3 I. OBTAINING PERSONAL DOCUMENTS REQUESTED FROM RETURNEES 1. Birth Certificate In order to obtain most of the documents it is necessary to get the birth certificate. It is issued by the Ministry of Interior (MoI) and the procedure is the same as the one for obtaining extracts from the register of marriages or deaths. It is issued on the same day of submission of the request. 2. Citizenship Certificate Citizenship certificate is necessary for obtaining other documents such as identity card or passport. The request for issuance of the certificate is submitted to the branch office of Ministry of Interior. The certificate is issued on the same day of submission of the request. If you are not registered in the Register of citizens of Montenegro you need to submit following documents: birth certificate (not more then 6 months old) certificate that he/she is not registered in the Register of citizens in the place of birth, place of birth of his/her father or place of residence citizenship certificate of parents identity card or certified photocopy (if the person does not have one, than certificate on place of residence) evidence on stamp duty payment The Birth Certificate and the Citizenship Certificate could be ordered electronically through the portal of the Ministry of Interior. Portal is called (Instruction is given on the left side of the page). 3. Identity Card Identity card is a document that proves our identity. With parent approval, identity card can be issued when 14 years is reached. When the person reaches 18 he/she is obliged to have the identity card. In order to get the identity card, at the counter of the municipal department of the Ministry of Interior and Public Administration, the applicant needs to bring: birth certificate Montenegrin citizenship certificate certificate on place of residence identity card of one of the parents (if it is the first time identity card is issued) evidence on paying 5,00 euro for the duties for forms you completed photographs will be made in your office of MoI When taking the identity card, the person is obliged to leave the fingerprint of the right hand forefinger. The identity card is issued for a period of 10 years, in the case of minors it is valid for 6 years, and in the case of a person over the age of 65 it will be valid for 40 years, and after that period you need to get a new one. If in meantime you change your last name, you are obliged to your change identity card as well. If you lose your identity card you are obliged to file its missing in 15 days period to Ministry of interior s municipal department and to request issuance of the new one. New identity card is issued when the old one is proclaimed invalid. 3

4 For issuance of the new identity card person needs: form for issuance of identity card, on the counter claim on missing identity card evidence of paying 3,00 euro for completing the pronouncement of the decision of proclaiming the identity card as invalid in the Official Gazette Term for issuance of the identity card is 7 days from the date of delivery the form for its issuance. In order to get to obtain the birth certificate, apart from your personal data, you need to know name and last name of your father, date of his birth, as well as name and the last name of your mother, her birth name and her date of birth. Birth certificate is issued on the same day of submission of the request. 4. Passport Passport is the document which is necessary for traveling abroad as evidence on nationality and identity. As an adult, you may submit the request for issuance of the passport. Term for issuance of the passport is 15 days from the date of submitting the application. Application is submitted to the Ministry of Interior in the place of residence and when abroad application is submitted in the consulate of our country. The passport is valid 10 years. For issuance of the passport apart from the form (bought in bookstores) you need to present: identity card, if you are a minor: birth certificate, citizenship certificate and consent of both parents. evidence on passport form payment for 15,00 euro evidence on stamp duty payment of 25,00 euro photographs will be made in your municipal department New passport is individual and parents cannot put names of their children in it. For minor Montenegrin citizen to the age of four, passport is valid for a period of two years, a request should be submitted by a parent, with approval of the other parent or legal guardian upon request. The passport is printed to Montenegrin language, Latin script, as well as English and French, and at your request, your signature could be written by Cyrillic alphabet. In the case you lose your passport or if someone steals it you are obliged to report this instantly to Official Gazzete of Montenegro and to pay administrative taxes in amount of 5,00 EUR.. If you lose your passport being abroad, please contact consular department of our embassy where they will give you travel certificate. For issuance of the travel certificate you need: citizenship certificate not more than 6 months old document with the photograph (identity card, drivers license) police record on reporting the disappearance of the passport (travel document) residence permit of the country in which you are three photographs (dimensions 3,5 x 4,5cm) two forms for issuance of the travel certificate 5. Work Book Work book is issued by the municipal Secretary for Social Welfare. For work book issuance you need: two application forms, completed in clear script (bought in a bookstore) original diploma on graduation 4

