7 FINAL LICENSE APPLICATION- EXHIBIT G 2 Project Boundary The project boundary is depicted in Figures G.1-1 and G.1-2. The boundary around the impoundments is displayed as a 100-foot buffer from the upper impoundment contour 2,485 feet and lower impoundment contour 1,092 feet. The boundary around the linear project features is depicted as set distances from the center line, no more than 200 feet in width. Roads to be used for the mitigation monitoring network wells are included in the boundary but no additional buffer distance was added for these. The boundary around noncontiguous features is described by a buffer of 60 feet. Mitigation monitoring network wells were given a buffer distance of 200 feet. Once all the buffered features were merged together, the result is the boundary shown in Figures G.1-1 and G.1-2. The boundary encloses only those lands that are necessary for the safe and efficient operation and maintenance of the project. Eagle Crest Energy Company,
8 FINAL LICENSE APPLICATION- EXHIBIT G 3 Federal and Non-Federal Lands Any public lands and reservations of the United States (Federal lands) [see 16 U.S.C. 796 (1) and (2)] that are within the project boundary, such as lands administered by the U.S. Forest Service (none in this case), Bureau of Land Management (BLM) (all project Federal lands in this case), or National Park Service (none in this case), or Indian tribal lands (none in this case), and the boundaries of those Federal lands, are identified as such on the map in Figures G.1-1 and G.1-2. Table 3-1 presents the lands of the United States within the project boundary. A total of 1, acres of Federal land are within the project boundary. Note that the tabulation presents each plot identified within the project boundary. In actuality, only a portion of the section may be within the project boundary. In addition, FERC Form 587 has been completed and is included in this section. The project is proposed to be constructed, in part, on land which is subject to a land exchange between the BLM and Kaiser Ventures, LLC. This land exchange was appealed to the Ninth Circuit Court of Appeals, and oral argument was heard on December 6, To date, there has been no decision on this case. Consequently, until the Ninth Circuit issues a decision, it is assumed that BLM is the current owner of the land exchange properties. Table 3-1 identifies the acreage of federal lands, assuming the current land ownership. However, if the land exchanged is effectuated, the amount of federal land this project will affect is decreased to acres. In this case, Table 3-2 displays the location of federal lands within the project boundary. The lands subject to the land exchange are displayed in light blue hatch in Figure G.3-1. All other lands identified as being within the project boundary are lands over which the applicant has plans to acquire fee title or appropriate rights to occupancy.
