1 Rental Agreement Terms & Cnditins f Hire We are Bathwick Car and Van Hire Ltd. Bath Rad Ind Est, Bath Rad, Chippenham, Wiltshire, SN14 0AB These terms apply, t the hire f the hrsebx, that we supply t yu the Hirer. N cntract shall exist between yu (the Hirer) and us (the Owner) fr the hire f the hrsebx until we have received and accepted yur rder which is cnfirmed when prviding payment fr the depsit r fr the full hire csts. We shall send cnfirmatin t yu in writing, either by t the address that yu prvide us, r by letter r text message. On cnfirmatin f yur rder, there shall exist a binding legal cntract between us that shall be gverned by English law and subject t the exclusive jurisdictin f the English Curts. The hrsebx shall remain the prperty f the wner at all times. Yu have n rights t the hrsebx ther than as the Hirer and yu shall nt d, permit r cause t be dne any matter r thing whereby ur rights t the hrsebx are r may be prejudicially affected. Yu shall be respnsible t us fr ensuring the accuracy f any rder submitted by yu, including whether the hrsebx is adequate fr yur purpses, and fr giving us any necessary c-peratin, assistance and infrmatin relating t the hire f the hrsebx r as we may reasnably require within a sufficient time t enable us t perfrm the cntract in accrdance with its terms. Yur bking is cnfirmed upn payment f the depsit f 50. This must be paid by credit r debit card. The rental must be paid in full befre the hrsebx will be made available t yu fr the hire, the balance can nly be paid by card. In additin t the payment in full being received by us, we must be satisfied with yur frms f identificatin and yu must ensure that yu fulfil the requirements f ur insurers. The hrsebx will nt be released until all relevant dcuments have been prduced in accrdance with the terms and cnditins. We will endeavur t ensure the hrsebx is ready fr cllectin n the date/time agreed. Hwever, in the event f matters arising beynd ur cntrl, we will nt incur any liability whatsever if we are unable t meet the agreed time/date. All hirers and drivers must meet the fllwing criteria, even if they plan nt t drive. They must als agree t and sign ur Terms & Cnditins f Hire All hirers (and additinal hirer drivers) must: The hirer MUST prvide us with the DVLA access cde t allw us t check their licence befre cmmencement f hire be aged between 25 & 75 years (Insurance Depsit may be required) hld a full UK r EU Licence (fr the weight f the hrsebx) held fr at least 2 years prir t the date f cmmencement f hire have tw years recent regular UK driving experience have n mre than tw Minr Mtring cnvictins r six penalty pints in the last five years Have n nn-mtring cnvictins (unless spent under the Rehabilitatin f Offenders Act)

2 nt have had any insurance declined, cancelled, renewal refused, r special terms impsed nt have had mre than ne fault accident r mre than tw nn-fault accidents in the last three years Drivers having a medical cnditin declarable t the DVLA, must have declared it t the DVLA and the DVLA must have issued them with a licence The fllwing ccupatins are nt autmatically cvered, and require referral t ur insurance prviders befre we can agree t the hire f the hrsebx. Where a referral is required, there is a nn-refundable fee (payable in advance) f 15 Prfessinal Entertainment Prfessinal Sprtspersns / Prfessinal Sprt Gaming Industry Press f any srt Freign Services Persnnel unless they have held a UK/EU Licence fr tw years The fllwing will be used fr Hirer/Driver identity verificatin purpses in cnjunctin with ur cmpleted prpsal frm/questinnaire. Prir t the release f the hrsebx, yu shall be required t prvide us with the fllwing frms f identificatin in respect f each prpsed driver (and the Hirer) f the hrsebx. In each case the riginal must be prvided: Valid Driver s Licence. The hrsebx is permitted t be driven, subject t meeting the requirements specified, by drivers aged between 25 and 75 years f age. Pht ID e.g. passprt r wrks ID 2 different prfs f address dated within the last 3 mnths i.e. Bank statement, utility bill etc. Please nte that, ntwithstanding yur payment f all sums wing t us in respect f the prpsed hire, the hrsebx WILL NOT be