OPENING OF THE MEETING On the behalf of the chairperson, the vice Chairperson of the Working Group 3 Ms. Irene Kaggwa Sewankambo opened the meeting by welcoming Members and thanking them for having taken time to attend the meeting 3. INTRODUCTION OF MEMBERS Members introduced themselves as per the attendance list in Annex I. In total five(5) Members attended the meeting of which four (4) were from National Regulatory Authorities within the Region, and one (1) representative of the EACO Secretariat. 4. ADOPTION OF THE AGENDA The proposed agenda for the working group and the stakeholders meeting were adopted as presented in Annex II. 5. RECAP OF THE LAST MEETING The chairman of the WG3 Mr. Vincent Ngundi gave a recap of the presentation made during the 21st EACO Congress and assemblies noting that the report was adopted by the EACO congress. The meeting agreed to send a liaison statement to EACO WG8: ICT Service pricing and industry analysis; on the issue of Charging Over-The-Top (OTT) Service Providers for Utilization of Telecommunication Networks, an issue that has been raised by the Operators assembly. The liaison statement is contained in Annex III. 6. KEY PRIORITY AREAS AND TIMELINES Members reviewed the progress made by the working group under the Terms of Reference and identified the key priorities to be included in the action plan of the working group for the next two working cycles. These priorities and timelines are contained in Annex IV. 7. REVIEW OF EAC E-BILL Members reviewed the EAC E-Transactions Bill, aligned it with the proposed EACO model E-Transactions Policy Framework and incorporated further inputs to the Bill. The inputs of the working group were mainly in the following areas: 1. General terms and definitions 2. Management of Critical Internet Resources 3. Data Protection 4. Interoperability
5 5 5. Cross Certification 6. Country Code Top Level Domain Names 7. Localization of Public Information 8. Postal and courier services The detailed inputs of the working group 3 to the E-transactions Bill are contained in the Annex V. 8. STAKEHOLDERS MEETING Members held a stakeholders consultative meeting to review the EAC E-transactions Bill and EACO s proposed E-Transactions Policy Framework from 10 th -11 th September In his opening remarks the Executive Secretary of EACO Mr. Hodge Semakula thanked the chairman and the working group members for their participation and for the efforts invested to develop the ICT sector in the region. He also noted that a lot has been achieved under WG3 and appreciated the contributions of the working group towards the EAC E-Bill and for having aligned it with the EACO proposed E-Transactions Policy Framework. He further emphasized that the development of the ICT sector has brought a number of opportunities but also created challenges of privacy, security and authentication, adding that the EAC E-transactions Bill and EACO s proposed E-Transactions Policy Framework are timely and would go a long way to address some of these issues. He also noted that the bill and policy are a tool for harmonization with other E-Transactions legislations that have been developed by EAC partner states. The chairman of WG3 thanked the secretariat for appreciating the work that has been achieved by the working group and further presented the EACO proposed E-Transactions Policy Framework highlighting the areas that had been incorporated into the EAC E- Transactions Bill. The vice chair of the WG3 then took participants through the detailed inputs of the working group into the EAC E-transactions Bill as contained in Annex VI. Members noted the submission of contributions from the stakeholders and agreed to support the proposals laid out in the Memorandum Of Understanding (MoU) presented by TESPOK, with the exception of the provision on clause 50 of the EAC E-Bill provided that the word council is replaced by the Partner States. 9. WAY FORWARD The WG agreed as follows: i. To progress the activities of the working group by the covering the priority areas for cycle 2 ( ).
6 ii. The EACO to officially submit the inputs of the working group on the EAC E- Transactions Bill to the EAC and EALA iii. Members agreed that the next WG3 meeting will be held in Arusha, Tanzania, from 14 th to 18 th March, CLOSURE OF THE MEETING 6 The Chairperson thanked all members and the Rapporteurs for the work well done and encouraged all members for future participation. The chairman also thanked Mr. Mwendwa Maundu and Mr. Atupenda Mugisha who participated remotely. 13 13 Contact: Vincent Ngundi Kessy Godliving The EACO WG 3 on ICTs Service Transactions and e-applications met in Arusha, Tanzania, from 7 th to 11 th September 2015 to discuss and present her 1 st Circle deliverables and coordinate EACO s consultation on the e- Transaction Policy as well as the e-bill currently being discussed at EALA level: During these discussion the issue on OTT came up in the area of e-transactions and prompting for service users in the Region been acquainted with pricing of such services to the Network Service providers. Your group being an expert office on this need, WG03 therefore is requesting WG08 to take up this study in view to assist the regional operators with professional approach in tariffing the OTT services utilizing their network resources an issue that is among new innovations in the sector with its embedded complexities of interpretation.
