Mu Nteko Ishinga Amategeko: Perezida na ba Visi-Perezida b Imitwe Yombi, Abadepite n Abasenateri kimwe n Abayobozi bemerewe koroherezwa ingendo bakora mu Nteko Imitwe Yombi, bazajya bagirana amasezerano yo kuborohereza ingendo n Umunyamabanga Mukuru wa buri Mutwe, naho Umunyamabanga Mukuru wa buri Mutwe azajya asinyana na Visi Perezida mu buri Mutwe ushinzwe Article 2: Scope of application of these Instructions These Instructions apply to Officials in Public Institutions who can acquire a vehicle for official and private purpose under the fleet policy. Article 3: Signing of Co-ownership agreement for a vehicle to be acquired by Officials in Public Institutions 1. Before purchasing a vehicle, a beneficiary of the vehicle loan scheme signs a Co-ownership agreement which fixes the terms and conditions of purchasing the vehicle with the Chief Budget Manager or another indicated authority of his institutions as follows: a. In Parliament: The President and the Vice President of both Chambers, Deputies and Senators as well as staff eligible to benefit transport facilitation working in Parliament will sign contracts of transport facilitation with the Secretary General in each Chamber while the Secretary General in each Chamber will sign with the Vice President in charge of Administration and finance in each Chamber. Article 2: Champ d'application des présentes Instructions Ces Instructions s'appliquent auxfonctionnaires des Institutions publiques qui peuvent acquérir un véhicule à usage officiel et privé conformément à la politique du charroi de l Etat. Article 3: Signature de l accord de copropriété du véhicule à acquérir par les Fonctionnaires dans les Institutions Publiques 1 Avant d'acheter un véhicule, le bénéficiaire de cette facilité de transport signe un accord de copropriété qui fixe les termes et conditions d'achat du véhicule avec le Gestionnaire Principal du Budget ou une autre Autorité indiquée dans chaque institutions comme suit : a. Au Parlement: Le Président et le Vice-Président pour toutes les Chambres, les Députes et les Sénateurs et autre personnel éligible de bénéficier la facilité de transport œuvrant au sein de ces deux Chambres signeront leurs contrats avec le Secrétaire Général respectif tandisque le Secrétaire Général signera le contrat avec le Vice- Président chargé de l Administration et des finances dans chaque Chambre. 18

In Supreme Court: The President and the Vice President and Judges under statute as well as staff eligible to benefit transport facilitation working in Supreme Court will sign contracts with the Secretary General while the Secretary General will sign with the Vice President in the Supreme Court. c. In Central Government Institutions (Presidency s Office, Prime Minister s Office, Ministries): i. In the Presidency Office: the Minister, the Director of Cabinet and the staff eligible to benefit transport facilitation will sign contracts with the Chief Budget Manager while the Chief Budget Manager will sign with the Director of Cabinet in the Presidency s Office. b. A la Cour Suprême: Le Président et le Vice-Président et les Juges sous statut et autre personnel éligible de bénéficier la facilité de transport œuvrant au sein de la Cour Suprême signeront leurs contrats avec le Secrétaire Général tandisque le Secrétaire Général signera le contrat avec le Vice- Président de la Cour Suprême. c.au Gouvernement Central (Présidence, Office du Premier Ministre et les Ministères) : i. A la Présidence de la République : Le Ministre, le Directeur de Cabinet et autre personnel éligible de bénéficier la facilité de transport signeront leurs contrats avec le Gestionnaire Principal du Budget tandis que Gestionnaire Principal du budget signera le contrat avec Directeur de Cabinet de la Présidence. ii. Prime Minister s Office: Right Honourable Prime Minister, Minister, Director of Cabinet and the staff eligible to benefit transport facilitation will sign contracts with ii. At the Ministry Level: The Minister, Minister of State, Director General as well as staff eligible to benefit transport facilitation working in the Ministry will sign contracts with the Permanent Secretary/Chief Budget Manager while the Permanent Secretary will sign with the Minister. d. In National Public Prosecutor Authority (NPPA): the Prosecutor General, the Vice Prosecutor General and the staff eligible to benefit transport facilitation will sign contracts with the Secretary General while the Secretary General will sign with the ProsecutorGeneral. iii. Au niveau du Ministère: Le Ministre, les Secrétaire d Etat, Directeur General ainsi que le personnel éligible pour bénéficier la facilité de transport au niveau du Ministère signeront leurs contrats avec le Secrétaire Permanent/Gestionnaire Principal du Budget tandis que le Secrétaire Permanent signera le contrat avec le Ministre. d. Au Parquet Général: le Procureur Général, le Procureur Général Adjoint et autre personnel éligible de bénéficier la facilité de transport signeront leurs contrats avec Secrétaire Général tandisque Secrétaire Général signera le contrat avec le Procureur Général, 20