made available t yu until we are reasnably satisfied with yur frms f identificatin and the hrsebx WILL NOT be released until all such dcuments have been prduced in accrdance with these terms. The Descriptin and price f hire services that yu rder will be as shwn in ur qutatin t yu r n ur website at the time when yu place yur rder. If we find an errr has been made we will infrm yu f the errr as sn as pssible and ffer yu the ptin f cancelling the rder r recnfirming the bking at the crrect price. If yu decide t cancel a refund f any relevant payment will be made. The Owner will prvide the Hirer with the fllwing A rental agreement fr the perid f hire, signed by bth parties t cnfirm agreement t all terms and cnditins held within this cntract A full tank f fuel upn cmmencement f hire

3 Full instructin n hw t perate the hrsebx A visual inspectin t highlight any damage prir t hire (t which bth parties agree) Cmprehensive vehicle insurance fr the perid f the hire Details f the 24 hur radside rescue fr bth the vehicle and hrse The Hrsebx is nly fr Persnal and Leisure Purpses. Hire & Reward is nt permitted and yur signature cnfirms that yu will nly be using ur vehicle fr this sle purpse. All equine animals t be carried by the hrsebx MUST travel with passprts, and it is the sle respnsibility f the hirer t cnfrm t this law. Any unbrken adults/yungsters/fals (unless travelling with their mare) are nt permitted t be carried in the hrsebx withut the express permissin f the wner (permissin MUST be requested befrehand) Dgs are allwed t travel in the hrsebx, hwever any damage incurred will be chargeable. N animals ther than hrses are t be carried in the lrry withut the express permissin f the Owner (permissin MUST be requested befrehand) Any and all animals transprted within the hrsebx shall be carried at yur risk as the Hirer, and yu shuld have apprpriate insurance cver in place. Unless therwise agreed in writing, the cllectin/return f the hrsebx will be at ur premises n the date(s) agreed fr the beginning/end f hire. We expect the hrsebx t be cllected/returned between the hurs f 6am & 8pm, unless therwise agreed in advance. If the vehicle is returned late, and we (the Owner) are nt ntified f the reasn fr late return and/r kept ntified f the expected time f return, a cst f 25 per hur may be charged fr every hur r part f after 8pm, r the last ntified amended time f return. T fulfil yur bligatin t us, yu shall btain and ensure the adequacy and accuracy f all necessary qualificatins, registratins, memberships, permissins and licences and cnfrm t all relevant rules and regulatins as may be required fr yu t drive and therwise use the hrsebx. During this hire cntract, yu shall: Ensure that the hrsebx is driven r therwise perated and used in a safe and prper manner and fr the purpses fr which it was designed and withut risk t health by persns wh at all times hld valid and current driving licences in the apprpriate classes. Pay fr all fuel fr the prper running f the hrsebx. The hrsebx is supplied with a full tank f fuel and must be returned with the same. indemnify us against all fines, penalties and liabilities payable by us by virtue f yur hire and/r use f the hrsebx r arising in respect f any nn-cmpliance r cntraventin f any transprt, traffic r ther law r regulatins, tgether with any csts r expenses relating theret incurred by such use f the hrsebx

4 Ensure that yu cmply with all weight and lad restrictins as may apply and ensure that yu d nt verlad the hrsebx, nr permit it t be verladed. In the event f the hrsebx being cnfiscated due t verlading, all fines, charges and lss f revenue will be charged t the Hirer. Ensure that all partitins and equipment are crrectly used t ensure safe transprtatin f animals. Ensure animals are prperly secured Ensure the strict NO SMOKING plicy is bserved Infrm us immediately f any change f address Immediately infrm us f the whereabuts f the hrsebx if at any time we request this infrmatin frm yu. Nt sell, assign, mrtgage, lend, let n hire r therwise dispse f r part pssessin with the hrsebx r any part theref, nr attempt r purprt t d s. Nt remve any furniture/fixtures/fittings frm the hrsebx. Nt remve r interfere with any