Box 8016 Baltimore, MD RE: Comments on Proposed Rule Patient Protection and Affordable Care Act; Establishment of Exchanges and Qualified Health Plans; Small Business Health Options Program To Administrator Cohen: On behalf of the Asian American Justice Center and the Asian Pacific American Legal Center, members of the Asian American Center for Advancing Justice, we submit the following comments pursuant to the request for public comment regarding the proposed rule, Patient Protection and Affordable Care Act (ACA); Establishment of Exchanges and Qualified Health Plans; Small Business Health Options Program (SHOP), 78 Fed. Reg. 15,553 (proposed March 11, 2013) (to be codified at 45 C.F.R. pts. 155 & 156). Our organizations are dedicated to promoting a fair and equitable society for all by working for civil and human rights and empowering Asian Americans, Native Hawaiians and Pacific Islanders (Asian Americans and NHPIs), and other underserved communities. We provide the growing Asian American and NHPI communities with multilingual support and culturally appropriate legal services, community education, and public policy and civil rights advocacy. We work with the Asian Americans and NHPI small business community, which has expressed a strong interest in ensuring policies that promote maximum enrollment in and utilization of SHOP Exchanges by small business owners and their employees. For example, [a]ccording to a

2 2 owned businesses that may be qualified to insure their employees through SHOP Exchanges. 3 Overall, Asian Americans own 5.7% of businesses in the United States and employ 2.8 million people. 4 SHOP Exchanges are expected to make a significant impact among Asian American and NHPI small business owners who will soon have access to affordable health insurance. Asian American and NHPI small business owners are a part of the fastest growing racial group 5 in the United States with dozens of different cultures and languages. Approximately 71% of Asian Americans speak a language other than English at home. 6 Approximately 32% of Asian Americans are limited-english proficient (LEP) and experience some difficulty communicating in English. 7 Approximately 21% of Asian American households are linguistically isolated, meaning that all members 14 years old and older speak English less than very well 8 and would be considered LEP. 9 Decisions to reduce enrollment periods or make program provisions more complex have real consequences for LEP individuals by deterring them from participating altogether. Below, we recommend changes to the proposed limitation of employer choice during the transitional year and the major reduction of enrollment periods from 60 days to 30 days (b)(3): Functions of a SHOP. SHOP options with respect to employer choice requirements. HHS has designated 2014 as a transition year for both state-facilitated and federally-facilitated SHOP Exchanges in which they would not be required to allow employers their full range of group plan options until The proposed rule provides that for plan years beginning before January 1, 2014, a state-facilitated SHOP must allow an employer to select a single group plan but need not allow an employer to select a metal level of plan (with the employee to pick from multiple plans within that level). The proposed rule also provides that federally-facilitated SHOP 2009 survey conducted of Korean owned small businesses in Koreatown, Los Angeles, 52% of respondents were uninsured and 30% replied that their dependents were also uninsured. Only 10% reported that all of their dependents had health care coverage. 3 3 Exchanges will only be offering a single group plan in Thus, both the employer s and employees choices may be limited. The success of SHOP Exchanges depends largely on their ability to remain competitive with group plans in the outside market by offering both employers and employees with choices. Encouraging small businesses, especially employers with less than 10 employees who earn low wages, to provide health insurance for their employees is an enormous challenge but one that the ACA has committed to overcoming. 10 While some employers will be able to qualify for the small business tax credit as an incentive to provide health insurance for their employees, many other employers who do not have fewer than 25 full-time equivalent employees and average wages of less than $50,000 a year will not be able to claim this credit. 11 Already, small businesses have had a low uptake of the existing tax credit that has been made available through the ACA. In 2010, only 170,300 small employers claimed the credit out of an estimated 1.4 million to 4 million employers eligible for the credit. 12 Research conducted by the U.S. Government Accountability Office found that the extremely low uptake of the tax credit was due to its complexity (primarily its eligibility factors, required data, and number of worksheets) and a lack of awareness about it among small businesses. 