At Province and City of Kigali level: The Governor or the Mayor of Kigali City and the staff eligible to benefit transport facilitation will sign contracts with the Executive Secretaryof the Province or Kigali City, while the Executive Secretary of the Province or the City of Kigali will sign with the Governor or the Mayor of the City of Kigali. e. Au niveau de la Province et la Ville de Kigali: Le Gouverneur ou Le Maire de la Ville de Kigali et autre personnel éligible de bénéficier la facilité de transport signeront leurs contrats avec le Secrétaire Exécutif de la Province ou de la Ville de Kigali tandis que le Secrétaire Exécutif de Province ou de la Ville de Kigali signera le contrat avec le Gouverneur ou le Maire de la Ville de Kigali. ii. Buri Rwego rushinzwe gucunga imari ya Leta (Budget Agency) mu zimaze kuvugwa haruguru, rusabwa gukurikirana iyubahirizwa ry amasezerano yo koroherezwa ingendo rugirana n Abakozi, kimwe n ayo abayobozi rushinzwe bari g. In Commission, Ombudsman and Specialized Organs: The President/ Executive Secretary where allowed, Ombudsman and his Deputies and the Staffs eligible to benefit transport facilitation will sign contracts with the Chief Budget Manager of these Institutions while the Chief Budget Manager will sign with the President / Executive Secretary, or the Ombudsman. Article 4: Management of co-ownership Agreement of vehicles acquired by Officials in Public Institutions a 1 Every budget agency above mentioned is required to monitor the implementation of the established contract for transport facilitation with its staff as well as those ongoing contracts, which were established g. Dans les Commissions, Ombudsman et Organes spécialisées: Le Président/Secrétaire Exécutif lorsqu il lui est permis, Ombudsman et ses Vices, ainsi que les fonctionnaires éligibles pour bénéficier la facilité de transport signeront leurs contrats avec le Secrétaire Exécutif, le Gestionnaire Principal du Budget de chaque institution tandis que le Gestionnaire signera le contrat avec le Président/Secrétaire Exécutif ou Ombudsman. Article 4 : Gestion de l Accord de Copropriété des véhicules acquis par les Fonctionnaires dans les Institutions Publiques 1. Chaque organe de gestion du budget de l Etat ci-haut mentionné est appelé à faire le suivi de mise en application des contrats de facilitation de transport établis avec son personnel ainsi que d autres contrats en cours préalablement établis entre le Ministère des infrastructures et ceux-ci avant l entrée en vigueur des 22

Every budget agency is also required to interest anyone who entered into agreement with the Government for transport facilitation and who completed provided co-ownership period or who reimbursed the government liability to request for clearance letter from the Ministry of Finance and Economic Planning granting him/her full ownership. This clearance letter must be kept with other required documents in the file of the co-owner found in every budget agency. présentes instructions. Cette lettre de non-créance doit nécessairement être gardée avec d autres documents exigés dans le dossier du copropriétaire tenu par chaque organe de gestion du budget. Ingingo ya 5: Raporo ya buri gihembwe Urwego rwose rushinzwe gucunga imari ya Leta rugeza kuri Minisiteri ifite Gutwara Abantu n Ibintu mu nshingano zayo raporo ya buri gihembwe igaragaza imicungire y amasezerano Abayobozi mu nzego za Leta bagirana na Leta mu rwego rwo kuborohereza ingendo. b. Copy of the registration certificate of the co-owned vehicle; c. Certificate indicating date and reason of the vehicle co-owner left the scheme; d. Debt statement document issued by the Ministry having Finance in his ambit indicating the Government liability to recover for the co-owner who left the scheme before the completion of the provided co-ownership period; e. Non clearance letter insuring that the beneficiary has finished refunding the Government liability issued by the Ministry of Finance and Planning. Article 5: Quarterly report Every Budget Agency must submit to the Ministry having Transport in its attributions a quarterly report showing the management of vehicle co-ownership agreements for transport facilitation of Government Officials. b. Article 5: Rapport trimestriel Chaque Organe de gestion du Budget de l Etat doit soumettre le rapport trimestriel au Ministère ayant les transports dans ses attributions. montrant la gestion des accords de copropriété du véhicule pour la facilitation du transport des fonctionnaires de l Etat. 24

Article 6: Transitional provision In implementation of these instructions, the current ongoing Co-Ownership Agreement shall still valid and will be managed under terms and conditions of these agreements. The Ministry having Transport in its attributions will handover not later than six months, counting from the date these instructions enter into force, the existing Coownership Agreements. Article 6: Disposition Transitoire Dans l application des présentes instructions, les accords en cours resteront valides et seront gérés conformément aux termes et conditions définies dans les présentes instructions. Le Ministère ayant les Transports dans ses attributions remettra dans un délai ne dépassant pas six mois après l entrée en vigueur des présentes Instructions, les accords de copropriété existants. Article 7: Repealing of inconsistent provisions of these Instructions All prior Instructions contrary to these Instructions are hereby repealed. Article 8: Commencement These Instructions shall come into force on the date of its signature.
