAVING Don t bet on sports. It is a violation of NCAA rules for a student-athlete to: 1. Provide information to any individual involved in gambling on Ohio State athletics 2. Solicit or accept any bet on any intercollegiate or professional team 3. Participate in any activity that influences the outcome of a game (i.e., point shaving) 4. Participate in any organized gambling activity that involves intercollegiate or professional athletics, including internet gambling (i.e., Fantasy Football league, Final Four pool, etc). Student-athletes that violate the gambling rules may be subject to the following sanctions: 1. Permanently lose all remaining athletic eligibility in all sports; and/or 2. Loss of athletic scholarship. Your Actions Can Affect Your Son: If your son provides you with information on Ohio State athletics and you use that information to gamble, your son s eligibility will be affected 12 13
8 PROMOTIONAL ACTIVITIES All appearances must be approved. Student-athletes must receive approval from the Compliance Office prior to participating in any promotional activity or community outreach Student-athletes may not receive any compensation or expenses other than actual expenses (i.e., meals and transportation) incurred from attending the event The student-athlete s name, picture, or appearance may not be used to promote the commercial ventures of any organization All money derived from the event must go directly to the charitable/nonprofit organization REAL WORLD VIOLATION EXAMPLE In November 2008, two Ohio State football studentathletes participated in a promotional activity on behalf of a charitable organization without prior approval from the compliance office. In addition, one of the student-athletes missed class to participate in the promotional activity. The penalty imposed by the NCAA resulted in both student-athletes missing one practice in preparation for the bowl game and the studentathlete who missed class was deemed ineligible until reinstated by the NCAA Reinstatement Staff
9 COMPLIMENTARY ADMISSIONS Don t sell your tickets. Student-athletes may receive up to four complimentary admissions to each home and away contest in the sport in which they are eligible to participate. Each studentathlete guest must present proper identification and enter at the designated site. If a name is not on the admissions list, that person will not be admitted. Individuals who may not receive complimentary admissions: Agents or Agents runners Athletics Representatives (i.e., Boosters, Student- Athlete Employers, Donors, Athletic Committee Members) Prospects or Recruits Instructors, tutors, mentors, academic advisors and academic unit staff Requests of Ohio State coaches, their family or friends Requests of Department of Athletics Staff members, their family or friends Media Public Officials Car Dealers NO SELLING TICKETS REAL WORLD VIOLATION EXAMPLE Complimentary admissions may not be sold or exchanged for anything of value by student-athletes or the individual designated to receive a complimentary admission. Such a sale is an extra benefit and will jeopardize the student-athlete s eligibility. Your Actions Can Affect Your Son: If you sell your complimentary admission, your son s eligibility will be affected If you receive a free ticket upgrade or use of a suite your son s eligibility will be affected. In the fall of 2010, the eligibility of an Ohio State football student-athlete was jeopardized when his parents were provided access to upgraded seats at a home football game that were not available to the general public. Although the cost of the parents original seats and upgraded seats were the same, the Big Ten Conference determined that a violation had occurred since the parents received special access to the seats because of their status as football studentathlete parents
