THIS AGREEMENT is made on BETWEEN THE PAROCHIAL CHURCH COUNCIL OF ST JOHN AT HACKNEY ( The PCC ) and the person(s) or body named above ( the hirer ) whereby in consideration of the sum(s) mentioned in paragraph 4 below:- The PCC agreed to permit the group to use the premises or part(s) of the premises designated in paragraph 3 for the purposes and period(s) and at the hire fee specified below:- Purpose of hire..... Room and facilities to be rented The PCC authorises the hirer to use a. the agreed areas of the Church buildings b. the restricted access car park area to the side of the church The PCC reserves the right to vary or withdraw any part of the Services or hours of use if reasonably necessary due to circumstances beyond the control of the PCC. The PCC reserves the right to substitute an alternative space in the Building at any time. 4. Termination This Agreement may be terminated by the hirer giving one month's notice to the PCC in writing or by the PCC giving one month s notice to the hirer in writing. This is subject always to PCC's right to immediate termination in the event of: a. the hirer failing to comply with the conditions of the Agreement b. non-payment of the hire fee as stated in our invoicing process 5. Security Under this agreement The PCC requires that a (refundable) deposit of 100 for the hire of the Hurdman Hall or the Urswick Chapel be paid, to cover any damage or loss the Church may sustain. For the hire of the main space, a (refundable) deposit of 300 will be required to cover any damage or loss the Church may sustain. 4. The PCC s obligations a. The PCC will endeavour to provide the Services but shall not be liable for any loss or claim of whatever sort arising from any failure to provide or the manner of performance of the Services. b. The PCC will make good any damage to the hirer's goods caused by any employee of the PCC using the Building.

3 5. Hirer s obligations a. The hirer will pay the Hire Fee of plus a (refundable) deposit of 100/ 300 (delete as applicable), making a total payment of to be paid in advance by direct debit or standing order payable to: The Parish of St John at Hackney HSBC 69 Pall Mall London SW1Y 5EY Sort code: A/c no.: b. The hirer will not to cause any damage to the Building or anything in the Building. c. The hirer will promptly response to all correspondence from the PCC or PCC representative. d. The hirer will not permit or do any act or thing which may cause damage nuisance or annoyance to other group or interrupt or interfere with Services e. The hirer will do nothing which may vitiate the PCC's insurance or cause an increase in the premium for such insurance f. The hirer will keep the building tidy and dispose of waste and recyclable material in the manner required by the PCC and not to leave any items in any other part of the Building g. The hirer will not to store or use hazardous materials or install any machinery or any other item unless agreed in writing by the PCC h. The hirer will not purport to sub-license the building or transfer any of the rights granted by this agreement to any other person i. The hirer will not interfere with the PCC's access to the Building j. The hirer will indemnify the PCC against any expense liability loss or proceedings incurred or suffered by the PCC arising from the activities omissions or operations of the group within the Building. k. The hirer will comply with the terms of any regulations made by the PCC from time to time of which reasonable notice has been given

The hirer will make good any damage to the Building or to the Office or at the discretion of the PCC reimburse the PCC for the cost of doing so and without prejudice to any other right to pay to the PCC a sum equal to any income lost as a result of the group failing to leave the office and the Building in a good condition on his or her departure m. The hirer will pay in full all cost and expense including solicitors' experts' and court fees incurred by the PCC in connection with or in contemplation of enforcement of any of the terms of this agreement n. The hirer is expected to arrange suitable insurance cover for itself and carry the correct documentation including CRB checks, children protection policies etc which is relevant legally to the hirer activities o. The hirer will notify the PCC in writing immediately of any fact that indicate any risk to the health of any person or the safety repair or security of the Building or any person using it p. The hirer is responsible for the safety and security of the building whilst onsite q. The hirer will not by act or omission to breach the terms of any legal obligation imposed on the PCC regarding the use of the Building r. The hirer will comply with the PCC's current equal opportunities policy as notified to the group from time to time s. The hirer will comply with the PCC's current health and safety policy as notified to the group from time to time t. The hirer will work within the realms of temperature and comfort that the building can reasonably provide u. The hirer will not sell alcohol by retail without consent

Exclusion The PCC shall not be responsible for death injury or illness by the hirer or any of its employees agents invitees or visitors or for any loss damage or destruction to the hirer s property or to the property of any such employees agents invitees or visitors unless otherwise provided by statute 7. Abandoned property If after the hirer has ceased to use the building any property is left in the Building the PCC may remove, sell, store or (where the property appears to the PCC not to be reasonably saleable) destroy or otherwise dispose of the property and the hirer will indemnify the PCC for the costs of such removal sale storage destruction or other disposal and against any claim by any party in respect of such property 8. Whole agreement The hirer acknowledges that this agreement contains the whole of the terms agreed with the PCC and that he was not induced to enter into this agreement by any representation not included in this agreement and that where the hirer is more than one person all liability is both joint and several 9. Variation by agreement The terms of this agreement shall not be varied save by written agreement and any temporary permission or failure to take action in respect of a breach by the hirer shall not vary the terms. No lease The parties acknowledge that this document does not create any leasehold interest and that the rights and obligations of the parties are purely personal and are not capable of binding any other person and that no person other than the parties shall have the right to any benefit from the agreement by virtue of the Contracts (Rights of Third Parties) Act 1999.
