2 Background The Legislative Coordinating Commission ( LCC ) is requesting proposals for web development programming services. The LCC contracted with a web developer to develop a database and web site to show Minnesotans how funds raised through the legacy amendment and the environment and natural resources trust fund are being used. The requirement for the LCC to develop the web site can be found in Minnesota Statutes 2012, section 3.303, Subdivision 10: State agencies receiving legacy and environment and natural resources trust fund appropriations provide the data that is displayed on the web site through a web-based data input form or by utilizing an Application Programming Interface (API). The web site currently provides information on approximately 7,000 projects. The web site is available at: The underlying development work has been completed using Drupal, an open source content management system. Additional work is required to further develop the web site. We anticipate assigning various database and web-programming tasks to the consultant, who will be expected to provide technical support to LCC staff. Specific tasks include, but are not limited to: Ongoing web site maintenance. General web site and database upgrades. Application Programming Interface (API) consulting. Develop an interactive map for the web site that would: o display project locations as a point o display specific project information on a mouse-over of the project point o include the ability to turn on/off layers by fund and possibly other filters Develop a tool for the project content type that automatically creates map data from an address. Develop or add a mobile friendly Drupal theme. This work will be carried out beginning with the execution of the contract, and extending through June 30, The contract is for a two year period, but can be extended by the LCC for two additional years. Upon receipt and evaluation of qualified proposals, the LCC will negotiate the specific terms of the contract with the selected consultant. The services are to be performed in accordance with the enclosed specifications and general conditions. CONTENTS OF PROPOSAL The proposal must: a. Describe the consultant s experience in the development of web-based interactive maps; b. Describe the consultant s demonstrated expertise providing technical support developing web sites with an open source content management system in a Linux/MySQL database server environment; c. Describe the consultant s demonstrated experience in providing technical support for web Page 2 of 5

3 sites employing MySQL geospatial capabilities, and providing a WKT-Shapefile translator; d. Describe the consultant s experience in JavaScript and PHP programming; e. Describe the consultant s experience with creating and/or enhancing Drupal based themes; f. Include the contractor s hourly rates; g. Describe the consultant s availability to accept tasks and projects to provide intermittent consulting services to the LCC over the course of the contract; h. Provide estimated costs for these contract elements 1. Technical support for the maintenance of the database and web site 2. Technical support for the API to agencies and the LCC 3. Development of the mapping functionalities described in the Background section 4. Development or addition of Drupal mobile friendly theme i. Address all other matters required by the specifications to be in the proposal. CONSIDERATION OF PROPOSALS The LCC reserves the right to reject any or all proposals, the right to waive any irregularity, the right to enter into a contract that varies from the specifications or general conditions, and the right to negotiate at any time with those that submit proposals or with any other party. The LCC will not necessarily select the proposal that offers the lowest price; the LCC reserves the right to consider price, quality, reliability, convenience, and any other factors that the LCC deems relevant. Because the development is in progress, existing contractors will be given preference. 4 General Conditions CONTRACT DOCUMENTS The contract documents include the Request for Proposal, general conditions, proposal and contract. LCC: AUTHORIZED AGENT The LCC referred to in the contract documents is the Minnesota Legislative Coordinating Commission. In matters relating to the discharge of this contract, the authorized agent is the LCC Director or person designated in writing by the LCC Director. LABOR LAWS All contractors and subcontractors shall conform to the labor law of the State of Minnesota and all other laws, ordinances, and legal requirements affecting the work in Minnesota. CHANGES IN WORK Changes in work specified in the final contract can be made by the LCC through the issuance of a Change Order. Acceptance of the Change Order will become effective after acceptance by the Contractor and after any cost difference is approved by the LCC. TERMINATION FOR DEFAULT If the Contractor fails to fulfill its obligations under this contract properly and on time or otherwise violates any provision of the contract, the LCC may terminate the contract by written notice to the Contractor. The notice must specify the acts or omissions relied on as cause for termination. The LCC will pay the Contractor fair and equitable compensation for satisfactory performance prior to receipt of the notice of termination, less the amount of damages caused by the Contractor s breach. If the damages are more than the compensation payable to the contractor, the Contractor will remain liable after termination and the LCC can affirmatively collect damages. TERMINATION FOR CONVENIENCE The performance of work under this contract may be terminated by the LCC, in whole or in part, whenever the LCC determines that termination is in the interest of the LCC. The LCC will pay all reasonable costs associated with this contract that the Contractor has incurred up to the termination and all reasonable costs associated with termination of the contract. However, the Contractor will not be reimbursed for any anticipatory profits that have not been earned up to the date of termination. Page 4 of 5

5 ASSIGNMENT Contractor may not assign, transfer or subcontract any rights or obligations under this contract without prior written consent of the LCC. APPLICABLE LAW This contract will be interpreted under the law of the State of Minnesota. Any action relating to this contract must be instituted and prosecuted in the district court in Ramsey County, Minnesota, and each party to the contract waives the right to change of venue. PAYMENT Payment will be made upon the terms agreed upon in the contract. Page 5 of 5
