15 Page 15 Project Objective Business/Legal Challenge Litigation is part of doing business. The exponential growth of data, coupled with evolving case law, amendments to the US Federal Rules of Civil Procedure FRCP) make responding to e-discovery requests in litigation costly and complex. E-Discovery can also overlap with internal investigations and audits, records retention guidelines, and compliance requirements. The objective therefore is to improve and document Crowley s administrative process and reduce the cost, duration and risk associated with the business and legal issues inherent in litigation.

17 Page 17 Our Approach After analyzing options, the team decided that the Clearwell ediscovery solution best meets our needs. We conducted a pilot test of the Clearwell solution using actual documents from a Crowley case, so that we could compare our actual historical costs to what the costs would have been if we had used Clearwell. Participants in the pilot included representatives from Legal, Risk Management, IT, Internal Audit and HR. During the pilot we also developed and documented an improved ediscovery process.

18 Page 18 Pilot Results The pilot confirmed that we could lower our ediscovery costs by using Clearwell Cost for Pilot Case Note: The Clearwell scenario reflects the actual results from the pilot. The Clearwell Plus scenario reflects projected results if we spent more time refining the results and reducing the number of documents.

19 Page 19 Pilot Results Based on the Clearwell - Plus scenario, the 5-year investment would be recouped after 5 matters... and Crowley would realize savings in excess of $1.2M after 25 matters.

20 Page 20 Final Steps Present results to Senior Management and obtain approval for purchasing the Clearwell solution. Solidify the cross-functional team and confirm their support of the new process. Finalize the Documented Process, including who is responsible for which steps. Leverage Clearwell consulting or AmDocs to help practice the new process on the first few matters.