5 for women, if married, extract from the register of marriages The secretary has the right to decide on the issuance of the employment book in the period from 3 to 30 days. 6. Health Certificate Health certificate is a document which serves as evidence that you have health insurance and anyone who has evidence that is insured from the Republic Health Care Service can have it. It is endorsed at the municipal department of the Republic health care service every three months. Public transport Public transportation in Montenegro comprises road transportation (bus service, taxi service, transportation by private car and rent-a-car), rail transportation (trains), air transportation (airplane transportation) and water transportation (ship transportation). Bus service comprises urban transport, suburban transport and intercity transport. For urban and suburban transport, a person may buy season tickets if he/she often uses this type of transportation. Season tickets can be bought at the offices of the transportation company. The cost of a one-way ticket trough the city are from 0.40 to 1.00 euros. Train tickets for rail transportation can be bought at the railway stations (till the start of the train), in travel agencies or during the trip from the conductor. Train tickets could be reserved by as well as by SMS. Requests for reservation could be sent on buking@zpcg.me, or SMS on phone number 068/ , or via phone call on For local passenger transport, Railway Transport of Montenegro offers various travel concessions such as: 60% discount for students up to the age of 27, holders of Montenegro Student Card, Children up to the age of 6 travel free of charge if accompanied by a train ticket holder, Children 6 to 14 years old travel with 50% discount, Persons up to the age of 26, retired persons, journalists and persons over the age of 60, travel with 30% discount at presentation of K-5 reduction card, Persons over the age of 75 may travel free of charge at presentation of K-5 reduction card issued by Railway Transport of Montenegro, 5

6 All the interested passengers may purchase a monthly pass at lower price and with discount up to 75%. For a group of 6 or more passengers there is 30 % discount The price of an annual subscription card which allows unlimited travel on any route in the area of Railway Transport of Montenegro is 300 euros. 01/03/2014. Railway transport of Montenegro introduced CAFFE SPECIAL tickets for trains from Bar-Podgorica-Bijelo and Polje-Podgorica-Bar More info on: Airline tickets may be bought in the offices of the airline companies, in travel agencies or on the internet. There are tickets for economic class and for business class, and they differ in price and convenience the traveler has during the flight. If you are a student and you are under 26 years old, you should use ticket EURO 26 with whom you can buy tickets on discount for all 3 types of transport. Traveler need to be at the airport 60 minutes before domestic flight, that is 90 minutes before international flight in order to check (confirm) his/her ticket. Allowed weight of luggage varies in dependence on carrier, however usual limit is around 20 kg or one suitcase.. In the airplane one may take hand-luggage limited in size and weight and it may not contain deodorants, glass bottles or any weapon or sharp objects, not even toenail clipper. More info on: 2. Driver s license Driver s license is submitted to drivers to 40 years old, and person over 40 years old driving license is valid 10 years, and for drivers over 70 years old it is valid for 2 years. In order to get the driving license you need to bring: proof that you pass driving egzam if you don t have an old drivers license medical evidence, not more then 6 months old proof of paying taxes (5,00 euro for request and 10,00 euro for administrative taxes for submitting the first drivers license; 15,00 euro for duplicate drivers license, 8,00 euro for an application)and identity card (identity card, passport, drivers license) for evidence. If you are older then 24 and have at least 5 years of drivers experience you may rent a vehicle in a rent-a-car agency. When renting a vehicle you sign a contract which defines your obligations as well as obligations of the company that rents you the vehicle, you are paying determined amount in advance and in some cases deposit some of your personal identification document. You may rent the vehicle for 24 hours minimum and it must be returned in proper condition. You may not use the vehicle outside the borders of Montenegro without the approval of the company. Permission for driving other person s vehicle may be obtained at the court. For obtaining this permission you need authorization from the owner of the vehicle, your driver s license and your identity card. Owner of the vehicle must present the same documents as well as documents on the vehicle. Authorization is issued in three originals one for you, one for the owner of the vehicle and one for the court. If you plan to go abroad by other person s vehicle, permission is issued in the Automobile Association of Montenegro. 6