identificatin marks r plates affixed t the hrsebx. In respect f the cnditin and maintenance f hrsebx, the Hirer is slely respnsible fr ensuring that: fluid levels are checked and adjusted as necessary the exterir, interir and uphlstery f the hrsebx is kept clean the hrsebx is nt used r perated in a manner cntrary t any statutry prvisin r regulatin r in any way cntrary t law the paintwrk, bdy and cachwrk f the hrsebx is nt defaced in any way n twing equipment r ther accessries are fitted n alteratins r mdificatins are made t the hrsebx r any parts r part f it, mechanical r therwise, r any f its accessries, withut ur prir written cnsent. the cst f the repair r rectificatin f any damage t the hrsebx resulting frm negligence r imprper use f the hrsebx by yu r any persn wh has used the hrsebx during the hire cntract is brne by yu the hrsebx is kept in gd repair and cnditin, fair tear and wear excepted where such expressin is t have its rdinary and natural meaning but des nt include: Bdywrk: dents r scratches (ther than small scratches r chips), failure f clur matching where repairs have been made Uphlstery: stains, burns r tears in seats, headlining r carpets. Mechanical: the ramp, partitins, engine, gearbx, clutch, axles, suspensin, steering and brakes nt being in gd wrking rder. Electrical: lighting and all equipment nt being in gd wrking rder.

5 Tyres: uneven wear f tyres, slits in tyre walls. Damage t any glass including the windscreen. Yu shall als: Indemnify the Owner shuld the Hirer incur any damages t the vehicle. The Owner will request a qutatin fr repair and the Hirer will be infrmed f the qute fr the repair and will be made t pay in full. Immediately give ntice t us f any lss r damage t the hrsebx. Indemnify us against all damage and neglect (whether caused by animals r therwise) t the hrsebx r its cntents arising frm the breach f yur bligatins under these terms (including yur failure t return the hrsebx in gd clean rder and wrking cnditin).please NOTE that there is a 50 surcharge if the any area f the hrsebx is nt in a gd clean cnditin Make full payment f the value f the vehicle, the amunt specified within this agreement, administratin fees, lss f revenue at the daily rate, based n the cmpany s lss f use f the vehicle and regardless f whether damages are a result f an act f Gd; shuld the client breach this agreement, illegally hire fr purpses ther than the transprt f a hrse as a pet and/r prvide false infrmatin t the cmpany, r the vehicle sustains damage due t uninsured theft, write ff. The hrsebx must be kept lcked and secured when unattended. The Hirer is cmpletely respnsible fr the safety and security f the vehicle and its cntents at all times. The vehicle must be kept lcked/secured when unattended and the keys must be kept safe. If yu, the hirer, lse pssessin r cntrl yu must take all necessary steps at yur wn expense t retain and recver pssessin and cntrl f the hrsebx. If the hrsebx is stlen, the Hirer expressly agrees t pay the Cmpany n demand the fair market value f replacing the vehicle, administratin fees plus lss f revenue, shuld the client fail t secure the vehicle r misplace the keys, which results in the vehicle being stlen. The theft must be reprted t the Owner immediately, and als t the plice, where a crime reference number shuld be btained. Return f the hrsebx. On terminatin f the hire hwsever r whenever ccasined, r n expiry f the perid f hire, yu shall n lnger be in pssessin f the hrsebx with ur cnsent and shall (unless we therwise agree) frthwith return the hrsebx t us at ur premises in gd clean rder and wrking cnditin and at yur expense and risk. Unless we therwise agree in writing, the return f the hrsebx shall be made by yu (in accrdance with ur terms & cnditins) returning it t ur premises n r prir t the date/time agreed fr the expiry f hire, t allw the hrsebx t be prepared fr the next Hirer. If the fuel tank has nt been filled, r if the hrsebx is nt returned in accrdance with ur agreed terms & cnditins, there will be a penalty charge f 50 which will immediately becme payable t us (the Owner). In additin, if the fuel tank is nt full, the cst f re-filling the tank will be added t this penalty charge.