13 Drawing from lessons learned about the underwhelming success of the small business tax credit, HHS should be concerned about making the rules for SHOP Exchanges simple and streamlined. The proposed rule s attempt to delay the full implementation of SHOP Exchanges offer of employer choice is contrary to the government s promise to provide small businesses with choice in group plans starting in Many small businesses have been dismayed by the ACA s current purported assistance to purchase affordable health insurance but have remained hopeful that the ACA s full benefits could be realized in Moreover, under the proposed rule, employers may not be able to distinguish the benefits of enrolling in SHOP Exchanges as compared to the outside market or Individual Exchanges. Employer choice is critical to the function of SHOP Exchanges, especially in their initial years. This concern should override the concern about complexities in building the operations needed to interact with SHOP enrollment systems. 4 4 this first year before they opt for enrolling in Exchanges outside of SHOP and would be less likely to switch plans in subsequent years when employer choice is made fully available. Additionally, it is likely that changed circumstances may cause churning between Individual and SHOP Exchanges. To the extent possible, the more that the two Exchanges operate similarly, the easier it will be for the employer and the employee to navigate and participate in the appropriate Exchange. That SHOP Exchanges will not have adequate systems to administer multiple qualified health plans is a valid concern. Rather than delaying the implementation of employer choice, however, the systems can be continuously improved in subsequent years. Employers and employees should understand their group plan options in whole from the start, and not have to be later informed that there are more options after the first year Enrollment periods under SHOP. The proposed rule seeks to change the enrollment period to select a QHP in SHOP Exchanges from 60 days to 30 days after the occurrence of a triggering event. The enrollment period triggered by the gain or loss of eligibility for Medicaid or CHIP would be 60 days and not 30 days. We highly recommend HHS to keep its original 60-day enrollment period for all triggering events. HHS justifies the proposed 30-day enrollment period as aligning with the current 30-day HIPAA enrollment period, and believe[s] that there is no rationale for providing a longer special enrollment period in a SHOP than is provided in the group market outside the SHOP. 16 We disagree, and also point to HHS s prior holding that a 60-day enrollment period for Individual Exchanges is a better policy for consumers. 17 Just as Individual Exchanges provide a 60-day enrollment period for consumers to select a QHP, 18 SHOP Exchanges should also retain a 60-day enrollment period for employees. Employees can reasonably be expected to need more than 30 days from the occurrence of a triggering event to understand their eligibility to select a QHP in SHOP Exchanges and, furthermore, to understand their different QHP options. In both Exchanges, triggering events involve major life changes, such as gaining a dependent or gaining new QHPs as a result of a permanent move. 19 Needing more time to navigate SHOP Exchanges may be particularly true for the previously uninsured who may not be health literate, immigrants who may not be familiar with our health care system, and LEP consumers who may not understand written informing materials from employers or QHPs. As discussed above, about one-third of the Asian Americans are LEP and experience some difficulty communicating in English Fed. 5 5 HHS has recently upheld a 60-day enrollment period for Individual Exchanges in a final rule, rejecting the need to be consistent with the HIPAA standard as commenters suggested. 20 HHS now uses the reasoning it had previously rejected to reduce the enrollment period for SHOP Exchanges. For Individual Exchanges, HHS maintained the 60-day period because this approach will give consumers the time they need to explore their coverage options through the Exchange, following a change in life circumstances. 21 Additionally, HHS exemplified the practice of the Medicare Prescription Drug Benefit Program to extend enrollment for two months beyond the occurrence of a triggering event. 22 HHS did not appear to find HIPAA s existing standard persuasive or desirable to follow. Allowing a 60-day enrollment period keeps the time frames consistent across all Exchanges to avoid confusion, especially if an employee transitions between Individual and SHOP Exchanges. There should not be a different rule for Individual and SHOP Exchanges. Because SHOP Exchanges seek to be more employer-friendly than the outside market, it does not necessarily need to follow the standards of HIPAA for the outside market. A far better solution to address the need to align the SHOP special enrollment period with the length of the special enrollment period under HIPAA would be to amend HIPAA regulations to allow for a 60-day period rather than shortening the period for SHOP coverage.