8 III. COMMUNICATION NETWORK 1. Fixed and Mobile Telephony Operators There is one fixed telephony operator in Montenegro T-com. All legal and physical entities that possess or rent living accommodation or business premises have the right on fixed line subscription. Area code for Montenegro is There are three mobile telephony operators. These are: TELENOR (069), T-MOBILE (067) and M:TEL (068). Numbers in mobile networks may be PREPAID and POSTPAID. Both kinds of numbers may be bought at the offices of mentioned telephone companies, with leaving your personal data. For PREPAID numbers, additions can be done in the mentioned offices, shops and kiosks on the amount wanted. POSTPAID number may have every citizen with his/her identity card who signs the contract with mobile telephony operator for at least one year. For postpaid numbers we pay the bill which is delivered on our home address on a monthly basis. Both kinds of customers had to pay the taxes in amount of 1,00 EUR for a number on a monthly base CONTACTS: Telenor 1188 T-mobil and T-com 1500 M-tel Media In Montenegro, we have print media or press (Vijesti, Pobjeda, Dan, Dnevne novine, etc.) and radio and television. The cost of Vijesti, Dan and Pobjeda is 0,70 EUR and Dnevne novine is 0,50 EUR.RT Crne Gore is state owned television (first channel, second channel and satellite program), and there are also some privately owned televisions (TV Pink, TV Atlas, TV IN, TV Vijesti, TV Prva, etc.). Radio Crne Gore is state owned radio, but there is also large number of privately owned radio stations. Additionally, there are media that provide their services over the internet. IV. PENSION Rights on retirement and disability insurance may be exercised in Pension and Disability Fund (Fond PIO). Fond PIO is an organization which is authorized to resolve issues regarding rights on retirement and disability insurance. Within Fond PIO, issues on the rights on retirement and disability insurance resolve municipal department on which territory the insurer was insured for the last time (the last insurance principle). Issues related to the rights on retirement and disability insurance applying international agreements on social security are resolved by the Department for implementation of international insurance. Municipal departments are authorized to resolve matters related to implementation of the Agreement on social security with Bosnia and Herzegovina, that is municipal department on which territory the insurer was insured for the last time in Montenegro. Rights regarding retirement and disability insurance comprise: right on retirement 8

9 the right to a disability pension right on reimbursement for body injuries right on compensation of funeral expenses. Pension may be: retirement pension disability pension family pension. 1. Retirement pension Pension years of service, years of insurance and special years of service In order to exercise right on Retirement pension insurer need to fulfill prerequisite regarding the following: age of life, and years of service, that is years of insurance. In order to explain the conditions insurer needs to fulfill to get the right on Retirement pension, it is necessary to explain terms pension years of service and years of insurance. Pension years of service is a broader term than the term years of insurance and it encompasses: years of insurance and special years of service. Years of insurance is the time period spent as an employee and based on this the insurer was insured on retirement and disability insurance, and during that time the social security contributions were paid. Special years of service is the time period spent without insurance (in wars, revolutionary work, time of performing military duties, in armed actions and in captivity, as well as time spent on medical treatment and medical rehabilitation because of the illness or injuries suffered in armed actions or in captivity after august 17 th 1990) which represent year of insurance according to the old rules. Terms for obtaining the right on pension Right on Retirement pension has the insurer: when become 67 years old, and at least 15 years of pension years of service (insurer whose years of insurance are calculated with increased duration, this age limit is decreased depending on the increase of the years of insurance). when reaches 40 years of years of insurance or 30 years of service of which not less than 20 years of effectively employed in workplaces where the mines shall be calculated at an accelerated rate Earlier retirement will be got at the age of 62 and at least 15 years of pension years of service. Terms for obtaining the right on retirement pension in transition period In transition period, from 31 st December 2024 (for men), as well as from 31 st December 2040 (for women) there are proposed more favorable conditions for insurers. Initiation of proceeding for exercise of the right on Retirement pension Proceeding for exercise of the right on Retirement pension is initiated on the request of the insurer. The right on Retirement pension may be exercised after termination of insurance (employment, that is performance of independent or agricultural activity). The request for the exercise of right on Retirement pension may be submitted before termination of insurance, providing the evidences on its unquestionable termination. Request for exercise of the right on Retirement pension is submitted to the Pension Fund municipal department on which territory the insurer was insured for the last time. Documents necessary for exercise of the right on Retirement pension With the request for exercise of the right on Retirement pension, following documents are submitted: work book (concluded) birth certificate 2. Disability pension Disability total or partial lost of working ability Disability in terms of the rules on pension and disability insurance exists when insurer due to the changes in his/her health condition, which cannot be cured by medical treatment or rehabilitation is unable to work anymore. Disability also exists when the insurer that is employed due to the changes in his/her health condition, which cannot be cured by medical treatment or rehabilitation, partially lost his/her working ability of 75%. Reason for disability may be: accident at work, professional illness, accident outside of the work or illness. The Fund determines the required check up of beneficiaries, not later than three years from the date of determination of the disability. Total or partial disability pension With fulfillment of other legal terms, the right on total disability pension has an insurer who totally lost his/her working ability. With fulfillment of other legal terms, the right on partial disability pension has an insurer who partially lost his/her working ability of 75%. Partial pension amounts 75% of total disability pension. 10

11 Requirements for vesting the right on disability pension a) Requirements for vesting the right on disability pension if disability is caused by the accident at work or professional illness. The main reason for vesting the right on disability pension is the existence of disability. If disability is caused by an accident at work or by professional illness, insurer vests the right on disability pension regardless of the duration of pension years of service and reached years in the moment of disability. b) Requirements for vesting the right on disability pension if disability is caused by the accident outside the work or by illness: If disability is caused by the accident outside the work or by illness, insurer has the right on disability pension if following requirements are fulfilled: Lost of working ability occurred before years of life proscribed for vesting the right on Retirement pension He/she had the pension years of service which covers at least one third of the working age c) Requirements for vesting the right on disability pension for persons under 30 years whose disability is caused by illness or the accident outside the work For insurer younger then 30, whose disability is caused by illness or accident outside the work more favorable conditions are proscribed for gaining the right on disability pension. Insurer whose disability is caused by illness or accident outside work before the age of 30 gains the right on disability pension when: Disability occurred before the age of 20 regardless the years of pension years of service; When disability occurs between the age of 20 and 30 if before disability insurer had at least one year of pension service insurance, if it is more favorable for him/her then requests proscribed for other insurers (in accordance with which one third of the working age must be covered by the pension years of service) Documents necessary for acquiring the rights on disability pension With request, that is suggestion for disability pension, the following documents are submitted: Medical documents which include: suggestion for expertise of the general practitioner on form 1, and report of the specialist, dismiss lists, evidences on medical treatment etc. Confirmation of the working place, description of work on form 1a, Birth certificate Copy of work book, and after disability is confirmed in the original work book, Report on the accident at work (if the insurer suffered accident at work) 3. Family pension Family members who can vest the right on family pension Family members who, with fulfillment of legal requests, may acquire the right on family pension: 11

12 Spouse; Children (children born in wedlock, children born out of wedlock, adopted children or step-children). Right on family pension may, acquire, with fulfillment of legal request, divorced spouse, if the final judgment vest him/her the right on alimony. Requirements for acquiring rights on family pension To acquire the right on family pension it is necessary for a family member, to fulfill: Requirements related to the deceased insurer, that is users of the right so called general requirements, and Requirements fulfilled by family members of the deceased insurer, that is user of the right in order to vest the right on family pension so called special requirements. In order to acquire rights on family pension it is necessary to cumulatively fulfill general and special requirements. Requirements related to the deceased insurer, that is user of the rights (general conditions) Right on family pension may acquire family members: of the deceased insurer who had at least five years of years of insurance or at least ten years of the pension years of service or fulfilled the requirements for old-age or disability pension deceased user of old-age or disability pension. If death of insurer or person who is insured on the rights of pension and disability insurance in the case of disability or bodily condition caused by the accident at work or professional illness caused by the accident at work or professional illness, members of his/her family acquire the right on family pension, regardless the period of pension years of service of the insurer, that is that person. Requirements related to the family members (special requirements): Requirements for the widow who