6 Yu shall fully indemnify us against any ther claims, liability, damages, lsses, csts & expenses suffered r incurred by r awarded against us & arising frm yur failure t return the hrsebx in accrdance with these terms NO REFUND r discunt will be given fr early return f the hrsebx. The Hirer must return the vehicle in the same cnditin as it was prir t the rental perid. The Hirer is respnsible fr any repair r refurbishment csts required t return the vehicle t its cnditin prir t the rental as well as csts incurred by direct cnsequence f such repairs r refurbishment being carried ut, including but nt limited t lss f business due t unavailability f the vehicle. This will include damage caused by kicking, bucking, chewing, biting r pushing the vehicle r equipment supplied. Any damage hwever caused by the Hirer, the Hirer s animals, representatives, family r friends will be charged t yu the Hirer. Insurance f the hrsebx is prvided under a fully cmprehensive plicy against lss r damage t its full replacement value fr the perid f yur hire ONLY fr drivers wh have cmpleted ur Hirer/drive prpsal frm, signed the cntract and agreed t the terms & cnditins. A cpy f the insurance plicy is available upn request. The fllwing excesses apply: Damage excess fr drivers aged years ld 1000 Excess fr Fire & Theft 1000 Windscreen 1000 Excess fr theft by Hirer 20% f lss Yu shall remain slely respnsible fr insuring and keeping insured all persnal gds and pssessins that d nt belng t us r are therwise prvided by us at the cmmencement f hire (including all equine animals and such ther animals that we cnsent t being carried in the hrsebx and the transprtatin f the same) under an apprpriate insurance plicy with suitable cver and with a reputable insurer. Such insurance shuld include cver against the risk f lss r damage by fire, theft, accident and ther risks including third party risks as are nrmally insured against in this respect. In n event shall we be respnsible t yu fr any lss r damage t persnal gds r pssessins equine animals and ther animals and yu hereby agree t indemnify us against any lss, damage r injury t the hrsebx (and any f its cntents) (except fr any caused by ur wn negligence) in s far as it is nt cvered by a plicy f insurance. Yu shall nt use r allw the hrsebx t be used fr any purpse nt permitted by the terms f the abve plicies f insurance, r d, r allw t be dne any act r thing whereby such insurance may be invalidated. In the event f an accident that results in damage t the hrsebx, the hirer must:- Nt admit liability t any persn in relatin t the accident Ensure names and addresses f all witnesses are cllected and passed t us (the Owner) Frthwith ntify us f the accident and in any event immediately after the accident.

7 Cmplete and deliver t us the relevant accident reprt within 24 hurs f the accident. Frthwith deliver any writ, summns r ther dcument relating t any prceedings arising ut f such accident t us. Render all assistance t us and ur insurers t the cnduct f such prceedings including withut prejudice t the generality f the freging cmmitting such prceedings t be brught by us in the name f yu and defending any prceedings brught against us. Frthwith upn demand fully and effectually indemnify us against all lsses, liabilities, csts, actins, claims r demands which we may incur r have brught r made against us in relatin t the hrse bx r its use and which are nt recverable under the plicy f insurance. The cntract shall be subject t yur right f cancellatin (see belw). Yu have the right t cancel the cntract at any time. Any cancellatin request must be made in writing t the address given abve r by /text message t the cntacts displayed n the website. Cnfirmatin f the cancellatin will be made t yu. Any mnies/depsit paid fr the hire are nt refundable if cancellatin is made within 7 days f the cmmencement f hire perid. These terms may be changed withut ntice t yu in relatin t any future hire.
