Kirkpatrick Office of the Secretariat Commodity Trading Commission Three Lafayette Center st Street, NW Washington, DC Re: Rule 40.6 Certification Listing Date for Energy Contracts Reference File: Dear Mr. Kirkpatrick: Pursuant to Section 5c(c)(1) of the Commodity Exchange Act, as amended ( Act ), and Section 40.6(d) of the regulations promulgated by the Commodity Trading Commission under the Act, NASDAQ, Inc. ( NFX or Exchange ) hereby notifies the Commission that it will commence listing 26 new financially settled energy futures and futures options (the Energy Contracts ) 1 on July 24, The Exchange previously filed a rule change, SR-NFX , stating that NFX would list Energy Contracts, on or after June 1, 2015, on a date to be announced by the Exchange through the issuance of a Regulatory Alert. The Exchange has selected July 24, 2015 as the first day of trading for Energy Contracts. The Exchange intends to issue the Regulatory Alert, attached as Exhibit A, announcing the initial listing of the following 26 Energy Contracts on July 9, 2015: 1 The 26 new Energy Contracts include five futures and two futures option contracts on oil and refined products, four futures and one futures option contract on natural gas, and 14 futures contracts on power. See SR-NFX filed March 11, 2015, proposing 28 new energy contracts. The Exchange will not list two power contracts proposed in SR-NFX , NFX PJM Western Hub Day-Ahead Off- (PJDQ) and NFX PJM Western Hub Day-Ahead (PJCQ), at this time.