acquires the right on family pension Widow acquires right on family pension, in the cases when: - till death of the spouse reached age of 52 till death of spouse or one year after the death of spouse became unable for work after death of spouse left one child or more children who have the right on family pension of that spouse, and the widow perform parental duty to those children. Widow, who, in duration of the rights based on that, became completely unable to work, retain the right on that pension while she is unable to work. Widow who, during the right on family pension acquired based on total inability to work or based on performance of parental duty towards those children, reaches the age of 52 permanently retain the right on family pension. The right on family pension has the widow who is pregnant, as well as widow whose child is the child of the deceased insurer and was born after insurer s death. Widow obtains that right from the day of death of insure i.e. user of the right. If the child is born dead or if it dies before it reaches six months of life, widow has right on family pension six months after the confinement. 12

13 Requirements for the child to acquire rights on family pension Child acquires the rights on family pension and it belongs to him/her: until the age of 19 when he/she reaches the age of 19 if he/she is in school, until he/she graduates, but latest to 24 years if he/she is in college, and 25 if he/she is at university while he/she is unable for independent life and work, incurred after the age in which the children have right on family pension, and before the death of the insurer, that is user of the right, if the insurer, that is user of the right supported him/her to his/her death. Disabled child, in accordance with the regulations on classification of the children who have problems in their development, obtains the right to the family pension and that right shall be in force from the cessation of employment, development e.g. performing of the individual business activity. The child whose schooling was stopped due to the disease, shall get the right to the family pension also during the time of duration of the disease until the age when the child can use its right to pension on the basis of schooling. This right can be extended but only for the period of disease due to which the child didn t attend school. In accordance with the regulations covering the military obligation, the child whose schooling was interrupted due to the military service, shall obtain its right to the military pension also during the time of military service but not longer than one year more than the age until which the right to pension on the basis of schooling may be used. Determining of the family pension Family pension shall be determined on the basis of age or disability pension which would belong to the insurer in the moment of his/her death e.g. in the percentage which is determined according to the number of family members who have right to that pension as follows: For one member: 70% For two members: 80% For three members: 90% For four or more members: 100%. If a right to pension belongs to the spouse or the divorced spouse of the deceased insure e.g. right beneficiary, family pension shall be in the amount which belongs to one family member and shall be divided by equal amounts. The age pension of the diseased insurer which is determined for the pension service of 20 years shall be deemed to be the lowest basis for determining of family pension. Apart from the family pension on the basis of one parent, children without both parents will also be entitled to the family pension on the basis of the other parent as follows: For one child: 20% For two children: 40% For three children: 60% For four or more children: 100% of age pension or disability pension of other parent. 13

14 If children, apart form the pension on the basis of one parent, are also entitled to the part of pension on the basis of other parent, family pension shall be determined as one pension and its amount mustn t exceed the amount of the biggest family pension for the pension service of 40 years. Initiating of the procedures for obtaining the right to family pension Procedure for obtaining the right to family pension shall be started on the request of the family member of the diseased insure e.g. right beneficiary. The request for obtaining the right to family pension shall be submitted to the regional unit in the area of which the deceased insure i.e. right beneficiary was insured for the last time. Documents necessary for obtaining the right to family pension Along the request for obtaining the right to family pension the following document ought to be submitted: Death certificate; Recording the job accident if the death occurred due to the injury which had happened during the work; Employment booklet; Birth certificate for all family members for whom the request for family pension is submitted; Marriage certificate for the widow/widower who obtains the right to the family pension; School certificates for the children aged above 19 years who are entitled to the family pension on the basis of schooling; Medical documentation for all family members who obtain the right to family pension on the basis of the complete work inability i.e. who are incapable for the independent life and work; Statement stating that family members who obtain the right to family pension do not work, are not engaged in some independent activity and are not beneficiaries of come other pension. Money allowance for the body handicap: Disability Disability occurs in cases of loss, significant damage or significant disability of specific organs or part of body, which impairs the normal activity of organism and requires bigger efforts in realization of life needs disregarding whether it causes or do not cause disability. Requirements for obtaining money allowance for disability The disability was caused during work or is classified as an professional disease and amounts to at least 50%. List of disabilities and percentage of these handicaps are prescribed by the Rule Book on Determining of Body Handicaps ( Official Gazette of the Republic of Montenegro No. 45/04 and No. 50/04). Determining of the amount of money allowance for disabilities Due to determining of the amount of money allowance, disabilities shall be, in accordance with their characteristics, classified into six degrees (groups). The amount of the money allowance for the disabilities shall be determined on the basis of the degree of disabilities in the appropriate percentage from the prescribed basis. 14

15 Determining of the amount of money allowance for disabilities Percentage of disabilities Level Money allowance in percentage of the amount bases 100% 1 40% 90% 2 36% 80% 3 32% 70% 4 28% 60% 5 24% 50% 6 20% Instituting legal action for obtaining rights to money allowance for disabilities: Procedure for obtaining rights for money allowance for disabilities shall be performed on the basis of the insurer i.e. right beneficiary, on the basis of the medical documentation which is mandatory submitted upon the request; The request for obtaining the right to money allowance for disabilities shall be submitted to the regional unit of the Pension Fund in the area of which the insured had been insured for the last time. Documentation necessary for obtaining the right to money allowance: Along with the request for obtaining the right to money allowance for disabilities, the following documentation ought to be submitted: Medical documentation (like in the case of disability pension); Confirmation from the working position, job description provided in the Form 1a; Record on the injury occurred on the working position (in case of the body handicap due to the injury that occurred during the work); Copy of the employment booklet. Right to the compensation of funeral costs: In case of the death of the pension beneficiary, person who covers the costs of funeral shall be entitled to the compensation of funeral costs. Compensation of funeral costs shall amount to three average pensions in the Republic, paid during the month before the death of the pension beneficiary. Request for compensation of the funeral costs is to be submitted during the period of 60 days from the day of the pension beneficiary s death. The request may be submitted in the regional unit or in the Pension Fund Central Service. Along with the request for the money allowance for the body handicap the following documents also have to be submitted: Birth certificate; Pension check or bank certificate with the identification number (if the deceased pension beneficiary used to receive pension from the bank); Funeral costs bill (issued by the communal i. e. funeral company). 15

HEALTH CARE Law stipulated that: each citizen has an obligation to use healthcare protection in accordance with the law and the instruction on medical treatment which is issued by the competent person employed in the healthcare sector. In other words, our relation with the persons employed in the healthcare sector must be based on the respect, tolerance and trust. In providing of healthcare protection priorities are exclusively based on medical criteria and the seriousness of the disease or injury. Our religion, cultural and moral beliefs must be respected. Children under age of 18 years, regular high school students and university students aged under 26 years, pregnant women, persons aged above 65 years, the unemployed who are recorded in the Unemployment Office, handicapped persons As well as people who have at least 10 times voluntarily donated their blood are entitled to the free of charge healthcare protection. Primary healthcare protection is implemented through the chosen doctor. 1. Primary Health Care Protection Primary health care protection implies providing of the health care services to the mother and children, prevention and control of cancer, mouth and teeth diseases, healthcare protection, mental health protection, immunization against the main contagious diseases, patronage visits, treatment and rehabilitation at home, prevention and treatment of the most frequent diseases and injuries as well as the urgent medical aid. Apart from that primary medical treatment includes laboratory, ultra-sound and radiogram check-ups at the primary level which is prescribed by the doctor, physiotherapy services, specialistic, consiliar and other services of specialist for pulmonal diseases, radiologists, psychiatrist, child psychiatrist, psychologist, pedagogue and pediatrician in the area of developing pediatric. 2. Doctors obligations Each person employed in healthcare sector is obliged by the law to provide urgent medical aid, always and at each place even in case of strike in the healthcare institution or in case of some other extraordinary circumstances. If staff employed at healthcare institution cannot provide necessary medical service they are obliged to address patient to other medical institution, with the most important findings and with providing reasons for that. Fine amounting to 10 minimum labor price amounts is envisaged for non providing of urgent medical. 17

18 Doctor is obliged to provide to patient all information concerning his/her health and also to keep them confidential except when consulting with other doctor. If doctor finds out that keeping professional secret may have negative impact on patient s health, he/she has the right to communicate data to some of the patient s family members. If patient is deprived from the healthcare protection or if patient is not content with the provided service, he/she can lodge a complaint to the healthcare institution management body. Complaint may be submitted verbally or in written and the answer can be provided immediately or during 5 days. If patient is not satisfied with that decision or answer he/she may address healthcare inspection. 3. Regular check-ups Until the second grade of the high school students are obliged to go through the annual regular check-ups which are performed due to the body development control, nourishment situation and health care situation of the school children. They are most frequently organized by the school, in the healthcare centre in the municipality in which the children live. Every student ought to have healthcare record which, in case of moving into the other school and/or after finishing of the high school, ought to be taken to the other, appropriate health care centre. In case that regular check-up identify kind of deviation or health care disturbance, the control medical check-ups will be carried out, usually during the second and fourth grade of the high school. At the age of sixteen years student starts to care about his/her health and doctors do not have to have consultation with students parents during making decisions concerning possible treatment. The exception is made in case that patient is not aware to understand the proposed medical advice. 4. The Selected Doctor Each insurer shall have his/her selected doctor. The goal of the initiation of this program is to enable doctor to have insight in your state of health e.g. decease record, sick leave etc in order to treat you in the best possible way. Upon selection of your doctor you will need to bring your health card and identity card. At the registration, you will sign the statement about the selection of the doctor for the period of one year. Lists of doctors are displayed at all registration points and you can make your own choice. You have the right to select any doctor from the list, regardless of the location of belonging PHC, because the computer registration will be made in the health centre where he/she works. General practitioners are selected doctors for adults, pediatricians for children and dentist for the persons above the age of 65. Men have one medical record while women have two-one with her primary care doctor and the other with her gynecologist. The appointment with a doctor shall be made by your own, but if you are not able to do it, the doctor will visit you at your home. The selected doctor can refer you to the specialist in order to get from him diagnosis, e.g. your further treatment. The same procedure is used for complicated diagnostic methods and treatment of specific diseases, as well. Only the selected doctor prescribes you a therapy and if other doctor prescribes a remedy or refer you to further treatment, you will bear the costs. More information you could find on 5. Referring to the specialist Selected doctor can refer you to the specialist examination only after completed analyses and in the case the additional expert opinion is required to set the diagnosis. For the specialist examination, certified doctor s order is required; otherwise you are obliged to pay specialist examination. For the appointment for specialist examination you need certified health card and certified doctor s order from your doctor. After specialist examination, with new results, you will go again to your doctor who has to be informed about changes in order 18

19 to register all changes and improvements in your medical record for further treatment. The specialist is obliged to provide you with urgent medical assistance without the doctor s order. Dentist Children and students up to 18 of age have the right on free dentist interventions, while persons older than 65 have the right on free teeth treatment and dental-prosthetic assistance. For the purpose of implementation of entitlement you are required to be registered with selected dentist. For children under 18, the free interventions include teeth treatment, selective grinding, exercises, breaking off bad habits etc. The chosen dentist is selected by beneficiaries who are entitled to free dental care. Policyholders can choose the dentist in the regional branches of the Health Insurance Fund in each municipality or in a dental clinic where the insured person wants to choose a doctor dentist with whom the Fund has entered into the contract. In addition to persons under 18 years, women during pregnancy and persons older than 65 years, the preventive services dental diseases are eligible to children, pupils and students, under 26 years, those suffering from epilepsy, multiple sclerosis, muscular dystrophy, cerebral palsy, paraplegia and quadriplegia, mental illness and persons with disabilities in accordance with the criteria regulated by special regulations, blind and deaf-mute people. All other persons aged between 18 and 65, besides examination, have the right on urgent dentist interventions, and treatment of acute infections and taking care of jaw and mouth injuries. Medical interventions Surgery and other medical interventions can be applied only with prior consent of the sick or injured person. If juvenile person is concerned, the parent brings the decision, if the juvenile person is older than 14, his opinion is taken in account as well. If patient s life is seriously endangered and he is not able to bring the decision, and because of urgency the consent of parent cannot be obtained, the team of doctors can decide about intervention. If you insist on interruption of the treatment during hospital stay, in spite of the warning of doctor in charge, you are obliged to submit appropriate statement in written. 6. Home care Health care service comprises right on the medical visits as well as medical treatment conducted by patronage service as instructed by the selected doctor. All patients, who due to their disease or immobility, are not able to visit public health centre, have rights on patronage service. Prior to patronage service visit, your selected doctor will write order for medical visit, with the precisely defined diagnosis and nature of your disease, as well as with the therapy to be applied. Competent public health centre bears the costs of therapy and patronage service arrival. 7. Emergency Emergency is a service in charge of site visits and providing first aid to the persons injured in an accident, as well as to the persons whose health is endangered and who are seeking urgent medical assistance. Urgent Block is the part of Clinical Center of Montenegro where urgent patients are transported by Emergency service and where the fast and efficient medical care is provided to them. After an intervention provided in Urgent Block, patients are accommodated in the appropriate hospital wards/departments for further treatment. 19

Health care of students All regular students of University of Montenegro have the right on free health care within the frame of Student Polyclinic with dentist and sport clinic, cabinet for physical therapy as well as service for injections and dressing. Apart from that, gynecologic and psychiatric examinations are enabled to them in the polyclinic centre. Student Polyclinic Centre is in charge of issuing health certificates for dormitories and university enrollment applications. 9. Private Health Institutions Employees of the healthcare institutions can work in private health institutions if they fulfill conditions of appropriate education and pass the licensing exam. Examinations in private health institutions are charged depending on the price list. For the establishment of private health institution a work license issued by competent Medical Chamber is required, which is in charge of extension of the licenses as well. If you are not satisfied with services in the private health institution, you can complain to the owner or health inspection. 10. Prescriptions Within the frame of mandatory health insurance you have the right on the medication that can be prescribed. You can obtain the prescribed medication if it is prescribed by your selected doctor and if the medication is on the positive list of medications provided by Health Insurance Fund of Montenegro. With the prescription, you can withdraw the medication in the state owned pharmacies, while for some medications, some small amount of payment is required (so called: participation). It is not recommended to buy medications without medical prescription because incompetent application of medications can be health dangerous, and can endanger health or even someone s life. Insurer also has the right on medicinal products and materials, used for diagnostics and treatment with the selected doctor in the case of treatment at home and in other areas of the primary health care protection which are not prescribed. The medications which can be used exclusively under medical supervision or can be given only by competent healthcare employees (medications in ampoules, infusion solution, vaccines, serums, children and artificial food) Sedatives can be applied exclusively with medical prescription and no pharmacy is allowed to sell them freely. If you are not satisfied with the service of the "state owned" pharmacies you can complain to the Pharmacy Institution of Montenegro. 11. Persons with a Mental Disease Person with mental disease is a person with mental disorders: mentally handicapped person, dependant on psychoactive substances (drug addicts, alcoholics), or with other behavior disorders. These persons, as well as all other citizens have the right on: access to the basic medications, healthcare and social protection in accordance with the healthcare needs and medical treatment under the same conditions applied in medical treatment of other persons treated in medical institutions. Person with mental disease has the right on protection from any type of exploitation, abuse, maltreatment and humiliating acts as well as the right on protection of personal dignity, human treatment and respect of their personality and privacy. Accommodation in psychiatric institution is mandatory if the authorized person and psychiatrist after examination decide that person can be adequately treated only in the psychiatric institution. 20
